The Unavoidable Consequences Of Homelessness, Sara K. Rankin, Laura Riley

The U.S. Supreme Court’s recent Grants Pass v. Johnson decision sounded the death knell for Eighth Amendment protections for people experiencing homelessness. The decision not only overruled key Ninth Circuit decisions, but also severely cabined the Court’s own precedent, allowing cities across the country to jail and fine people for doing nothing other than surviving in public space when they have no reasonable alternative. The Eighth Amendment’s prohibition against cruel and unusual punishment is a powerful symbol of America’s aspiration to realize the dignity and humanity of all its people, especially those who are marginalized and vulnerable to systemic discrimination …

An Ugly Common Ancestor: Dred Scott, Roe And Enumerationism, David S. Schwartz

The Dred Scott case holds a deserved place in the constitutional “anticanon” of Supreme Court decisions that exemplify rejected constitutional views. But the complex history of the case, the convolution of the opinion by Chief Justice Roger Taney, and the complicated relationship between its two primary holdings have generated multiple, often conflicting arguments about its negative “lessons.” Such arguments—particularly that of Robert Bork arguing that Dred Scott is the “very ugly common ancestor” of Lochner v. New York and Roe v. Wade—have masked an important element of the Taney opinion: its central reliance on “enumerationism,” the doctrine of limited enumerated …

Drone Assassinations: The Limits Of The President’S Constitutional Authority To Strike Foreign Military Officers With Drones Without Congressional Approval, Christopher A. Smith

While drones are a significant asset to the United States Military, their presence also presents unique challenges. The ability to stalk and engage in assassination style killings of high-ranking foreign military officials without ever placing United States forces presents a new issue where the President can intrude on Congress’s power to declare war. This is especially true with regard to the War Powers Resolution, which requires military action without congressional authorization to be limited in nature, scope, and duration. Ultra Vires Review Of Federal Agency Action Made Simple(R), Richard W. Murphy

The law governing ultra vires review seeking injunctive relief to challenge statutory violations by federal agencies is a mess. Although administrative law generally limits judicial review to final actions, a substantial body of caselaw holds that this type of ultra vires review can reach interlocutory actions, vastly expanding judicial reach. Although administrative law now insists that federal courts must exercise independent judgment when reviewing agency statutory interpretations, caselaw limits this type of ultra vires review to correcting only the most spectacular statutory violations. Tank bromeliads are found in rainforests across the Neotropics and harbour diverse invertebrate communities between their leaf axes. Various factors influence the invertebrate species richness and differences in composition in bromeliad phytotelmata, most notably, habitat size. However, there has been little work on invertebrate communities in bromeliads in western Amazonia or at different heights in the canopy. We collected 63 epiphytic bromeliads (Aechmea hoppii (Harms) L.B.Sm, A. nidularioides L.B.Sm) on the eastern edge of the Tropical Andes Biodiversity Hotspot in Ecuador and explored which biological and physical variables explained the differences in invertebrate composition among bromeliads.
