Ecocide In War And Peace, From The Air Pollution Consequences Of The War In Ukraine To Japan's Disposal Of Fukushima Water Into The Ocean, Giovanni Chiarini Jan 2024

Ecocide In War And Peace, From The Air Pollution Consequences Of The War In Ukraine To Japan's Disposal Of Fukushima Water Into The Ocean, Giovanni Chiarini

Case Western Reserve Journal of International Law

This Article will propose and analyze potentially prosecutable cases of alleged global ecocide and propose targeted amendments to Articles 36(3) and (5) of the ICC Rome Statute. These proposed amendments may serve as a blueprint to procedurally ensure environmental expertise at the international judicial level. Ecocide is unfortunately not currently recognized under the Rome Statute. However, certain scholars have suggested defining it as a fifth international crime. This analysis identifies environmental crises, international criminal law expectations and examines the environmental pollution caused by the Russian invasion of Ukraine and the Japanese government’s decision to dispose of radioactive treated water from …

Novel Phase Shifters Using Reconfigurable Filters, Georgiy Brussenskiy Jan 2024

Novel Phase Shifters Using Reconfigurable Filters, Georgiy Brussenskiy

Graduate Thesis and Dissertation 2023-2024

Phase shifters play a crucial role in radar, satellite communications, and 5G networks. Recently, the idea of using filters as phase shifters have attracted much interest due to providing many benefits such as smaller area, lower noise figure, easier fabrication method as compared with other technologies, reduced cost, and the ability to work as multi-functioning device. This work focuses on the implementation of bandstop-based and bandpass-based filtering phase shifters. For the bandstop-based approach, some of the resonating structures that were examined are stubs, LC tanks, L-shaped/U-shaped half wavelength resonators and many others. Periodic stub loading filter design method was compared …

Enhancing Oil-In-Water Emulsified Bildgwater Treatment Using Electric Field Forward Osmosis (Effo), Nareg Krikorian Jan 2024

Enhancing Oil-In-Water Emulsified Bildgwater Treatment Using Electric Field Forward Osmosis (Effo), Nareg Krikorian

Graduate Thesis and Dissertation 2023-2024

Bilgewater discharge needs to meet the existing regulations with an oil concentration of less than 15 ppm. Among many treatment options, forward osmosis (FO) can be an economic-environmental method utilizing an osmotic pressure gradient between feed solution (FS) and draw solution (DS) which are separated via a semipermeable membrane. However, FO membrane foundling is still challenging. The main objective of this study was to evaluate the effect of electric field forward osmosis (EFFO) to mitigate membrane fouling and thus improve oil-in-water emulsion separation. Standard bilge mix (SBM) was used as representative bilgewater and mineral oil (MO) was used as control. …

Graduate Thesis and Dissertation 2023-2024

This thesis examines how the organizations ASPIRA and the Young Lords Party fostered a cultural identity within Puerto Ricans in New York or “Nuyoricans.” ASPIRA, founded in 1961 by Antonia Pantoja, aimed to create leaders who would later give back to their communities. They established clubs for Puerto Rican high school students in schools and at ASPIRA centers in Manhattan, Brooklyn, and Bronx. The Young Lords Party, founded in 1969, was a grassroots organization that fought against social injustices through their initiatives called “offensives.” ASPIRA and the Young Lords Party contributed greatly towards the development of a Nuyorican identity and …

Recombination And Excision: Dna Repair Proteins In Prokaryotic Host-Virus Conflicts, Amer Azim Hossain Jan 2024

Recombination And Excision: Dna Repair Proteins In Prokaryotic Host-Virus Conflicts, Amer Azim Hossain

Student Theses and Dissertations

Bacteriophages, or simply phages, are viruses that infect bacteria. They are the most abundant biological entity on our planet and outnumber bacteria 10:1 in the ocean. In response to this threat, bacteria have evolved a diverse battery of immune systems that prevent infection, which in turn has resulted in the development of numerous counter-defense mechanisms by phages. This evolutionary arms race drives molecular innovations and presents exciting avenues for the discovery of new molecular biology and new biotechnology tools, such as restriction enzymes and CRISPR-Cas9. My thesis investigates how mechanisms of DNA repair, specifically recombination and base excision, have been …

The Creation And Destruction Of Zulu And Comanche Power During The 19th Century, Erhard M. Van Deventer Mr. Jan 2024

The Creation And Destruction Of Zulu And Comanche Power During The 19th Century, Erhard M. Van Deventer Mr.

History Dissertations - Archive

During the 19th century, the Zulu and Comanche were two of the most powerful and dynamic indigenous peoples on opposite sides of the Atlantic Ocean. Both constructed regional powers that opposed European expansion based on their imperialistic nature, not to be confused with European imperialism. Comparing the Zulu and Comanche illustrates how each constructed an imperialistic realm and how their rise to power was connected to their keen use of conquest, diplomacy, and resource management as tools of statecraft in creating their domains. Their domains were created by imperialist expansion based on conquest. However, diplomacy and monopolizing essential regional resources …

Global Deaf And Disability-Led Partnerships For Accessible Emergency Response And Humanitarian Action, Alina A. Engelman, Joe Booze, Alexia Izquierdo Jan 2024

Global Deaf And Disability-Led Partnerships For Accessible Emergency Response And Humanitarian Action, Alina A. Engelman, Joe Booze, Alexia Izquierdo

The Journal of Sociology & Social Welfare

Disability-serving non-profit, non-governmental organizations (NGOs) play a critical role in fostering care networks and supporting humanitarian action for disabled people before and during emergencies, particularly in the absence of targeted philanthropic and governmental support. However, relatively few NGOs serving disabled people are led or operated by people with disabilities, especially by disabled women. This analysis, based on survey and interview data with leadership, explores the impact of two disability-led operations. Findings have profound implications for how social work practice can center disability justice both in preparing for and responding to emergencies. This paper assesses the needs and impact of two …

Strategic Implications Caused By Hypersonic Strike Weapons, Marc D. Johnson

Graduate Theses/Dissertations

Emerging technology is having a substantial impact on strategic stability. This thesis will analyze the impact of developing hypersonic weapon systems globally on strategic stability. Hypersonic weapons are defined as weapons that travel at least five times the speed of sound (Mach 5). Hypersonic Strike Weapons (HSW) are hypersonic weapons capable of maneuvering at hypersonic speeds that makes them much more difficult to engage when traveling at such high speeds. They are a relatively new technology that is currently being pursued by multiple nations throughout the world.

The United States is currently the only country that has officially declared all …

Foreign Intervention And Internal Displacement: Urban Politics In Postwar Beirut, Amanda Rizkallah Jan 2024

Foreign Intervention And Internal Displacement: Urban Politics In Postwar Beirut, Amanda Rizkallah

All Faculty Open Access Publications

Uneven democratization is a common yet poorly understood legacy of civil war. In the aftermath of the Lebanese Civil War (1975–1990), wartime processes of displacement interacted with Syria's intervention to transform local postwar political orders. In Beirut's suburbs, the bonds built between armed actors and displaced populations created opportunities for displaced people to extract responsiveness from local institutions, despite their vulnerability. But the power of displaced populations in their host community hinges on the fate of the locally dominant armed actor. If the armed actor is an ally of the intervening power, it can maintain political control over its strongholds, …

Synthesis, Characterization, And Performance Assessment Of Reusable And Biodegradable Antimicrobial Polymeric Membranes For Aerosolized Pathogen Inactivation And Filtration, Ebuka Ogbuoji Jan 2024

Synthesis, Characterization, And Performance Assessment Of Reusable And Biodegradable Antimicrobial Polymeric Membranes For Aerosolized Pathogen Inactivation And Filtration, Ebuka Ogbuoji

Theses and Dissertations--Chemical and Materials Engineering

Air filtration technology has proven effective in purifying air by trapping particulates which can cause adverse health effects. High Efficiency Particulate Air (HEPA) filters, capable of capturing over 99.99% of PM0.3, are recommended for critical applications. However, conventional non-woven HEPA filters rely on electrostatic interactions to trap smaller particles, which can deplete over time or after cleaning, reducing filtration efficiency and posing health risks. Additionally, these filters contribute to plastic waste.

This dissertation investigated the feasibility of using flat sheet polymeric membranes fabricated via nonsolvent-induced phase separation (NIPS) as reusable and biodegradable alternatives to commercially available non-biodegradable air …

Symbolic Anthropology And Jimi Hendrix’S Performance Of “The Star-Spangled Banner”, Hunter Motta, Alexander Proulx Jan 2024

Symbolic Anthropology And Jimi Hendrix’S Performance Of “The Star-Spangled Banner”, Hunter Motta, Alexander Proulx

Spectrum

Turmoil and unrest are often cited as root forms of inspiration for artistic pieces representing the period in which they take place. Take the punk rock explosion in the mid to late 70s, graffiti, and Frida Kahlo paintings, for example. If we are to see art as the language of people, we must then see public art as the language of the public. These pieces often become instrumental to the movements they support as they do not tell onlookers what to feel, but rather, depict it.

One such piece, a reworking of the National Anthem performed by Jimi Hendrix at …

Encryption Backdoors And The Fourth Amendment, Robert M. White Jan 2024

Encryption Backdoors And The Fourth Amendment, Robert M. White

Marquette Law Review

The National Security Agency (NSA) reportedly paid and pressured technology companies to trick their customers into using vulnerable encryption products. This Article examines whether any of three theories removed the Fourth Amendment’s requirement that this be reasonable. The first is that a challenge to the encryption backdoor might fail for want of a search or seizure. The Article rejects this both because the Amendment reaches some vulnerabilities apart from the searches and seizures they enable and because the creation of this vulnerability was itself a search or seizure. The second is that the role of the technology companies might have …

Defeat Fascism, Transform Democracy: Mapping Academic Resources, Reframing The Fundamentals, And Organizing For Collective Actions, Francisco Valdes Jan 2024

Defeat Fascism, Transform Democracy: Mapping Academic Resources, Reframing The Fundamentals, And Organizing For Collective Actions, Francisco Valdes

Seattle University Law Review

The information we gathered during 2021–2023 shows that critical faculty and other academic resources are present throughout most of U.S. legal academia. Counting only full-time faculty, our limited research identified 778 contacts in 200 schools equating to nearly four contacts on average per school. But no organized critical “core” had coalesced within legal academia or, more broadly, throughout higher education expressly dedicated to defending and advancing critical knowledge and its production up to now. And yet, as the 2021–2022 formation of the Critical (Legal) Collective (“CLC”) outlined below demonstrates, many academics sense or acknowledge the need for greater cohesion among …

Gwayak Ateg Onaakonigewi Dibenjigewin: Decolonizing Jurisdiction In Anishinaabe Tribal Courts, Kekek Jason Stark Jan 2024

Gwayak Ateg Onaakonigewi Dibenjigewin: Decolonizing Jurisdiction In Anishinaabe Tribal Courts, Kekek Jason Stark

Nebraska Law Review

It is generally understood as a matter of federal Indian law that determinations of tribal law should properly be interpreted by tribal courts. This is because tribal courts do not always adhere to the same legal philosophy as their settler colonial counterparts. Many tribal courts subscribe to traditional law, which is an “essential source” of tribal jurisprudence. Anishinaabe communities have maintained a rich body of traditional tribal law since time immemorial. However, these customary law principles are only recently being included in modern-day Anishinaabe tribal court determinations. This Article builds upon the Anishinaabe law principles articulated in recent opinions and …

The Time War: Comparatively Analyzing The Process Of Settler Colonialism & The Importance Of Personal Record, Naomi Hardin Jan 2024

The Time War: Comparatively Analyzing The Process Of Settler Colonialism & The Importance Of Personal Record, Naomi Hardin

Senior Honors Theses and Projects

In this work, I argue for the necessity of framing settler colonialism as an ongoing process of exploitation and genocide, rather than an event of the past. Understanding settler colonialism as ongoing allows us to recognize how white supremacy utilizes direct and indirect forms of violence to not just occupy land but extract resources, build infrastructure that ensures its survival, and displace indigenous peoples. I offer first a sketch of settler colonialism as it is happening in Palestine, Algeria, and the Americas. I engage with books and research essays to think comparatively about these phenomena & further reveal the legacies …

Warwilding: A Weapon And A Shield In The Midst Of Conflict, Lynn Ma Jan 2024

Warwilding: A Weapon And A Shield In The Midst Of Conflict, Lynn Ma

UC Law Environmental Journal

War disrupts the lives of people, governments, and the wider environment. The purpose of this article is to examine how rewilding and ecological planning could be applied to military logistics to enhance peace and security amid war and post-war periods. This is explored through a concept that conservationists have coined “WarWilding.” I will develop my conclusions by analyzing WarWilding case studies from active warfare and post-war zones. To evaluate the boundaries in the ethics of WarWilding, this paper will frame the analyses around provisions in the Convention on the Prohibition of Military or Any Other Hostile Use of Environmental Modification …

Legal Endearment: An Unmarked Barrier To Transforming Policing, Public Safety, And Security, Emmanuel Mauleón Jan 2024

Legal Endearment: An Unmarked Barrier To Transforming Policing, Public Safety, And Security, Emmanuel Mauleón

Articles

The problems of racialized policing have come into renewed focus over the past decade. The advent of viral bystander videos has not only forced a popular confrontation with moments of both routine and extraordinary policing violence but also sparked protests, uprisings, and grassroots movements to challenge current practices in policing and determine what must be done to transform it. And yet, even after the mobilization of one of the largest racial justice movements in American history, transformative change remains elusive. This Article offers an answer to this puzzle by foregrounding White people’s collective relationship with policing and describing how this …

Policing The Strait: How China’S Policing Of The Taiwan Strait Violates The U.N. Convention On The Law Of The Sea, Elizabeth C. Parker

American University International Law Review

As tensions continue to grow across the Taiwan Strait, China is using domestic maritime law to justify an expansion of police power in the international waters of the Taiwan Strait in violation of international law. This Comment will argue that the People’s Republic of China has violated the UN Convention on the Law of the Sea (“UNCLOS”) by implementing non-resource-related police power in waters meant only for resource exploration and management. In comparing the language of China’s domestic maritime law with that of UNCLOS, this Comment will show that the People’s Republic of China has used domestic law to reinterpret …
