Paved With Good Intentions: Unintended Consequences Of Federal Proposals To Integrate Child Support And Parenting Time, Lisa V. Martin, Stacy Brustin Jan 2015

Paved With Good Intentions: Unintended Consequences Of Federal Proposals To Integrate Child Support And Parenting Time, Lisa V. Martin, Stacy Brustin

Faculty Publications

Promoting the relationships between noncustodial parents and their children has become a federal policy priority. Recent policy proposals aim to achieve this by integrating adjudications of custody and parenting time within proceedings to establish child support. These proposals share several laudable goals, including encouraging the involvement of fathers in their children’s lives, increasing compliance with child support orders, and facilitating unmarried parents’ access to court processes for resolving custody and visitation disputes. But the simplistic solutions employed by the proposals, some of which would mandate that custody and visitation be adjudicated in all child support proceedings, pose serious risks to …

Cloning Miranda: Why Medical Miranda Supports The Pre-Assertion Of Criminal Miranda Rights, Colin Miller Jan 2015

Cloning Miranda: Why Medical Miranda Supports The Pre-Assertion Of Criminal Miranda Rights, Colin Miller

Faculty Publications

Courts across the country have concluded that suspects cannot assert their Miranda rights before being subjected to custodial interrogation. This reluctance to credit pre-assertions can be traced to dicta from McNeil v. Wisconsin, in which the Supreme Court noted that “[m]ost rights must be asserted when the government seeks to take the action they protect against.” This article challenges this notion by drawing an analogy between criminal suspects and patients. In 1990, Congress passed the Patient Self-Determination Act (“PSDA”), the so-called medical Miranda, which requires health care providers who accept money from Medicaid or Medicare to inform patients of their …

Integrative Biology Faculty and Staff Publications

In 2014, a major epidemic of human Ebola virus disease emerged in West Africa, where human-to-human transmission has now been sustained for greater than 12 months. In the summer of 2014, there was great uncertainty about the answers to several key policy questions concerning the path to containment. What is the relative importance of nosocomial transmission compared with community-acquired infection? How much must hospital capacity increase to provide care for the anticipated patient burden? To which interventions will Ebola transmission be most responsive? What must be done to achieve containment? In recent years, epidemic models have been used to guide …

Sensitizing Pancreatic Cancer To Gemcitabine Through Sphingosine Kinase 2 Inhibition, Clayton Scott Lewis Jan 2015

Sensitizing Pancreatic Cancer To Gemcitabine Through Sphingosine Kinase 2 Inhibition, Clayton Scott Lewis

MUSC Theses and Dissertations

Pancreatic cancer is extraordinarily resistant to chemotherapy. With current treatment options on average extending life by less than a year, advancements in sensitizing tumors to chemotherapy are a must. The combination of gemcitabine and nab-paclitaxel is the current standard of care for treating pancreatic cancer. Resistance to both of these drugs can occur through deregulation of the NFMκB pathway, MAPK pathway, Bcl-2 family members, as well as the balance of sphingolipids. More importantly, resistance to gemcitabine occurs through aberrations in its metabolism – mainly overexpression of the M2 subunit of ribonucleotide reductase. Additionally, overexpression of the transcription factor c-Myc has …

Modulation Of Gilt And Pax3 By Ganoderic Acid Dm Enhances Radiation And Chemoimmunotherapy Of Melanoma, Jessica D. Hathaway-Schrader Jan 2015

Modulation Of Gilt And Pax3 By Ganoderic Acid Dm Enhances Radiation And Chemoimmunotherapy Of Melanoma, Jessica D. Hathaway-Schrader

MUSC Theses and Dissertations

Melanoma is an aggressive skin cancer that plagues Western populations. Current treatments such as surgery, chemotherapy, and high-dose radiation have had some success, but often fail in treating late stage metastatic melanoma. Immunotherapies have been successful in treating a small percentage of late stage patients, but these treatments do not provide a long-lasting response to effectively clear the tumor. Therefore, current studies have been investigating whether combining common treatments with immunotherapies would provide the necessary boost to further improve tumor killing. An optimum presentation of HLA class II proteins is essential for the activation of CD4+ T cells, which provide …

The Male Army Nurse Corps Officer Experience In The Vietnam Conflict, John P. Pelletier Jan 2015

The Male Army Nurse Corps Officer Experience In The Vietnam Conflict, John P. Pelletier

MUSC Theses and Dissertations

Background: A considerable amount of research has been conducted on the wartime experiences of female nurses who served in the Vietnam conflict and as a result, much is known about their experiences and the impact that their service had on their personal and professional lives. The same, however, is not true for male nurses. Anecdotal evidence suggests that the experiences of male Army Nurse Corps (ANC) Officers may have been substantially different from that of their female colleagues, thus making the impact of the experience on them potentially different. Overall Objective: This study explores and interprets the lived experiences of …

Signals From The 4th Dimension: Role Of Extracellular Matrix Signaling In Synaptic Plasticity Mediating Addiction, Alexander C. W. Smith Jan 2015

Signals From The 4th Dimension: Role Of Extracellular Matrix Signaling In Synaptic Plasticity Mediating Addiction, Alexander C. W. Smith

MUSC Theses and Dissertations

Chronic cocaine abuse causes maladaptive neuroadaptations that underlie vulnerability to relapse, even after protracted abstinence. A great deal of work has examined mechanisms of neuroplasticity by which these occur. However, the majority of experimentation has focused on intracellular signaling cascades, while the extracellular compartment has been largely ignored. In the past decade, work has emerged in the learning and memory literature that indicates that extracellular matrix remodeling and signaling is required for adaptive forms of neuroplasticity (e.g. learning and memory), although it has not been thoroughly examined in models of maladaptive neuroplasticity. Throughout this dissertation a drug self-administration, extinction and …

Preparing For Changes In Teacher Preparation Program Accountability: Evaluating The Factors That Influence Job Placement Of Teacher Preparation Program Graduates, Amy F. Johnson Phd

All Student Scholarship

Teacher preparations programs are facing increased pressure to report on the outcomes of their graduates, including their job placement rates. Prior research on job placement for teachers establishes that a variety of factors are related to whether or not individuals apply for and receive jobs. This research study explored these factors through quantitative analysis of three cohorts of teacher preparation program completers within the University of Maine system, using logistic regression to identify the individual and contextual characteristics that are most predictive of job application and hiring.

Antidiarrhoeal, Antisecretory And Antispasmodic Activities Of Matricaria Chamomilla Are Mediated Predominantly Through K+-Channels Activation, Hassan Mehmood, Siraj Munir, Uzair Ali Khalid, Mudassir Asrar, Anwarul Hassan Gilani

Department of Biological & Biomedical Sciences

Background: Matricaria chamomilla commonly known as “Chamomile” (Asteraceae) is a popular medicinal herb widely used in indigenous system of medicine for a variety of ailments. However, there is no detailed study available showing its effectiveness in hyperactive gut disorders like, abdominal colic and diarrhoea. This study was designed to determine the pharmacological basis for the folkloric use of Matricaria chamomilla in diarrhoea.
Methods: The crude aqueous-methanolic extract of Matricaria chamomilla (Mc.Cr) was studied for its protective effect in mice against castor oil-induced diarrhoea and intestinal fluid accumulation. The isolated rabbit jejunum was selected for the in-vitro experiments using tissue bath …

Is Burnout Separable From Depression In Cluster Analysis? A Longitudinal Study, Renzo Bianchi, Irvin Sam Schonfeld, Eric Laurent Jan 2015

Is Burnout Separable From Depression In Cluster Analysis? A Longitudinal Study, Renzo Bianchi, Irvin Sam Schonfeld, Eric Laurent

Publications and Research

Purpose: Whether burnout and depression represent distinct pathologies is unclear. The aim of this study was to examine whether burnout and depressive symptoms manifest themselves separately from each other or are so closely intertwined as to reflect the same phenomenon.

Methods: A two-wave longitudinal study involving 627 French schoolteachers (73 % female) was conducted. Burnout was assessed with the Maslach Burnout Inventory and depression with the 9-item depression module of the Patient Health Questionnaire.

Results: Burnout and depressive symptoms clustered both at baseline and follow-up. Cluster membership at time 1 (T1) predicted cases of burnout and depression at time 2 …

Analysis Of Factors Contributing To Early Adoption Of Multi- Municipal Comprehensive Plans In Pennsylvania, Karen Vanderhoff Jan 2015

Analysis Of Factors Contributing To Early Adoption Of Multi- Municipal Comprehensive Plans In Pennsylvania, Karen Vanderhoff

Electronic Theses and Dissertations

On the cusp of entering the 21st century, after decades of unchecked development of available land which exceedingly outpaced population growth, Pennsylvania was facing an impending land crisis. In a statewide response to reduce sprawl and preserve land, the Pennsylvania legislature passed Act 67 and Act 68, amending the Pennsylvania Municipal Planning Code. These amendments gave more power and tools to municipalities for developing multi-municipal comprehensive plans with neighboring municipalities. In this study, I use logistic regression to examine whether there are commonalities among municipalities which have developed multi-municipal comprehensive plans following the passage of Acts 67 and 68. My …

Property, Morality, And Moral Psychology: Comments On Gerhart’S Property Law And Social Morality, Dave Fagundes Jan 2015

Property, Morality, And Moral Psychology: Comments On Gerhart’S Property Law And Social Morality, Dave Fagundes

Texas A&M Journal of Property Law

My comments will proceed in two parts. In Part I, I will briefly describe and summarize the study of moral psychology, indicating how it might apply to property law. And in Part II, I will analyze Property and Social Morality through the lens of moral psychology, showing how Professor Gerhart’s project may be advanced through a richer understanding of the content of our ethical beliefs about property and the psychological mechanisms that give rise to them.

Moral Obligation And Natural Capital Commons On Private Land: Perspectives On Peter Gerhart’S Property Law And Social Morality, Blake Hudson Jan 2015

Moral Obligation And Natural Capital Commons On Private Land: Perspectives On Peter Gerhart’S Property Law And Social Morality, Blake Hudson

Texas A&M Journal of Property Law

This Article makes a simple and hopefully straightforward attempt to demonstrate how Gerhart’s property theory fills the gaps in privatized commons resource theory. Part II describes in more detail privatized commons resource theory, while Part III discusses Gerhart’s theory both generally and more specifically in the context of natural resources management. This Part first analyzes Gerhart’s explicit grappling with the commons broadly, and more directly wrestles with how his theory lays a legal framework for addressing temporal commons and the interests of future generations in natural capital. Next, this Part discusses the role of positive public law in manifesting society’s …

Renewing Respect For Record Notice: Cleaning Up The Pennsylvania Title Wash, Marc Prokopchak Jan 2015

Renewing Respect For Record Notice: Cleaning Up The Pennsylvania Title Wash, Marc Prokopchak

Texas A&M Journal of Property Law

To understand the title wash concept, one must first understand the underlying laws that brought it into existence. Accordingly, this Article will begin by providing a brief overview of Pennsylvania’s historical treatment of land for taxation purposes, as well as several important early 1800s state legislative acts, before discussing how these two subjects work together to “wash” a title. This discussion will also include the subsequent changes to the laws that effectively abrogated the title wash for more recent titles with less extensive chains of ownership.

Next, this Article will examine the Pennsylvania and related federal courts’ treatment of the …

Budgeting On Autopilot: Do Sequestration And The Independent Payment Advisory Board Lock-In Status Quo Majority Advantage?, Christina S. Ho

Tulsa Law Review

Amid deeply polarized discourse over spending choices, Congress has resorted frequently to the particular device of binding “automatic” cuts, a form of Congressional precommitment whereby Congress takes steps at time one with the intention of changing the likelihood it will make certain choices at time two. I argue that these devices are dis-ingenuous in two ways. First, legal analysis shows they do not actually bind Congress, even as they claim to. To the extent they have any traction, it is by appealing to our nor-mative reluctance to flout pre-existing rules, which, in other words, means they work by invoking the …

What Is Wrong With Sex In Authority Relations? A Study In Law And Social Theory, Galia Schneebaum Jan 2015

What Is Wrong With Sex In Authority Relations? A Study In Law And Social Theory, Galia Schneebaum

Journal of Criminal Law and Criminology

Criminalization of Sex within Authority Relations (SAR)—such as sex in the relationship between a therapist and a patient or an employer and an employee—is a growing phenomenon. Current theories conceptualize and consequently justify SAR offenses either under a liberal conception of sexual autonomy or under a feminist conception of gender inequality. Yet both conceptualizations are inadequate and fail to capture the distinctiveness of this new legal category. Specifically, they fail to explain the main puzzle underlying SAR offenses, which proscribe sexual contact in the absence of coercion by the offender. Rejecting both liberal and feminist analytical frameworks, this Article draws …

Geology In Environmental Management, Michael A. Kruge Jan 2015

Geology In Environmental Management, Michael A. Kruge

Department of Earth and Environmental Studies Faculty Scholarship and Creative Works

From the geological perspective, the two overriding environmental management concerns are the destructive impact of hazardous natural events on human health and property and the deleterious impact of human activity on the natural environment. The knowledge derived from the geological sciences serves as the basis for a more enlightened approach to the reduction of unnecessary risk involved in the siting and construction of buildings and transportation networks, as well as the extraction of natural resources and waste management. Armed with such knowledge along with political sensitivity, environmental managers will have opportunities for positive social impact in negotiating the challenges as …
