The New-Breed, “Die-Hard” Chinese Lawyer: A Comparison With American Civil Rights Cause Lawyers, James E. Moliterno, Rongjie Lan
Washington and Lee Journal of Civil Rights and Social Justice
In times of social upheaval, lawyers can mark the way toward social change. In particular, when lawyers become more aggressive than traditional lawyers in the cause of fighting injustice, they face backlash from multiple sources, including government and their own profession. Such was the case during the U.S. civil rights movement. Unusually aggressive behavior by cause lawyers was met with hostility from their own profession and from government action. Those lawyers, while battered at times with physical violence, bar ethics charges, contempt of court, and state hostility, survived and changed social conditions at the same time they altered the culture …

Dogs Of War Get A New Lease On Life: Why The Military Extraterritorial Jurisdiction Act Violates The Eighth Amendment In Light Of United States V. Slatten, Michael D. Stinnett-Kassoff
Washington and Lee Journal of Civil Rights and Social Justice
The United States has relied on Private Military Firms (PMFs) extensively to carry out its numerous overseas military missions since the end of the Cold War. Civilians and contractors have always had a place in American wars, even during the American Revolution and beyond. But the recent American incursions into Afghanistan and Iraq brought an unprecedented number of private contractors into the forefront of these conflict zones, the discussions surrounding them, and the legal questions arising from their ashes. Particularly, private contractors in Iraq seemed to be operating in a legal grey area—they clearly were not soldiers, and they clearly …
Mediation, Self-Represented Parties, And Access To Justice: Getting There From Here, Jacqueline Nolan-Haley
Mediation, Self-Represented Parties, And Access To Justice: Getting There From Here, Jacqueline Nolan-Haley
Fordham Law Review Online
Mediation is enthusiastically promoted as a vehicle for providing access to justice. This is as true in developing countries as it is in the United States. For individuals, mediation promises autonomy, self-determination and empowerment; for courts, there is the lure of procedural and administrative reforms—reduced dockets and greater efficiencies. Unburdened with formal discovery, evidentiary and procedural rules, pleadings, and motions, mediation is thought to generate access to justice at a faster pace than litigation. Commentators sing its praises while bemoaning its underutilization. I argue that claims about mediation’s ability to provide access to justice should be more modest because mediation …

The United States and the North Atlantic Treaty Organization (NATO) face daunting challenges in the Baltic region. Russia is behaving aggressively. Its military is more capable than it has been at any point since the end of the Cold War. More importantly, Russia is finding creative ways to subvert the status quo and to sow discord without triggering Article 5 of NATO, which declares that an attack against one member is an attack against all.
These problems are formidable, but we have reason to be optimistic. Far from shattering NATO’s cohesion and undermining its resolve, Russian aggression has reinvigorated the …

Recent Developments In The Law Of The Seas Ii: A Synopsis, John M. Gantus
San Diego Law Review
The following materials are a compilation of events relevant to law of the seas that took place from March 15, 1970 to March 1, 1971. While it is fairly complete it is far from exhaustive, due to the lack of continuity and organization of source materials. Major sources include the New York Times, the Environmental Reporter, and the United States Code Congressional and Administrative News, as well as a little help from our friends. The format used is basically the same as that used last year when the first synopsis was published. For those of our readers who found the …

Memory In T/Rubble: Tackling (Nuclear) Ruins, Marilena Parlati
CLCWeb: Comparative Literature and Culture
The 1945 bombs at Hiroshima and Nagasaki seem to have recently started to recede back in the memory of Western culture. 9/11 and the age of global warfare which we are in have averted our gazes away from that past, in our tremulous expectations of the next traumatic event. In the twentieth century, poets like Tony Harrison have tackled this delicate topic, while Japanese culture has in many ways been forced and willing to reconsider its own agendas and sense of identity from those ‘ground zeroes’ onwards. In both A Pale View of Hills (1982) and An Artist of the …

Trauma, Ethics, And The Body At War In Brittain, Borden And Bagnold, Carolina Sánchez-Palencia Carazo
CLCWeb: Comparative Literature and Culture
In her article “Trauma, Ethics, and the Body at War in Brittain, Borden and Bagnold,” Carolina Sánchez-Palencia Carazo discusses how the autobiographical accounts of the conflict by Vera Brittain, Enid Bagnold and Mary Borden, inspired by their experiences as voluntary nurses in the front, deconstruct the meanings of femininity, masculinity and patriotism, contesting the official rhetoric of passivity that defined the role of women in World War I. Their extreme engagement with the precariousness and vulnerability of others elicits an empathic response that can be interpreted through Judith Butler (2004; 2009), Emmanuel Lévinas (1969) and Alan Badiou’s (1993) ethics of …

Trespassing Physical Boundaries: Transgression, Vulnerability And Resistance In Sarah Kane’S Blasted (1995), Paula Barba Guerrero, Ana Mª Manzanas Calvo
CLCWeb: Comparative Literature and Culture
Sarah Kane’s Blasted has been analyzed from various perspectives that address the layers of destruction it exposes. From the questioning of its title and meaning, to the unravelling of the protagonists’ abusive relationship, the analyses have emphasized the depiction of vulnerability as the defining human trait that Jean Ganteau observes in contemporary British literature. However, a key aspect has been overlooked in the critical response to the play: for Kane vulnerability does not equal helplessness, but rather stands in opposition to it. Hence, this article concentrates on how Blasted formulates a new understanding of vulnerability that fits Judith Butler’s later …

An Exploration Of Iranian Use Of Gray Zones And Their Deterrence, Lauren Zimmerman, Amanda Urick
UNO Student Research and Creative Activity Fair
Iran, being the religious minority in the Middle East, has begun to extend its reach outside of its borders by influencing the stability of other states within the region. They have been utilizing their economic revenue to fund terrorist organizations and cyber capabilities to threaten free use of the internet in the Middle East. Iran is the world's most active state sponsor of terrorism, but how do we deter them? Our paper will explore the history of deterring Iran and future possibilities.

Performing Research: Contemplating What It Means To Be A "Man", George Belliveau
Artizein: Arts and Teaching Journal
Sharing research in performative modes opens new possibilities for meaning making. This article offers a monologue that explores my experience of working on a theatre project with military veterans. The impact of working on the creative process with veterans inspired this performed piece, and provided an opportunity to contemplate what it means to be a ‘man’ in today’s society. The article first situates performed research within current arts-based literature prior to sharing the creative piece, which is at the heart of this offering. The piece then concludes with how performed research opens the possibility for different forms of engagement and …
Killing Times [Table Of Contents], David Wills
Killing Times [Table Of Contents], David Wills
Philosophy & Theory
Killing Times begins with the deceptively simple observation—made by Jacques Derrida in his seminars on the topic—that the death penalty mechanically interrupts mortal time by preempting the typical mortal experience of not knowing at what precise moment we will die.
Killing Times traces the logic of the death penalty across a range of sites. Starting with the struggles of American courts to articulate what methods of execution constitute “cruel and unusual punishment,” Wills goes on to show the ways that technologies of death have themselves evolved in conjunction with fraught ideas of cruelty and instantaneity, from the guillotine through today’s …

The End Signs! Are We Getting The Message?, Terry L. Rankin
Doctor of Ministry
The problem addressed in this dissertation has three dimensions: imminent global catastrophe, the elitist tyranny responsible for it, and Christian detachment from both.
The purpose of this dissertation is not to solve the problem in any of those three dimensions. The aim is threefold—to deconstructively demonstrate the reality of the problem; to expose its historical roots in philosophy, science, and theology; and to offer a case-study example of how it the problem may be clearly viewed and understood for the purposes of 21st century Christian life. The case study is not simple or easy, but neither is the problem it …

Protecting Users Of Social Media, Margaret Ryznar
Protecting Users Of Social Media, Margaret Ryznar
Notre Dame Law Review Reflection
Social media platforms started as a fun way to connect with friends and family. Since then, they have become a science fiction nightmare due to their capacity to gather and misuse the data on their users.
It is not irrational for social media providers to seek to capitalize on their data when they provide the platforms for free. Indeed, their business model is to sell data to third parties for marketing and other purposes. Yet, users should be able to expect that their data is not used to hurt them or is not sent to disreputable companies. Indeed, fewer people …

Uxo Detection System Of 2028, Mia Kobs, Jennifer Hernandez, Keenan Wood, Kelsey Catano, Robert Sylvia
ENGS 89/90 Reports
UXOs can range from small bomblets to artillery shells that have failed to explode and are found all over the world. Within the US alone, twenty new sites are found yearly. UXOs pose a significant threat to civilian lives and prevent development of land where they are found.
Our sponsor, White River Technologies (WRT), has developed a device of 7 transmitter coils that integrates geophysical mapping technology for UXO detection. This method of detection uses transmitter coils that produce magnetic pulses and receiver coils. The current iteration of the system is heavy, bulky, difficult to transport, and takes weeks to …

Marching in the Gettysburg Liberty Parade in May 1918 was a drum corps consisting entirely of Civil War veterans. As local citizens demonstrated their patriotism—notably with the Kaiser hanging in effigy—the old soldiers helped keep the pace for two thousand citizens who turned out to vigorously support the Great War. It was no doubt a moving moment, the nation's largest veteran demographic encouraging and supporting the next generation of soldiers to fight for cause and country in a very different war waged on a very different continent. Though fifty years separated the trenches of Petersburg from those of the western …

Copyright © 2019 American Society for Microbiology. All Rights Reserved. Species within the genus Burkholderia exhibit remarkable phenotypic diversity. Genomic plasticity, including genome reduction and horizontal gene transfer, has been correlated with virulence traits in several species. However, the conservation of virulence genes in species otherwise considered to have limited potential for infection suggests that phenotypic diversity may not be explained solely on the basis of genetic diversity. Instead, differential organization and control of gene regulatory networks may underlie many phenotypic differences. In this review, we evaluate how regulation of gene expression by members of the multiple antibiotic resistance regulator …

The Internet of Things (IoT) and the Internet of Everything (IoE) have driven processors into nearly every powered de- vice, from thermostats to refrigerators to light bulbs. From a security perspective, the IoT and IoE create a new layer of sig- nals and systems that can provide insight into the internal opera- tions of a device via analog side channels. Our research focuses on leveraging these analog side channels in IoT/IoE processors to detect intrusions. Our goal is to defend against cyberattacks that insert malware into IoT devices by detecting deviations in the code running on their processors from known …
Examining Adaptive Structures Of Military Families In Relation To Deployment, Gabriel Reed
Examining Adaptive Structures Of Military Families In Relation To Deployment, Gabriel Reed
Doctor of Psychology (PsyD)
Military families experience stressors unique to their occupation which strongly influence family structure. Deployment is one of the most impactful and unique experiences that a majority of current military families have experienced as it influences familial stability and structures. Previous research has found that when compared to civilian American families, military families tend to identify as more rigid than flexible while still maintaining good familial satisfaction reports. By examining the correlation between various family structure domains of military families (cohesion, flexibility, rigidity, deployment history, and familial satisfaction) mental health workers may better assist these families in establishing strategies to endure …
