Traditional textualism instructs judges to adhere to a statute's linguistic meaning and reject as irrelevant its interpretive consequences. Justice Scalia famously contrasted his restrained textualist judge with "Mr. Fix-It," a judge who inappropriately weighs consequences. Today, however, textualists increasingly embrace consequentialist reasoning. This Article documents this undertheorized shift and the emerging textualist efforts to justify it, including Justices Kavanaugh and Barrett's arguments for nonliteralism and judicial sensitivity to context. This Article critiques these efforts: Modern textualist theory lacks a compelling explanation for its newfound reliance on interpretive consequences.

Treatment termination occurs, invariably, in every psychotherapy relationship. Closing the therapy relationship is often a complex process and requires targeted training for psychotherapists to terminate treatment competently and in a way that preserves gains made and fosters continued client growth. Discontinuation of psychotherapy services requires practitioners to apply ethical knowledge, clinical expertise, and relational boundaries. Further, the nuances of forced, end-of-year termination in clinical training environments necessitates targeted supervision and explicit guidelines. Phosphorus is a commonly consumed mineral in the traditional human diet and plays an essential role in human physiological functions. With the use of phosphate additives, high phosphate intake has become increasingly prevalent in recent years. Phosphate is regulated in the body by a homeostasis mechanism. A disruption to the homeostasis has a link to various pathologies such as bone health, cardiovascular disease, cancers, and kidney issues. Various studies have investigated the role of phosphate and its effects on human function. Bone health, cardiovascular disease, cancer, premature aging, dementia, and kidney disease are linked with high phosphorus intake.

This study investigates teachers’ professional practices during the delivery of a transnational professional development programme by one Finnish university for a cluster of Brazilian private universities. The objective is to identify local instructors’ patterns of teaching (teachers’ personal-professional qualities), which are conceptualised as approaches to teaching and self-efficacy beliefs, as well as participation in professional development practices (professional cultures and professional development activities). An online questionnaire was sent to the teaching staff of five universities and 201 responses were received and analysed. This study examines how various challenges and support systems influence international students’ satisfaction, as reflected in their intention to recommend their university. Using the Expectation Confirmation Theory (ECT), it examines whether students’ initial expectations moderate the relationships between challenges and satisfaction, and between institutional support and satisfaction. Analysis of survey data (N = 712) indicates that the majority of international students report satisfaction with their university experience. Ordinal logistic regression analyses reveal that perceived institutional support and higher initial expectations are associated with increased likelihood of recommending the university. However, achieving consistent and repeatable results, or reproducibility, is a significant challenge that affects the credibility of these models. This thesis addresses reproducibility through two studies related to the KneeHub Project, which is a multi-institutional collaboration designed to investigate reproducibility in finite-element modeling of the knee.

Conventional wisdom perceives patent protection as a necessary evil. Patent protection, the argument goes, raises the prices of patented products and processes, thus restricting access to innovation. But without it, not enough innovation will be produced. Hence, generations of scholars have sought ways to curb the market power of patentees via various legal interventions, such as prizes, compulsory licenses, and other forms of regulation. Charter schools are publicly funded, tuition-free, K–12 schools that have more flexibility than traditional public schools in curriculum, staffing, and more. CAR T cell (CART) therapy holds promise for cancer treatment, but heterogeneity among products limits clinical effectiveness, making systematic profiling essential to identify predictors of success. Recently, a phase 1 clinical trial investigated whether a constitutively active IL-7 receptor (C7R) could safely improve the function and persistence of GD2-directed CARTs (GD2.CARTs) in pediatric patients with high-grade CNS tumors. We analyzed infusion products from trial participants using a custom-designed 33-color full spectrum flow cytometry (FSFC) panel combined with an image-based tumor killing assay to characterize CART products and evaluate the impact of C7R on GD2.CART performance. This thesis investigates how private investment could align doughnut economic framework. Doughnut economics is a strong sustainability economic framework where the economy operates within planetary boundaries while ensuring social equity. Theories of sustainable development, weak sustainability, and strong sustainability are discussed to provide theoretical context for doughnut economics and mainstream economics. The analysis concludes that conventional, profit maximizing private investment does not support a doughnut economics system by supporting the depletion of natural resources and exacerbating social issues. Information is encoded and stored in three types of memory: sensory memory (SM), short-term memory (STM), and long-term memory (LTM). SM has a large capacity but retains information for only a brief period. When information transfers to STM, only a limited amount can be stored. Information in STM can then be transferred to LTM, which has a much larger capacity and longer retention time. STM is often conceptualized as working memory (WM) to highlight its role in active information processing. Src homology 2-domain containing protein tyrosine phosphatase 2 (SHP2), encoded by the Ptpn11 gene (Tyrosine-protein phosphatase non-receptor type 11), is a key downstream effector of PD-1/PD-L1 signaling and is likely important, in addition to immune modulation, in tumor development and vascular homeostasis. SHP2 conveys PD-1 mediated inhibitory signaling in T cells, and is emerging as a therapeutic target. Importantly, there is an association between immune checkpoint inhibitors (ICIs), immune-related adverse events (irAEs), and cardiovascular complications, underscoring the need to understand SHP2’s role in these processes. The landlord, a supportive housing provider, failed to plead that the premises and tenancy are subject to OMH and DOHMH regulations, violating RPAPL § 741. Despite progress in addressing racism in the United States, its effects remain deeply entrenched, particularly for Black families. Research on Black parenting shows that parents adapt their strategies to protect children from criminalization, discussing violence, providing safety within the home, and limiting exposure to unsafe environments while also managing their own stress. This presentation will highlight recent geologic mapping efforts done by the Indiana Geological and Water Survey, including detailed bedrock mapping at a finer scale than previously available and updated landslide inventory mapping focused on southeastern Indiana. The second part of the presentation will cover the emergency response to a significant slope failure that occurred along SR 56 in Madison following heavy rainfall in March and April 2025. This study looks at how academic libraries in the New York City metropolitan area are using TikTok to engage with their communities, particularly students. It analyzes the most popular videos from five active library accounts, categorizing content types and measuring engagement through TikTok’s built-in metrics. Results indicate that humorous and lighthearted content consistently receives the highest engagement, while instructional or “how-to” videos tend to underperform. These findings suggest that while TikTok may not be the most effective platform for instructional outreach, it holds potential as a tool for visibility, community engagement, and humanizing the library’s presence. Evaluating foundation models using a single aggregated metric, such as a weighted sum, presents significant limitations. These methods can mask catastrophic regressions in individual capabilities, establish arbitrary trade-offs between metrics, and fail to distinguish true improvements, where all members of a set have increases ≥0 (Pareto improvements), from changes where some metrics decline. This disclosure details a method for robust metric aggregation. The technique computes a composite score using a more Pareto-sensitive function (harmonic mean, geometric mean, etc.) as a base aggregator, which inherently penalizes low sub-metric values. Objective: The aim of this mixed methods systematic review was to explore if Yoga can alleviate mental health issues for Indigenous people, and how participants experience the effects.

Methods: Peer-reviewed primary research published in English retrieved from 2002 to March 2024 was identified using the databases Medline, Scopus, Informit, ProQuest and PsycINFO. Qualitative, quantitative and mixed method studies with Indigenous populations, where the primary intervention was Yoga or mindfulness programs with significant yoga components that reported on mental health outcomes were included.

This dissertation addresses fundamental questions surrounding mortality and does so existentially. Of central concern is what it means to be mortal, the value of mortality, how we ought to relate to it, whether immortality is preferable to mortality, and what moral obligations can be derived from our mortality. By engaging thinkers such as Heidegger, Kierkegaard, Jonas, Epicurus, and contemporary anglophone philosophers, this project seeks to challenge prevailing attitudes towards death. Through a meta-philosophical lens, I argue for the value of mortality as a shaper of the meaningfulness of existence, and for the cultivation of what I call ‘genuine mortality consciousness’ …
