The Forum against Sex Determination and Sex Preselection began its campaign in Mumbai against discriminatory abortions of female foetuses in April 1986. In the 25 years since then, laws have been enacted against the practice but female foeticide continues. It is a major challenge to fight the use of pre-selection techniques for sonpreference without jeopardising women’s right to safe abortion.

Normalmente, somos crítico do Presidencialismo.

Simbolismo Das Origens. A Lição De Brotero, Paulo Ferreira Da Cunha

Sebastianismo E Constituição, Paulo Ferreira Da Cunha
Sebastianismo E Constituição, Paulo Ferreira Da Cunha

Direito Pensado, Sentido E Vivido Em L. A. Warat, Paulo Ferreira Da Cunha

E contudo...

Identidade E Atraso, Paulo Ferreira Da Cunha

Merry Season’S Controversy, Lorin Geitner
Merry Season’S Controversy, Lorin Geitner
Lorin C. Geitner
Discussion of the infamous "Christmas Controversy" – the legality of religious symbols in holiday displays on public land. This issue is examined both from the viewpoint of an attorney and a scholar of religion: From a legal point of view, the article examines the holdings of three major Supreme Court cases which have addressed this issue. From the viewpoint of religious scholarship, the article examined the relevant sociology of religion, which is also an important factor in accounting for why, in spite of settled precedents, this issue remains controversial.

Crise & Democracia, Paulo Ferreira Da Cunha

"President Lyndon Baines Johnson liked to quote the prophet Isaiah. 'Come, let us reason together,' Johnson sometimes said (assuming the voice of God) as he prepared to exercise his famous powers of persuasion. But Johnson was no literalist. Jesus told his disciples that the poor would be 'with you always.' Johnson and the other architects of the Great Society disagreed. Convinced that privation had no place in modern America, they confidently launched the concatenation of federal initiatives known as the War on Poverty. That war is now over; the poor, as predicted, remain. Yet the battle mattered--not because it was …
Citizen Responsibility And The Reactive Attitudes, Amy Sepinwall
Citizen Responsibility And The Reactive Attitudes, Amy Sepinwall
Amy J. Sepinwall
This paper takes seriously the notion that individuals may bear responsibility for the transgressions of their group even where they do not bear the hallmarks of individual culpability. More specifically, I contend that citizenship itself can ground responsibility for the crimes of one’s nation-state, and I advance this contention in the context of a discussion about Americans’ responsibility for abuses committed in the course of the war in Iraq.
Moreover, the kind of responsibility I have in mind is not simply the forward-looking variety, which is what many forms of civil liability and reparations programs contemplate; nor is it simply …

Dangerous Psychopaths: Criminally Responsible But Not Morally Responsible, Subject To Criminal Punishment And To Preventive Detention, Ken Levy
Ken Levy
How should we judge psychopaths, both morally and in the criminal justice system? This Article will argue that psychopaths are generally not morally responsible for their bad acts simply because they cannot understand, and therefore be guided by, moral reasons.
Scholars and lawyers who endorse the same conclusion automatically tend to infer from this premise that psychopaths should not be held criminally punishable for their criminal acts. These scholars and lawyers are making this assumption (that just criminal punishment requires moral responsibility) on the basis of one of two deeper assumptions: that either criminal punishment directly requires moral responsibility or …

A Conceptual Model Of Academic Success For Student-Athletes, Keith Harrison
Dr. C. Keith Harrison
Concern over the academic talent development of Division I student–athletes has led to increased research to explain variations in their academic performance. Although a substantial amount of attention has been given to the relationship between student–athletes and their levels of academic success, there remain critical theoretical and analytical gaps. The purpose of this article is to develop a conceptual model to understand and explain the cumulative processes and characteristics—as a whole and in stages—that influence academic success for Division I student–athletes. Research on student–athletes and academic success is reviewed and synthesized to provide a rationale for the basic elements of …

Gaining Ground: Towards A Discourse Of Posthuman Animality: A Geophilosophical Journey, Anne Louise Schillmoller
Anne Schillmoller
The paper seeks articulate possibilities for a reciprocal ground of animality, a non hegemonic conceptual frontier within which the sovereign terrain of liberal humanism might yield to networks of alliances and reciprocities among human and other animals. The objective is to locate topographies where the conditions of creaturely life may be conceptualised in relational and non anthropocentric terms. It seeks to identify possibilities for a discourse of animality which avoids the haunting spectre of humanism. Specifically, it explore routes which may avoid the dualisms of western thought and identify alternative ways by which animality might be conceptualised and represented. Its …
