Is Originalism Orthodoxy?, Neel Sukhatme

What theory of constitutional interpretation has the Supreme Court followed? We search Supreme Court opinions for a wide range of sources that originalists identify as central to their methodology, over the entire universe of cases beginning in 1791. We find that for much of Supreme Court history, conventional indicators of originalist practice--citations to Founding-era sources--are largely absent, raising questions about originalism's past orthodoxy. Originalist citation practices are absent for much of the 19th century and grow sharply in the late 20th century. The Article elaborates the implications of these findings for debates in constitutional law.

Identity-Dependent Externalities Can Mitigate Overbidding In Tullock Contests: Theory And Evidence, Dan Kovenock, Jian Song, Francesco Trevisan

We investigate how identity-dependent externalities infuence bidding behavior in Tullock lottery contests. While experimental studies of standard contests, in which losers are indiferent to the winner’s identity, consistently document overbidding, the role of identity-dependent preferences remains less explored. We address this gap by frst showing that the class of three-player Tullock lottery contests with identity-dependent externalities considered here can be mapped into a standard Tullock lottery contest with appropriately chosen prize valuations and endowments, yielding identical Nash equilibrium predictions. We then use this mapping to design a laboratory experiment that directly compares the two “equilibrium-equivalent” contest formats. In our three-player …

After trial on the tenant's counterclaims of breach of warranty of habitability, harassment, and rent overcharge, the court entered judgment for the tenant on all three. The subject apartment was found to be an unlawful combination of predecessor apartments whose legal rent was never registered with DHCR, requiring application of the default formula under RSC § 2522.6(b)(3) to calculate overcharge damages. The court awarded a rent abatement, civil penalties for harassment, and entered an order enjoining the landlord from further harassing the tenant.

Motivation: Antibody therapeutic efficacy depends on high-affinity target engagement, yet laboratory affinity maturation is slow and costly. Most protein language models (PLMs) lack explicit training for high affinity, and current preference optimization methods introduce computational overhead without clear affinity improvements. Therefore, structure-aware and parameter-efficient approaches for antibody affinity optimization are urgently needed.

Results: We propose SimBinder-IF, a structure-aware antibody optimization model trained by freezing the Evolutionary Scale Modeling inverse folding (ESM-IF) structure encoder and fine-tuning only its decoder via Simple Preference Optimization (SimPO) to prefer stronger binders. Objectives: This study examines how multiple stress dimensions (levels, sources, effects, and coping mechanisms) relate to teaching performance in resource-constrained Southeast Asian public higher education, addressing the geographic concentration of faculty stress research in Western contexts.

Methods: Using multiple regression analysis with 80 permanent faculty members across three campuses of a state university system, I assessed relationships between stress factors and teaching performance. The study employed validated stress assessment instruments examining stress levels, sources (student, teacher, environment, work-related), effects (self, family, work), and coping mechanisms.

Medical device–related pressure injuries are a significant and largely preventable patient safety problem, yet existing pressure injury risk scales do not adequately capture device-specific risk factors in adults. This methodological study developed and psychometrically evaluated a standardized risk assessment scale to identify medical device–related pressure injury risk in hospitalized adult patients. An initial item pool was generated from an extensive literature review and clinical expertise, and content validity was assessed by seven experts using the Davis technique (content validity index = 0.96). As Large Language Models and AI chatbots become increasingly prevalent, pressing questions are raised about whether beliefs formed through LLM interactions carry the same epistemic weight as beliefs formed through human testimony. How we answer this question depends on whether LLMs can function as testifiers, a role which is typically assumed to require a human or human-like agent. This assumption has gone largely unexamined, yet its consequences are significant: if LLM outputs cannot constitute testimony, then the justificatory tools of testimonial epistemology are unavailable to any beliefs formed through LLM interaction. Pancreatic ductal adenocarcinoma (PDAC) has one of the lowest five-year survival rates among cancers and is characterized by near-ubiquitous occurrence of oncogenic KRAS mutations. Oncogenic KRAS activates several downstream pathways, including ERK 1/2 MAPK and PI3K, which are critical for PDAC. However, accumulating evidence suggests that PI3K activity can be maintained independent of oncogenic KRAS. The high prevalence of KRAS^G12R in PDAC challenges the prevailing model of KRAS-driven PI3K activation, as this mutant is defective in direct engagement with PI3Kα. Developing three-dimensional (3D) skin models provides a physiologically relevant platform to investigate the dynamic interactions between the skin microbiome and immune cells in chronic wounds, offering insights into delayed healing, persistent inflammation, and microbial dysbiosis. Traditional in vitro models fail to replicate the complex architecture of human skin and its immune-microbiome crosstalk, motivating the development of biomimetic systems that incorporate stratified epidermal layers, dermal fibroblasts, and innate immune components such as macrophages and neutrophils. Engineered 3D skin constructs inoculated with wound-associated microbiota, including Staphylococcus aureus, Pseudomonas aeruginosa, and Cutibacterium acnes, can reveal how biofilm formation, quorum sensing, …

The Samin community (Sedulur Sikep) in Margomulyo, Bojonegoro, has the value of Pitutur Luhur inherited by Samin Surosentiko, but it has not been represented in the batik jarik motif as a communal identity. This creation-based research aims to explore this value, realize it in the design of written batik, and examine its philosophical meaning as an effort to preserve intangible cultural heritage. Regulatory Innovation Through Authority: An Analysis Of India’S Central Consumer Protection Authority’S Functioning (2020–2025), Gaurav Pathak, Mohit Yadav, Anush Ganesh

International Journal on Consumer Law and Practice

This article presents the first comprehensive empirical analysis of India’s Central Consumer Protection Authority (CCPA), since its establishment in 2020, based on an examination of 165 orders across 118 cases through 2025. The study fills a critical research gap by systematically analysing CCPA’s enforcement patterns, procedural efficiency, and regulatory evolution. The unique dataset reveals that CCPA has fundamentally transformed India’s consumer protection landscape through a distinctive dual approach that combines reactive enforcement with proactive regulation. This article examines the narrative functions of strangeness and hospitality in J.R.R. Tolkien’s The Book of Lost Tales, focusing on Eriol’s transformation from foreign traveller into listener, witness, and transmitter of Elvish tradition. Through a comparative reading of selected Old Norse and Anglo-Saxon texts—particularly Hávamál, Gylfaginning, and Beowulf—it identifies recurrent literary configurations in which hospitality regulates admission, identity, reciprocity, danger, and access to knowledge. The comparison is morphological rather than genetic: it does not posit direct derivation or a uniform Germanic code. Pragmatism is the hallmark of two recent Supreme Court

decisions on the separation of powers, Kennedy v. Braidwood

Management, Inc., and Federal Communications Commission

(FCC) v. Consumers’ Research. These cases, which dealt with the

Appointments Clause and the nondelegation doctrine (public and

private) respectively, reject a rigid, literalist approach. Instead,

these decisions strive to make government workable, in the process

facilitating implementation of Congress’s plans.

Both Braidwood and Consumers’ Research decline to require

Congress to recite “magic words” or lock in future executive branch

officials with mechanical formulas or caps on fees. Instead, each

decision looks at legislation …
