Thirteenth Amendment Echoes In Fourteenth Amendment Doctrine, Christopher W. Schmidt
Thirteenth Amendment Echoes In Fourteenth Amendment Doctrine, Christopher W. Schmidt
UC Law Journal
This Article argues that to better understand the historical development of Fourteenth Amendment antidiscrimination doctrine, we should look to the Thirteenth Amendment. The Fourteenth Amendment was drafted in response to debates over the meaning of the Thirteenth Amendment; it was widely understood at the time of ratification as building upon the constitutional commitments embodied in the Thirteenth Amendment; and assumptions about liberty and equality more commonly associated with the Thirteenth Amendment have had a recurring, if underappreciated, influence on judicial interpretations of the Fourteenth Amendment.
I trace these Thirteenth Amendment influences on the Fourteenth Amendment from Reconstruction to some of …

Avatars And Derivative Works: Harmonizing The Interests Of Creators And Consumers, Reina Shinohara
UC Law Journal
As we spend more of our days online, we are seeing a shift in content moving towards a progressively simulated reality. The virtual worlds of video games and other online communities have become a norm for many, with an influx of creative content derived from those spaces being widely shared and enjoyed by millions across the country. As instances of works featuring virtual worlds and our virtual representations within those worlds become more frequent, it becomes imperative that there be a clear delineation on what protections govern those expressions within and concerning those virtual spaces. Total Wreck, Bianca Arroyave
Total Wreck, Bianca Arroyave
LMU Theses and Dissertations
Bianca is the baby of her large Colombian/Puerto Rican family. She will use that and her spitfire personality to her advantage any chance she gets. A heated debate is her love language and sarcasm, the enemy. A lover of surreal worlds, Bianca thinks of herself part of her own Colombian crime family. Growing up on a healthy diet of campy black comedies and deep crime dramas, Bianca fuses the two in a new way. She would say her disability is the least interesting thing about her, but it does serve to give her a unique perspective on writing disabled characters. …
"Blood Must Flow:" The Arkansas Militia Wars Of 1868-1869, Eric Johnson
"Blood Must Flow:" The Arkansas Militia Wars Of 1868-1869, Eric Johnson
Tenor of Our Times
“Blood Must Flow: The Arkansas Militia Wars of 1868-1869” analyzes a period of particular political and racial violence during Arkansas Reconstruction. The Arkansas Militia Wars consisted of two phases. The first was an outbreak of political and racial violence that swept over much of the state in the months leading up to the presidential elections in the fall of 1868. This period coincided with the emergence of the Ku Klux Klan in Arkansas, and much of the violence was perpetuated by Klansmen. The second phase began the day after the election concluded, when Governor Powell Clayton declared martial law in …

Sex Addiction: A Literary And Yogic Perspective, Adrienne Hope Hite
Sex Addiction: A Literary And Yogic Perspective, Adrienne Hope Hite
LMU Theses and Dissertations
First offering insight into the disease of sexual addiction overall and what, in fact, does delineate it from sexual promiscuity, this paper will go on to seek ways to mitigate such behavior by exploring not only symptoms, but the existing underlying issues as well through a yogic whole-body perspective. Furthermore, diving deeper into such an application, specifically under the context of the yamas and niyamas and investigating how both might, not only serve as therapeutic tools for sex addicts, but perhaps allow for a healthier approach overall to sex in the modern world.
First offering insight into the disease of …
In Search Of Divine Liberated Love: A Yoga Memoir, Katie D. Davidson
In Search Of Divine Liberated Love: A Yoga Memoir, Katie D. Davidson
LMU Theses and Dissertations
I opted to write a memoir about my personal experiences in yoga, rather than a traditional research-based thesis. A key distinction between memoir and autobiography or auto-ethnography is that it’s not linear—much like my yoga journey. Often, experiences, particularly around healing emotional trauma, are more circular in nature, perhaps even more of a spiral. According to Carl Jung, “The spiral in psychology means that when you make a spiral you always come over the same point where you have been before, but never really the same, it is above or below, inside, outside, so it means growth.” (Jung 5, p. …

Aging Voices In The American Church Choir: A Study In Ethnomusicology And Ethnodoxology, Shirley Claudeen Ehler
Aging Voices In The American Church Choir: A Study In Ethnomusicology And Ethnodoxology, Shirley Claudeen Ehler
Doctoral Dissertations and Projects
Despite American church choirs being a distinct culture across all denominations and independent church entities, this traditional worship community of singers is a minority culture in the United States. Furthermore, existing journal literature frequently features young voices, e.g., children's, middle school, teen, and university choirs and choruses. Aging-voice research literature began to appear in the 1990s for individual voices or voices in community choirs. Aging voices are a unique ethnicity found in every race within the church choir culture. Researched literature on the aging voice in the American church choir is conspicuous by its absence, pushing American church choir aging …
An Investigation Of The Impacts Of Locus Of Control On Marital Satisfaction Among Wives Of Combat Veterans With Ptsd In The U.S., Rachel Sims
Doctoral Dissertations and Projects
Posttraumatic stress disorder (PTSD) is a significant cause of marital instability and divorce among PTSD veterans, which researchers have cited in the field of psychological disorders. The current study investigated the psychological structure of how marital satisfaction was related to the locus of control among wives of veterans with PTSD diagnosis. No prior studies have explored this relationship, as shown from an extensive search in current literature. The study compared the reported marital satisfaction of women with the locus of control to fill this gap. The family systems theory was applied to guide this research study. In addition, the study …
Solidarity And The Soviet Union, Jillian Forrester
Solidarity And The Soviet Union, Jillian Forrester
History & Classics Undergraduate Theses
The Solidarity trade union was the first independent, self-governing union to receive recognition under a Communist government. The union itself went beyond simple labor organizing, also becoming a political entity that helped Poland transition to a post-Communist government. The success of this union was due to its status as both union and social movement, as it was able to deeply permeate all aspects of society. Furthermore, the union's successful exploitation of existing social and economic issues in Poland brought the government to the bargaining table and led directly to its great success.
Let Us March On: Lavilla, Florida, And The History Of The Harlem Of The South, Christine Sullivan
Let Us March On: Lavilla, Florida, And The History Of The Harlem Of The South, Christine Sullivan
History & Classics Undergraduate Theses
Jacksonville, Florida, is a city that defies most expectations of an American city. Its massive size covers a vast array of people, cultures, and traditions. Jacksonville’s colorful history encompasses stories of success, failure, and control by three different nations. This diversity of people and backgrounds overwhelms Jacksonville’s narrative, leaving stories and memories forgotten. No more groups have been forgotten or overlooked in Jacksonville’s story more than the Black natives and residents. LaVilla, a neighborhood in downtown Jacksonville, is the historically Black community that has been consistently left out of Jacksonville’s story. LaVilla, known as the ‘Harlem of the South’, was …
The Party Respectfully Requests A Jury Trial On All Issues So Triable: What Issues Are Triable To A Jury And What Issues Should Be Triable To A Jury? A Comment On The Right To A Jury Trial, With A Focus On Civil Trials, And When The Right Exists, Michael Downing
Mercer Law Review
“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed . . . .” But what about civil prosecutions? What about prosecutions under state law, not federal? What does the universally expected “right to a jury trial” really mean or afford the parties to a trial?
Under federal law and the United States Constitution, by the time the Bill of Rights was drafted, the ideal of an accused’s right to a jury trial was already deeply rooted within …
Properties Design And Construction For William Shakespeare’S A Midsummer Night’S Dream, Nathan Alexander
Properties Design And Construction For William Shakespeare’S A Midsummer Night’S Dream, Nathan Alexander
Johnny Carson School of Theatre and Film: Theses, Student Research, and Creative Work
In the fall of 2021, the University of Nebraska-Lincoln put on a production of A Midsummer night’s dream. I am Nathan Alexander and I designed and built the properties used in the show. This thesis will discuss my design process as well as my construction process throughout this production. My writing serves as a reference to the collaborative process of theatre, and you will find as you read on that a large amount of my designs did not make it into the final production. This did not discourage me, instead it motivated me to discover what this show wanted to …
