Forgotten Federal-Missionary Partnerships: New Light On The Establishment Clause, Nathan S. Chapman

Notre Dame Law Review

Americans have long debated whether the Establishment Clause permits the government to support education that includes religious instruction. Current doctrine permits states to do so by providing vouchers for private schools on a religiously neutral basis. Unlike most Establishment Clause doctrines, however, the Supreme Court did not build this one on a historical foundation. Rather, in cases from Everson v. Board of Education (1947) to Espinoza v. Montana Department of Revenue (2020), opponents of religious-school funding have claimed American history supports a strict rule of no-aid.

This paper explores the notions of “Sinophone” and “Chinese-language cinema” under the rubrics of postcolonialism in Chinese film studies both in China and elsewhere around the world. The paper argues that these postcolonial-inspired notions misconstrue Chinese national identity building as imperialist/colonialist endeavours, and dichotomize Han and Chinese ethnic minorities. The paper offers its counterargument by examining cinematic practices of people’s cinema, minority nationality films and native-language films in the PRC.

This paper examines the impact of postcolonial theory in China on the question of the nation from historical and genealogical perspectives. China first encountered Jameson’s third-world national allegory and Edward Said’s Orientalism, which were quickly assimilated into the framework of the China/West dichotomy. Then Homi Bhabha’s ideas of national identity and cultural hybridity were utilized in studying Chinese ethnic minorities and identity construction. From the earlier views of postcolonialism as cultural resistance to cultural production now, Chinese postcolonial studies have acquired new energy for growth.

This paper examines the genealogy of Chinese literary theory under the Chinese Communist Party (CCP), in terms of Moscow-Yan’an-Beijing Modes from the inception of the CCP to the present. The focus of this paper is the state-sanctioned textbooks of literary theory and criticism from the beginning of the PRC to the present. The story of these textbooks tells us as much about the complex entanglement of Chinese Marxism or Maoism with Soviet Marxism, i.e. Leninism and Stalinism in the Mao era as about the powerful, on-going impact of that ideological lineage today.

In this dissertation, we introduce a novel cognitive engine design for intelligent, self-aware and spectrum-agile communications. The targeted cognitive radio (CR) has sensing and learning abilities that incorporate advanced signal processing and machine/deep learning (ML/DL) techniques. It can operate over a heterogeneous wideband spectrum that is much wider than the ones proposed in the literature, most likely covering several hundreds of MHz. It has the ability to detect existing signals in the surrounding RF environment and identify their origins. Although Raymond Chandler and C. S. Lewis seem to be a rather strange pairing, the ways in which they both borrow from Arthurian literature and use the myth to speak to their cultural moment are strikingly similar. Following T. S. Eliot’s use of the Grail quest in The Waste Land (which set a standard for the use of such material in Modern literature), these authors use Arthurian elements as a means of exposing hidden connections between the fragments of the literary past and the present within Chandler’s Marlowe novels and Lewis’s science fiction trilogy. The isolation, purification, and clinical deployment of antibiotics is one of the major drivers of decrease in morbidity and mortality from infectious bacteria in the 20th century. The rapid, ubiquitous deployment of antibiotics encouraged swift development and distribution of antibiotic resistance. New, novel techniques, technologies, and ultimately therapeutic antimicrobial compounds will be required to counter the rise of antibiotic resistant microbes. Historically, mimicking naturally occurring compounds has been the most fruitful method for discovering new antibiotics; unsurprisingly, many recent efforts have focused on expanding the cultivation and detection of previously unknown microbes and compounds, respectively. This article examines both Amish masculine cultural norms and practices and the characteristics of Amish men specifically as men. The first goal is to pull together information from the secondary literature on Amish men and masculinity. Salient characteristics or traits such as egalitarianism, pacifism, and rationality are discussed, and placed in the context of Gelassenheit (yieldedness), of the gender relations within families, and of Raewyn Connell’s notion of “hegemonic masculinity.” The second goal is to assess the appropriateness of general characterizations of the Amish gender regime, such as one with women as second-class citizens to men or as a “soft …

The Creek nation with its lands situated in regions claimed both by Spain and the United States occupied a strategic position at the close of the War of the American Revolution. Since no treaty existed between the two countries the question of boundaries was left entirely for future determination. The Spaniards desired to extend the limits of the Floridas as far northward as possible; while the Americans wished to establish the boundary near the Gulf as specified in the treaty with Great Britain.

This article seeks to explain wireless telegraphy (W/T) equipment, its development and use over the course of the First World War and how W/T performed in conjunction with the established landline network. W/T deployment during Canadian Expeditionary Force battles is evaluated to determine whether W/T was viewed as an alternative battlefield communication medium or simply as a standby for emergency situations. The analysis discloses that the Canadian infantry was unable to take advantage of continuous wave, a superior form of wireless that the artillery relied upon. In October 1915, during only their second tour of the front line, New Brunswick’s 26th Battalion conducted a reconnaissance-in-force upon a recently detonated German mine in front of their firing trench. The “crater fight,” as it has come to be known, resulted in twenty-one dead and thirty-six wounded but was portrayed as a success. But how much of what was printed in local newspapers was true? Mainstream science studies has long marginalized the intersection of capitalisms and technoscience, instead placing interactionist, liberal, and Foucaultian analysis at its forefront, and has had little to say about scientists as critics of the capitalizations of knowledge. Yet at the interstices of the field, scientists, decolonial, feminist, and critical race scholars were engaging capitalisms in ways that rejected conventional Marxism. Some of the roots of these analyses were visible in the journal Science for the People (SftP) revived in 2019, after thirty years of dormancy.
