Faculty members, as language policy implementers, retain significant control of the enactment of policy in local contexts. In order to better understand the relationship between de jure language policies at multiple levels of the policy hierarchy, in addition to faculty members? acceptance or rejection of these policies, this study investigated faculty perspectives on language policy, specifically at a southeastern university in the United States. This study employed multiple methods of research including a policy examination and a survey. Shoot First, Ask Later: Constitutional Rights At The Border After Boumediene, Brittany Davidson

Adopting Boumediene's functional approach in analyzing extraterritorial application of the United States Constitution at the U.S.-Mexico border will promote uniformity and provide guidance to courts and officials. Currently, courts are applying Verdugo-Urquidez's sufficient connections test, and different variations thereof permitting courts to arbitrarily decide who is entitled to constitutional protection in the absence of uniform precedent. Adopting Boumediene as the guiding test will not automatically trigger constitutional protection, instead, constitutional protection will only be granted if extending protection to an alien at the U.S.-Mexico border is justified based on the three-prong test.

This honors project is a choreographic work based on a testimony of a woman named Ashley Abercrombie who went from a journey of excellence, to drug abuse, to salvation. The objective of this project was to create an artistic social action piece based on faith. The final work of choreography was movement that was directly related to the story line of Ashley Abercrombie’s testimony, at seventeen minutes in length, and includes a cast of eleven. Troubleshooting Legal Malfunction: Lexmark And Consumer Standing Under The Lanham Act, 48 J. Marshall L. Rev. 453 (2015), Jeremy Rovinsky

This article suggests that the recent Lexmark decision, while resolving the confusion relating to Lanham Act standing requirements, does nothing to protect those most vulnerable—the consumers. Congress must explicitly declare that consumers have standing under the Lanham Act when they have been damaged by purchasing falsely represented goods or services. Section I provides a history of the Lanham Act and illustrates how different courts initially allowed and then precluded consumers from bringing claims under Section 43(a)’s “any person” language. Section II critiques the opinions that have found no consumer standing, including the Supreme Court’s recent Lexmark decision. Section III highlights …

Content-Based Confusion And Panhandling: Muddling A Weathered First Amendment Doctrine Takes Its Toll On Society's Less Fortunate, Clay Calvert

Richmond Journal of Law and the Public Interest

This article examines multiple problems now plaguing the fundamental dichotomy in First Amendment jurisprudence between content-based and content-neutral regulations of speech. The troubles were highlighted by the U.S. Supreme Court's 2014 divided decision in McCullen v. Coakley. Building from McCullen, this article uses a quartet of federal court rulings from 2014 and 2013 involving anti-begging ordinances affecting the homeless as analytical springboards for examining these issues in depth. Ultimately, the article proposes a three-step framework for mitigating the muddle and calls on the nation's high court to take action to clarify the proper test for distinguishing between content-based and content-neutral …

Shareholders are organizing and mobilizing on new social media platforms like Twitter. This changes the dynamics of shareholder proxy contests in ways that favor shareholders over management. Disruptive technology may bring about a shareholder revolution, which may not be in shareholders' best interests, at least from the perspective of shareholder wealth maximization, and it also has powerful implications for the future of corporate social responsibility.

We see the early modern as an open carry society. Hamlet’s success in the swordplay at the end is usually seen as his triumph, fulfilling his father’s injunction at last. The 2013 RSC production of Hamlet projected ambiguity, which I share. The most intriguing angle was Hamlet’s costume. Jonathon Slinger very quickly donned half of a fencing jacket; but the straps of the jacket dangled, strongly suggesting a straight jacket. Half mad, half resolute, Hamlet is driven through much of the play until, I will argue, he reinvents himself as a mad version of divine providence. The providential idea is …

Since the emergence of feminist literary criticism over four decades ago, scholars have been posing “new questions about old texts” (Tuttle 184), and in the field of Nineteenth- Century Spanish studies, questions Bridget Aldaraca, Lou Charnon-Deutsch, Catherine Jagoe, Susan Kirkpatrick, Jo Labanyi, Linda Materna and Karen Rauch have advanced continue to inform our understanding of gender discourse in nineteenth-century Spain. You Don’T Need A Metaphor To Know Which Way The Case Goes: The Senate Reference And Constitutional Metaphors, Richard Haigh

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This article uses the Supreme Court of Canada’s Reference re Senate Reform as a basis for arguing that metaphors are not always appropriate in constitutional adjudication. In that decision, the Court relies on the metaphor of “constitutional architecture” ten times (11 if a subheading is counted). Despite the multiple references, the Court leaves unanswered questions about what the architecture metaphor is doing. Does it help to clarify? Is it the same or different from the text itself? Is it the same or different from “structure”? Is not the metaphor itself capable of multiple meanings? Relying too heavily on metaphors allows …

By creating this multi-media performance piece, I hope to educate and spread awareness on the happenings of the Korean War by looking through the perspective of my grandfather as a North Korean runaway and eventually a South Korean soldier. My end goal is that people will not only be touched by his story, but come away with a greater understanding and deeper grasp of the lasting effects of the Korean War. I would also personally like to gain a stronger appreciation for my heritage as a Korean-American.

A Little Help From My Friends: A Relational Health Communication Competence Approach To Social Support For Forensic Educators, Heather J. Carmack, Todd T. Holm

National Forensic Journal

The purpose of this study was to examine factors that impact forensic educators’ perceived social support, including communication competence, job stress, and job burnout. Communicatively competent educators reported higher levels of administrative and family support than forensic educators who did not report high levels of communication competence. Educators who reported high levels of stress and burnout report lower levels of support from supervisors, coworkers, and family compared to educators who reported low levels of stress and burnout. Female coaches reported lower levels of support from supervisors, coworkers, and families, compared to male coaches. Educators with a large coaching staff reported …

This article examines the issues faced by the City of Detroit and the Detroit Institute of Arts when Detroit filed for municipal bankruptcy. Creditors called for the sale of the highly esteemed DIA art collection to pay outstanding municipal pension obligations. The DIA and the Michigan Attorney General viewed the collection not as an asset, but as a charitable public trust. Simply put, the City faced the question of what mattered most – pensions or paintings? Along the way, the parties and courts struggled with valuation of the art collection, a history of judicial decisions and lawmaking regarding charitable trusts …

The film's reviewers almost invariably commented on the parallels with Streetcar, many noting, too, that Cate Blanchett, who plays the title character, Jasmine, had also successfully played Blanche Dubois in Liv Ullmann's 2009 production of the play at the Brooklyn Academy of Music.2 But for all the similarities in character types and plot structure and for all the allusions to specific lines in Streetcar, the themes of Blue Jasmine are very different from those of Williams's play because the story that Allen tells also channels the fall of Bernie Madoff and his wife, Ruth.
