A Critical Assessment Of Bill S-203, Ending The Captivity Of Whales And Dolphins Act: Challenging The Exclusivity Of Anthropocentrism And Science-Based Justifications, Rachel De Graaf Jan 2024

A Critical Assessment Of Bill S-203, Ending The Captivity Of Whales And Dolphins Act: Challenging The Exclusivity Of Anthropocentrism And Science-Based Justifications, Rachel De Graaf

Animal Law Review

Bill S-203, An Act to amend the Criminal Code and other Acts (ending the captivity of whales and dolphins) became Canadian law in 2019, banning the captivity of cetaceans. This Article critically examines Bill S-203, arguing that it is underpinned by anthropocentric and science-based justifications that will work as exclusionary forces against many animals in need of legal protection. Instead, the Article advocates for an empathetic and multi-jural approach that accounts for human-animal interconnectedness and the unique cultures of animals. This argument is theoretically rooted in vegan ecofeminism’s empathic and non-binaristic perspective. As such, this Article scrutinizes the reasoning behind …

Phylogenetic Relationships Of A North American Radiation Of Clematis (Ranunculaceae), Jesse Harris, Thomas H. Murphy, Erin A. Manzitto-Tripp, Nicolás Medina, Zach Irick, L. Dwayne Estes, Stacey D. Smith

Aliso: A Journal of Systematic and Floristic Botany

Clematis L. is one of many plant genera that contributes prominently to the species richness and endemism of the southeastern United States. Here we examined phylogenetic relationships among species in Clematis sect. Viorna, commonly known as leatherflowers, which are distributed primarily in the southeastern United States. We used data from restriction site-associated ddRADseq to reconstruct a best estimate phylogeny of this group. Our analyses revealed that the North American members of sect. Viorna form a well-supported clade, and several of the traditionally recognized infrasectional taxa were resolved as monophyletic. Although characters employed in classification including habit and inflorescence position …

Environmental Enrichment For Farmed Animals, Alexandra Schauer Jan 2024

Environmental Enrichment For Farmed Animals, Alexandra Schauer

Animal Law Review

Environmental enrichment standards are set in many animal welfare laws, but such protections are generally withheld from farmed animals. Instead, farmed animals are subject to substandard enclosures that are under-stimulating and inappropriate for their species-specific behavioral needs. Scientific studies have shown that the inclusion of environmental enrichment in an animal’s enclosure balances their production of stress hormones, which has beneficial implications for the overall health and wellbeing of the animal. Establishing enclosure standards for farmed animals that include provisions relating to environmental enrichment would improve farmed animal well-being and, subsequently, the health of the humans who consume products deriving from …

Saving Species Or Sacrificing Science?: Navigating The Legal Labyrinth Of Research And Conservation Through The Case Of The Long-Tailed Macaque, Maliat Chowdhury Jan 2024

Saving Species Or Sacrificing Science?: Navigating The Legal Labyrinth Of Research And Conservation Through The Case Of The Long-Tailed Macaque, Maliat Chowdhury

Animal Law Review

For decades, long-tailed macaques have served an instrumental role in advancing biomedical research. However, due to the recent primate shortage in U.S. laboratories, these macaques have become coveted targets for poachers. In 2022, the International Union for Conservation of Nature (IUCN) elevated the long-tailed macaque’s threat level from “Vulnerable” to “Endangered,” citing research-related capture as a critical factor contributing to their decline. Under this new status, long-tailed macaques are at risk of being categorized under Appendix I of CITES, a designation that will subject them to stricter trade regulations. Alarmed by the potential obstacles this reclassification may pose to scientific …

Animal Sentience Should Be The Key For Future Legislation, Margaret Landi, Lida Anestidou Jan 2024

Animal Sentience Should Be The Key For Future Legislation, Margaret Landi, Lida Anestidou

Animal Law Review

This Article posits that changes in U.S. laws and policies regarding animal experimentation depend on the recognition of animal sentience. Sentience—distinct from cognition and self-awareness—is the ability of an animal to experience pain, pleasure, and other emotions. First, this Article reviews the reasons animals are still used in biomedical research and the relevant characteristics of U.S. law. This is followed by a discussion of sentience and the concepts of cognition and self-awareness, and a discourse on societal interests. The Article concludes with an analysis of six bioethical principles considered central to the future of animal experimentation. Overall, conferring sentience would …

The Repeal Of Religious Accommodations -- A Constitutional Analysis, Ronald J. Colombo Jan 2024

The Repeal Of Religious Accommodations -- A Constitutional Analysis, Ronald J. Colombo

American University Law Review

Under modern Supreme Court jurisprudence, the First Amendment ordinarily imposes no heightened standard of review upon neutral laws of general applicability that coincidentally burden the free exercise of religion. To relieve or minimize this burden, however, lawmakers are generally free to promulgate exemptions from, or accommodations to, such laws for the benefit of religious adherents. Such accommodations are common.

When a law is not neutral with respect to religion, or when the law is not generally applicable, then it will be subject to the exacting test of strict scrutiny to the extent that it burdens the free exercise of religion. …

The cytotoxic and immunogenic-activating properties of a cobalt(III)-cyclam complex bearing the non-steroidal anti-inflammatory drug, flufenamic acid is reported within the context of anti-cancer stem cell (CSC) drug discovery. The cobalt(III)-cyclam complex 1 displays sub-micromolar potency towards breast CSCs grown in monolayers, 24-fold and 31-fold greater than salinomycin (an established anti-breast CSC agent) and cisplatin (an anticancer metallopharmaceutical), respectively. Strikingly, the cobalt(III)-cyclam complex 1 is 69-fold and 50-fold more potent than salinomycin and cisplatin towards three-dimensionally cultured breast CSC mammospheres. Mechanistic studies reveal that 1 induces DNA damage, inhibits cyclooxygenase-2 expression, and prompts caspase-dependent apoptosis. Breast CSCs treated with 1 exhibit …

Early-Career Georgia Agriculture Teachers' Agricultural Mechanics Professional Development Needs, Christopher Crump Jan 2024

Early-Career Georgia Agriculture Teachers' Agricultural Mechanics Professional Development Needs, Christopher Crump

Murray State Theses and Dissertations

Agricultural mechanics is a prominent topic in Georgia Agricultural Education, as it is the agricultural subject matter area with the second-largest enrollment across all school systems in the state. However, with Georgia agricultural teacher preparation programs only requiring three credit hours in the subject matter area, questions arise as to whether Georgia agriculture teachers are properly prepared to teach this subject matter area, especially if those teachers did not complete a traditional teacher preparation program. This nonexperimental, quantitative study assessed early-career Georgia agriculture teachers’ professional developmental (PD) needs in agricultural mechanics. Qualtrics was utilized to collect responses to a research …

Can Edna Be Used To Locate Shawnee Hills Cavefish Forbesichthys Papilliferus?, Megan Brandt, Timothy Spier Phd, Gary Zeruth Phd

Murray State Theses and Dissertations

Traditional stream fish sampling methods, such as seining and electrofishing, are time consuming, expensive, and limited to short stretches of stream. However, the analysis of environmental DNA (eDNA) from water samples promises to be a quick, inexpensive method for detecting fish. The streams of the Land Between the Lakes Recreational Area (LBL) are unique, undisturbed streams which contain many interesting fish species for which little information exists. One such rare species is the Shawnee Hills Cavefish Forbesichthys papilliferus, which is known to exist in a few LBL streams. However, the complete distribution of the Shawnee Hills Cavefish in LBL …

Intrinsic Motivators For Participation And Persistence In Intercollegiate Athletics, Kevin Saal Jan 2024

Intrinsic Motivators For Participation And Persistence In Intercollegiate Athletics, Kevin Saal

Murray State Theses and Dissertations

Abstract

Since its inception, intercollegiate athletics’ conflicting existence vacillates between a history of rich, co-curricular and developmental experiences for young people, and a multi-billion-dollar industry transformed by limitless commercialization, expense and exploitation. The “professionalization” of intercollegiate athletics and blurring of motivational factors influencing participation and persistence threatens its holistic academic and developmental purpose (Duderstadt, 2000, p. 78). This dissertation provides a review of motivational theories, in addition to summarizing numerous contextually relevant intrinsic and extrinsic regulators impacting human behavior. Through a quantitative research methodology this study proposes research broadly investigating intrinsic motivation, seeking to develop a better understanding and establish …

Breaking The Silence: A Mixed Methods Study On Opioid Education, Overdose Risks, And Treatment Education Among College Students, Anita Silwal

Theses and Dissertations--Communication

The opioid crisis is a national public health emergency in the United States. Opioid education, naloxone training, and medication for opioid use disorder treatment (MOUD) are evidence-based practices to mitigate opioid overdose. The opioid crisis is affecting people of all ages, including college students. Research indicates the gap in research among college students on how they perceive this public health emergency and how it is affecting them; thus, this dissertation aims to address the gap by examining college students' knowledge, attitude, and behavioral intentions toward opioid education, naloxone training, and referral to MOUD to those struggling with opioid addiction. The …

Intersectionality Matters In Food And Drug Law, Colleen Campbell Jan 2024

Intersectionality Matters In Food And Drug Law, Colleen Campbell

University of Colorado Law Review

Feminist scholars critique food and drug law as a site of gender bias and regulatory neglect. The historical exclusion of women from clinical trials by the FDA prioritized male bodies as the object of clinical research and therapies. Likewise, the FDA’s prior restriction on access to contraceptive birth control illustrates how patriarchal and paternalistic attitudes within the Agency can harm women’s reproductive health. However, there is little analysis of how race and gender intersect in this domain. This Article uses the regulation of skin-lightening cosmetics products to illustrate why and how intersectionality matters in food and drug law. While the …

Colonizing Queerness, Jeremiah A. Ho Jan 2024

Colonizing Queerness, Jeremiah A. Ho

University of Colorado Law Review

This Article investigates how and why the cultural script of inequality persists for queer identities despite major legal advancements such as marriage, anti-discrimination, and employment protections. By regarding LGBTQ legal advancements as part of the American settler colonial project, I conclude that such victories are not liberatory or empowering but are attempts at colonizing queer identities. American settler colonialism’s structural promotion of a normative sexuality illustrates how our settler colonialist legacy is not just a race project (as settler colonialism is most widely studied) but also a race-gender-sexuality project. Even in apparent strokes of progress, American settler colonialism’s eliminationist motives …

Adoption As Substitute For Abortion?, Malinda L. Seymore Jan 2024

Adoption As Substitute For Abortion?, Malinda L. Seymore

University of Colorado Law Review

In Dobbs v. Jackson Women’s Health Organization, Justice Samuel Alito relied on adoption as part of the justification for holding that abortion is not constitutionally protected. First, he said, “[s]tates have increasingly adopted ‘safe haven’ laws, which generally allow women to drop off babies anonymously.” Second, “a woman who puts her newborn up for adoption today has little reason to fear that the baby will not find a suitable home.” Using adoption as an adequate substitute for abortion is a long-standing strategy for the antiabortion movement, but it is often embraced by pro-choice advocates as well. This position is supportable …

Gender Classification Through Postural Analysis: A Comparative Study Of 2d Images And 3d Reconstructions., Prathamesh Dixit Jan 2024

Gender Classification Through Postural Analysis: A Comparative Study Of 2d Images And 3d Reconstructions., Prathamesh Dixit

Master's Projects

In computer vision, gender classification has become a vital task having applications in human-computer interaction, healthcare, and surveillance. In this study, we look at a two-step approach based on human joint information for gender classification. In this research, we use convolutional neural networks (CNNs).

With Leeds Sports Pose (LSP) dataset, we use a C5 pre-trained model to map and extract joint information from 2D RGB images and after pre-processing and background removal, we use PiFUHD to transform these 2D images into 3D representations. Next, we train our models on RGB images and joint images for both 2D and 3D representations. …

Image Segmentation By Convolutional Neural Networks In Coral Resilience Research, Jennifer Benbow Jan 2024

Image Segmentation By Convolutional Neural Networks In Coral Resilience Research, Jennifer Benbow

Master's Projects

As ocean temperatures rise, coral bleaching is becoming more frequent and severe. Selective breeding experiments show promise for enhancing coral resilience, but scaling these projects is hindered by the labor-intensive nature of taking numerous time series measurements as corals grow. Automating this process with computer vision is one solution to this bottleneck, and to our knowledge, no such tool exists at present. To fill this gap, we have trained a set of machine learning models, based on the Mask R-CNN framework, for segmenting juvenile corals in lab-based coral resilience research. This work shows that retraining the Mask R-CNN architecture through …

Characterizing The Relationship Between The Presence Of Depression Risk, Post-Traumatic Stress Disorder, And Benzodiazepine Use To Get High, Julia Kollitz

Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)

Aim: To determine if there is a relationship between depression risk, post-traumatic stress disorder (PTSD), and engaging in benzodiazepine misuse.

Methods: A secondary cross-sectional analysis was conducted on data from a sample of people who use drugs (n=743). Depression risk was assessed via the Center for Epidemiological Studies-Depression scale. Meeting DSM-IV criteria for PTSD was identified using the Mini International Neuropsychiatric Interview (MINI). We used simple and multivariable logistic regression models to estimate the association between mental health factors of interest and benzodiazepine misuse, defined as self-reported benzodiazepine use “to get high” in the past six months.

Results: Of the …

From Sabers To Spikes: A Newfangled Reconstruction Of The Ancient, Giant, Sexually Dimorphic Pacific Salmon, †Oncorhynchus Rastrosus (Salmoninae: Salmonini)., Kerin M. Claeson, Brian L Sidlauskas, Ray Troll, Zabrina M Prescott, Edward B Davis Jan 2024

From Sabers To Spikes: A Newfangled Reconstruction Of The Ancient, Giant, Sexually Dimorphic Pacific Salmon, †Oncorhynchus Rastrosus (Salmoninae: Salmonini)., Kerin M. Claeson, Brian L Sidlauskas, Ray Troll, Zabrina M Prescott, Edward B Davis

PCOM Scholarly Works

The impressive †Oncorhynchus rastrosus of the Pacific Northwest's Miocene and Pliocene eras was the largest salmonid ever to live. It sported a hypertrophied premaxilla with a pair of enlarged teeth which the original describers reconstructed as projecting ventrally into the mouth, leading them to assign the species to "Smilodonichthys," a genus now in synonymy. Through CT reconstruction of the holotype and newly collected specimens, we demonstrate that the famed teeth projected laterally like tusks, not ventrally like sabers or fangs. We also expand the original description to characterize sexual dimorphism in mature, breeding individuals. Male and female †Oncorhynchus rastrosus differ …

Postings on social media on Twitter (now X), BioAnthropology News (Facebook), and other venues, as well as recent publications in prominent journals, show that primatologists, ecologists, and other researchers are questioning the terms “Old World” and “New World” due to their colonial implications and history. The terms are offensive if they result in erasing Indigenous voices and history, ignoring the fact that Indigenous peoples were in the Americas long before European colonization. Language use is not without context, but alternative terminology is not always obvious and available. In this perspective, we share opinions expressed by an international group of primatologists …

Antisemitic Terrorism, J. Richard Broughton Jan 2024

Antisemitic Terrorism, J. Richard Broughton

Lewis & Clark Law Review

Recent surges in antisemitic activity—and antisemitic violence, in particular—have led increasingly to conversations about the connections between antisemitism and domestic terrorism. While the nexus between antisemitic violence and domestic terrorism has long been expressed in rhetorical terms, its connection in legal terms—notably, federal criminal law—has been more attenuated. This Article explores that connection and finds that existing federal criminal law requires rethinking: it is underinclusive and thus inadequate to fully capture and punish the threats posed by today’s domestic violent extremism, and particularly antisemitic violence. The Article surveys recent federal prosecution in cases involving actual or threatened antisemitic violence, and …

Applying The Public Trust Doctrine To Local Governments, Talia O. Thuet Jan 2024

Applying The Public Trust Doctrine To Local Governments, Talia O. Thuet

Lewis & Clark Law Review

Under the public trust doctrine, the government holds public lands in trust for the public and cannot unreasonably restrict citizens from accessing them or otherwise breach its duties as a trustee. The public trust doctrine is often thought of as a state law doctrine. However, local governments own a significant portion of public land. Some local governments argue that the public trust doctrine does not apply to them because the state is the proper trustee under the public trust doctrine. This Comment argues that the public trust doctrine applies to local governments. State law preempts local government law on matters …
