Silent War: Applicability Of The Jus In Bello To Military Space Operations, Kubo Mačák
Silent War: Applicability Of The Jus In Bello To Military Space Operations, Kubo Mačák
International Law Studies
There are no molecules of air that could carry sound waves in the vacuum of outer space. Accordingly, space warfare may well become the first type of war whose signature sound would be—silence. But does the law of armed conflict (jus in bello) fall silent in times of Silent War? This article addresses the uncertainty at the heart of this issue. First, it delineates the relevant conceptual framework by examining the factual notion of “military space operations,” and its relationship with the legal concept of “armed conflict,” as well as the overlap between the potentially applicable bodies of …

Navigating A Life Of Theory: An Autobiography Of Privilege, Place And Teaching, Philip E. Bernhardt
Navigating A Life Of Theory: An Autobiography Of Privilege, Place And Teaching, Philip E. Bernhardt
The Qualitative Report
Experiences that influence and shape an individual’s pedagogical commitments serve as a unique lens to conceptualize professional transformation. This narrative provides an autobiographical account of the author’s journey from student to teacher. The article, which is divided into two distinct, but tightly connected narratives, draws on this tradition to examine and develop a more nuanced understanding of those life experiences influencing the author’s complex journey as an educator. Each narrative begins with a short autobiographical reflection highlighting significant life moments and histories. Second, critical and post-structuralist theory is interwoven to examine ways the author conceptualizes the significance of the experiences …

Heller And “Assault Weapons”, David Kopel, Jonathan Lowy, Allen Rostron
Law Review Symposia
A discussion of how Heller has been applied to “assault weapon” bans, with special attention given to the Fourth Circuit’s en banc decision in Kolbe v. Hogan, which held that the popular AR-15 rifle and other “assault weapons” are not protected arms under the Second Amendment.
Moderated by Professor E. Gregory Wallace.
Honour And Dignity: Trauma Recovery And International Law In The Issue Of The Comfort Women Of South Korea, Gudrun Getz
Honour And Dignity: Trauma Recovery And International Law In The Issue Of The Comfort Women Of South Korea, Gudrun Getz
Journal of International Women's Studies
Despite the decades of work undertaken by the international legal community to attain full and satisfactory reparation for the consequences of Japan’s actions during World War II, the emotionally-charged bilateral dispute between Japan and South Korea over the issue of the so-called ‘comfort women’ continues to this day. This paper is focused on analysis of the discourses surrounding the issue through the lens of a psychoanalytic methodological framework. Based upon the therapeutic work of one of the world’s leading sexual trauma specialists Judith Herman and her text Trauma and Recovery (1992), the paper examines the issues at stake in the …

Heller In The Lower Courts, Brannon Denning, Dennis Henigan, David Kopel, Hannah Shearer
Law Review Symposia
A discussion of how federal circuit courts have applied Heller, with a focus on lower court views of Heller’s holding and scope, the extent to which Heller provides a general framework for constitutional analysis in Second Amendment cases, what guidance Heller provides for resolving cases involving the right to arms in public places, the development of analytical frameworks beyond Heller, and whether lower courts have given proper deference to Heller in their Second Amendment decisions.
Moderated by Professor Sarah Ludington.
Minds Of Metal And Wheels: Tolkien And Lewis On Science And Faith, Mike Kugler
Minds Of Metal And Wheels: Tolkien And Lewis On Science And Faith, Mike Kugler
Northwestern Review
J.R.R. Tolkien and C.S. Lewis expressed a view of science in relation to religion that resonates with the views of many conservative Christians today: an association of modern science with anti-humanist convictions and totalitarian control of nature and human life. However, Kugler argues that Tolkien and Lewis’s view was rooted in personal and scholarly commitments to pre-modern literary worldviews. These were then confirmed by their experience of two world wars, the rise of the welfare state, and the threat of totalitarian barbarism in the first half of the twentieth century. If their world is arguably not ours, need we share …

From Maroons To Mardi Gras: The Role Of African Cultural Retention In The Development Of The Black Indian Culture Of New Orleans, Robin Ligon Williams
From Maroons To Mardi Gras: The Role Of African Cultural Retention In The Development Of The Black Indian Culture Of New Orleans, Robin Ligon Williams
Masters Theses
After a three hundred year journey from the continent, African cultural retention remains at the core of the Black Indian masking tradition of New Orleans. Prior research from progenitors in anthropology and ethnomusicology, focusing on African cultural retention, include the ground-breaking ethnographies of Robert Farris Thompson, Gwendolyn Midlo Hall, Kalamu Ya Salaam, Michael P. Smith, Margaret Thompson Drewel, Stephen Wehmeyer, Jason Berry and others, have established a solid foundation for research on African influences and retentions in expressive folk cultures, laying a firm foundation for this project. The author’s insider experiences within the Black Indian tradition are underscored by several …
Echelon Defense: The Role Of Sea Power In Chinese Maritime Dispute Strategy, Ryan D. Martinson
Echelon Defense: The Role Of Sea Power In Chinese Maritime Dispute Strategy, Ryan D. Martinson
CMSI Red Books
On April 10, 2012, two Chinese law-enforcement cutters on joint patrol in the South China Sea received orders to proceed immediately to Scarborough Shoal, a disputed cluster of rocks 140 nautical miles west of Subic Bay, the Philippines. Earlier that day, a Chinese fisherman aboard one of several boats moored in the lagoon had transmitted an alarming message to authorities in his home port in Hainan: “Philippine Navy ship number 15 heading this way.”
Ship number 15 was BRP Gregorio del Pilar, an elderly former U.S. Coast Guard (USCG) cutter now serving as a frigate in the Philippine navy. …
Race, Sexuality, And Masculinity On The Down Low, Stephen Kochenash
Race, Sexuality, And Masculinity On The Down Low, Stephen Kochenash
Dissertations, Theses, and Capstone Projects
In a so-called post-racial America, a new gay identity has flourished and come into the limelight. However, in recent years, researchers have concluded that not all men who have sex with other men (MSM) self-identify as gay, most noticeably a large population of Black men. It is possible that a tainted history of Black enslavement in this country that is inextricably linked with ideas of space, surveillance, subversion, and survival inform a Black male’s self-identification as being “on the down low” (DL). This begs the question: What does mainstream society view as gay-ness and how is the DL constructed …

The Politics Of United States Army Doctrine, David C. Rasmussen
Dissertations, Theses, and Capstone Projects
The US Army made four significant shifts in the content of its capstone operations doctrine, Field Manual (FM) 100-5 / FM 3-0, along a spectrum of war since the end of WWII: 1) in 1954 it made a shift from a doctrine focused almost exclusively on mid-intensity conventional warfare to a doctrine that added significant emphasis to high-intensity nuclear warfare; 2) in 1962 it made an even greater shift in the opposite direction toward low-intensity unconventional warfare doctrine; 3) in 1976 it shifted back to an almost exclusive focus on mid-intensity conventional warfare content; 4) and this is where Army …
