Conclusion

By many different measures, rural Nebraskans are positive about their community. Many rural Nebraskans rate their community favorably on its social dimensions: as friendly, trusting and supportive. Most rural Nebraskans say it would be difficult to leave their community. And, most rural Nebraskans disagree that their community is powerless to control its future.

Across all years of this study, rural Nebraskans’ views about the change in their community have generally been positive. The proportion believing their community has changed for the better during the past year has usually been greater than the proportion believing it has changed for the …

Journal of Intellectual Property Law

The current work for hire doctrine, as embodied by 17 U.S.C. Sections 101 and 201 and interpreted by the judiciary, provides a default rule of copyright ownership in favor of employers where a work is created by an employee in the scope of employment. In the absence of a written agreement, a finding that an engagement is a work for hire under the statute automatically results in all ownership being vested in the employer. This result often contradicts business norms and the understanding of one or both of the parties. In this Article, the author advocates abolishing the all-or-nothing concept …

The Price Of Social Norms: Towards A Liability Regime For File-Sharing, Daniel J. Gervais

Journal of Intellectual Property Law

The paper starts by asking whether P2P file-sharing of music can be stopped. Based on a discussion of (a) the interaction among law (regulation), technology and the market and (b) relevant social norms, the paper takes the view that it may not be possible to stop file-sharing. The paper then turns to an analysis of the economics and structure of a viable licensing model that could be implemented now without legislative or technological changes. The paper argues that P2P licensing could be good business. The paper ends with a brief look at (a) whether the licensing model could be exported …

With its Office of Digital Humanities Start-up Grant, the Image Analysis for Archival Discovery (Aida) team set out to further develop image analysis as a methodology for the identification and retrieval of items of relevance within digitized collections of historic materials.1 Specifically, we sought to identify poetic content within historic newspapers, using Chronicling America's newspapers (http://chroniclingamerica.loc.gov/) as our test case. The project activities we undertook—both those completed and those in process—support this goal and align well with the activities proposed in our original funding application and as approved by NEH. For 170 years, Akron has been linked to the wider world—ever since John Brown, the famous abolitionist and Akron’s most consequential resident, traveled on behalf of Colonel Simon Perkins to the European capitals in 1846 to market the wool that became Akron’s first international export. In the late nineteenth century, Akron industrialist Lewis Miller captured international accolades for the farm machinery manufactured at his Buckeye Mower Works, located where E. J. Thomas Hall stands today. The Gettysburg Compiler: On the Front Lines of History

Bodies in Conflict: From Gettysburg to Iraq is a brand new exhibit in Schmucker Art Gallery at Gettysburg College. Curated by Mellon Summer Scholar Laura Bergin ’17, it features eleven depictions of bodies engaged in various conflicts in U.S. history, ranging from the Civil War to the war in Iraq. In addition to curating the physical exhibit found in Schmucker Art Gallery, Bergin also created a virtual version, which can be accessed online through the Schmucker Gallery web page.
