Gpa Accession: Lessons Learned On The Strengths And Weaknesses Of The Wto Government Procurement Agreement, Christopher R. Yukins, Johannes S. Schnitzer Jan 2015

Gpa Accession: Lessons Learned On The Strengths And Weaknesses Of The Wto Government Procurement Agreement, Christopher R. Yukins, Johannes S. Schnitzer

GW Law Faculty Publications & Other Works

Many member nations of the World Trade Organization (WTO) have joined the Government Procurement Agreement (GPA), a plurilateral agreement which aims to open public procurement markets. Joining the agreement reflects a commitment to international free trade, and to the rule of law in public procurement. A revised version of the GPA entered into force in 2014, and incorporated many amendments intended to make it easier for developing nations join the GPA. Among other things, the revised GPA now allows developing nations acceding to the GPA to open their public procurement markets more slowly, various transitional measures. This article reviews those …

The Puzzle Of Alfarabi's Parallel Works, Miriam Galston Jan 2015

The Puzzle Of Alfarabi's Parallel Works, Miriam Galston

GW Law Faculty Publications & Other Works

Scholars disagree about the correct interpretation of Alfarabi’s Political Regime and Virtuous City, treatises that have striking similarities, yet notable differences. For some, the treatises encapsulate Alfarabi’s philosophy; for others, they express only politically salutary opinions. Both interpretations fail to explain why he wrote parallel works. If both reflect Alfarabi’s genuine philosophic doctrines, why did he compose separate but parallel treatises, both written when his philosophy was mature? Alternatively, if the treatises are political or rhetorical, why did Alfarabi compose two versions, and why did he choose these two accounts rather than others? To answer these questions, I discuss several …

Constitutional Law: A Contemporary Approach, Gregory E. Maggs, Peter J. Smith Jan 2015

Constitutional Law: A Contemporary Approach, Gregory E. Maggs, Peter J. Smith

GW Law Faculty Publications & Other Works

The third edition of the casebook, which is suitable either for a one- or two-semester course, strives to make constitutional law easily teachable and readily accessible for students. The authors have selected the cases very carefully and provided extensive excerpts of the opinions so that students get a good sense of the Court's reasoning. Text boxes call the students' attention to important aspects of each opinion, and the book is filled with introductions, points for discussion, hypotheticals, and executive summaries. The authors present a diversity of views on every subject, and, reflecting some of their own disagreements, the authors have …

Gastrointestinal T lymphocytes are critical for mucosal immunity and HIV pathogenesis, yet little is known about normal T cell numbers and phenotypes in different regions of the gut, or the degree to which ART can restore levels to those of HIV-uninfected individuals. To investigate these questions, we measured T cell frequencies and markers of memory, activation, anergy, and homing in the blood, ileum, and rectum of HIV- and ART-suppressed HIV+ adults. In HIV- individuals, T cell frequencies and phenotypes differed significantly between sites. Compared to HIV- adults, HIV+ adults had lower absolute CD4+T cell counts in the ileal lamina propria …

Genetic Diversity In Oxytocin Ligands And Receptors In New World Monkeys, Dongren Ren, Guoqing Lu, Hideaki Moriyama, Aaryn C. Mustoe, Emily B. Harrison, Jeffery A. French Jan 2015

Genetic Diversity In Oxytocin Ligands And Receptors In New World Monkeys, Dongren Ren, Guoqing Lu, Hideaki Moriyama, Aaryn C. Mustoe, Emily B. Harrison, Jeffery A. French

School of Biological Sciences: Faculty Publications

Oxytocin (OXT) is an important neurohypophyseal hormone that influences wide spectrum of reproductive and social processes. Eutherian mammals possess a highly conserved sequence of OXT (Cys-Tyr-Ile-Gln-Asn-Cys-Pro-Leu-Gly). However, in this study, we sequenced the coding region for OXT in 22 species covering all New World monkeys (NWM) genera and clades, and characterize five OXT variants, including consensus mammalian Leu8-OXT, major variant Pro8-OXT, and three previously unreported variants: Ala8-OXT, Thr8-OXT, and Phe2-OXT. Pro8-OXT shows clear structural and physicochemical differences from Leu8-OXT. We report multiple predicted amino acid substitutions in the G protein- coupled OXT receptor (OXTR), especially in the critical N-terminus, which …

Generation Of An Attenuated, Cross-Protective Pepino Mosaic Virus Variant Through Alignment-Guided Mutagenesis Of The Viral Capsid Protein, Godwill M. Chewachong, Sally A. Miller, Joshua J. Blakeslee, David M. Francis, Thomas Jack Morris, Feng Qu Jan 2015

Generation Of An Attenuated, Cross-Protective Pepino Mosaic Virus Variant Through Alignment-Guided Mutagenesis Of The Viral Capsid Protein, Godwill M. Chewachong, Sally A. Miller, Joshua J. Blakeslee, David M. Francis, Thomas Jack Morris, Feng Qu

School of Biological Sciences: Faculty Publications

Mild variants of many viruses are able to protect infected plants from subsequent invasion by more severe variants of the same viruses through a process known as cross-protection. In the past, the cross-protective viral variants were commonly derived from mild field isolates that were sometimes genetically heterogeneous, providing variable levels of crossprotection. Here, we report a novel approach to rapidly generate crossprotective variants of the tomato-infecting Pepino mosaic virus (PepMV) independently of the availability of mild field isolates. Our approach sought to attenuate PepMV by mutating less conserved amino acid residues of the abundantly produced capsid protein (CP). These less-conserved …

Pollen Limitation And Flower Abortion In A Wind-Pollinated, Masting Tree, Ian S. Pearse, Walter D. Koenig, Kyle A. Funk, Mario B. Pesendorfer Jan 2015

Pollen Limitation And Flower Abortion In A Wind-Pollinated, Masting Tree, Ian S. Pearse, Walter D. Koenig, Kyle A. Funk, Mario B. Pesendorfer

School of Biological Sciences: Faculty Publications

Pollen limitation is a key assumption of theories that explain mast seeding, which is common among wind-pollinated and woody plants. In particular, the pollen coupling hypothesis and pollination Moran effect hypothesis assume pollen limitation as a factor that synchronizes seed crops across individuals. The existence of pollen limitation has not, however, been unambiguously demonstrated in wind-pollinated, masting trees. We conducted a two-year pollen supplementation experiment on a masting oak species, Quercus lobata. Supplemental pollen increased acorn set in one year but not in the other, supporting the importance of pollen coupling and pollination Moran effect models of mast seeding. …

Understanding Immigration Law, Second Edition lays out the basics of U.S. immigration law in an accessible way to newcomers to the field. It offers background about the intellectual, historical, and constitutional foundations of U.S. immigration law. The book also identifies the factors that have historically fueled migration to the United States, including the economic "pull" of jobs and family in the United States and the "push" of economic hardship, political instability, and other facts of life in the sending country. In the middle chapters, the authors provide a capsule summary of the law concerning the admissions and removal procedures and …

Kenya Second National Communication To The United Nations Framework Convention On Climate Change, Government Of Kenya Jan 2015

Kenya Second National Communication To The United Nations Framework Convention On Climate Change, Government Of Kenya

East Africa

Climate Change is the most serious global challenge of our time. Kenya signed the United Nations Framework Convention on Climate Change (UNFCCC) on 12 June 1992, and ratified it on 30 August 1994. It also ratified Kyoto Protocol on 25 February 2005 which entered into force on 26 May 2005. As a Party to the Convention, Kenya has implemented initiatives to meet its obligations and commitments, including the development of its First National Communication (FNC) that was prepared in 2002 with support from the Global Environment Facility (GEF) through the United Nations Environment Programme (UNEP). The FNC included preparation of …

Somaesthetics And Dance, Curtis L. Carter Jan 2015

Somaesthetics And Dance, Curtis L. Carter

Philosophy Faculty Research and Publications

Dance is proposed as the most representative of somaesthetic arts in Thinking Through the Body: Essays in Somaesthetics and other writings of Richard Shusterman. Shuster- man offers a useful, but incomplete approach to somaesthetics of dance. In the examples provided, dance appears as subordinate to another art form (theater or photography) or as a means to achieving bodily excellence. Missing, for example, are accounts of the role of dance as an independent art form, how somaesthetics would address differences in varying approaches to dance, and attention to the viewer’s somaesthetic dance experience. Three strategies for developing new directions for dance …

Integrating Ecological And Engineering Concepts Of Resilience In Microbial Communities, Hyun-Seob Song, Ryan S. Renslow, Jim K. Fredrickson, Stephen R. Lindemann Jan 2015

Integrating Ecological And Engineering Concepts Of Resilience In Microbial Communities, Hyun-Seob Song, Ryan S. Renslow, Jim K. Fredrickson, Stephen R. Lindemann

Department of Agricultural and Biological Systems Engineering: Faculty Publications

Many definitions of resilience have been proffered for natural and engineered ecosystems, but a conceptual consensus on resilience in microbial communities is still lacking. We argue that the disconnect largely results from the wide variance in microbial community complexity, which range from compositionally simple synthetic consortia to complex natural communities, and divergence between the typical practical outcomes emphasized by ecologists and engineers. Viewing microbial communities as elasto-plastic systems that undergo both recoverable and unrecoverable transitions, we argue that this gap between the engineering and ecological definitions of resilience stems from their respective emphases on elastic and plastic deformation, respectively. We …

Uncertainty Analysis Of An Irrigation Scheduling Model For Water Management In Crop Production, S. Mun, G. F. Sassenrath, Amy M. Schmidt, N. Lee, M. C. Wadsworth, B. Rice, Jason Q, Corbitt, J. M. Schneider, M. L. Tagert, J. Pote, R. Prabhu Jan 2015

Uncertainty Analysis Of An Irrigation Scheduling Model For Water Management In Crop Production, S. Mun, G. F. Sassenrath, Amy M. Schmidt, N. Lee, M. C. Wadsworth, B. Rice, Jason Q, Corbitt, J. M. Schneider, M. L. Tagert, J. Pote, R. Prabhu

Department of Agricultural and Biological Systems Engineering: Faculty Publications

Irrigation scheduling tools are critical to allow producers to effectively manage water resources for crop production. To be useful, these tools need to be accurate, complete, and relatively reliable. The current work presents an uncertainty analysis and its results for the Mississippi Irrigation Scheduling Tool (MIST) model, showing the margin of error (uncertainty) of the resulting irrigation advice arising solely from the propagation of measurement uncertainty through the MIST calculations. The final relative uncertainty in the water balance value from MIST was shown to be around 9% of that value, which is in the normal range of the margin of …

Surface Energy Balance, Evapotranspiration, And Surface Coefficients During Non-Growing Season In A Maize-Soybean Cropping System, Lameck O. Odhiambo, Suat Irmak Jan 2015

Surface Energy Balance, Evapotranspiration, And Surface Coefficients During Non-Growing Season In A Maize-Soybean Cropping System, Lameck O. Odhiambo, Suat Irmak

Department of Agricultural and Biological Systems Engineering: Faculty Publications

Surface energy balance components, including actual evapotranspiration (ET), were measured in a reducedtill maize-soybean field in south central Nebraska during three consecutive non-growing seasons (2006/2007, 2007/2008, and 2008/2009). The relative fractions of the energy balance components were compared across the non-growing seasons, and surface coefficients (Kc) were determined as a ratio of measured ET to estimated alfalfa (ETr) and grass (ETo) reference ET (ETref). The non-growing season following a maize crop had 25% to 35% more field surface covered with crop residue as compared to the non-growing seasons following soybean crops. Net …

Search For Third-Generation Scalar Leptoquarks In The Tτ Channel In Proton-Proton Collisions At √S = 8 Tev, Vardan Khachatryan, Vallary Bhopatkar, Marcus Hohlmann, Himali Kalakhety, Darren Mareskas-Palcek, Tuhin S. Roy, Francisco Yumiceva, The Cms Collaboration Jan 2015

Search For Third-Generation Scalar Leptoquarks In The Tτ Channel In Proton-Proton Collisions At √S = 8 Tev, Vardan Khachatryan, Vallary Bhopatkar, Marcus Hohlmann, Himali Kalakhety, Darren Mareskas-Palcek, Tuhin S. Roy, Francisco Yumiceva, The Cms Collaboration

Aerospace, Physics, and Space Science Faculty Publications

A search for pair production of third-generation scalar leptoquarks decaying to top quark and τ lepton pairs is presented using proton-proton collision data at a center-of-mass energy of √s = 8 TeV collected with the CMS detector at the LHC and corresponding to an integrated luminosity of 19.7 fb−1. The search is performed using events that contain an electron or a muon, a hadronically decaying τ lepton, and two or more jets. The observations are found to be consistent with the standard model predictions. Assuming that all leptoquarks decay to a top quark and a τ lepton, the existence of …

Saving Our Sisters: Effects Of A Computer-Based Version Of Sista On The Hiv-Related Behaviors Of African American Women, Krystal Frieson Jan 2015

Saving Our Sisters: Effects Of A Computer-Based Version Of Sista On The Hiv-Related Behaviors Of African American Women, Krystal Frieson

Theses and Dissertations--Educational, School, and Counseling Psychology

Human Immunodeficiency Virus (HIV) and Acquired Immunodeficiency Syndrome (AIDS) are infectious diseases wreaking irreparable havoc on the lives of millions all around the world. Of those infected and affected by HIV in the United States, African Americans disproportionately bear the burden of this disease, which has resulted in a major crisis within the African American community. In 2010, African Americans accounted for approximately 44% of all new HIV infections among adolescents, 13 years of age and older, and adults [Centers for Disease Control and Prevention [CDC], 2012). These statistics become even more dismal when both race and gender enter the …

The Inclusive Human Trafficking Checklist: A Dialectical Methodology Of Measurement, Maria C. Almario Jan 2015

The Inclusive Human Trafficking Checklist: A Dialectical Methodology Of Measurement, Maria C. Almario

Theses and Dissertations--Educational, School, and Counseling Psychology

The identification of victims of human trafficking and consequential service provision is characterized by a significant disconnection between the estimated prevalence of this issue and the number of cases identified. The current dissertation introduces the Inclusive Human Trafficking Checklist (IHTC) as a screening measure, evaluates the appropriateness of the instrument, evaluates whether there are differences in assessment based on the participant’s profession, level of knowledge, and training, and assesses if users of the instrument perceive it as useful. A total of 201 participants were asked to rate three vignettes predetermined by experts to qualify as a either human trafficking case …

The Compensation Conundrum In Partial Takings Cases And The Consequences Of Borough Of Harvey Cedars, Brittany Harrison Jan 2015

The Compensation Conundrum In Partial Takings Cases And The Consequences Of Borough Of Harvey Cedars, Brittany Harrison

Cardozo Law Review de•novo

This Note suggests that the goals the Harvey Cedars court sought to achieve—including reduced windfalls and greater certainty in the law—would best be achieved by applying the market value rule as adopted in California, which follows a value plus damages approach and requires payment for the part taken. Part I of this Note introduces the Harvey Cedars case. Part II provides a historical background to partial takings cases and a discussion of the special benefits doctrine, a type of compensation method that emerged as a compromise position to compensation to better protect condemnees. Part III surveys the various compensation methods …

Religious Freedom: Why States Are Unconstitutionally Burdening Their Own Citizens As They “Lower” The Burden, Jason Goldman

Cardozo Law Review de•novo

Part I of this Note traces the development of the Supreme Court’s First Amendment precedent, including a discussion of Congress’s enactment of Federal RFRA. Part II introduces the states’ legislative efforts with regard to free exercise statutes, culminating with the problematic “burden” RFRA movement. Part III outlines a brief history of both the Establishment Clause and Separation of Powers doctrine, and analyzes how “burden” RFRAs are unconstitutional in light of each, respectively. Part IV discusses the implications of this progressive trend, specifically focusing on the boundless government litigation, civil rights concerns, and the health and safety issues that have resulted. …

Are Physician-Patient Communications Protected By The First Amendment?, Martha Swartz Jan 2015

Are Physician-Patient Communications Protected By The First Amendment?, Martha Swartz

Cardozo Law Review de•novo

In the past several years, a number of states have enacted laws restricting physicians’ rights to speak freely with their patients. These laws go beyond informed consent laws enacted in most states in the 1960s and 1970s. While the informed consent laws require physicians to provide certain categories of information to patients prior to invasive treatment—such as the nature of the risks and benefits entailed—these new laws either prohibit physicians from discussing certain topics or mandate that they provide specific information to their patients that is only questionably supported by medical evidence. In the past several years, a number of …

Information Privacy And Data Security, Lauren Henry Jan 2015

Information Privacy And Data Security, Lauren Henry

Cardozo Law Review de•novo

Legal academic and policy discourse generally presumes that information privacy and data security are interchangeable goals. The conventional wisdom is that data security is a handmaiden of information privacy, and so what serves data security will serve information privacy. However, this view is an oversimplification of the relationship between the two fields. This Essay aids law and policy development in both fields by correctly defining their relationship to one another. Data security has separate objectives from information privacy that can be agnostic or even in opposition to information privacy. The law should acknowledge information privacy and data security as separate …
