Revising International Law: A Liberal Account Of Natural Resources, Fernando R. Tesón

San Diego Law Review

In this Article, I defend the view that natural resources originally belong to individuals who have legitimately established private property claims over them. Natural resources do not belong to a collective entity such as the people or the state. My argument is simple. Relying on the Lockean contractarian tradition, I argue that individuals must delegate any resource controlled by the state. This is because all powers of the state are, morally, delegated powers. A group’s claims over natural resources is entirely derivative of the original claims of its members. Only individuals can originally appropriate natural resources; only they have the …

Drawing from the work of sensory historians, this paper will explore the importance of the senses in understanding one’s surroundings and define what qualifies as sensory experience in a museum setting. Through a combination of research and observations during museum visits, it explores examples of how each sense has been incorporated into museums and exhibits. It presents examples of immersive and interactive exhibits providing multi-sensory experiences, including examples of both effective and non-effective ways in which these elements have been used. It is the author’s premise that the museum should remain artifact-centered, and sensory elements should be used to supplement, …

This thesis examines the Anglo-American reception, from the 1930s to the early 2000s, of the ideas of the German political theorist Carl Schmitt. The introduction provides an overview the key concepts in Schmitt’s writings in the 1920s. Chapter one examines Schmitt’s influence on the German-Jewish émigré political theorists Leo Strauss and Hans Morgenthau, in an attempt to explain how Schmitt’s ideas were initially transported from Germany to the U.S. The second chapter is a more detailed case study of the American leftist journal, Telos, which played a key role in introducing Schmitt’s writings to a broader, English language audience in …

Incomplete Conversions: Intentions Of Indigenous Idolatry In Early Colonial Latin America, Amanda Boos

After the Spanish conquest of Latin America different religious groups set up missions to convert the Indians to Catholicism. In the 1530s and 1560s overzealous officials started punishing the indigenous people for idolatry because they saw it as a rejection of Catholic and Spanish rule. This thesis examines why indigenous people continued their religious practices after their supposed conversion to Catholicism. The author argues that indigenous traditions of incorporating new deities into their pantheon led them to believe that the Catholic god was another to be included in their worship, not one to replace their belief system. 禮壞樂崩時代聖賢君子的堅持與抉擇, Kuo-Liang Yeh

西周末葉一直到漢初，自周初建立起來的禮樂文明逐漸崩壞，其間約七百餘年，國家社稷爲何没有全面瓦解？其後漢武帝提倡儒術，終使往後二千餘年的歷史持續受到禮樂文明的影響，成爲中華文化的特色。此一歷史過程，值得探討。

本文臚舉十六項西周末葉至春秋末年禮壞樂崩的事實，然後陳述當時明君、賢大夫以及儒者如何堅持理念及禮典，同時如何體察世變做出抉擇，展現正面的力量，因而使得國家社稷不致迅速土崩魚爛，進而説明反映上述理念的古禮書的性質與價值之所在。結論是：《儀禮》、《禮記》爲典範，而《春秋》及三《傳》爲正負面之教材，這使得漢武帝提倡儒術有所依據，中華之禮樂文明成爲可能。討論古代文化，捨此諸書，無法有所褒貶，而這是孔子及其後學的主要貢獻。

劉百閔的經學著述, Chun Hing Hui

劉百閔 (1898-1968) 是20世紀五六十年代香港著名的經學家。他在1949年由廣州移居香港前，長期投身政界。1952年9月，被香港大學聘爲中文系講師，1956年被擢爲中文系高級講師。前後服務香港大學13年，於1965年6月榮休。在退休前一年開始專注於整理舊作，以“學不倦齋自刊書”的名義先後出版《經子肄言》、《易事理學序論》與《周易事理通義》三書。於1968年1月4日不幸因喘病遽然辭世。《孔門五論》是他生前最後一本親自定稿的“學不倦齋自刊書”，在他逝世三個月後被冠以“劉百閔遺著”之名出版面世。1970年3月出版的《經學通論》則是在未及親自定稿的情況下付梓的，也是最後一部“劉百閔遺著”。這五部經學著述都是他任教香港大學時的教學與研究成果。本文即擬探討此等著述的若干特色，藉以窺察當時香港經學教育的一二情狀。

I consider myself an autodidactic musician by the musical and compositional achievements I have made without formal music training. I chose to research the compositional traits of other autodidacts to see their successes and challenges with their knowledge. Theatre criticism has evolved with the advancement of technology and the decline of print journalism. As consumers are given increasing agency by which they can filter the news and reporting they read and occasionally replace it with their own, the idea that a sole voice on a certain topic brandishes more dominance over it than the masses of people involved in its creation and sustainment becomes progressively absurd. I did so by completing an examination of five personal observations in my craft. Historians follow those tributaries of early American history and trace their converging currents as best they may in an immeasurable river of human experience. The Butlers were part of those British imperial currents that washed over mid Atlantic America for the better part of the eighteenth century. In particular their experience reinforces those studies that recognize the impact that the Anglo-Irish experience had on the British Imperial ethos in America. This study approaches the material assemblage of Coalwood, a cordwood camp that operated from 1900-1912 in Michigan’s Upper Peninsula, with a dialectal method and a theory of internal relations in order to understand how daily life was produced and reproduced. Common sense notions often see home and work as separate entities that only relate to one another externally. My archaeological and historical research abstracts domestic labor as a set of social relations that are dialectically and internally connected to the processes of capital accumulation. l’Art Brut , also commonly referred to as “outsider art,” is comprised of a variety of visual media by untrained or mentally ill artists. The string quartet is subtitled this because it takes inspiration from the work of these artists; with its jagged edges, vibrant colors, and horrid scenes, there is an organic beauty inherent in such eclectic and divergent art. Another factor which drew me to the artwork of the mentally ill was the commonality of Kenophobia: an abnormal fear of empty spaces. Converging my various identities as artist, educator, firefighter and city employee I delved into the City of Boise’s LIV campaign. LIV’s intent is the reimagining of municipal government and its engagement with employees, residents, and business. I pursued three different projects: interning in Human Resources, sitting on the Vista revitalization committee, and coordinating art students with the Boise Farmers Market “Mobile Market” project. This essay describes how using unsupervised topic modeling (specifically the latent Dirichlet allocation topic modeling algorithm in MALLET) on relatively small corpuses can help scholars of literature circumvent the limitations of some existing theories of the novel. Using an example drawn from work on Victorian novelist Anthony Trollope's Barsetshire series, it argues that unsupervised topic modeling's counter-factual and retrospective reconstruction of the topics out of which a given set of novels have been created allows for a denaturalizing and unfamiliar (though crucially not “objective” or “unbiased”) view. In other words, topic models are fictions, and scholars of literature should consider …

More than a thousand men from northwest Arkansas served in the Union Army during the American Civil War. The conflict devastated a region that had previously enjoyed impressive economic growth. The years of suffering during the war eventually left the region largely depopulated. As people returned to the region after the war was over, unionists and their families fought not only to rebuild, but to secure the benefits they felt their loyalty to the federal government deserved. Kenya was an unusual case within the larger narrative of decolonization in the British Empire. The presence of white settlers, the relative newness of the colony, and the particular way in which the British pursued the civilizing mission all combined to make the end of empire particularly violent for all parties involved. Independence in Kenya was precipitated by a bloody civil war, known as Mau Mau, and the imposition of martial law by the government for almost a decade. Christopher Marlowe’s drama Edward II has long been known for its representation of a close male, arguably homosexual, friendship between King Edward II and his favorite, the French Piers Gaveston, as well as their union’s negative effects on the court.
