A Comparative Analysis Of The People's Republic Of China And Its Treatment Of Uyghur Muslims And Nazi Germany And Its Treatment Of The Jewish People, Jordan R. Ellis Jan 2022

A Comparative Analysis Of The People's Republic Of China And Its Treatment Of Uyghur Muslims And Nazi Germany And Its Treatment Of The Jewish People, Jordan R. Ellis

Honors Undergraduate Theses

Like many before, this thesis uses the tragedy of the Holocaust as a historical comparison to an event occurring today, mainly in the Xinjiang region of the People’s Republic of China. Many historians have argued that comparisons to the Holocaust should be academically or intellectually prohibited. Many have stated that such an effort could minimize the perceived severity of or unintentionally raise other events to the level of the Jewish genocide. However, such comparisons should be permitted and are necessary to help prevent a similar atrocity from ever occurring again. There is much to be learned from Nazi policy and …

Movies To Fall Asleep To: The Antitrust Implications Of Terminating The Paramount Consent Decrees, Isha C. Biswas Jan 2022

Movies To Fall Asleep To: The Antitrust Implications Of Terminating The Paramount Consent Decrees, Isha C. Biswas

American University Business Law Review

This Comment will argue that, while the Consent Decrees seem obsolete in the 21st century when studios own significant numbers of theaters, movies are no longer released one theater at a time like they were in 1948, which implicates relevant antitrust standards. With the prevalence of streaming, termination of the Paramount Decrees would allow streaming giants such as Disney+ and Netflix to monopolize the movie release market through the hybrid release model, impacting future case law and litigation. Part II of this Comment will examine the Paramount case, the consent decrees that resulted from it, and the judicial and congressional …

Towards A Dramaturgical Theory Of Constitutional Interpretation, Jessica Rizzo Jan 2022

Towards A Dramaturgical Theory Of Constitutional Interpretation, Jessica Rizzo

Seattle University Law Review

Like legal texts, dramatic texts have a public function and public responsibilities not shared by texts written to be appreciated in solitude. For this reason, the interpretation of dramatic texts offers a variety of useful templates for the interpretation of legal texts. In this Article, I elaborate on Jack Balkin and Sanford Levinson’s neglected account of law as performance. I begin with Balkin and Levinson’s observation that both legal and dramatic interpreters are charged with persuading audiences that their readings of texts are “authoritative,” analyzing the relationship between legal and theatrical authority and tradition. I then offer my own theory …

Hostile Learning Environments, The First Amendment, And Public Higher Education, Todd E. Pettys Jan 2022

Hostile Learning Environments, The First Amendment, And Public Higher Education, Todd E. Pettys

Connecticut Law Review

The Supreme Court has never squarely addressed the First Amendment status of student-on-student verbal harassment at public institutions of higher education. Does the First Amendment permit public colleges and universities to discipline students on the grounds that their speech has created a hostile learning environment for others on campus? If so, what is the analysis underlying that constitutional judgment, and what are the requisite hallmarks of such an environment? Does it matter whether a student’s speech created the hostile learning environment on its own or whether it wielded that power only by virtue of its combination with the speech of …

Dancing The Storm: Neurobiological Correlates Of Trauma-Related Psychopathology In Youth Resettled As Refugees, And The Efficacy Of Creative Arts And Movement Therapies To Address Trauma-Related Psychopathology, Lana Ruvolo Grasser Jan 2022

Dancing The Storm: Neurobiological Correlates Of Trauma-Related Psychopathology In Youth Resettled As Refugees, And The Efficacy Of Creative Arts And Movement Therapies To Address Trauma-Related Psychopathology, Lana Ruvolo Grasser

Wayne State University Dissertations

Exposure to stress and trauma activates key adaptive pathways, including the sympathetic adrenomedullary system and the immune system, which can result in long-term health impacts of trauma especially when experienced during sensitive developmental periods. Alterations in these systems are measurable through non-invasive methods including skin conductance response (SCR), fear potentiated startle (FPS), and inflammation. Research regarding the impact of trauma, and more specifically posttraumatic stress disorder, has primarily focused on adults, and there is a paucity of neurobiological research in displaced populations—like refugees—who may experience higher rates of trauma exposure and related psychopathology. The present study measured SCR to a …

Resorbing Patent Law's Kessler Cat Into The General Law Of Preclusion, Dennis D. Crouch, Homayoon Rafatijo Jan 2022

Resorbing Patent Law's Kessler Cat Into The General Law Of Preclusion, Dennis D. Crouch, Homayoon Rafatijo

Faculty Publications

It has become exceedingly common in our legal system that courts, in the guise of respect for precedent, compound upon errors. Legal precedents are written documents, but "[t]he reality we can put into words is never reality itself." As such, we seldom find a court decision that embodies the entire legal reality regarding the questions presented. In this respect, the legal system inherently suffers from a lack of what mathematicians call completeness. Each decision gives rise to countless inferences because what lower courts observe by reading the precedent is not the entire legal reality but an incomplete reality exposed to …

Men Who Conquered & The Women Who Mov'd Them, Nikita Chinamanthur

Scripps Senior Theses

Considering John Dryden’s Aureng-Zebe and Christopher Marlowe’s Tamburlaine the Great, this thesis examines how drama shaped popular ideas of the Indian subcontinent in Renaissance England. This thesis engages in a comparative analysis of formal choices such as doubling, tripling, and etymology to assess the efficacy of two incomplete portrayals of South Asia configured as women.

Escaping Modesto: George Lucas, Film Auteur, And The Alteration Of Movie History, Krister Persson Jan 2022

Escaping Modesto: George Lucas, Film Auteur, And The Alteration Of Movie History, Krister Persson

Undergraduate Honors Theses

This video essay analyzes the early filmography of George Lucas as a critique of auteur theory. Dissecting THX 1138 (1971), American Graffiti (1973), and Star Wars (1977) based on their autobiographic qualities, this short documentary investigates the advantages and disadvantages of viewing a complicated cinematic work through the lens of an individual author. Analysis focuses on Lucasfilm founder George Lucas and his reputation for controversially altering his works through special edition re-releases, calling into question the sanctity of theatrical releases and the confines of a film auteur. Does a filmmaker, particularly one whose films are drawn from personal experience, have …
