In another essay being published contemporaneously with this one, I have explained that as the concept "human right" is understood both in the Universal Declaration of Human Rights and in all the various international human rights treaties that have followed in the Universal Declaration's wake, a right is a human right if the rationale for establishing and protecting the right-for example, as a treaty-based right-is, in part, that conduct that violates the right violates the imperative, articulated in Article i of the Universal Declaration, to "act towards all human beings in a spirit of brotherhood." The late Harold Berman was a pioneering scholar of Soviet law, legal history, jurisprudence, and law and religion; he is best known today for his monumental Law and Revolution series on the Western legal tradition. Berman wrote a short book, Law and Language, in the early 1960s, but it was not published until 2013. In this early text, he adumbrated many of the main themes of his later work, including Law and Revolution. He also anticipated a good deal of the interdisciplinary and comparative methodology that we take for granted today, even though it was rare in the …

America was born in revolution. Outraged at numerous abuses by the British crown—to include the conduct of British soldiers in the colonists’ daily lives—Americans declared their independence, creating a new republic with deep suspicions of a standing army. These suspicions were intensely debated at the time of the nation’s formation and enshrined in the Constitution. But congressional limitations on the role of the military in day-to-day affairs would have to wait. This did not occur until after the Civil War when Southern congressmen successfully co-opted the framers’ earlier concerns of a standing army and passed a criminal statute—the 1878 Posse …

Romania, a former communist country in Eastern Europe, saw the iron curtain lifted in 1989, and started at that time the transition to a free market economy. The past couple of decades encompass extraordinary changes in the economic structure and environment, with state monopolies being dissolved and private companies entering the market and competing in western manner. I use Edith Wyschogrod's figure of the heterological historian to argue that we have a responsibility to learn from the "dead others" of the past in order to better apply in practical ways the lessons we learn from history. I draw on an interpretation of Nietzsche's view on historiography, to examine the claims of Hegel's dialectic, namely, that the Ideal Absolute for which Spirit pines, is actually achievable, particularly through the advent of the Internet. Beginning with a relatively well-known interpretation of Hegel's philosophy of history, Fukuyama's, I show how Hegel's dialectic takes shape in Fukuyama's interpretation as a negative …

This Thesis analyzes the rhetoric executed by different presidents in order to sustain the battle against drugs. The war on drugs is one of the longest battles the United States has fought. From its inception under President Richard Nixon to Barack Obama, the war on drugs has become an institutionalized presidential program responsive to public demands for action against the spread of illegal drugs. Over the airwaves, presidential rhetorical overtures on the matter go hand in hand with the drug war on the streets. Frequency is known to modulate outcomes on tasks like picture naming. According to the frequency lag hypoThesis there is a common mechanism for the effects of word frequency, language dominance and bilingual and monolingual differences in picture naming (Gollan, Montoya, Cera, & Sandoval, 2008; Gollan, Slattery, Goldenberg, Van Assche, Duyck, & Rayner, 2011). English monolinguals and English-Spanish bilinguals were tested on a picture naming task with pictures that had high and low frequency names. Response times, priming scores, and error rates were assessed. Response times indicated that monolinguals, and bilinguals were slower to respond to for low frequency picture names …

Slavocracy's Collective Atlantic: Utopian And Dystopian Discourse In Contemporary Narratives Of Slavery, Jalaine Nicole Weller

A number of contemporary narratives of slavery speak to a collective experience of the transatlantic slave trade and engage that space as a narrative contact zone of heterogeneous interpretations of slavery. These interpretations emphasize the multiplicity of black and white subjectivity and the personal struggle to self-create utopian relational experience within and without the dystopian reality of enslavement. Overall, it is the Atlantic--as a physical space, temporal triangle, and personal experience--that facilitates this collective experience.

Immediately following the Mukden Incident in 1931 and the founding of Manchukuo, the Japanese supported puppet state in northeastern China, the Imperial Japanese Army found itself again face to face with their old enemy Russia, now the Soviet Union. The border disputes between these two countries would soon become armed conflicts. The Japanese Korea Army as well as the Kwantung Army, stationed in Manchuria, would soon follow a policy of limited war against the Soviet Red Army, here in particular during the battles of Changkufeng, in 1938, and Nomonhan in 1939.

Reinventing The Old West: Concordia Cemetery And The Power Over Space, 1800-1895, Nancy Gonzalez

Utilizing Concordia Cemetery as a framework, this study analyzes the social and economic development of El Paso County and the surrounding areas after the U.S.-Mexico War (1846-48). The cemetery was a vast commercialized zone before it was a burial ground, and silenced histories, voices, and people that lived and thrived on this land are incorporated into this work. The role of the original owners, Hugh Stephenson and Juana Maria Ascarate, as well as the Mexican networks, intermarriage and Mexican American women, and the presence of ethnic Mexicans are subjects that are also examined. When it comes to evangelism and missiological methods, should we follow in the steps of Jesus? Many missionaries are doing just that. In Luke 10 Jesus instructs his disciples, giving them a method to accomplish their appointed mission. This involves three phases: (1) searching for the “person of peace”; (2) supporting a house fellowship; and (3) securing a missionary base of operations. Such an approach is certainly worth examining but only in light of the biblical authority and context as well as the missionary’s cultural context.

Moved To Move: Socially Contextualizing Women's Exercise Motivations, Dusti Rae Werner

All Graduate Theses, Dissertations, and Other Capstone Projects

Using qualitative data from 11 interviews with women who exercise regularly, this research explores women's motivations to exercise, how they make social comparisons and how they self-evaluate their bodies through the social context of gender, socio-economic status and race. Women with intrinsic motivations to exercise find more positive, long term outcomes than those with extrinsic motivations. Women compare themselves to similar others, such as their peers to form self-evaluations more readily than they do media images. Respondents also indicated the importance of relationships in beginning and maintaining exercise regimes.

Athenian Black Glass Pottery: A View From The West, Justin St. P. Walsh, Carla Antonaccio

Art Faculty Articles and Research

Excavation of archaic Morgantina (c.700–450 BC), Sicily, has brought to light a significant pattern in the distribution of imported Greek pottery. This pattern, which shows a preference for imports with features that referred to metal vessels, is echoed at sites around the western Mediterranean. We argue that the preference for certain types was communicated back to Greek producers, and that it also reflects the particular local interests of non-Greeks, who associated metallic features not only with wealth, but also with their own ancestral traditions.

This project looks at two holy sites in the Christian world and their respective pilgrimages: El Camino de Santiago de Compostela in Galicia, Spain and El Santuario de Chiamyó in New Mexico, USA. The project first discusses the general background of pilgrimage, specifically in the Christian tradition, laying some theological and historical foundations. It then looks at the history of El Camino de Santiago de Compostela up through the modern day, tracing the importance of the pilgrimage and the associated saint, Santiago Mayor (The Apostle James the Greater). The Harry Potter series by J.K. Rowling was, for many Millennials, a defining literary and media experience. The popularity of the series has spawned many fan-made parodies. Meanwhile, in recent years, the classical Petipa story ballet style has begun to give way to more modern structures of choreography. The Marauder’s Son, the culmination of a yearlong choreographic endeavor, is a story ballet that strives to introduce new audiences to classical dance through the use of the first book in the Harry Potter series, Harry Potter and the Sorcerer’s Stone.
