Stasis In Moltmann E Schmitt, Pier Giuseppe Monateri Dec 2013

Stasis In Moltmann E Schmitt, Pier Giuseppe Monateri

Pier Giuseppe Monateri

The essay introduces an original interpretation of Moltmann’s thought on Christian kenosis, according to the fundamental critical method known as ‘close reading’. On this ground, the Author brings to the surface the complex bulk of literary quotations which give substance to a specific passage in Moltmann’s work “The Crucified God”. Quotations become an intellectual device apt to produce meaning through its proper deferral and suspension. Within this framework, the Author’s main purpose is to put at the centre of the scene the explicit reference made by Moltmann to C. Schmitt’s concept of stasis, in order to explain the self-emptying of …

Institutionalized Silence: The Problem Of Child Voicelessness In Divorce Proceedings, Brandon Sadowsky Dec 2013

Institutionalized Silence: The Problem Of Child Voicelessness In Divorce Proceedings, Brandon Sadowsky

Brandon Sadowsky

In this paper, I present the current state of child representation in divorce proceedings. I argue that children should be represented in all divorce proceedings. I then consider the best interest and client-directed models of child representation and argue that each model is supported by important intuitions: paternalism and autonomy, respectively. I try to formulate a hybrid model that satisfies both of these intuitions.

Voice Without Say: Why Capital-Managed Firms Aren’T (Genuinely) Participatory, Justin Schwartz Aug 2013

Voice Without Say: Why Capital-Managed Firms Aren’T (Genuinely) Participatory, Justin Schwartz

Justin Schwartz

Why are most capitalist enterprises of any size organized as authoritarian bureaucracies rather than incorporating genuine employee participation that would give the workers real authority? Even firms with employee participation programs leave virtually all decision-making power in the hands of management. The standard answer is that hierarchy is more economically efficient than any sort of genuine participation, so that participatory firms would be less productive and lose out to more traditional competitors. This answer is indefensible. After surveying the history, legal status, and varieties of employee participation, I examine and reject as question-begging the argument that the rarity of genuine …

Hannah Arendt E O Pensamento Político: A Arte De Distinguir E Relacionar Conceitos., Andre De Macedo Duarte Jun 2013

Hannah Arendt E O Pensamento Político: A Arte De Distinguir E Relacionar Conceitos., Andre De Macedo Duarte

Andre de Macedo Duarte

The text discusses Arendt’s peculiar political thought, whose originality and independence concerning classic ideological criteria such as right and left frequently arises perplexities amongst her readers. This situation is aggravated by the fact that Arendt offers no explanation concerning the methodological procedures that orient her political thought. My hypothesis is that the main characteristic of Arendt’s political thinking lies in its capacity of both distinguishing and relating the distinguished concepts, an interpretation that counters current critical readings that stress Arendt’s supposedly rigid and contemporarily unattainable concepts. Against those criticisms, I argue that by facing the rupture of tradition Arendt exercised …

Chinese Diaspora As People Of Their Own Countries And Chinese Philosophy As A World Philosophy, Chenyang Li, Hong Xiao Jun 2013

Chinese Diaspora As People Of Their Own Countries And Chinese Philosophy As A World Philosophy, Chenyang Li, Hong Xiao

Hong Xiao

In this essay, we follow Tang Junyi's lead in exploring issues related to Chinese diaspora and Chinese philosophy. While we largely endorse Tang's call for overseas Chinese to establish themselves in their adopted lands, we argue for a more nuanced view of the identity of Chinese people outside China: they not marginalized individuals scattered outside of their "homeland," China, rather they are people legitimately established in their own respective countries. In this connection, we also advance a view of future Chinese philosophy as a world philosophy rooted in China as well as in the world at large. In our view, …

Comparing Suffering Across Species, John Nolt Jun 2013

Comparing Suffering Across Species, John Nolt

John Nolt

Moral life often presents us with trade-offs between the sufferings of some individuals and the sufferings of others. Researchers may need to consider, for example, whether the suffering imposed on animals by a certain line of medical experimentation justifies the relief that the resulting discoveries may bring to (human or non-human) others. Often in such cases, the suffering of some individuals is incomparable with—that is neither greater than nor less than nor equal to— the suffering of others. While this complicates moral decision-making across species, it does not undermine it.

Balance Or Trade-Off? Online Security Technologies And Fundamental Rights, Mireille Hildebrandt May 2013

Balance Or Trade-Off? Online Security Technologies And Fundamental Rights, Mireille Hildebrandt

Mireille Hildebrandt

In this contribution I argue that the image of the balance is often used to defend the idea of a trade-off. To understand the drawbacks of this line of thought I will explore the relationship between online security technologies and fundamental rights, notably privacy, non-discrimination, freedom of speech and due process. After discriminating between three types of online security technologies I will trace the reconfiguration of the notion of privacy in the era of smart environments. This will lead to an inquiry into the metaphor of the scale, building on the triple test regarding the justification of the limitation of …

Music Of Worship And The Sanctification Of The Believer, Jonathan D. Twining Apr 2013

Music Of Worship And The Sanctification Of The Believer, Jonathan D. Twining

Jonathan D Twining

Because of its importance in the life of a believer, music should aid in the sanctification process. The debate concerning the use of contemporary music in church worship contexts arises from the belief that musical styles can either encourage or discourage the sanctification of a believer by influencing emotions. The efficiency of music for the purpose of sanctification should be considered by the listener. Music that is associated with unbiblical influences and intentions may not be fit for use in worship settings.

Los Límites Morales Del Mercado: Justicia Como Dignidad Humana, Carlos Andrés Pérez Garzón Feb 2013

Los Límites Morales Del Mercado: Justicia Como Dignidad Humana, Carlos Andrés Pérez Garzón

Revista Justicia y Derecho ISSN 2323-0533

English Abstract: In these days it seems that money is the king of the world. It regulates both the market …

Understanding Ill-Structured Engineering Ethics Problems Through A Collaborative Learning And Argument Visualization Approach, Michael H.G. Hoffmann, Jason Borenstein Feb 2013

Understanding Ill-Structured Engineering Ethics Problems Through A Collaborative Learning And Argument Visualization Approach, Michael H.G. Hoffmann, Jason Borenstein

Michael H.G. Hoffmann

As a committee of the National Academy of Engineering recognized, ethics education should foster the ability of students to analyze complex decision situations and ill-structured problems. Building on the NAE’s insights, we report about an innovative teaching approach that has two main features: first, it places the emphasis on deliberation and on self-directed, problem-based learning in small groups of students; and second, it focuses on understanding ill-structured problems. The first innovation is motivated by an abundance of scholarly research that supports the value of deliberative learning practices. The second results from a critique of the traditional case-study approach in engineering …

Gouvernementalité Algorithmique Et Perspectives D'Émancipation : Le Disparate Comme Condition D'Individuation Par La Relation?, Antoinette Rouvroy, Thomas Berns Jan 2013

Gouvernementalité Algorithmique Et Perspectives D'Émancipation : Le Disparate Comme Condition D'Individuation Par La Relation?, Antoinette Rouvroy, Thomas Berns

Antoinette Rouvroy

Democracy In Transition: Political Participation In The European Union, Kyriakos N. Demetriou Jan 2013

Democracy In Transition: Political Participation In The European Union, Kyriakos N. Demetriou

Kyriakos N. Demetriou

The essays in this collection, written by a cross-regional group of experts, provide illuminating insights into the causes of declining levels of citizen participation and other distinct forms of civic activism in Europe and explore a range of factors contributing to apathy and eventually disengagement from vital political processes and institutions. At the same time, this volume examines informal or unconventional types of civic engagement and political participation corresponding to the rapid advances in culture, technology and social networking. The contents of this volume are divided into three essentially interrelated parts. Part I consists of critical essays in the form …

Commentary: Critical Analysis Of Chiropractic At The Crossroads Or Are We Just Going Around In Circles., Dennis M. Richards

Dennis M Richards

This commentary presents critical analysis of a paper published by Dr John Reggars, and based, as he admitted, on his perceptions and opinions. Many of those are wrong. Others raise important questions. Sourced from a lecture presented by him at the 2010 annual conference of the Chiropractic and Osteopathic College of Australia (‘COCA’), this polemic is best understood in its historical and political contexts. COCA’s objects include political activity and Reggars is its vice president, which he failed to declare.

Vitalism And Value In Undergraduate Chiropractic Education, Dennis M. Richards Jan 2013

Vitalism And Value In Undergraduate Chiropractic Education, Dennis M. Richards

Dennis M Richards

Vitalism is a philosophical viewpoint with ancient origins. In more recent times it has been discussed as a reaction to dominant reductionist and mechanist models in science and health. A ‘new vitalism’ incorporates recent developments in philosophy and science.

Demographic changes, particularly ageing, are occurring in many societies. These changes and the rise of non-communicable diseases resulting from unhealthy lifestyles challenge biomedicine’s ability to address them and societies’ abilities to pay for treatment of them.

Chiropractic was founded on and continues to involve vitalist thinking. A vitalist approach by chiropractors might offer solutions to these challenges. Such an approach would …

Three Paradigms Of Scientific Realism : A Truthmaking Account, Jamin Asay Jan 2013

Three Paradigms Of Scientific Realism : A Truthmaking Account, Jamin Asay

Prof. ASAY Jamin, Frederick

This paper investigates the nature of scientific realism. I begin by considering the anomalous fact that Bas van Fraassen's account of scientific realism is strikingly similar to Arthur Fine's account of scientific non-realism. To resolve this puzzle, I demonstrate how the two theorists understand the nature of truth and its connection to ontology, and how that informs their conception of the realism debate. I then argue that the debate is much better captured by the theory of truthmaking, and not by any particular theory of truth. To be a scientific realist is to adopt a realism-relevant account of what makes …
