Hart Or Dworkin: Who Better Illuminates The Nature Of International Law?, Colton V. Acosta

The purpose of this thesis is to explore two legal theorists' conceptions of law and adjudication and then to use those conceptions to analyze which conception better illuminates the nature of international law. Hart thinks that a mature legal system is composed of primary and secondary rules. For Hart, whether a legal system exists is a matter of value-neutral social fact; a legal system is unified by formal criteria of validity that constitute the fundamental rule of the system. Law in no way relies on moral principles. Hart's theory for international law culminates in viewing international law as decidedly law, …

This paper and accompanying sources hope to provide a detailed examination of the world of Darlings at Hollins University between the years 1900 and 1921, using primary sources gathered from The Spinster, the university’s yearbook. As a small, single-sex university established in 1843, Hollins has a unique history of romantic relationships between students. Students who participated in these relationships between the years of 1900 and 1921 were called Darlings. These same-sex relationships flourished at Hollins in the early 20th century, and were a well known and accepted part of life at Hollins. For this study, over a hundred primary sources …

Finance literature has been studying the gender gap and the roles of women in business and finance. Focusing on mutual fund management, this study revisits the idea by investigating the impact of gender-specific investing styles on the level of volatility involved with the funds. The initial hypothesis is that the performance of funds managed by females is less volatile compared to funds managed by males. If we have statistical evidence to show this hypothesis is valid, gender diversification should be encouraged in asset management. Five letters from the John Little Lobdell family, who had refugeed with their slaves first to the Natchitoches, Louisiana, area and finally to Canton (Omen) in southeast Smith County, Texas, in very late 1863. These letters describe the area and property, the sale of slave families, visitors, the end of the war, and negotiations with the freedpeople over labor contracts and transportation back to Louisiana.

"To 'Spill Their Hearts Blood In The Good Cause Of Releasing The Yankees': The Plot To Free The Prisoners At Camp Ford." Chronicles Of Smith County, Texas 46 (2015): 12-18., Vicki Betts

In November, 1863, Northern deserter Joseph K. Davisson discovered a plot to free the federal prisoners at Camp Ford near Tyler, Texas. The plot was headed by former Texas state representative George W. Whitmore and his family, to be assisted by a loosely organized network of East Texas Unionists. Prison commander Col. R. T. P. Allen sent two undercover operatives to the Whitmore home in southeast Smith County where they confirmed the plan and then tricked the men into falling into a Confederate trap where they were captured.

The Power Of Creativity: How Web-Based Parody Encourages Chinese Civil Participation, Amber Boczar

This article investigates that relationship between e’gao (parody using web-based media) and Chinese civil participation. E’gao (恶搞 EUH-gow) uses videos, images, and text based campaigns that use humor to remove fear of political commentary and action. By detailing the development of China’s internet use, and the creation of the e’gao movement, I argue that e’gao removes the fear of participating in campaigns and movements, which criticize government policy and actions on both local and state levels, by using humor and anonymity of large online numbers. E’gao can provide a way for the common citizens to mold policy, and hold authority …

At 8:15 am on August 6th, 1945, the world and the way in which we fight wars changed forever. Immediately following the drop of the Little Boy atomic bomb, the city of Hiroshima was decimated, leaving the surviving citizens to deal with poverty, starvation, loss of loved ones, and utter destruction of their lives. After the bombing, survivors were left with burns, radiation poisoning, and physical scars. Unknown to the survivors of the atomic bombings, or Hibakusha, were the ensuing psychological and emotional damages. In 2014, we know more about traumatic experiences than in 1945. Studies from …

The purpose of this research was to understand the experience of a Playback Theatre (Playback) program for adolescents addressing themes of bullying perpetration and victimization. The guiding question for the study was: What was the phenomenological experience for homeless youth participating in Keep the Peace Leadership Program, a Playback program at Manhattanville College in Purchase, NY? The sample consisted of 11 youth residing at the Coachman Family Center in White Plains, NY, 11 Manhattanville students, and four adults from Big Apple Playback Theatre in NY. The purpose of this mixed method investigation was to discern whether participation in a task-specific music therapy group contributed to quality of life for adults with intellectual disabilities. Engaging in social interaction had previously been shown to benefit physical and emotional health (Duvdevany, 2008) while lack of social connection had produced detrimental effects, most often loneliness and depression (de Belvis et al., 2008). VizScore is an open-source, on-screen notation delivery system designed with the performer’s strengths in mind. By harnessing a performer’s learned skills of reading traditional paper notation and practice of interpreting time from a conductor’s gestures, VizScore creates a notation environment that can integrate seamlessly into any performance situation and help musicians play in time with other instruments, live or computer-generated. The paper reviews some general design principles of on-screen notation as put forth by current experts in the field and offers a new model for on-screen notational display. "I really was never any more than what I was," Bob Dylan writes in his autobiography Chronicles, "a folk musician who gazed into the gray mist with tear-blinded eyes and made up songs that floated in a luminous haze."1 I'd call his proclamation inefficient if that didn't imply that it gets a job done, albeit poorly. The sentence, rather, strikes me as grand­sounding balderdash. It begins with a promise of humility, after which it gradually evaporates into bleary images that never realize anything resembling actual meaning. Like the roaming of the library shelves, or the process of surfing the web, I am drawing from “slivers” of existing material so as to create more challenging panoramic prints. The scale has increased and the similarity to the facets that are found in fine glass is obvious. They float back and forth between the analytical and the abstract. I am combining numerous slivers into extended “brain waves” that represent how learning is practiced and accomplished today—in bits and pieces. affairs on social relations within a community of undocumented migrants in Chicago, and the ways men attempt to limit their impact. My fieldsite for this exploration is The Eatery, a small Chicago restaurant in which migrants or their natal or extended family members worked and to which all were anchored. What I found was that men’s trysts were not merely tolerated; they were understood to not count. I argue that this arrangement upheld both the affairs and the patriarchal privilege that allowed them in the first place, even as it mitigated their probable negative effects on inter-migrants social relations. This paper describes how, from the early twentieth century, and especially in the early Cold War era, the plant physiologists considered their discipline ideally suited among all the plant sciences to study and explain biological functions and processes, and ranked their discipline among the dominant forms of the biological sciences. At their apex in the late-1960s, the plant physiologists laid claim to having discovered nothing less than the “basic laws of physiology.” This paper unwraps that claim, showing that it emerged from the construction of monumental big science laboratories known as phytotrons that gave control over the growing environment. Hathrasi rasiya is a traditional song genre of North India’s Braj region, performed by semi-professional members of music clubs (akhār.ās) and informed by a complex set of prosodic schemes, with secondary melodic aspects. As these schemes involve, however tangentially, a kind of music theory, and the genre is patronized by local elites and enjoyed by connoisseurs, it constitutes a member of the “intermediate sphere” of regional genres that share features of both classical and folk musics. The era of human impact throughout the Earth’s biosphere since the Industrial Revolution that has recently been named the Anthropocene poses many challenges to the humanities, particularly in terms of human and non-human agency. Using diverse examples from literature, travel reflections, and science that document a wide range of agencies beyond the human including landscape, ice, weather, volcanic energy or gastropods, and insects, this essay seeks to formulate a broader sense of agency. All of our examples probe new kinds of relationships between humans and nature. Much has been said about the influence of Plotinus, the Platonist philosopher, on the ideas of Augustine of Hippo, the Western Church Father whose writings had the largest impact on Western Europe in the Middle Ages. This thesis considers both writers’ ideas concerning matter, evil, and language. It then considers the way in which these writers’ ideas influenced their style of writing in the Enneads and the Confessions. Plotinus’ more straightforward negative attitude towards the material word and its relationship to the One ultimately makes his writing more academic and less emotionally powerful. This paper evaluates whether students’ perceptions of Appalachian English improve through a method of instruction that uses dialect literature in the classroom. Most existing methods of instruction tend to portray dialects as wrong, incorrect, or in some way less rule-governed than Standardized English, despite the numerous studies that have demonstrated otherwise (e.g., Labov 1969, Wolfram 1986). The data from this study derives from two groups of students enrolled in introductory composition and communication at the University of Kentucky. Each group is given a pre-test to determine attitudes toward Appalachian English and Standardized English. An experimental group is then exposed to …

Loanwords are integrated into Classical Arabic from various languages such as Latin, Greek, Persian, Syriac, Turkish, and others. When such words get borrowed into Arabic, they either get adopted, remaining as they are in the source language, or get adapted by undergoing certain phonological and morphological alterations. Such morphophonological changes would be defined within an adaptability scale which exhibits three different positions. The first position is occupied by merely adopted (MA) loanwords, like khurasān ‘cement’ (Persian), the second position is assigned for partially adapted (PA) loanwords, as shatarandj ‘chess’ (Persian chatrang), and the third position is for the fully …
