Tracing The History Of Discourses On Professionalism In The “Sister Professions” Of Librarianship And Social Work In The United States, Rachel E. Trnka Apr 2023

Tracing The History Of Discourses On Professionalism In The “Sister Professions” Of Librarianship And Social Work In The United States, Rachel E. Trnka

Faculty Scholarship and Creative Works

In Whole Person Librarianship: A Social Work Approach to Patron Services (2019), Zettervall and Nienow aptly refer to librarianship and social work as ‘sister professions’, highlighting their gendered histories and similar professional values. Both librarianship and social work emerged as service-oriented, female-dominated professions in the late nineteenth century. Questions about professional identity have concerned librarians and social workers since those early days, with scholars and practitioners in both fields examining markers of professionalism, such as training, associations, and values. This article compares the historical development of professional social work and librarianship by tracing the changing discourses on professionalism, attending to …

Evaluating The Impact Of Personalized Professional Learning On Technology Integration In The Classroom, Angela Bishop Burgess Apr 2023

Evaluating The Impact Of Personalized Professional Learning On Technology Integration In The Classroom, Angela Bishop Burgess

Theses and Dissertations

Classroom access to technology such as a computer or the Internet does not guarantee a high-level of integration of technology by the teacher or application by the student. Tools that could be used to increase student creation or personalized learning opportunities may instead be used by the teacher at lower levels of use that replace non-technological tools. The purpose of this action research was to implement and evaluate the impact of technology-focused personalized professional learning on participants’ use of and attitudes towards classroom technology. It attempted to show that modeling technology integration in professional learning opportunities for educators could have …

Care For The Land: Restoration As Interspecies Care Labor And Emergent Activism At The Hawaiian Fishpond-Scape, Cynthia Ruimin Shi , '23

Senior Theses, Projects, and Awards

In the last two decades, environmental NGOs on the islands of Hawai’I have been leading efforts to restore traditional land practices and foodways, among them fishpond, or loko i’a, which are traditional aquaculture infrastructures that ensure a stable production of fish protein. This ethnographic study of loko i’a restoration projects is informed by four months of fieldwork grounded in participant observation at Paepae O He’eia, a non-profit organization on the windward side of O’ahu heading the restorative effort at He’eia fishpond.

My thesis addresses the ethics of care, labor, and Indigenous worldmaking emerging from ecological and cultural restoration of fishponds …

Brazilian Camming: The Monetization Of Intimacy In Online Sex Work, Fernanda Veiverberg Apr 2023

Brazilian Camming: The Monetization Of Intimacy In Online Sex Work, Fernanda Veiverberg

Master's Theses

This thesis addresses a form of online feminized labor in Brazil, which employs digital technology to relieve the urges for intimacy and monetary insecurity. Camming is a genre of online sex work, in which cam models sell their body image and attention online through computer-mediated interactions. It constitutes a profitable activity that employs body performance without physical contact between model and client, typical in most categories of sex work such as prostitution, and where the clients are not mere spectators as within the pornography industry because camming requires authenticity and communication. For that, I explored three conceptual spheres that combined …

Shooting To Minimize Gender Discrimination As An Unintended Consequence Of Title Ix, Alexa Potts Apr 2023

Shooting To Minimize Gender Discrimination As An Unintended Consequence Of Title Ix, Alexa Potts

Dickinson Law Review (2017-Present)

Title IX is a federal law prohibiting sex-based discrimination in any education program or activity that receives federal funding. Congress initially passed Title IX out of concern for sexbased equality in academia. However, Title IX has had significant impacts on athletics, resulting in increased athletic opportunities for females. To be Title IX compliant, institutions must provide equality in athletic participation for both sexes. The Office of Civil Rights provided a three-part test to measure equality in athletic participation. Institutions must satisfy at least one of the three prongs to meet Title IX requirements as they pertain to equality in athletic …

Federal Bureaucratic Studies, Jesse M. Cross Apr 2023

Federal Bureaucratic Studies, Jesse M. Cross

Washington and Lee Law Review

A vast literature has developed in legal scholarship on the topic of bureaucratic governance. To date, this literature has focused squarely on the executive branch. Yet a second bureaucracy also exists in the federal government: the congressional bureaucracy. Recent legislation scholarship has brought this bureaucracy into focus—documenting its traits, practices, and culture. In so doing, it has created a rich new opportunity for cross-disciplinary dialogue—one where executive-branch studies and legislative studies collaborate toward a larger understanding of how bureaucracy operates, and can operate, in a presidentialist system.

To begin that cross-disciplinary conversation, this Article turns to five themes in the …

Creativity and Change Leadership Graduate Student Master's Projects

ABSTRACT OF PROJECT

Nurturing Creativity Using Intentional Event Design

The purpose of this project is to continue the research and strengthen the academic foundation that underlies the intersection where creativity and creative leadership are supported by intentional event design. This project will explore the tools that can help determine if an organization encourages bold creativity or limits the time or energy allowed for creative problem solving, and the many ways we can design experiences with the intention to allow creativity to enter the room. This will extend the practical applications and explore stories where leadership, creativity and experience design intersect …

Defending The First Premise: Why Prenatal Life Is Not The Exception, Jessica Buchanan Apr 2023

Defending The First Premise: Why Prenatal Life Is Not The Exception, Jessica Buchanan

Senior Honors Theses

This thesis frames the abortion debate by dividing the pro-life position into two premises: that the government must protect human beings’ right to life, and that an unborn human organism is a human being. It briefly describes the proposition that the unborn are moral persons. It then proceeds to examine philosophical, legal, and practical objections to the first premise, concluding that if the unborn are established as human beings, the government must uphold their right to life. While this thesis is intended to argue in favor of restricting elective abortion, it does not put forth an opinion on what should …

Continuous Casting Of Microencapsulated Alloys As Phase Change Materials, Yuri A. Gulak Apr 2023

Continuous Casting Of Microencapsulated Alloys As Phase Change Materials, Yuri A. Gulak

Master’s Theses - College of Engineering

The overarching goal of this work is to provide a potential solution to the growing needs for largescale thermal energy storage via the development of a highly scalable manufacturing process, namely continuous casting, toward industrial scale production of high temperature microencapsulated phase change materials. Using borosilicate glass coated tin metal as a model system, we designed, built, and validated two continuous casting machines with high-throughput in-line data-acquisition. The first machine enabled continuous casting of glass coated metal microwires. And the second machine subsequently uses the glass-coated metal microwire as feedstock to produce glass coated metal particles. Analytical, numerical, and experimental …

The Short Unhappy Life Of The Negotiation Class, Linda S. Mullenix Apr 2023

The Short Unhappy Life Of The Negotiation Class, Linda S. Mullenix

University of Michigan Journal of Law Reform

On September 11, 2019, Judge Dan Aaron Polster of the United States District Court for the Northern District of Ohio, Eastern Division, approved a novel negotiation class certification in the massive Opiate multidistrict litigation (MDL). Merely one year later on September 24, 2020, the Sixth Circuit reversed Judge Polster’s certification order. While the Opiate MDL has garnered substantial media and academic attention, less consideration has been directed to analyzing the significance of the negotiation class model and the appellate repudiation of this innovative procedural mechanism.

This Article focuses on the development and fate of the negotiation class and considers the …

Giving The Fourth Amendment Meaning: Creating An Adversarial Warrant Proceeding To Protect From Unreasonable Searches And Seizures, Ben Mordechai-Strongin Apr 2023

Giving The Fourth Amendment Meaning: Creating An Adversarial Warrant Proceeding To Protect From Unreasonable Searches And Seizures, Ben Mordechai-Strongin

University of Michigan Journal of Law Reform

For at least the past 40 years, police and prosecutors have had free reign in conducting illegal searches and seizures nominally barred by the Fourth Amendment. The breadth of exceptions to the warrant requirement, the lax interpretation of probable cause, and especially the “good faith” doctrine announced in U.S. v. Leon have led to severe violations of privacy rights, trauma to those wrongly searched or seized, and a court system overburdened by police misconduct cases. Most scholars analyzing the issue agree that the rights guaranteed by the Fourth Amendment—to be free from unreasonable search and seizure—have been severely eroded or …

The Securities Law Disclosure Conundrum For Publicly Traded Litigation Finance Companies, Robert F. Weber Apr 2023

The Securities Law Disclosure Conundrum For Publicly Traded Litigation Finance Companies, Robert F. Weber

University of Michigan Journal of Law Reform

The Article examines a peculiar legal dilemma—implicating securities law, legal ethics, and evidence law—that arises when litigation finance companies (LFCs) become public companies. LFCs provide funding to litigants and law firms for prosecuting lawsuits in exchange for a share of the lawsuit recoveries. In recent years, LFCs have significantly altered the landscape of the civil justice system in common law jurisdictions. But their assets, which are just rights to proceeds from lawsuits, are notoriously opaque— who really can predict what a jury will do when it comes to liability and damages? When LFCs go public, this opacity frustrates public investors’ …

Evaluating Antitrust Remedies For Platform Monopolies: The Case Of Facebook, Seth G. Benzell, Felix B. Chang Apr 2023

Evaluating Antitrust Remedies For Platform Monopolies: The Case Of Facebook, Seth G. Benzell, Felix B. Chang

Vanderbilt Law Review

This Article advances a framework to assess antitrust remedies and policy interventions for platform monopolies. As prosecutors and regulators barrel forward against digital platforms, soon it will fall upon courts and administrative agencies to devise remedies. We argue that any sensible solution must include quantification of the welfare effects on a platform’s various constituents. The Benzell-Collis model predicts the effects of proposed solutions on a platform’s profits and the welfare of its users. The model also considers additional aspects of welfare unique to the social media setting, such as digital platforms’ nonmonetary goals, platform addiction, and externalities from platform use. …

Get Out To Got Out: Residential Mobility And The Language Of Opportunity In A Black Southern Louisiana Family, Gabrielle Cosey , '23 Apr 2023

Get Out To Got Out: Residential Mobility And The Language Of Opportunity In A Black Southern Louisiana Family, Gabrielle Cosey , '23

Senior Theses, Projects, and Awards

This study examines the migration of Black, middle and upper class members of my family from Black neighborhoods in Southern Louisiana into white neighborhoods. Most of the canon on Black residential patterns question why such high levels of residential segregation remain. Thus, the existing literature explores various structural and individual reasons as to why Black households, regardless of income level, continually reside in Black neighborhoods, even though they often exhibit higher rates of poverty and associated characteristics. This research project approaches the topic from the opposite end, centering its analysis on Black individuals who move into white neighborhoods, in order …

Reliance Interests In Statutory And Constitutional Interpretation, William N. Eskridge Jr., Apr 2023

Reliance Interests In Statutory And Constitutional Interpretation, William N. Eskridge Jr.,

Vanderbilt Law Review

People and companies rely on public law when they plan their activities; society relies on legal entitlements when it adapts to new technology, economic conditions, and social groups; legislators, administrators, and judges rely on settled law when they pass, implement, and interpret statutes (respectively). Such private, societal, and public “reliance interests” are the “dark matter” of America’s law of interpretation. They underwrite most interpretive doctrine, and their perceived force broadly and deeply affects the application of doctrine.

Reliance interests anchor the constitutional bias in favor of interpretive continuity, and they provide guardrails for the leading theories of interpretation-—namely-—textualism or original …

Spanish L2 Development In A Short-Term Domestic Immersion Program, Kara Moranski, Juan Godoy-Peñas, Bernard Issa, Mandy Faretta-Stutenberg, Harriet Wood Bowden

Faculty Articles, Papers, and Other Scholarship

This exploratory study evaluated the impact of a Spanish second language (L2) domestic immersion (DI) program that was developed expediently at a large university in the United States in response to widespread study abroad (SA) program closures due to COVID-19. Spanish language learners (n = 14) participated in an intensive, six-week summer immersion program for a total of 96 contact hours over the duration of the program. L2 development was evaluated via a conceptual replication of Issa et al. (2020), which recently provided compelling evidence of the benefits of short-term SA programs. L2 gains were measured using an acceptability …

Against Political Theory In Constitutional Interpretation, Christopher S. Havasy, Joshua C. Macey, Brian Richardson Apr 2023

Against Political Theory In Constitutional Interpretation, Christopher S. Havasy, Joshua C. Macey, Brian Richardson

Vanderbilt Law Review

Judges and academics have long relied on the work of a small number of Enlightenment political theorists-—particularly Locke, Montesquieu, and Blackstone—-to discern meaning from vague and ambiguous constitutional provisions. This Essay cautions that Enlightenment political theory should rarely, if ever, be cited as an authoritative source of constitutional meaning. There are three principal problems with constitutional interpretation based on eighteenth-century political theory. First, Enlightenment thinkers developed distinct and incompatible theories about how to structure a republican form of government. That makes it difficult to decide which among the conflicting theories should possess constitutional significance. Second, the Framers did not write …
