Pharmaceutical companies are subject to monopolies of their own making in the pharmaceutical market. Legislators have tried to limit these monopolies by passing legislation in the hopes that it will lower prices. Unfortunately, these attempts to lower the costs of prescriptions have caused more issues to arise over time. When employing complex aspects of intellectual property law, such as evergreening and product hopping, there is no control exerted over pharmaceutical companies.

Over the last decade, many states have passed laws seeking to restrict or ban certain medications approved by the United States Food and Drug Administration (FDA). One of the most recent examples: gender-affirming care medications for transgender youth and young adults. As of January 2025, twenty-six states have passed laws banning or restricting the provision of genderaffirming care to minors. Proponents of these laws challenge the procedures and prescription drugs as “experimental,” while critics of these laws characterize both as best-practice medical care. In either case, these laws demonstrate a second-guessing of the FDA’s long-established authority in determining the safety …

Judicial embrace of the consumer welfare standard reduced the indeterminacy and political manipulability of U.S. antitrust law. Continual invocations of antitrust’s consumer welfare focus, however, have created the misimpression that consumer harm is a sufficient, not merely a necessary, condition for condemning antitrust-relevant behaviors like agreements in restraint of trade and exclusion-causing unilateral acts. Such a “consumer harm sufficiency” view underlay the plaintiffs’ claims in Epic Games v. Apple and FTC v. Qualcomm and has inspired scholarly proposals to condemn various antitrust-relevant behaviors simply because they occasion consumer harm.

Scholars have engaged in a sharp argument over whether the judiciary should follow the original understanding in interpreting the Constitution. Recent criticism has argued that originalism fails because it does not advance a substantive moral or political good. This paper responds to this criticism by advancing an instrumental justification for originalism. It argues that a nation may fail to make a constitution because regions with differing policy preferences may not trust each other to obey the agreement after ratification. Constitution-makers can overcome this obstacle by committing to future enforcement of the agreement by an independent judiciary. To maintain the founding …

Corporate laws in the United States require corporations to be governed by a board of directors consisting of humans—otherwise known as the natural person requirement. Mandating governance by individual persons stands in contrast to typical American business ideals and the freedom of contract. There are various reasons for corporate law’s imposition of the natural person requirement—many of them historical. But the justification for the natural person requirement has not been sufficiently critiqued, particularly in the context of AI. In the five decades since Papert coined the term Computational Thinking (CT), it has become a core framework for thinking about learning, problem-solving, design, and creativity. Although CT is most commonly, and initially, associated with the cognitive orientations involved in coding and learning to code, it also includes situated and critical processes related to computational problem solving. Herein we unpack ways researchers in different fields and points in time have organized CT. In this study, we aim to better understand the effects of generative AI within a constructionist learning design. We explore participants’ experiences in a graduate level course on Artificial Intelligence in Education, where generative AI is studied as: a cultural object to understand and critically evaluate, an interactive learning technology, and a creative material generator. Students explored AI in education via Python, philosophical and empirical scholarship, and generative AI. They applied this knowledge to the design and prototyping of a learning technology related to their professional backgrounds and interests. This thesis explores the evolving landscape of Educational Technology (EdTech) and examines how the Montessori educational philosophy is translated into digital learning environments. The study aims to identify design implications for children’s educational applications (apps) that seek to align with Montessori principles and what aspects of a Montessori-based application excel over a non-Montessori-based application. A qualitative thematic analysis was conducted using a custom-developed codebook to analyze user reviews posted by guardians of children on the Apple App Store. Closed-source large language models (LLMs) developed by large technology companies continue to grow in popularity. However, ethical conversations surrounding the safety of model outputs have been a prominent topic of discussion. This project aims to assess three leading closed-source LLMs: OpenAI’s ChatGPT, Google’s Gemini, and Anthropic’s Claude, to analyze how their outputs perform when treated as a subject of several psychological evaluation scales measuring biased behaviors against women. There are currently few commercially available multi-function accessory mounts for electric wheelchairs that are practical for high-level quadriplegics. Consequently, an individual user must design and create one for themselves, an undertaking that requires significant resources in the form of expertise, time, and money. Sexual abuse, in all of its many forms, has been a controversial topic for centuries. This project looks at a specific subset of sexual abuse: high school student-teacher assaults. Victims of sexual abuse often face barriers to justice. This project addresses several demographic barriers. Research has shown that people of color and members of the queer community are typically reluctant to report due to police and societal perceptions of these groups. Teenagers face additional challenges, such as not know how their peers, parents, school, or community will react. In 2021, households with a White householder made up 65.3% of all U.S. households and held 80.0% of all wealth. Those with a Black householder made up 13.6% of all U.S. households but held only 4.7% of all wealth. And their median wealth ($24,520) was about one-tenth the median wealth of households with a White householder ($250,400). This disparity in Black wealth and White wealth is almost an order of magnitude. Political misinformation has become an increasingly prominent topic of discussion among scholars across disciplines, particularly in the wake of the 2020 American presidential election. Despite growing scholarly interest in this phenomenon, however, contemporary research has yet to examine misinformation alongside traditional epistemological theory. This thesis aims to remedy this gap by synthesizing classical epistemology, journalism and media research, and political science to investigate the impact of misinformation on political knowledge acquisition. The purpose of this qualitative, interpretive study was to explore the perceptions of Black, veteran, in-service teachers regarding recruitment and retention strategies in rural Tennessee K-12 public schools. This study addressed significant racial disparities in the Tennessee education system, where the percentage of Black teachers was notably lower than the percentage of Black students, particularly in rural schools. Data were collected from 20 Black, veteran, in-service teachers using questionnaires and semi-structured interviews to examine the factors influencing their decisions to seek employment and remain in rural districts. Although secondary schools are responsible for engaging in transition planning for students with disabilities (Individuals with Disabilities Education Act, 2004), research indicates these plans are often lacking in efficacy (Greene, 2015) and in their alignment with students’ interests and needs (Hughes et al., 2023). The purpose of this project was to implement a qualitative evaluation process to measure the progress of the East London Church’s transition toward a flatter team-based ministry model. The research evaluated the effectiveness, fitness for purpose, and procedural weaknesses of the church's articulated leadership goals, which included equipping members for ministry, increasing member involvement, forming ministry teams, and sharing power and resources. The study employed a mixed-methods approach, integrating quantitative data from two Church Health Assessment (CHA) surveys separated by a three-year interval with qualitative insights from focus groups to provide a comprehensive understanding of the transition process. Sibling sexual abuse is the most common yet least reported, treated, and studied manifestation of child sexual abuse (Bertele & Talmon, 2023; Caffaro & Conn-Caffaro, 2005; Krienert & Walsh, 2011; O’Brien, 1991). It is a particularly challenging form of intrafamilial sexual abuse for parents and caregivers because their children are both the victim and the perpetrator of the abuse. They struggle to balance the needs of both children (Duane et al., 2002; Tener et al., 2020) and may experience heightened stress and associated psychological difficulties. When one thinks of government, what comes to mind are familiar generalpurpose entities like states, counties, cities, and townships. But more than half of the ninety thousand governments in the United States are strikingly different: they are “special-purpose” governments that do one thing, such as supply water, fight fire, or pick up the trash. These entities have expanded far more rapidly than any other form of government. Yet they remain understudied, and they present at least two puzzles. First, special-purpose governments are difficult to distinguish from entities that are typically regarded as business organizations—such as consumer cooperatives—and thus underscore the …

Standard theories of precedent limit the legal effect of a precedent to cases within the scope of its holding. Yet the widespread use of analogies to precedent in legal reasoning presupposes that precedents have legal implications for cases outside the scope of their holdings. This Article suggests that arguments from analogy to precedent have the currency they do in our legal system because respect for a precedent requires more than treating the precedent’s holding as true: It also requires the judge, for purposes of deciding the case, to update her other beliefs around the assumption that the precedent’s holding is …

Querying The Ecological Sublime: Colonial Aesthetics, Anticolonial Thought, And The ‘Double Fracture’, Tacuma Peters

This article examines the ecological sublime in its relationship to the history of colonial aesthetics, anticolonial thought, and contemporary colonialism. It argues that, while Edmund Burke utilized the sublime in support of colonialism (including settler colonialism) in North America and colonial slavery, Samson Occom and Ottobah Cugoano developed versions of the sublime to contest British colonialism in the Americas. The history of this aesthetic contestation has not been represented in scholarship on the ecological sublime, which, this article shows, has a vexed relationship with historical and contemporary colonialism.
