Views Of The Irish Judiciary On Technology In Courts: Results Of A Survey, Brian M. Barry Dr, Rónán Kennedy Dr
Articles
Technology continues to transform how judges perform their functions, both in Ireland and elsewhere. This article reports the results of a survey of Irish judges on their use of technology in their role, their attitudes towards technology, and their views on how it impacts on the judicial function. The survey, part of a global survey, found that Irish judges habitually used digital technologies, and were broadly satisfied with the technology available in chambers, but less so with what was provided in courtrooms. Although generally happy to embrace change, the majority of respondents were concerned with, and did not prefer, online …

A massive amount of crustaceans and bivalves are consumed each year, leading to millions of tons of processing side streams from the seafood industry. Considering the current trend of (bio)circular and zero-waste food production, crustacean and bivalve processing side streams (CBPS) seem a promising and emerging resource for producing high-value-added products. This paper highlights the general composition of CBPS with high commercial values, namely, protein, lipids, carotenoids, minerals and chitins. The extraction strategies of these fractions, including conventional chemical and environmentally friendly methods, are also discussed. This review presents and summarises CBPS as raw materials for developing fast time-to-market products …

The prevalence of hate speech and offensive language on social media platforms such as Twitter has significant consequences, ranging from psychological harm to the polarization of societies. Consequently, social media companies have implemented content moderation measures to curb harmful or discriminatory language. However, a lack of consistency and transparency hinders their ability to achieve desired outcomes. This article evaluates various ML models, including an ensemble, Explainable Boosting Machine (EBM), and Linear Support Vector Classifier (SVC), on a public dataset of 24,792 tweets by T. Davidson, categorizing tweets into three classes: hate, offensive, and neither. The top-performing model achieves a weighted …

Digital technology is now pervasive, however, not all groups have uniformly benefitted from technological changes and some groups have been left behind or digitally excluded. Comprehensive data from the 2017 Current Population Survey shows that older people and persons with disabilities still lag behind in computer and internet access. Furthermore unique ethical, privacy and safety implications exist for the use of technology for older persons and people with disabilities and careful reflection is required to incorporate these aspects, which are not always part of a traditional software lifecycle. In this paper we present the Inclusion4EU project that aims to co-design …

The increasing power consumption of Data Center Networks (DCN) is becoming a major concern for network operators. The object of this paper is to provide a survey of state-of-the-art methods for reducing energy consumption via (1) enhanced scheduling and (2) enhanced aggregation of traffic flows using Software-Defined Networks (SDN), focusing on the advantages and disadvantages of these approaches. We tackle a gap in the literature for a review of SDN-based energy saving techniques and discuss the limitations of multi-controller solutions in terms of constraints on their performance. The main finding of this survey paper is that the two classes of …
Helping The Helpers: The Role Of Organizational Support And Peer Influence On Police Officer Receptivity To Employee Assistance Programs, Kenneth Quick
Publications and Research
Purpose – This study aims to investigate critical differences between police officer willingness to use and recommend an employee assistance program (EAP) to a peer, including the relationship between officer perceptions of macro-level organizational support and micro-level EAP support.
Design/methodology/approach – A survey of 213 police officers from a large, urban police department in the Northeast United States of America is used to evaluate the relationship between officer perceptions of the EAP and the officers’ willingness to use and recommend the EAP to peers. Generalized linear regression models are used to evaluate the moderating effect of perceived organizational support (POS) …
Working Towards Promotion To Full Professor: Strategies, Time Management, And Habits For Academic Librarian Mothers, Marta Bladek
Working Towards Promotion To Full Professor: Strategies, Time Management, And Habits For Academic Librarian Mothers, Marta Bladek
Publications and Research
After briefly sharing my experience as an academic librarian mother, the chapter places it within the larger context of academia in which women, especially mothers, lag behind men in attaining the full professor rank. It then outlines the strategies that have enabled me to gradually make progress towards promotion. The chapter discusses strategies to use at the institutional level (familiarity with local requirements, personnel process and related trainings, as well as the availability of leaves and grants), at the departmental level (workflow adjustments, scheduling arrangements, and strategic choice of projects and service commitments), and then at the individual/personal level (seeking …
The Role Of Suspect Development Practices In Eyewitness Identification Accuracy And Racial Disparities In Wrongful Conviction, Margaret Bull Kovera
The Role Of Suspect Development Practices In Eyewitness Identification Accuracy And Racial Disparities In Wrongful Conviction, Margaret Bull Kovera
Publications and Research
This article reviews the three previously studied categories of variables that are related to eyewitness identification accuracy: estimator (characteristics of the witnessing conditions), system (characteristics of the identification procedure that are under the control of the criminal legal system), and reflector (variables that reflect the likely accuracy of a witness). Although eyewitness scholars frequently turn to these variables and models of memory to explain why eyewitnesses make mistakes, none of these variables provides a reasonable explanation for the large racial disparities in wrongful convictions based on mistaken identifications, yet problematic policing practices might. The policies and practices guiding police efforts …

Differences In Religious Framing Of Muslims And Islam In American Media Coverage Before And After The Trump Campaign, Emily Greene-Colozzi, Amy Adamczyk, Senahan Kiyal Keles
Publications and Research
Over the last 20 years Muslims have received a disproportionate amount of news media attention. In 2017 they were again thrust into the spotlight when the Trump administration issued a travel ban blocking entry from seven predominately-Muslim countries. With our hand coding of over 900 newspaper articles and mixed modeling techniques, we examine the newspaper rhetoric surrounding Muslims before and during the Trump administration and across US states. We find that after President Trump’s election, fewer newspapers mentioned religion or referenced Muslim claimsmakers. We also reveal that higher state-level religious salience was associated with more newspapers referencing religious claimsmakers in …

The Political Ramifications Of Judicial Institutions: Establishing A Link Between Dobbs And Gender Disparities In The 2022 Midterms, Udi Sommers, Or Rappel-Kroyzer, Amy Adamczyk, Lindsay Lerner, Anna Weiner
Publications and Research
In the American system of government, courts are designed to operate within the legal sphere, with limited political interference. Is it possible, though, that a behavior that is at the heart of the political process can be influenced directly by a judicial decision? Focusing on voter registration big data for the universe of voters in North Carolina around the time of Dobbs v. Jackson Women’s Health Organization, the authors assess the roles of gender, political party affiliation, and age in voter registration. North Carolina is the only state whose voter registry has the necessary granularity over time and information needed. …
Regulatory Trading, David A. Weisbach
Regulatory Trading, David A. Weisbach
Coase-Sandor Institute for Law & Economics Research Paper Series
Regulatory trading systems, such as the SO2 cap and trade system, are ubiquitous in environmental and natural resources law. In addition to cap and trade systems for pollutants such as SO2, NOx and CO2 , environmental and natural resources law uses trading in areas such as endangered species, water quality, wetlands, vehicle mileage, and forestry and farming practices. Trading, however, is rarely used as a regulatory approach in other areas of law. This paper seeks to identify the reasons for this dichotomy. To understand the dichotomy, the paper examines the uses of trading in environmental and natural resources law, where …
The Corporate Governance Of Public Utilities, Aneil Kovvali, Joshua A. Macey
The Corporate Governance Of Public Utilities, Aneil Kovvali, Joshua A. Macey
Coase-Sandor Institute for Law & Economics Research Paper Series
Rate regulated public utilities own and operate one-third of U.S generators and nearly all the transmission and distribution system. These firms receive special regulatory treatment because they are protected from competition and subject to rate caps. In the past decade, they also have been at the center of high-profile corporate scandals. They have bribed regulators to secure subsidies for coal-fired generators and nuclear reactors. They have caused wildfires and coal ash spills that resulted in hundreds of deaths and billions of dollars in liability. Their failure to maintain reliable electric service has contributed to catastrophic blackouts. Perhaps most consequentially, they …
Against Anti-Tax Exceptionalism, David A. Weisbach
Against Anti-Tax Exceptionalism, David A. Weisbach
Coase-Sandor Institute for Law & Economics Research Paper Series
This paper examines the arguments found in what has become known as the anti-tax exceptionalism literature. That literature seeks to apply the rules of administrative law to tax procedures. The core claim is that the procedures used by the Internal Revenue Service and the Treasury routinely violate the requirements of administrative law. Secondarily, that literature argues that this is normatively bad: the Treasury and Internal Revenue Service should not be treated differently from other administrative agencies because the tax system is not exceptional. Promoting the goals of administrative law, that literature argues, requires that the tax system conform to standard …

Overview Of The Characteristics Of Tax Havens, Dhammika Dharmapala
Coase-Sandor Institute for Law & Economics Research Paper Series
Tax havens have become a subject of great interest among policymakers, scholars and the general public, and are central to many important current policy debates. This chapter provides an overview of the scholarly literature on the characteristics and origins of tax havens. The earlier literature, used cross-country analysis and found evidence that tax havens tend to have stronger governance institutions than comparable nonhaven countries. The more recent literature analyzes the historical origins of tax havens and undertakes longitudinal analysis of their adoption of haven-like laws. This chapter also presents a descriptive analysis of the relationship between tax haven status and …
Climate Change Policy In The International Context: Solving The Carbon Leakage Problem, David A. Weisbach, Samuel S. Kortum
Climate Change Policy In The International Context: Solving The Carbon Leakage Problem, David A. Weisbach, Samuel S. Kortum
Coase-Sandor Institute for Law & Economics Research Paper Series
Under the Paris Agreement, nations set their own emissions goals and policies. As a result, climate policies vary widely across countries, with some countries imposing stringent emissions policies and others doing very little. A key problem when carbon policies vary across countries is that energy-intensive industries can relocate to places with few or no emissions restriction. Relocated industries would continue to pollute but would be operating in a less desirable location. Moreover, the countries that imposed strict emissions reductions lose the benefit of having those industries located domestically. This problem, known as leakage, is one of the key reasons the …
Distributing Deterrence Fairly: A New Rationale For Decoupling Tort Liability, H. Javier Kordi
Distributing Deterrence Fairly: A New Rationale For Decoupling Tort Liability, H. Javier Kordi
Coase-Sandor Institute for Law & Economics Research Paper Series
Tort law faces a dilemma: how to adhere to a principle of make-whole compensation without entrenching social inequities. High-earning people receive greater compensation awards, resulting in an unequal distribution of deterrence. The deterrence disparity arises because injurers would rationally direct risky activity towards poorer victims to reduce liability costs; it persists even if race and gender classifications are barred from compensation. This Article offers a novel solution to the dilemma. It develops a decoupled liability regime under which injurers pay damages and are subject to standards of care that are invariant across individual victims, thus equalizing the distribution of deterrence. …
Duplicative Taxation Among The States: A Problem Not Worth Solving?, Julie Roin
Duplicative Taxation Among The States: A Problem Not Worth Solving?, Julie Roin
Coase-Sandor Institute for Law & Economics Research Paper Series
Recent legal and economic changes—not to mention the rise in telecommuting caused by COVID--have raised the salience of a long-simmering fact about the operation of state and local income tax systems: some multistate employers and employees pay a combined income tax liability that is higher than the tax they would have borne had they operated in just one jurisdiction. Seemingly beyond the reach of the courts to correct, there have been persistent calls for Congressional action to eliminate or reduce this “duplicative” taxation. This Article suggests that the alleged problem may be both less of a problem, and more resistant …
Privacy Protection, At What Cost? Exploring The Regulatory Resistance To Data Technology In Auto Insurance, Omri Ben-Shahar
Privacy Protection, At What Cost? Exploring The Regulatory Resistance To Data Technology In Auto Insurance, Omri Ben-Shahar
Coase-Sandor Institute for Law & Economics Research Paper Series
Regulatory and sociological resistance to new market-driven technologies, particularly to those that rely on collection and analysis of personal data, is prevalent even in cases where the technology creates large social value and saves lives. This article is a case study of such tragic technology resistance, focusing on tracking devices in cars which allow auto insurers to monitor how policyholders drive and adjust the premiums accordingly. Growing empirical work reveals that such “usage-based insurance” induces safer driving, reducing fatal accidents by almost one third, and resulting in more affordable and fair premiums. Yet, California prohibits this technology and other states …
Strategic Subdelegation, Brian D. Feinstein, Jennifer Nou
Strategic Subdelegation, Brian D. Feinstein, Jennifer Nou
Coase-Sandor Institute for Law & Economics Research Paper Series
Appointed leaders of administrative agencies routinely record subdelegations of governmental authority to civil servants. That appointees willingly cede authority in this way presents a puzzle, at least at first glance: Why do these appointees assign their power to civil servants insulated by merit protection laws, that is, to employees over whom they have limited control? This article develops and tests a theory to explain this behavior. Using original data on appointee-to-civil servant delegations and a measure of the ideological distance between these two groups of actors, we show that appointees are more willing to vest power in civil servants when …

New Advances In Long-Term Monitoring Of Storm-Deposited Boulder Ridges Along Rocky Shorelines Of San Salvador Island, Bahamas, Bosiljka Glumac, Ursula Miquel, H. Allen Curran
Geosciences: Faculty Publications
Beginning in January 2012, we have monitored two boulder ridges on San Salvador: Singer Bar Point (SBP, length ~790 m) along the reef- and lagoon-protected northern coast and The Gulf (TG, length ~460 m) on the island’s high-energy southern coast. This long-term monitoring aims at documenting changes in ridge morphology and distribution, and the direction and amount of movement of individual boulders to gain insights into the intensity and effects of storms on these coastal areas.
In the initial stage of our investigations, the largest boulders from each site were photographed, GPS-located, measured, and characterized by composition and morphology. Boulders …

Journal Articles: Oncology and Hematology
BACKGROUND: Patients with mantle cell lymphoma (MCL) exhibit a wide variation in clinical presentation and outcome. However, the commonly used prognostic models are outdated and inadequate to address the needs of the current multidisciplinary management of this disease. This study aims to investigate the clinical and pathological features of MCL in the immunochemotherapy era and improve the prognostic models for a more accurate prediction of patient outcomes.
METHODS: The North American Mantle Cell Lymphoma Project is a multi-institutional collaboration of 23 institutions across North America to evaluate and refine prognosticators for front-line therapy. A total of 586 MCL cases diagnosed …
Conflict, Consistency And The Role Of Conventional Morality In Judicial Decision-Making, Aditi Bagchi
Conflict, Consistency And The Role Of Conventional Morality In Judicial Decision-Making, Aditi Bagchi
Faculty Scholarship
Cardozo defends a pragmatic approach to judicial decision-making. Judges should apply and develop legal rules with an eye toward their social function. “Public policy” at this stage of decision-making theoretically could be rooted in a social scientific exercise or some other direct attempt to come up with the optimal rule.
Cardozo instead directs judges to conventional morality. Conventional morality is an unlikely solution given the specter of inconsistency that it raises. But in the disagreement and conflict about conventional morality that seem to render it unstable lie the resources for self-correction over time. Judicial decision-making is inevitably inconsistent to some …

Hiding In Plain Sight: An Ilo Convention On Labor Standards In Global Supply Chains, James J. Brudney
Hiding In Plain Sight: An Ilo Convention On Labor Standards In Global Supply Chains, James J. Brudney
Faculty Scholarship
This Article proposes a solution to the primary challenge currently confronting governments, employers, and workers under international labor law: how to promote and protect decent labor conditions in global supply chains (GSCs).
The Article begins by summarizing why existing public law and private law approaches have failed to meet this challenge over several decades. It describes the shortcomings of law and practice in developing countries as well as the weakness of corporate social responsibility (CSR), including the most ambitious version of CSR, the U.N. Guiding Principles on Business and Human Rights. It then analyzes the problems with recent national laws …

Title IX protects against sex-based discrimination and harassment in covered education programs and activities. The Biden Administration's recently proposed Title IX regulations do not, however, include discrimination on the basis of menstruation or related conditions as a form of discrimination based on sex. This comment on the proposed regulations explains why the regulations should include conditions related to menstruation and recommends changes for how to do so.
