What is the law and society framework and where has it gotten us? A student in a classroom might raise their hand and offer "understanding legal pluralism" as a possible answer. However, the conceptual problem with legal pluralism is the coexistence of potentially conflicting bases of justification. Given this, desiring to understand how the law shapes the structural underpinnings of whichever "legal" phenomena and its "ongoing transformation", is nevertheless an immense achievement that stops short of its underlying goal – the achievement of human dignity through human rights. Due to the growth of recording technology, recorded music has become the most common form of music listening. Having high-fidelity audio is as important on audience perception of the music as the composition and the musical interpretation. As the process of recording and the final medium of the recording have advanced, the fidelity of the audio has increased, thus decreasing the listener’s awareness of the recording itself and bringing their attention to the music. This joint research and creative honors project challenges the traditional painted portrait of Western culture. I do this through a study of the history of portraiture compared to construction of identity in the contemporary world. I argue that the traditional portrait of a single and serious individual doesn’t truly express what it means to be human today. Instead, I propose that a “sociological portrait” may be more accurate because it accounts for both the large, societal constructs that shape our identity as well as our more personal and emotional states. This dissertation, Construing Character: Virtue as a Cognitive-Affective Processing System, develops an empirically plausible account of neo-Aristotelian virtue based on the psychological model of personality as a cognitive-affective processing system. The psychological model holds that an individual’s subjective construal of a situation is crucial to understanding that individual’s behavior. The account of virtue developed in the dissertation begins, therefore, with an elaboration of the distinctive way in which the virtuous person construes situations, which is used to develop and defend a McDowellian view of practical reasoning. “Neither a Slave nor a King” intervenes in the scholarly debate over the “antislavery origins” of the sectional crisis in antebellum America – how the rise of a northern antislavery movement escalated the sectional tensions that led to southern secession and the Civil War. There are two main strands of literature on the antislavery origins of the sectional crisis. The first, in which social and cultural historians are dominant, focuses on the rise of radical (or “immediate”) abolitionism in the 1830s, exploring its impact on North-South relations and antebellum reform generally. Theatres Of Reality, Fiction, And Temporality: Vegard Vinge And Ida Müller’S Ibsen-Saga (2006 - 2015), Andrew L. Friedman

This dissertation examines the influence of modernist aesthetics and ideologies on contemporary, European and U.S. experimental theatre. I argue that modernist and contemporary experimental theatres offer competing notions of reality, fiction, and temporality, which I interrogate through Vegard Vinge and Ida Müller’s Ibsen-Saga. I illuminate this tension by reading current modes of performance against the Saga’s productions and work practices, as well as their aesthetic and ideological foundation in three modernist sources: the artificiality of Ibsen’s realism, the utopianism and totality of Richard Wagner’s Gesamtkunstwerk, and the temporal provocations of the historical avant-gardes. Charles Ives on the Nature of Experience: The Compositional Designs and Aesthetic Programs of Three Orchestral Works explores the hypothesis that Ives set in motion in many of his compositions a juxtaposition of temporal process (such as polyrhythm and polymeter) with the aim of exploiting a person’s innate abilities to entrain. Ives believed participants engaged in a juxtaposition of temporal processes are able to form personalized experiences by choosing which elements to attend to.

My dissertation is a historical and ethnographic project that delves into the conflictive relationship between the development of the Dominican state and the formation of the community of the port city of Samaná. The African diasporic community of Samaná has actively constructed the local space throughout shifting political projects, while sustaining their collective voices against the waves of dispossession crashing on their shores. Using a combination of archival research, participant observation, oral history and ethnography, I document multiple instances of state intervention to understand how the Samaná community has been coerced over time to consent to these processes. There is a dearth of literature on how immigrant groups understand minority groups in the United States, in particular, African-Americans. Increased technology and more rapid global movement in the 21st Century challenges 20th explanations of assimilation (Chicago School) and necessitates more research focused on how immigrant groups and racialized minorities interact to negotiate new worlds. This ethnographic research was conducted over thirteen months during 2012 and 2013 in a post-industrial neighborhood in the northeast that had been the site of 11 purported anti-bias attacks against Mexican immigrants during the summer of 2010. Although great strides have been made since the landmark 1969 Stonewall Riots in liberating queer equal rights, both politically and societally, there are still prevalent belief systems in strong opposition to those human rights of gender and sexuality. Biblical religion, through its various monotheistic faiths and denominations, continues to condemn queer as a sin against God because, they argue, God, (through the text of the Bible written solely by men), defines queer as an abomination. Crossing the Great Divide has been a working project for over two years. The project was initially inspired by the maps drawn and paths traversed by Meriwether Lewis and William Clark 1804-1806. From June to August of 2015 a few travelers and myself followed their historic journey and traversed the landscapes of the American frontier on bicycle. Many theoretical treatments of Caribbean and Latin American surrealism(s), most notably Fredric Jameson and Alejo Carpentier’s foundational essays on magical realism, argue that the surrealism of the European metropole is a sophisticated avant-garde movement, in contrast to the blunt tool of Caribbean and Latin American surrealism which reaches back toward a precolonial past in order to bolster a nationalist project. Existing critical writing about Paul Laraque, a Haitian poet and surrealist identifies Laraque as Haitian first and foremost: as a political poet using surrealism solely in support of a nationalist project. "The day may come when 'Freddy Got Fingered' is seen as a milestone of neo-surrealism. The day may never come when it is seen as funny," wrote Ebert in his April 20, 2001 review of the film. On Tuesday November 2, 1993, New Yorkers went to the polls to vote in the mayoral election between the incumbent Democratic candidate, David Dinkins, and the Republican-Liberal Party candidate, Rudolph Giuliani. As with most local New York elections, several additional candidates were on the ballot. Jimmy McMillan, known now as the “Rent is Too Damn High” candidate, made his first bid for public office that year. The clear frontrunners, Giuliani and Dinkins, would finish just percentage points apart, with Giuliani garnering 50.9% of the popular vote and Dinkins only 48%. Lessons from early academic television courses from the 1950s guide an assessment of current disruptive technologies that shape Massive Open Online Courses (known as MOOCs) and other informal online learning opportunities today. This dissertation explores some of the unique contributing factors that led to the creation of Sunrise Semester (1957-1982), a popular network television program co-produced by New York University and CBS that offered college credit to viewers. The 1990s saw the rise of third wave feminism, queer theory and the digital age. This paper looks at how the three come together in YouTube video bloggers’ promotion of queer sex-positive ideology. Sex positivism is the belief that all safe, consensual sex is healthy, while queer theory emphasizes the diversity and instability of sex and gender identities. YouTube vloggers engaged in life-streaming profit from the entertainment value of revealing personal sexual information while framing their sexual revelations as healthy, shame-free sex positivism.
