Use Your Words: On The "Speech" In "Freedom Of Speech", Leslie Kendrick

Michigan Law Review

Freedom of speech occupies a special place in American society. But what counts as “speech” is a contentious issue. In countless cases, courts struggle to distinguish highly protected speech from easily regulated economic activity. Skeptics view this struggle as evidence that speech is, in fact, not distinguishable from other forms of activity.

This Article refutes that view. It argues that speech is indeed distinct from other forms of activity, and that even accounts that deny this distinction actually admit it. It then argues that the features that make speech distinctive as a phenomenon also make it distinctive as a normative …

Agriprocessors, a preeminent kosher meatpacking plant, was the site of the largest workplace raid in US history. 390 workers arrested out of the approximately 900 employed over three shifts. As is now well-known, hundreds ICE agents in riot gear and fully armed, alongside dozens of Iowa state police, descended on this small rural town of 2,000+ residents in northeast Iowa with its moniker “Hometown to the World.” Two thirds of the workers apprehended by ICE that day were Guatemalan nationals, mostly from rural communities in the Department of Chimaltenango where I have conducted ethnographic research since the …

Theatre artists and organized religion both use the same tactics and strategies in order to connect to their audiences. This isn’t a coincidence: Over the course of human history organized religion and performance traditions developed, grew and evolved together. Performance practices grew out of religious traditions and often incorporated elements of spiritual celebration and religious ritual into their practices. In ancient Greece dramatic practices developed as a celebration of the god Dionysus, Sanskrit theatre of Ancient India evolved as a means of communicating Hindu myths to the masses and Noh theatre of ancient Japan started as shamanistic dance traditions. Shortly after John Wilkes Booth killed Abraham Lincoln on April 14, 1865, President Andrew Johnson directed that Booth’s alleged coconspirators be tried in a makeshift military tribunal, rather than in the Article III court that was open for business just a few blocks from Ford’s Theater. Johnson’s decision implicated a fundamental constitutional question that was a subject of heated debate throughout the Civil War: When, if ever, may the federal government circumvent Article III’s requirements of a criminal trial by jury, with an independent, tenure-protected presiding judge, by trying individuals other than members of the armed forces in a military …

In recent years, healthcare needs have shifted from treating acute conditions to meeting an unprecedented chronic disease burden. The healthcare delivery system has structurally evolved to address two primary features of acute care: the relatively short time period, on the order of a patient encounter, and the siloed focus on organs or organ systems, thereby operationally fragmenting and providing care by organ specialty. Much more so than acute conditions, chronic disease involves multiple health factors with complex interactions between them over a prolonged period of time necessitating a healthcare delivery model that is personalized to achieve individual health outcomes. This paper is to inform on-going discussions over proposed new federal accessibility legislation, and in particular discussions about whether such legislation should be extended to First Nation reserve communities. This paper is not a part of the consultation process that is being undertaken with various First Nations organizations. It surveys statutory law, reports, literature and jurisprudence. It discusses the legal landscape that must inform any dialogue about extending the federal regime to First Nation communities and assesses successes and challenges associated with three existing federal regimes that apply on First Nation Reserves.

As social movements amplify across the globe, activists and researchers are increasingly interested in the pedagogies of revolutionary transformation. To provide a rich resource for political educators and organizers, this paper formulates what we call an (un)communicative communist pedagogy that is oriented against communicative capitalism. We show that there is a taut connection between capitalism and democracy that consists of a shared logic, pedagogy, and aesthetic that revolves around communication, inclusion, and transparency. Without grasping this aesthetic connection, anti-capitalist struggles are reduced to liberal reforms that end up reinforcing and deepening capitalist production relations. The absence of official platforms and institutions such as museums and visual arts spaces; while the artistic amateur scene was flourishing, there were no museums or national galleries where collections of the best local and regional artworks could be found, appreciated and studied by artists and citizens. This cultural desert was the result of the government’s attention to bread and butter issues. In his article "Disoriented Nationalist Discourse of the Wenxuan Group amidst Manchukuo's Anti-Modern Chorus" Chao Liu analyzes the proposal of "native-land literature" made by left-wing Chinese writers in occupied northeast China. As it turns out, inheriting the nationalist discourse of the May Fourth Movement and further radicalizing it via a "new romanticism," those writers over-emphasized the socio-political function of literary production and took native-land literature as the most effective tool for nationalist mobilization. In his article "Frame, Preference, and Memory in Literary History Narration" Guoqiang Qiao analyzes the frame, preference and memory in literary historiography from a narratological and cognitive perspectives. He maintains that literary history is of multileveled narration that includes not only the perceptualized literary events, literary figures, and literary works, but also the conceptualized spirit of the time, national culture, and personal and collective memories. Qiao employs the basic concepts of frame, preference, and memory to suggest a cognitive approach to the narration of literary history. The Victoria regia was discovered in British Guiana in 1837, and for over ten years explorers and scientists tried different methods to transport viable seeds back to England. When the seeds were finally on British soil, no one could grow them successfully except Joseph Paxton, the head gardener for the Duke of Devonshire. Paxton built a special glass house at Chatsworth estate to mimic the tropical climate the Amazonian lily required, and created an innovative tank that was heated with coal and fitted with an apparatus to gently keep the water moving, replicating freshwater rivers.
