Using hermeneutical methodology, this paper examines some of the legal fictions that form the foundation of Federal Indian Law. The text of the U.S. Supreme Court’s 1823 Johnson v. M’Intosh opinion is evaluated through the lens of the Convention on the Prevention and Punishment of the Crime of Genocide to determine the extent to which the Supreme Court incorporated genocidal principles into United States common law. The genealogy of M’Intosh is examined to identify influences that are not fully apparent on the face of the case. International jurisprudential interpretations of the legal definition of genocide are summarized and used as …

This study explores whether the best practices of refugee integration policies, as supported by scholars, are present in the European Union (EU) and some of its Member States between 2014 and 2021, accounting for the responses of these governments to the 2015 refugee crisis in Europe. In addition, it seeks to reveal the likelihood of future collective governance of refugee integration at the EU level. The article analyzes the development of Ukrainian Orthodoxy in the context of the revenge policy of Russia against Ukraine at the turn of the 21st century. In 2003, Natalie Maines, the lead singer of the band then known as the Dixie Chicks, made a political statement to an all British audience. Her statement was both critical of the Iraq War that America had just entered, and also critical of then-President Bush. The Chicks were immediately blacklisted, with audiences burning the Chicks merchandise and radio stations refusing to play any of the music penned by the Chicks. This thesis combines the disciplines of political science and philosophy to illuminate the conceptual links between ethnic nationalism, postcolonial disputes, and epistemology. In doing so, it proposes a novel understanding of postcolonial disputes that moves beyond the politics of national sentiments and socially constructed historical memory to one that also recognizes the epistemic stakes in the contestation. Threatening a lawsuit, Howell prepared a memorandum to NBC citing evidence of voters changing their votes to Godwin, because as one put it, "A national network can't be wrong."⁷⁸ Howell's memorandum also mentioned an indirect tie of McGee to Godwin. Godwin constantly demanded that Howell disclose how he would replace the revenue under his tax plan.⁴³ Throughout the campaign, Godwin stressed inconsistencies between positions Howell took on various issues in 1973 and what he had said in the past. This article examines the durable, yet largely overlooked, claims of Bahu Begam (1727–1815) to dynastic wealth and authority in the Awadh nawabi (1722–1856), a North Indian Mughal ‘successor state’ and an important client of the East India Company. Chief consort (khass mahal) to Nawab Shuja-ud-Daula (r. 1754–75) and mother to his successor Nawab Asaf-ud-Daula (r. 1775–97), Bahu Begam played a well-documented role in the regime’s tumultuous politics, particularly during Warren Hastings’s tenure as the Company’s governor-general (1773–85) and his later parliamentary impeachment. Inaction on climate change has been traditionally explained by economic incentives, but some of the variability in climate policies cannot be explained by economics alone. During the COVID-19 pandemic, anti-Asian hate peaked and came to national attention. Given the country-wide scope of this issue, a potential avenue for its address is through federal representatives, and particularly through those representatives who identify as Asian-American. This community’s political participation began long before 2020, and this thesis evaluates how Asian-American representatives have provided meaningful political representation in various situations for a national Asian-American constituency.
