Golden Age Or Gilded Cage? The Rise And Dissolution Of The Olympic Art Competitions, 1912–1948, Stella E. Gatziolis Apr 2026

Golden Age Or Gilded Cage? The Rise And Dissolution Of The Olympic Art Competitions, 1912–1948, Stella E. Gatziolis

Young Historians Conference

In 1912, Baron Pierre de Coubertin’s modern day Olympics celebrated not only its five year anniversary, but the first inclusion of the Olympic Art Competitions. Resembling a neo-Renaissance, Coubertin envisioned a “balance of the muscle and the mind” through the unity of the physical and intellectual. But by 1948, the art competitions had collapsed, leaving the social experiment to be forgotten by future generations. Drawing upon personal testimony from Coubertin and his loyal successors, and records from the International Olympic Committee, this paper explores how Coubertin’s extreme dedication to a pure and sanctified Neoclassical ideal led to the art competition’s …

Nation-Building On Pillars Of Fascism: How Italian Fascist Ideals Have Remained Alive In Eritrean Identity Through The Asmaran Urban Landscape, Caspian Green

Young Historians Conference

Roughly a third of Eritrea’s time as an Italian colony was spent under fascist rule, during which the Italian colonists dramatically changed the Asmaran urban environment, as well as its relationship with the rest of the Eritrean colony, to reflect fascist principles. After the fall of the Italian colonial empire, Eritrean political leaders sought to use the physical landscape to justify their claims to sovereignty, reapplying those pre-existing fascist principles to Eritrean nationalism. By examining Italian-Asmaran buildings, roads, and legal structures in their contexts, common threads between past fascist beliefs and the modern Eritrean military state emerge, offering a better …

Preventable Tragedy: A Negligence Case Study In University Recreation Programs, John J. Miller, Jeffrey F. Levine, Jason W. Lee Apr 2026

Preventable Tragedy: A Negligence Case Study In University Recreation Programs, John J. Miller, Jeffrey F. Levine, Jason W. Lee

Global Sport Business Journal

This case study examines the lightning strike that killed a player during a university intramural softball game, emphasizing the importance of understanding legal responsibilities in sport and recreation settings. The incident occurred after visible lightning was observed yet play continued due to the absence of a formal severe-weather policy and uncertainty among student officials and administrators. Although industry standards for lightning safety were widely available, the lack of clear institutional guidance contributed to delayed decision-making and confusion at a critical moment.

This case study is important to students because it demonstrates how legal concepts discussed in class can have real, …

Understanding Modern American Politics Through Identity And Pop Music Between 2018 And 2025: A Musicological Analysis, Emilyn Bedell Apr 2026

Understanding Modern American Politics Through Identity And Pop Music Between 2018 And 2025: A Musicological Analysis, Emilyn Bedell

Ramifications

This project studies how music impacts our society by examining the ways popular musicians (Taylor Swift, Chappell Roan, and Hozier) imbue their songs with their identity. Their music engages their authentic self and social interests, effectively communicating their artistic and social values to their audience. This study examines three artists who recently became popular, so there is less established musicological research focused on them. To explore them deeper, I draw on cultural sources such as newspapers and magazines, in addition to academic journals. I also analyze their music and videos alongside recorded interviews to understand the sociopolitical issues for which …

From Mogadishu To Minneapolis: Transnational Political And Social Ties In The Somali Diaspora, Kate E. Mcfarland Apr 2026

From Mogadishu To Minneapolis: Transnational Political And Social Ties In The Somali Diaspora, Kate E. Mcfarland

Young Historians Conference

Beginning in the 1980s, Somalis have fled Somalia in order to escape persecution and political violence, find new economic opportunities, and achieve a better life. One major destination of these migrants is Minneapolis, Minnesota, which is now home to over 80,000 Somalis, making up 18% of Minneapolis’ population. Due to this sizable Somali enclave, Minneapolis and Somalia have created and maintained a transnational relationship. This paper examines that relationship, focusing on the causes of the Somali diaspora, evidence of transnational connections (such as remittances, cultural exchange, and political effects), and the challenges that threaten this tie. Understanding this relationship is …

Optimizing Antibiotic Strategies With A Clinical Pathway Approach: Enhanced Initiation And De-Escalation In Community-Acquired Pneumonia, Ahmad Behzadpour

HCA Healthcare Journal of Medicine

Background

Community-acquired pneumonia (CAP) remains a leading cause of hospitalization, mortality, and health care expenditure worldwide. Inappropriate use of broad-spectrum antibiotics contributes to antimicrobial resistance, adverse drug events, and increased costs. Antibiotic stewardship and standardized clinical pathways are key strategies to improve prescribing practices.

Methods

This quality improvement (QI) initiative was conducted at a 240-bed tertiary care teaching hospital from January 2023 through January 2025. A CAP-specific digital clinical pathway was developed using Curbside Health® and integrated into the electronic health record (EHR), accessible through a structured order set to support real-time clinical decision-making. The intervention included provider education and …

Revolutionary Resistance In Denmark: The Impact Of Grundtvigism On The Danish Resistance To Nazi Occupation, Holland Burd Apr 2026

Revolutionary Resistance In Denmark: The Impact Of Grundtvigism On The Danish Resistance To Nazi Occupation, Holland Burd

Young Historians Conference

This paper examines the impact of nineteenth century philosopher and theologian Nikolaj Frederik Severin Grundtvig on the Danish resistance during World War II. Born in 1783, Grundtvig established a framework that paved the way for Danish national pride, setting the stage for a united resistance effort against Nazi occupation in October of 1943. His beliefs inspired movement towards the common good and allowed the Danes to reconnect with their cultural identity. Nazi Germany invaded Denmark in 1940, initially preserving an image of peace through a model protectorate. However, the image of peace was destroyed in 1943 after Nazi Germany ordered …

Journal of Tolkien Research

This article details the dispersal and reconstruction of the library of Michael H.R. Tolkien (1920-1984) and provides a partial bibliography of the known contents of this library.  The author has been collecting the books from Michael's library for a number of years and lists these items along with books owned by other collectors.  It is hoped that this bibliography will add to knowledge regarding the reading and collecting interests of both Michael specifically and the Tolkien family in general, as many of the books were given as gifts by his father, brothers, sister, and others.  This bibliography also adds knowledge …

Increasing The American Commitment To Multilateral Climate Action From The Bottom Up: An Assessment Of U.S. States’ Federally Protected Capacity To Increase Compliance With International Climate Commitments, Brynne H. Robbins Apr 2026

Increasing The American Commitment To Multilateral Climate Action From The Bottom Up: An Assessment Of U.S. States’ Federally Protected Capacity To Increase Compliance With International Climate Commitments, Brynne H. Robbins

Bates College Undergraduate Law Review

With comprehensive domestic rollbacks to environmental protections, environmental federalism is more important now than ever. Can states’ prerogatives under federalism be channeled into international institutions in a way that affects meaningful change and mitigates the federal government’s inaction? Are states able to elicit greater compliance with the U.S.’s former commitments to international agreements like the Paris Agreement? And how has their sphere of international influence changed under a second Trump administration?

This article will assess the degree to which subnational actors, protected by federalism, can mitigate federal inaction on climate by examining five different ways states have extended their influence …

Beyond Tacit Consent: Rethinking Immigrant Membership In Locke’S Social Contract, Claire A. Orfield Apr 2026

Beyond Tacit Consent: Rethinking Immigrant Membership In Locke’S Social Contract, Claire A. Orfield

Bates College Undergraduate Law Review

This thesis considers the tension in Locke’s writings between universal natural-rights obligations required of a state and the exclusion of foreigners from the potential to become express consenters, thereby becoming permanent members of a state and receiving more than just baseline legal protection. Although other scholars certainly acknowledge this tension, most of them utilize it to support the abandonment of Locke’s framework of tacit and express consent altogether. This thesis, on the other hand, conducts an immanent critique of John Locke’s theory of consent by demonstrating that his own conceptual framework contains the resources for a more expansive understanding of …

A Constitutional Black Box: Critically Assessing The Constitutional And Algorithmic Implications Of The Netchoice Cases, Sam Merkatz Apr 2026

A Constitutional Black Box: Critically Assessing The Constitutional And Algorithmic Implications Of The Netchoice Cases, Sam Merkatz

Bates College Undergraduate Law Review

In 2024, the Supreme Court of the United States jointly heard Moody v. NetChoice, LLC and NetChoice, LLC v. Paxton, cases challenging Florida and Texas statutes that restricted the capacity of social media platforms to moderate content. While remanding the cases, the Court reaffirmed that content moderation and curation qualify as protected expression under the First Amendment. This paper critically assesses the Court's majority opinion and its nonbinding dicta regarding the expressive nature of algorithmic moderation.

Specifically, drawing on Justice Alito’s concurrence in judgement only, this paper argues that the Court fails to account for fundamental differences between traditional …

Chicago, Arbitrary Detention And Torture: An Examination Of Human Rights Violations And Legal Responses Under The Second Trump Administration, Gianna Keuer

Bates College Undergraduate Law Review

This paper uses a human rights-based analysis to explore the legal implications of the second Trump administration’s deportation policies, using frameworks enacted by international legal organizations and state-level bodies. Drawing upon the Convention Against Torture, the International Covenant on Civil and Political Rights, and established state policies, the paper identifies important jus cogens norms against arbitrary detention and torture. With Chicago serving as a case study, the paper explores different avenues that have been employed to counter violations of prohibitions of arbitrary detention and torture, ultimately concluding that state-level policy responses and impact litigation cases serve as a more efficacious …

The Paradox Of Equal Protection: Anti-Subordination Rhetoric In Service Of Anti-Classification Ends, Aanya Ghosh Apr 2026

The Paradox Of Equal Protection: Anti-Subordination Rhetoric In Service Of Anti-Classification Ends, Aanya Ghosh

Bates College Undergraduate Law Review

This article examines the evolution of Equal Protection jurisprudence through the competing lenses of anti-classification and anti-subordination. Anti-classification holds that the Constitution prohibits governmental use of racial categories regardless of purpose; anti-subordination holds that the Equal Protection Clause targets the perpetuation of racial hierarchy rather than the mere use of racial categories. Beginning with the foundational ambiguity of Brown v. Board of Education (1954) and tracing the doctrinal trajectory through Regents of the University of California v. Bakke (1978), Grutter v. Bollinger (2003), Parents Involved in Community Schools v. Seattle School District No. 1 (2007), and Students for Fair Admissions …

Understanding Government Regulation On Food And The Constitutionality Of Banning High Fructose Corn Syrup For National Defense, Charlotte Bernhard Apr 2026

Understanding Government Regulation On Food And The Constitutionality Of Banning High Fructose Corn Syrup For National Defense, Charlotte Bernhard

Bates College Undergraduate Law Review

The following work explores a hypothetical scenario in 2029 where President Gavin Newson  hopes to decrease obesity to increase the number of Americans eligible for the draft. As tensions rise in North Korea, the President considers sending around 200,000 troops to South Korea and Japan, yet with high levels of obesity in the United States, a low number of eligible Americans for deployment may put unnecessary strain on troops. Therefore, the President considers banning high fructose corn syrup-containing products to decrease obesity rates.

This work explores how the President and American government can constitutionally limit foods containing high fructose corn …

The Missing Step To Equality: Feminist Readings Of The Broken Rung, Putri Rizky, Muhammad Irfan Syaebani, Rofikoh Rokhim Apr 2026

The Missing Step To Equality: Feminist Readings Of The Broken Rung, Putri Rizky, Muhammad Irfan Syaebani, Rofikoh Rokhim

International Conference on Business and Management Research (ICBMR)

Women’s underrepresentation in leadership remains a persistent global challenge, often analyzed through the metaphor of the glass ceiling. While this concept highlights barriers at the top of organizational hierarchies, it fails to capture the earlier and more foundational obstacle of the broken rung: women’s disproportionate exclusion from their first promotion into managerial positions. This research employs a desk analysis to examine the causes, mechanisms, and implications of the broken rung within the Indonesian context, linking it to three theoretical frameworks: liberal feminism, symbolic violence, and intersectionality.

The study finds that from a liberal feminist perspective, the broken rung …

When Work Becomes Decent: Linking Decent Work To Turnover Intention Through Direct And Indirect Pathways In Indonesia’S Blue-Collar Sector, Dewi Setiani, Elok Savitri Pusparini

International Conference on Business and Management Research (ICBMR)

High turnover remains a persistent challenge in labor-intensive industries, particularly among blue- collar workers in developing countries. This study investigates the role of Decent Work in reducing Turnover Intention through the mediating effect of Job Satisfaction, focusing on employees in the false eyelash manufacturing sector in Central Java, Indonesia. Guided by the Psychology of Working Theory (PWT), Self-Determination Theory (SDT), and the Job Demands–Resources (JD-R) framework, the study aims to provide theoretical and practical insights into employee retention strategies.

Data were collected through a survey of 578 production employees across five major eyelash manufacturing companies. Covariance-based structural equation modeling (CB-SEM) …

Ex Aequo Et Bono In Indonesian Legal Practice: An Explorative Study And Critique Against Current Understanding Of The Term, Tristam Pascal Moeliono Apr 2026

Ex Aequo Et Bono In Indonesian Legal Practice: An Explorative Study And Critique Against Current Understanding Of The Term, Tristam Pascal Moeliono

Padjadjaran Jurnal Ilmu Hukum (Journal of Law)

Doctrinal uncertainty persists regarding the extent to which judges in Indonesia may adjudicate on the basis of equity and fairness, particularly in relation to requests for decisions grounded in ex aequo et bono. This issue is especially evident in civil proceedings, where such requests are frequently articulated in pleadings and closing statements. Drawing on an analysis of regulatory frameworks and judicial practice, and employing normative and comparative legal approaches, it is argued that adjudication grounded in equity—conceptually linked to fairness, propriety, and broader considerations of justice—constitutes an inherent component of judicial obligation in Indonesia. At the same time, requests …

The Role Of Music Publishers In Managing Copyright In Musical Works In Indonesia: A Legal Analysis, Diana Silfiani Apr 2026

The Role Of Music Publishers In Managing Copyright In Musical Works In Indonesia: A Legal Analysis, Diana Silfiani

Padjadjaran Jurnal Ilmu Hukum (Journal of Law)

This study aims to examine music publishers as managers of song and music copyrights in Indonesia. Although music publishers are legally recognized as part of the rights holders, in practice they demonstrate distinct and broader characteristics, functions, and roles compared to other rights holders. Due to the absence of clear and comprehensive regulations under Indonesian law, this study compares the legal framework governing music publishers in Indonesia with those in the United States and South Korea to seek comparable regulations. The analysis adopts a qualitative approach, using normative juridical research and a prescriptive typology to propose alternative solutions to the …

The Legal Status Of Indonesia-China Joint Statement 2024 And Its Legal Implications For Unclos Under The Law Of Treaties, Amanda Christie, Diajeng Wulan Christianti Apr 2026

The Legal Status Of Indonesia-China Joint Statement 2024 And Its Legal Implications For Unclos Under The Law Of Treaties, Amanda Christie, Diajeng Wulan Christianti

Padjadjaran Jurnal Ilmu Hukum (Journal of Law)

The legal standing of joint statements in international law remains contested, particularly with respect to their qualification as treaties under the Vienna Convention on the Law of Treaties. This issue has become increasingly relevant following the 2024 Joint Statement between Indonesia and China on Advancing the Comprehensive Strategic Partnership and the China-Indonesia Community with a Shared Future. Despite its political framing, item nine, which contains a provision on joint development in areas described as overlapping claims in the South China Sea, raises critical legal concerns that the implications may constitute a legally binding treaty. This article employs a doctrinal legal …

Implementation Of The Administrative Dispute Resolution System For Citizens' Legal Protection In Indonesia After The Enactment Of Law Number 30 Of 2014 On Government Administration, Ayi Solehudin, Zainal Muttaqin, Dewi Kania Sugiharti Apr 2026

Implementation Of The Administrative Dispute Resolution System For Citizens' Legal Protection In Indonesia After The Enactment Of Law Number 30 Of 2014 On Government Administration, Ayi Solehudin, Zainal Muttaqin, Dewi Kania Sugiharti

Padjadjaran Jurnal Ilmu Hukum (Journal of Law)

The integrated administrative dispute resolution system in Indonesia positions Administrative Proceedings as the primum remedium and the State Administrative Court as the ultimum remedium. This system is intended to provide comprehensive legal protection for citizens. However, in practice, it can lead to prolonged and ineffective dispute resolution processes, thereby limiting citizens' access to defend their rights before the the Administrative Court. This study analyses an effective integrated state administrative dispute resolution system that ensures legal protection for citizens. The legal issues addressed include the regulation of Administrative Proceedings within the integrated state administrative dispute resolution system following the enactment …

Improving Judicial Reasoning In Constitutional Rights Cases: The Case For A Structured Proportionality Test In The Indonesian Constitutional Court, Muhamad Dzadit Taqwa Apr 2026

Improving Judicial Reasoning In Constitutional Rights Cases: The Case For A Structured Proportionality Test In The Indonesian Constitutional Court, Muhamad Dzadit Taqwa

Padjadjaran Jurnal Ilmu Hukum (Journal of Law)

This study evaluates the structured proportionality test modelled after the German approach. It argues that the Indonesian Constitutional Court should adopt this test when reviewing statutory limitations on constitutional rights under the amended 1945 Constitution. While the structurally weak protection of constitutional rights in the Constitution provides the contextual motivation for this inquiry, the central focus is instrumental: to assess the benefits and challenges of proportionality as a tool for improving judicial reasoning in constitutional rights adjudication. The analysis identifies three key benefits, including enhanced problem identification, improved justification of legislative limitations, and strengthened methodological rigor in judicial decision-making. At …
