Jürgen Habermas (b. 1929) and Charles Taylor (b. 1931) are two of the most important philosophers of the late 20th and early 21st centuries. Throughout their lengthy bodies of work, spanning from the 1960s and continuing today, they were frequent interlocutors, and often responded to one another’s theories and arguments. They also engaged in direct debates in edited volumes to which they both contributed, including Communicative Action: Essays on Jürgen Habermas's The Theory of Communicative Action (1991), Multiculturalism (1994), and The Power of Religion in the Public Square (2011). The Eurocentric and male narrative of the anti-colonial struggle in Africa during the twentieth century marginalized women’s contributions and presented them as passive victims of colonialism. Therefore, this study offers a more comprehensive historical account of women's leadership in Africa and a more inclusive and liberated narrative of the anti-colonial movement. Achieving this goal involves delving into the roles and contributions of two prominent female figures in the anti-colonial resistance in Northern and Sub-Saharan Africa during the twentieth century: Huda Shaarawi from Egypt and Funmilayo Ransome-Kuti from Nigeria. The increasing prevalence of mental health issues among college students is a critical concern. Disorders such as depression and anxiety are becoming more common, with depression notably a major risk factor for suicide—the second leading cause of death in this age group. Despite this troubling trend, significant barriers to accessing mental health services remain. Arbitrating With Indian Tribes: Separability, Tribal Sovereign Immunity, And Exhaustion Of Tribal Remedies, Paul F. Kirgis

Indian tribes have emerged as significant contributors to the national and regional economies, notably through industries such as gaming, natural resource extraction, technology, and consumer lending. This increasing commercial activity brings with it increasing commercial disputes. Both Indian tribes and their nonmember counterparts need a fair and reliable forum to ensure that agreements are performed, loans repaid, and avoidable harms compensated. But the complex legal landscape of tribal sovereignty and jurisdiction complicates dispute resolution involving tribes. Tribes’ status as sovereign entities raises challenging issues of federal and state court jurisdiction, tribal sovereign immunity, and exhaustion of tribal remedies. Arbitration offers …

A Theory Of Structural Guarantees: How The Constitution Combats Unequal Distributions Of Liberty, Michael S. Cecil

Structural inequality is a widely invoked but often undertheorized concept in constitutional discourse. A persistent question in constitutional theory is whether structure itself is a subject of justice—and how, if at all, institutional arrangements that produce unequal distributions of liberty might demand corresponding remedies. The strained efforts of courts and legislatures in addressing structural inequality through individual rights-based frameworks underscore the need for a more robust theoretical account. This Article contributes to that effort by advancing a theory of “structural guarantees” grounded in principles of justification from the social contract tradition. Walking The Line On Safety And Free Speech: Sidestepping First Amendment Challenges To Median Bans, Taylor J. Black

In 2021, the Tenth Circuit held a ban targeting pedestrians on street medians in Albuquerque, New Mexico unconstitutional under the First Amendment. Citing a crisis of pedestrian fatalities, Albuquerque has since promulgated a new pedestrian-safety ordinance with an adjusted median ban that prohibits pedestrians from sitting or standing on certain street medians. This ban not only fails to increase pedestrian safety but also arbitrarily blames the city’s poorest residents and poses a threat to First Amendment freedoms. Because the city cannot produce case-specific evidence to show that the ban is narrowly tailored to ameliorate a nonspeculative harm, the current ban …

New Mexico dedicates significant resources to incarceration—particularly with respect to prison medical care. Although New Mexico has mostly transitioned away from privately operated prisons, the New Mexico Corrections Department (NMCD) continues to contract with various corporations to provide health services in state-owned prisons. Not surprisingly, the private contractors’ cost-saving measures often result in the provision of grossly inadequate healthcare that constitutes cruel and unusual punishment under the Eighth Amendment. Prisoner litigation under 42 U.S.C. § 1983, however, is fraught with substantive and procedural barriers to recovery. The New Mexico Civil Rights Act (NMCRA or “the Act”) provides an avenue of …

Few areas of law are so completely entrusted to judge’s discretion, and therefore engender the risk of judicial abuse, as the contempt power. Despite this risk, New Mexico has significantly expanded the criminal contempt power over the last three years. Yet the results of this expansion—which typically play out in trial courts with little publicity and rare appellate review—have not been studied in any detail. This Comment examines how New Mexico trial courts used criminal contempt from January 1, 2023, to October 20, 2024, in light of the broad discretion granted to these courts. The present disclosure provides a method for behavioral prediction of a cardholder, performed by an artificial intelligence (AI) agent utilizing reinforcement learning in conjunction with a Markov Decision Process (MDP) framework. A Language Learning Model (LLM) acquires state and transition probabilities from an analytical processing unit. The LLM accesses historical interaction data and feedback records from a specialized vector database. The LLM analyzes and assimilates historical information retained within the vector database. The LLM implements cognitive algorithms predicated on defined contextual parameters with the aim of developing a personalized card usage strategy. The LLM orchestrates a sequence of interactive prompts.

This study analyses the situation of child labour in coastal and marine activities in Zanzibar, Tanzania, by examining activities carried out by children, the major driving factors for engaging in child labour, as well as the associated impacts to children’s schooling and wellbeing. Questionnaire survey, focus group discussions (FGDs), participant observations, and key informant interviews (KII) were all used to collect data for the study. Drawing on Bourdieu’s (1986) framework of embodied, objectified and institutionalised capital, this paper explores how technological universities (TUs) support the development of students’ cultural capital through active learning approaches. The formation of technological universities in Ireland marked a notable shift in the higher education landscape, with an emphasis on these institutions meeting the regional and economic needs of the location in which they operate. Currently, there is a dearth of studies pertaining to cultural capital and TUs. The landlord improperly used the pseudonym "Jane Doe" in the pleadings in violation of CPLR 1024. To use a fictitious name, a petitioner must submit an affidavit detailing the genuine efforts made to ascertain the party's identity. Here, the landlord's affidavit was silent regarding any effort to identify the occupant, who was a known party from prior proceedings. The landlord's cross-motion to amend the caption to substitute the tenant's real name was denied as prejudicial.

This dissertation is a study on the epistemological theory of divine illumination in the works of Meister Eckhart (c. 1260 - 1329 CE). Illumination, first asserted by St. Augustine, is the theory that the human intellect is incapable of achieving epistemic certainty regarding what it sensorily receives. To gain this certainty, the mind is reliant upon illumination, wherein the sensed object is known by the mind through the light of that object's divine idea, which also serves as its ontological principle. This bibliometric study investigates global research trends on phonological awareness in second language learning (SLL) among pre-primary school children from 2014 to 2023. The study utilizes data from the Dimensions database, and is guided by three objectives: analysing publication volume trends, identifying leading contributors (countries, institutions, authors, journals), and mapping dominant research themes. It employs the VOSviewer—a software tool for constructing and visualizing bibliometric networks—to conduct co-authorship, co-citation, and keyword co-occurrence analyses. The results show a steady increase in research output, peaking in 2021, reflecting a growing scholarly interest. This paper examines the intonation systems of content and yes-no questions in Cinyambwa, a dialect of Cigogo Bantu language (G.11 in Guthrie’s classification). The study investigates the intonation patterns of different questions to show how content questions are differentiated from yes-no questions prosodically. It focuses on how the industry responded to local and global socio-economic and political dynamics from the colonial period in the 1900s through 2020. This study explores the perceptions of smallholder farmers in semi-arid areas of Chamwino District, Tanzania, regarding the adoption of improved maize seeds as an adaptation strategy to climate change.
