Navahine V. Hawai'i Dept. Of Transportation: The Keiki Will Lead Us, Catherine Smith

Scholarly Articles

The author analyzes the landmark case Navahine v. Hawaiʻi Department of Transportation, which culminated in the world’s first constitutional climate settlement. Catherine Smith, serving as an expert for the youth plaintiffs, situates the case within Hawaiʻi’s legal tradition of prioritizing children’s rights and intergenerational equity. She explores the evolution of children’s constitutional protections, contrasting Hawaiʻi’s progressive jurisprudence with the dominant adult-centric legal framework on the mainland. She critiques four recurring analytical missteps in U.S. courts that marginalize children’s interests and highlights Hawaiʻi’s public trust doctrine and cultural values, such as the Aloha Spirit, as models for addressing climate-related harms. …

Caregiver Resources For Aging With An Intellectual And/Or Developmental Disability (Raidd), Lena M. Conway

Entry Level Occupational Therapy Doctoral Capstone Projects Class of 2025

Caregivers of individuals with intellectual and/or developmental disabilities (IDD) are essential in supporting health, well-being, and aging in place; however, they are often overlooked in policy and occupational therapy (OT) practice. Caregivers frequently experience heightened levels of stress, anxiety, depression, physical fatigue, and social marginalization. Adults with IDD face disproportionately high rates of chronic disease and mental health conditions, and despite the development of resources to support this population, caregivers report barriers to locating, understanding, and utilizing these assets. A scoping review was conducted to determine and explore the needs of caregivers and the systemic challenges they face, including fragmented …

Parkinson’S Optimal Wellness And Educational Resource (Power) Project, Christina Mcfadden

Entry Level Occupational Therapy Doctoral Capstone Projects Class of 2025

By 2030, over 1.3 million adults in the U.S. are predicted to be diagnosed with Parkinson’s disease (PD), with Pennsylvania exhibiting a notably high incidence (Parkinson’s Foundation, 2023; Willis et al., 2022). Despite this prevalence, non-specialist clinicians, policymakers, and the public generally remain poorly informed in adequately supporting PD (World Health Organization [WHO], 2022). There is a gap within the literature regarding occupational therapy’s (OT) role in community-based PD programming in the U.S. The Parkinson’s Optimal Wellness and Educational Resource (POWER) Project addresses this through a tertiary health approach as identified in the WHO’s Parkinson’s technical brief (2022). Informed by …

Making A “Judicial Examination”: Credibility And Rationality In Clelia Duel Mosher’S Speech “The Relation Of Health To The Woman Movement”, Elisabeth Stevens Jan 2025

Making A “Judicial Examination”: Credibility And Rationality In Clelia Duel Mosher’S Speech “The Relation Of Health To The Woman Movement”, Elisabeth Stevens

University Honors Papers

At the turn of the 20th century, academics and laymen alike used scientific inquiry into the “biological realities" of the male and female body to explain women's lesser position in society. The scientific field was dominated by men who produced knowledge which seemed to 2 cement female inferiority. Thus, the woman movement of the time, working to improve women's social condition, encountered not only political and economic roadblocks to their efforts, but also an institutional barrier based on presumed fact. The women movement both violated social knowledge and the institution of science itself.

Systemic Challenges In Pediatric Healthcare: Exploring Reimbursement Disparities And Their Impact On Healthcare Equity, Jessica Ford-Davis, Alexandra Gillette

Theses, Dissertations and Capstones

Introduction: Medicare, Medicaid, and the Children’s Health Insurance Program (CHIP) have provided health coverage for over 135 million Americans, with Medicaid playing a significant role in financing pediatric healthcare. Medicaid covers a wide range of services for children, particularly those from low-income families or with special healthcare needs, including preventive care, immunizations, vision and dental services, and mental health treatments. However, Medicaid reimbursement rates are lower compared to Medicare and private insurance, in some cases 30.6% lower, and have often been insufficient to cover the full cost of care, contributing to financial losses for children's hospitals. Despite these challenges, nearly …

Determining The Concentrations Of Trace Metals In Caffeinated Beverages By Icp-Aes, Lillian B. Gruss, James O'Donoghue, Maya Schram

Research and Creativity Symposium

A myriad of different caffeinated beverages are advertised and readily available to consumers. Previous research has identified the presence of elevated levels of metals unsafe for consumption in many of these beverages, energy drinks in particularly. We aim to analyze concentrations of chromium, aluminum, and lead, three such metals, in a variety of different caffeinated beverages. A calibration curve relating concentration of chromium, lead and aluminum to corrected peak height for five solutions of standardized concentration was created using a ThermoFisher iCAP 6000 Series. The same instrument was then used to analyze samples of eight different caffeinated beverages. The corrected …

All Electronic Theses and Dissertations

Postsecondary education (PSE) programs play a crucial role in preparing students with intellectual and developmental disabilities (IDD) for adulthood by enhancing employment, independent living, and social skills Zhang et al., (2023). The expansion of PSE programs has provided students with diverse opportunities tailored to their needs, benefiting both individuals with disabilities and their peers without disabilities. However, significant disparities remain in health, economic, and social outcomes for individuals with disabilities. Legislative support, such as the Higher Education Opportunity Act, has promoted inclusion. Still, challenges persist, including low self-disclosure rates and inconsistencies in Summary of Performance (SOP) documentation (Graybill et al., …

Home—The Final Frontier: Why Privacy Means Protecting Workers' Rights To Time And Space, Joshua Fairfield, Amanda Reilly Jan 2025

Home—The Final Frontier: Why Privacy Means Protecting Workers' Rights To Time And Space, Joshua Fairfield, Amanda Reilly

Scholarly Articles

This article critiques the failure of current privacy frameworks to protect workers—especially teleworkers—from the growing encroachment of employer surveillance into their homes. It argues that prevailing privacy regimes, including notice-and-choice models and the GDPR, inadequately address the systemic power asymmetries in the employment relationship, often enabling rather than restricting invasive monitoring. Drawing from labor law traditions, the authors propose a rights-centered framework that views time and space as essential for human dignity and autonomy. They call for a non-negotiable floor of protections, including surveillance-free periods, bans on data commodification, and the establishment of an enforcement inspectorate. By reframing privacy not …

Breaking The Barrier: Implications Of 2024 Ruling Against Nar On Home Prices And Market Quality, Minseo Kim

Economics Honors Projects

On August 17, 2024, a court ruling changed real estate market practices that prohibit the posting of real estate agent commission rates on multiple listing services and mandate buyer contracts that specify agent commission fees. Real estate agent commissions function as intermediary transaction costs, and this ruling aims to potentially reduce these costs. Using data on single family home transactions in St. Paul, Minnesota from Zillow.com, Realtor.com, and Ram- sey County Property Tax database, I utilize a difference in difference model to examine the short-term impacts of the ruling on market dynamics in resi- dential real estate such as home …

Perspectivism And Wicked Problems: Patterns In The Discovery Process Of Leibniz, Bohr, And Turing, Ernesto Diaz Jan 2025

Perspectivism And Wicked Problems: Patterns In The Discovery Process Of Leibniz, Bohr, And Turing, Ernesto Diaz

Natural Sciences and Mathematics | Faculty Authored Dissertations and Theses

This research investigates fundamental patterns in how transformative scientific knowledge emerges and becomes established, examining three pivotal cases: Leibniz's development of calculus, Bohr's formulation of complementarity, and Turing's conceptualisation of computation and artificial intelligence. The study introduces the o-é-c model (Ouverture Ontologique - Épistémè Socialisante - Connaissance Éclairante) to explain how individual insights become integrated into collective knowledge through structured phases of development. Drawing on Minsky's conception of knowledge as mental models for problem-solving and Longino's social epistemology, the research demonstrates how wicked problems—those that resist formulation within existing frameworks—catalyse the creation of new knowledge domains. The model reveals how …
