The unconstitutional conditions doctrine dictates what a government can and cannot do when exercising its police powers to promote community interests. Recent Supreme Court jurisprudence highlights a special application of the doctrine in the land use context, with Sheetz v. County of El Dorado recognizing constitutional scrutiny of legislative decisions. After decades of using its own analysis, Washington courts now use the federal approach in these cases. This evaluation study assessed the impact of Stay Independent participation on topic familiarity and the likelihood of making a recommended behavior change among community-residing older adults. Stay Independent focuses on the nutritional needs of older adults, emphasizing Whole Person Wellness and the Health Belief Model. It was initially created in Iowa for community-residing adults aged 60 and older and has been adapted for cultural appropriateness in Louisiana. Existing literature provides ample evidence of the detrimental impact of de-unionization on various determinants of individual health. However, there is a lack of direct empirical research linking de-unionization to objective health outcomes. By leveraging the differential timing of Right-to-Work law implementation across four states in the United States, we quantify the role of union presence in opioid misuse. Using a synthetic control method, our analysis reveals a persistent decline in unionization rates in the affected states within 4-6 years of RTW enactment. This reduction precipitated a considerable increase in both nonfatal and fatal overdoses, as measured by opioid-related treatment admissions …

In this Essay, we argue that the proper test for antitrust’s rule of reason is a four-step, burden-shifting framework that ends with a balancing of the likely harms and benefits of particular conduct. One reason balancing has become rare even in circuits that permit it is that it seems hard. Antitrust is shot through with economic theory and evidence, and courts aren’t experts in economics. So they tend to look for shortcuts that allow them to resolve the case without having to apply that economic evidence to assess the likely net effect of a defendant’s conduct. Even when a prisoner has overcome all of AEDPA’s requirements and the Supreme Court’s equitable bars to relief, the writ of habeas corpus may issue only as “law and justice” require. The Court has recognized in recent Terms that the habeas statute thus confers on courts discretion to deny relief notwithstanding the satisfactions of the statutory and equitable preconditions. As chairman of the National Labor Relations Board, Donald Dotson was nothing if not controversial. Though he headed the Board for five years, he was never shy about criticizing the Board’s practices.
