Half Monk, Half Hitman: Applying Just War Theory To Private Military And Security Companies In The Context Of Humanitarian Intervention, Robert J. Peters
Half Monk, Half Hitman: Applying Just War Theory To Private Military And Security Companies In The Context Of Humanitarian Intervention, Robert J. Peters
Florida Journal of International Law
In Part II, this Article will discuss potential benefits of private military companies. Part III will address and acknowledge criticisms of PMSCs. Part IV provides a brief legal context, and Part V will discuss the just war theory criteria relevant to PMSCs in the context of humanitarian intervention. This section will examine why PMSC humanitarian intervention may be permissible in certain circumstances. The PMSC Executive Outcomes will serve as a dual case study; on the one hand, it would have been authorized by just war theory to contract with the United Nations to intervene in Rwanda. However, Executive Outcomes also …

The "Comfort Women" Reparation Movement: Between Universal Women's Human Right And Particular Anti-Colonial Nationalism, Ethan Hee-Seok Shin
Florida Journal of International Law
In this Article, I seek to place the “comfort women” reparation movement in East Asia’s broader colonial and post-colonial legal history. This Article will follow a largely chronological order with discussion of relevant legal points. Part II narrates the history of political and legal developments since the Imperial Japan period that set the stage for the “comfort women” reparation movement from the 1990s. In Part III, I will discuss the main legal issues concerning the Japanese reparation. Parts IV and V will explore and analyze the redress efforts at the U.N. human-rights bodies in the 1990s and the South Korean …
Justiciability Of All Human Rights: Scottish Independence As Redress For British Human Rights Abuses, Ann M. Piccard
Justiciability Of All Human Rights: Scottish Independence As Redress For British Human Rights Abuses, Ann M. Piccard
Florida Journal of International Law
On September 18, 2014, an overwhelming number of Scottish residents turned out to vote on one simple question: Should Scotland be an independent country? The deceptively simple yes or no question on the ballot could not begin to reflect the complex underlying issues. If the Independence Referendum had been approved—meaning a “yes” vote, the goal of Independence proponents and of the Scottish National Party (SNP)—every facet of life for the Nation and its citizens could have been affected. The presence of nuclear weapons; membership in the European Union; the very nature and name of the currency used in every transaction …

Nuclear Chain Reaction: Why Economic Sanctions Are Not Worth The Public Costs, Nicholas Colby Watson Wolfe
Florida Journal of International Law
The purpose of this Article is to convince policymakers that the achievement of an interim nuclear agreement with Iran should not be seen as a mandate on the effectiveness of economic sanctions, and that further use of economic sanctions is not worth the public costs to targeted nations or the United States. First, this Article will explain the basic uses and legal provisions for economic sanctions. Second, this Article will detail the public costs that economic sanctions can inflict on the United States and on the nations it targets. Lastly, this Article will explain the interim nuclear agreement with Iran, …
Israeli Nuclear Deterrence: The Failure Of A Concept: "How Did The Change In Israel's Strategic Context Affect The Usefulness Of The Israeli Nuclear Deterrent?", Amr Nasr El-Din
Archived Theses and Dissertations
This study will aim at examining how the changes in Israelâ s security environment affected the strategic usefulness of its nuclear deterrent. The Israeli nuclear deterrent was developed during the 1950s and the 1960s when Israelâ s strategic setting was, mainly, dominated by state-centered security threats. Consequently, Israel, at the time, was mainly concerned with the possible symmetrical military confrontations with its Arab neighbors; something that would have created strategic value for the Israeli nuclear deterrent. Yet, a closer examination of the evolution of the Israeli security environment since 1982 will reveal that Non-State Actors (NSAs) and asymmetrical forms of …
Behind The Steel Bars Of History: The Post-Civil Rights Era Radical Prison Movement, Stephen Perez Jr.
Behind The Steel Bars Of History: The Post-Civil Rights Era Radical Prison Movement, Stephen Perez Jr.
Binghamton University Undergraduate Journal
The resistance and political action taken by the incarcerated in prisons like Attica Correctional Facility during the post-civil rights era (1968 -1972) faced an unprecedented state-led, counterinsurgent force. The socio-historical context of this suppression is a time of crisis for the U.S. as it struggled to maintain capitalist hegemony in the face of anti-systemic movements from the New Left. The post-civil rights era was a moment in US history that saw the strongest and most radical challenge to racial capitalism to date in the form of a social movement led by prisoners, yet the historical legacy of radical prison organizing …

Continuity In Commerce: Development Of The Panton, Leslie And Company Trade Monopoly In West Florida, Thomas D. Watson
Continuity In Commerce: Development Of The Panton, Leslie And Company Trade Monopoly In West Florida, Thomas D. Watson
Florida Historical Quarterly
As the year 1782 drew to an end, the framers of Indian policy in British East Florida found themselves in a quandary. Although the evacuation of Savannah and Charleston signaled the end of military campaigning, the precise status of the British Empire in postwar North America remained unknown. To Thomas Brown, Indian superintendent of the Southern District, and Governor Patrick Tonyn, this uncertainty was a matter of real concern; numerous deputations of Indians—some from as far as the Great Lakes region— had descended on St. Augustine seeking assurances of continued British support. The officials responded by encouraging the Indians to …
Governor George Johnstone Of British West Florida, R. F. A. Fabel
Governor George Johnstone Of British West Florida, R. F. A. Fabel
Florida Historical Quarterly
George Johnstone was the first governor of British West Florida. His activities from his arrival at Pensacola in October 1764, to his departure in January 1767, have inspired detailed by narrow description. What nobody has sufficiently considered are the reasons for his appointment as governor and the circumstances surrounding the loss of this office. These omissions are worthy of examination. It is surprising that a junior naval officer with a spotty record should have been selected for one of the more lucrative colonial governorships. Even more astonishing is that a man who proved to be the most vigorous and possibly …
Mermaids Riding Alligators: Divided Command On The Southern Frontier, 1776-1778, W. Calvin Smith
Mermaids Riding Alligators: Divided Command On The Southern Frontier, 1776-1778, W. Calvin Smith
Florida Historical Quarterly
George Clemenceau's oft-quoted remark that war was too important a matter to entrust to the military simply put into words a thought prevalent in the western civil mind at least since the days of the Roman Republic. The obverse, that politics is too vital a business to be left to politicians, is equally true in the western military mind but less-often spoken. For a general to utter these words would bring immediate accusations of a “Caesar-complex” or worse. That twentieth-century playwrights would permit such a statement only from a power-mad, insanely-obsessed general, such as Jack Ripper in the production, Dr. …

Refining Japan’S Integrative Position On The Territorial Sovereignty Of The Senkaku Islands, Atsuko Kanehara
Refining Japan’S Integrative Position On The Territorial Sovereignty Of The Senkaku Islands, Atsuko Kanehara
International Law Studies
China and Japan face a tense situation in the East China Sea over conflicting sovereignty claims to the Senkaku Islands. In order to cope with the situation appropriately and precisely, Japan needs to thoroughly analyze it from the dual perspectives of the law of the sea and the law of territorial acquisition. Japan denies any existence of a dispute with China over the territorial sovereignty of the islands. The legal effects of the existence of a “dispute” need to be understood and considered by Japan when it constructs its position from the perspectives of the law of the sea and …
A History Of Land Tenure In The Ixil Region, Elaine Elliott
A History Of Land Tenure In The Ixil Region, Elaine Elliott
Maya America: Journal of Essays, Commentary, and Analysis
After the Spanish conquest, the IxilMayainitially remained less affected than more centrally located groups. However, dramatic changes occurred due to Guatemalan national government laws in the late 1800s which allowed claims on “vacant land”. Maya on those lands quickly adapted, claiming the areas where they had lived for over a millennium. The government favored large landowners who contributed to the national economy with export crops, particularly coffee. In the 1950s era of land reform, small farmers briefly obtained land, something quicklyreversed with the overthrow of the national government, accused of communism for these reforms. Conflict escalated when a leftist guerrilla …

Effects Of Exogenous Ketone Therapy On Performance, Cardiorespiration, And Seizure Genesis During Exposure To Hbo2 In The Sprague Dawley Rat, Nicole M. Stavitzski
USF Tampa Graduate Theses and Dissertations
Hyperbaric oxygen (HBO2) is used for clinical HBO2 therapy and in undersea and aerospace medicine. HBO2 is a humanmade extreme environment and protracted exposures can cause several adverse physiological effects on the body. For example, HBO2 increases the partial pressure of oxygen (PO2) in the body leading to redox stress. Redox stress is, in part, a cause of oxygen toxicity that manifests as seizures in its most severe form (central nervous system oxygen toxicity, CNS-OT). This dissertation focuses on strategies to be employed specifically for the warfighter breathing HBO2. Currently, the only way to prevent CNS-OT is to lower the …

Malaysia is opening parts of its services to greater foreign participation due to globalisation. Local banks have since consolidated a decade ago and foreign banks expanding their businesses in local markets have intensified the competition. As a result, credit card adoption is getting more challenging to marketers. Hence effective marketing strategies are important. The theoretical model of the paper is based on the buyer behaviour model by Kotler and Armstrong (1999). The model identifies the major factors which influence consumer buyer behaviour and how buyer decision process affects the buyer behaviour. The paper aims to examine the effectiveness of marketing …

Blackwater Rising: The Legal Issues Raised By The Unprecedented Privatization Of U.S. Military Functions, Robert D. Peltz
Blackwater Rising: The Legal Issues Raised By The Unprecedented Privatization Of U.S. Military Functions, Robert D. Peltz
University of Miami Law Review
The Army has used civilian contractors to provide supplies and services to its forces in the field since the Revolutionary War. These early contractors fed the cavalry’s horses and transported supplies. Over the years, the role of the civilian contractor has dramatically evolved. Following the Vietnam War and the end of the draft, there has been an ever-increasing privatization of functions previously performed by the military.
The wars in Iraq and Afghanistan, which began in response to the September 11 attacks and have only recently started to come to a formal end, have significantly accelerated this process. As a result, …

Teaching English In Ukraine: An Educator’S Guide To Teaching Russian-Speaking Ukrainian Students, Gabrielle Hirschy
College of Arts and Cultural Studies
Seeking to make an impact on the world through teaching English overseas, soon-to-graduate college student Annica feels drawn to Eastern Europe as she peruses a world map hanging on her dorm room wall. Her pointed finger drifting from country to country, she stumbles upon an unfamiliar, yet fairly large, eastern European country and reads “Ukraine.” Joy fills her heart, as she believes she’s found her destination. Seeking to gain information about teaching in Ukraine, she takes to the internet and her university’s resources. Suddenly, however, she is bombarded with academic and non-academic search results alike that dive deep into Russian …
The White Supremacist Penetration Of Western Security Forces: The Wider Implications, Kumar Ramakrishna
The White Supremacist Penetration Of Western Security Forces: The Wider Implications, Kumar Ramakrishna
New England Journal of Public Policy
This article argues that recent instances of white supremacist penetration of Western security forces should not be regarded as isolated issues. They are related to the worrying wider phenomenon of the gradual societal and political mainstreaming of white supremacist ideas in Western countries. Drawing on the German and US cases as examples, the article unpacks the argument by first examining the core theories of white supremacism: the “great replacement” and “white genocide.” It then explores how these theories have been weaponized, before proceeding to analyze the structure and modalities of the white supremacist threat. The article then considers the wider …
