Rethinking Federal Inducement Of Pretext Stops, Farhang Heydari
Rethinking Federal Inducement Of Pretext Stops, Farhang Heydari
Vanderbilt Law School Faculty Publications
Few topics in policing have received more attention than pretextual traffic stops—traffic stops made for crime-fighting purposes. Community leaders, legislators, police executives, and even presidents have recognized that the overuse of pretext stops has deleterious effects, including racially disparate enforcement, needless death, and degraded public trust in law enforcement. The result is a growing movement at the state and local level to roll back the widespread use of this tactic.
As promising as these developments are, most discussions of pretext stops largely omit a key player that drives the problem: the federal government. Presidents from Bush to Biden have decried …

A Review Of The Progression Of Concussion Protocols Used Over Time In High School And College Athletics, Renee M. Thompson
Honors Thesis
Concussions have a significant impact on teenagers and young adults. Most concussions occur when participating in sports. Therefore, the focus is on high school and college athletes for this review. Over the years many new concussion studies and protocols have been implemented and removed. Concussions are head injuries, where the person has suffered trauma causing the brain to shift and receive damage. This typically impacts brain tissue and a variety of symptoms results. Concussions were traditionally not considered with the same severity as broken bones or bloody wounds. Head injuries can have extreme effects on the body and daily living …
Otherization And Healthcare: A Philosophical Analysis Of Gender-Based Discrimination In Medicine, Rachel M. Beare
Otherization And Healthcare: A Philosophical Analysis Of Gender-Based Discrimination In Medicine, Rachel M. Beare
Honors Thesis
Healthcare interactions are a core feature of medical practice and medicine cannot function without these relationships. Moreover, the physician-patient relationship within healthcare have revealed varying problems that arise within the interpersonal interactions. These problems were even more concerning when they showed gender discrimination occurring within medical interactions, such as workplace discrimination of female physicians, higher risk of misdiagnosing and mortality of female patients, and an overall medical culture that invalidated women. Understanding the extent of these problems was achieved through analyzing philosophical structures presented within the philosophical writings of G. W. F. Hegel and Simone de Beauvoir. Application of Hegel’s …

Utilizing an information provision survey, I collected data on demographic factors, personal beliefs, and attitudes towards solar energy. The research focused on determining how information provision affects public perceptions and the likelihood of adopting solar technologies. The findings revealed a significant positive correlation between detailed and contextually relevant information and increased acceptance of solar energy solutions. The enhanced intervention was particularly effective in changing beliefs about solar energy's reliability and economic benefits, addressing critical local issues such …
Prison Labor: The Ethical And Economic Implications Of Rethinking The Thirteenth Amendment And Fair Labor Standards Act, Peter Holland
Prison Labor: The Ethical And Economic Implications Of Rethinking The Thirteenth Amendment And Fair Labor Standards Act, Peter Holland
Brigham Young University Prelaw Review
Prisoners have historically been paid extremely low wages, if any, for the jobs they perform while incarcerated. The Thirteenth Amendment, which made slavery illegal except as a punishment for crime, has often been used to validate this practice. This paper will argue that denying prisoners minimum wage is a misapplication of both the Thirteenth Amendment and the Fair Labor Standards Act. Additionally, the paper claims that paying prisoners minimum wage would have many positive economic consequences.

This paper presents a school improvement plan aimed at implementing and integrated interoception-based curriculum for social-emotional learning (SEL) in preschool classrooms, with the goal of fostering emotional regulation skills among young children. Drawing on recent research emphasizing the significance of SEL from early childhood through adolescence, this plan addresses the need for explicit teaching of emotional awareness and regulation in preschool settings. The proposed curriculum integrates interoception-based activities to enhance children’s ability to recognize and respond to internal bodily sensations and emotions. Through a review of relevant literature and personal classroom experience, this paper explores the foundations and practical implications …
The Effects Of Self-Efficacy On The Accuracy Of Self-Assessments, Griffin Forberg
The Effects Of Self-Efficacy On The Accuracy Of Self-Assessments, Griffin Forberg
Master's Theses & Capstone Projects
Self-efficacy plays an important role in academic performance and self-concept development. This action research investigates the effects of self-efficacy on self-assessment accuracy among engineering students during a 3D modeling unit. Utilizing a mixed-methods approach, the study contains Likert scales to assess self-efficacy and quantitative methods to determine student's predicted and actual performance. Findings reveal that while self-efficacy improves over time, students become more likely to underestimate their abilities. The study suggests the need for a variety of feedback sources and highlights potential limitations in the tested self-assessment practices. Future research should explore other subject areas and different assessment formats to …

Improving Social And Emotional Learning In Middle School, Casey Canaday
Master's Theses & Capstone Projects
Research shows that social-emotional learning has a direct impact on the academic and overall success of students in educational environments and beyond. Effective social-emotional programs and strategies implemented with fidelity can improve school climate and culture, positively impacting students, teachers, staff, and families. Without explicit teaching of social-emotional concepts, students are not given the opportunities to reach their full potential to be well-rounded individuals with developed social-emotional skills that support their overall wellness. The findings of a variety of research related to social-emotional learning guided the school improvement plan that was created to successfully implement social-emotional learning practices into schools. …

Play Having Its Place In Early Childhood Education, Emily Streicher
Play Having Its Place In Early Childhood Education, Emily Streicher
Master's Theses & Capstone Projects
This literature review and school improvement plan focuses on the power of play for early childhood learners. Play is an innate characteristic in humans and various species alike. Despite the overwhelming evidence supporting play for children, academic demands and pressures felt by teachers and administrators are causing play in early childhood settings to be eliminated or reduced. Teachers, along with administrators, play a key part in this. Early childhood research suggests that teachers' beliefs indicate the likelihood of teachers' intentions to develop a child-centered curriculum and pedagogy that meet children's development and needs (Cheung et al., 2022). Ergo, this school …

Decommodifying Cultural Heritage: A Linguistic Unpacking Of "Cultural Property", Zoe Creamer
Decommodifying Cultural Heritage: A Linguistic Unpacking Of "Cultural Property", Zoe Creamer
William & Mary Law Review
The complex history of cultural property regulation in the United States, discussed below, suggests a lack of consensus regarding the definition of the legislation’s target. However, as this Note argues, it is futile to attempt crafting a precise definition of the objects qualifying for protection under such legislation without first addressing the dueling interests inherent in the operative words. An examination of the various aims of cultural property legislation reveals two competing goals. On one side exists the desire to protect cultural heritage for the world’s enrichment, and on the other is the desire to protect private ownership rights. These …
The Impact Of Modernization On Mating Strategies In Iran: A Comparison Across Cities Versus Small Towns, Saeed Koohgard, Kai Lin Lynn Tan, Norman P. Li, Marzie Hashemi
The Impact Of Modernization On Mating Strategies In Iran: A Comparison Across Cities Versus Small Towns, Saeed Koohgard, Kai Lin Lynn Tan, Norman P. Li, Marzie Hashemi
Research Collection School of Social Sciences
The mating market in Iran has shown an increased rate of relationship formation. In such relationships, the most important pillar is physical attractiveness. We adopt an evolutionary perspective to understand this trend. Through comparing districts with different levels of modernization, this study explores the effects of modernization on mate preferences in Iran. We propose that rapid modernization reduces the preference for long-term relationships and has led to a rise in short-term mating strategies. We predict that the rise of short-term mating strategies will be reflected in higher frequencies of relationships and prioritizing physical attraction in mateseeking in modern versus non-modern …

Tort Theory And The Restatement, In Retrospect, Keith N. Hylton
Faculty Scholarship
This is my third paper on the Restatement (Third) of Torts. In my first paper, The Theory of Tort Doctrine and the Restatement (Third) of Torts, I offered a positive economic theory of the tort doctrine that had been presented in the Restatement (Third) of Torts: General Principles, and also an optimistic vision of how positive theoretical analysis could be integrated with the Restatement project. In my second paper, The Economics of the Restatement and of the Common Law, I set out the utilitarian-economic theory of how the common law litigation process could generate optimal (efficient, wealth-maximizing) rules and compared …

Faculty Scholarship
Philippe Sands’ The Last Colony1 tells the story of how Chagos Islanders won the right to return to the lands of their birth through a 2019 Advisory Opinion of the International Court of Justice (ICJ).2 In 1965, while the United Kingdom stood in the midst of conceding to the independence claims of myriad anti-colonialists throughout its imperial holdings, it took the anachronistic step of creating a colony—the British Indian Ocean Territory (BIOT).3 In flagrant violation of UN Resolution 1514,4 the United Kingdom detached the Chagos Archipelago from the colony of Mauritius. And between 1967 and 1973, …

Charity Law & Blockchain Technology: Using Old Wineskins For New Wine?, Lloyd Hitoshi Mayer
Journal Articles
Whenever something new emerges, the question of how existing law applies arises. Sometimes it is both easy to answer that question and the answer is consistent with the policy goals of existing law. But sometimes the answer to that question is uncertain, does not fit well with those policy goals, or reflects a mixture of these two issues.
This question is particularly vexing today with respect to new assets facilitated by blockchain technology. These new assets include cryptocurrencies, non-fungible tokens (NFTs), and ownership interests in decentralized autonomous organizations (DAOs). Commentators have written about how certain laws, particularly securities law, apply …

Covid-19 Web Archives: Evolving Catholic And Marian Devotional Practices, Kayla Harris, Stephanie Shreffler
Books and Book Chapters by University of Dayton Faculty
The COVID-19 pandemic had a tremendous impact on the work of academic librarians and archivists. Stay-at-home orders meant that librarians often had to set aside in-progress tasks and identify new remote projects. For archivists who primarily work with physical items, the pandemic also meant reassessing how to provide services to patrons, steward the collections, and continue to acquire new material that falls within the collecting scope. The Archivists at the University of Dayton used some of their time at home to start web archive collections that recorded how the pandemic affected Catholic life in the United States and the world. …

Alfred Russel Wallace Notes 30. Wallace A Theist? Part I., Charles H. Smith
Faculty/Staff Personal Papers
Alfred Russel Wallace (1823−1913) has been portrayed as a ‘theist’ on a large number of occasions from his own time on to the present. In this, the first of a two part work, this assessment is questioned. In part one, the matter of Wallace’s personal philosophy and spiritual orientation is explored, the conclusion being that Wallace was a lifelong agnostic who can hardly be aligned with theism.

A Compendium Of Cross-Culturally Valid Intimate Partner Violence Assessment Items For North American Spanish Speakers, Alberto D. Torres-Aragón
Undergraduate Honors Theses
Intimate partner violence (IPV) is physical, psychological, or sexual abuse by a current or former romantic partner. The long- and short-term consequences can lead to severe repercussions. To prevent these consequences of IPV, we need to screen for it and assess it. Across cultures, IPV is present and should be assessed regardless of linguistic boundaries. Spanish is the most widely used language in the U.S. other than English; therefore, assessment instruments that can reliably capture IPV in Spanish are necessary. Although Spanish-language IPV instruments are available, they may be challenging to understand for Spanish speakers because of linguistic differences. In …

Introduction: Peer recovery support services (PRSS) for substance use disorder (SUD) are a flexible and evidence-based intervention employed across multiple settings and for a variety of populations. These services have expanded over the past two decades, but there is little research on recruitment and training of prospective peer workers - the peer to career pipeline. This study observed training outcomes for applicants to a peer worker scholarship program in Texas.
Methods: A total of 448 participants provided baseline personal history information, and a subset of participants (n = 239) completed optional psychosocial surveys. Logistic regression analysis tested associations of personal …
