This lecture, delivered to the Supreme Court Historical Society, details the ways in which justices of the Hughes Court provided guidance to members of the political branches in formulating constitutional solutions to the economic crisis of the 1930s. Among the policy areas considered are farm debt relief, energy policy, agricultural policy, civilian relief and public works, retirement pensions, and unemployment compensation.

The Dissent and Its Change is a historical look at a few of the men who have had an important impact on the United States Supreme Court. Justice Oliver Wendell Holmes is best known for his many dissenting opinions while on the Supreme Court. He was one of the first Justices to give the dissenting opinion legitimacy and to make it into a powerful force that can change the law. Justice Holmes spent much of his thirty-year term on the Supreme Court dissenting against the use ofthe Fourteenth Amendment to invalidate laws passed by state and federal legislatures. In the …

Abraham Lincoln was a fatalist. That, at least, was what he told many people over the course of his life. "I have all my life been a fatalist," Lincoln informed his Illinois congressional ally, Isaac Arnold. "Mr. Lincoln was a fatalist," remembered Henry Clay Whitney, one of his Springfield law clerks, "he believed ... that the universe is governed by one uniform, unbroken, primordial law." The roots of United States conceptions of birthright citizenship lie deep in England's medieval past. This Article explores Calvin's Case (1608) and the early modem common-law mind that first articulated a theoretical basis for territorial birthright citizenship. Involving all the important English judges of the day, Calvin's Case addressed the question of whether persons born in Scotland, following the descent of the English crown to the Scottish King James VI in 1603, would be considered "subjects" in England. The Martinsville Seven: Virginia's Most Controversial Court Case, 1949 - 1951, Michael Dean Plemmons

History Theses & Dissertations

In January, 1949 seven black youths were arrested and charged with brutally beating and raping a white woman in Martinsville, Virginia. The judicial process lasted over two years and gained national and international attention. The defendants were ultimately found guilty and sentenced to death for their ruthless crime. The conviction came as no surprise. The evidence was overwhelming, but the verdict created controversy. Some claimed the youths were victims of Jim Crowism while others believed the punishment was just.

Judicial Intelligence: Allied Signal Intelligence And The War Crimes Trials Of Class "A" War Criminals At The International Military Tribunal For The Far East, 1946-1948, William Todd Baker

This thesis examines the use of Allied signal intelligence as evidence in the prosecution of Japanese military and political leaders accused of major war crimes before the International Military Tribunal for the Far East in 1946-1948. Allied signal intelligence helped illuminate Japan's participation in the Second World War. MAGIC signal intelligence, as part of a larger body of evidence presented by the prosecution, served also to aid in the convictions of Japanese military and political leaders accused as Class “A” war criminals.
