Conservation As Multiple Use, Sandra B. Zellmer Jan 2024

Conservation As Multiple Use, Sandra B. Zellmer

Faculty Law Review Articles

The world is facing unprecedented species extinctions, wrought in large part by climate change. Slashing greenhouse gas emissions is one crucial response to the climate/biodiversity crisis. The conservation of intact ecosystems and the life-sustaining services they provide is another. This goal will be beyond reach if conservation commitments do not cover federal public lands, particularly multiple use lands.

The Bureau of Land Management (“BLM”) has recently proposed a pathbreaking new rule that explicitly defines conservation as a multiple use. In doing so, the Conservation and Landscape Health Public Lands Rule (“Conservation Rule”) puts conservation on par with other statutorily listed …

Effective Programming And Instruction For Students With Social And Behavioral Needs, Anna S. Cook

All Electronic Theses and Dissertations

Providing special education services to students with Emotional Behavioral Disorders (EBD) can be especially complex. EBD students often display academic deficits which are compounded by difficult behaviors and result in many students lagging 1-2 grade levels behind their peers. If not addressed adequately, the combined skill and behavioral challenges continue into adulthood and lead to troubling outcomes such as higher rates of unemployment, dysfunctional relationships, and negative encounters with the legal system. Early and consistent effective intervention is critical to benefit EBD students across academic and social-emotional domains to facilitate as much appropriate inclusion as possible. This review examines: the …

Multi-Parent Custody, Jessica Feinberg Jan 2024

Multi-Parent Custody, Jessica Feinberg

Faculty Publications

In recent years, a number of jurisdictions have enacted laws recognizing that a child may have more than two legal parents (multi-parentage). Recognition of multi-parentage represents a significant change to the legal framework governing parentage— for most of U.S. history, it was well established that a child could have a maximum of two legal parents. While commentators undoubtedly will continue to debate the wisdom of multi-parentage recognition, it is clear both that multi-parentage has arrived and that its arrival raises many novel and important questions across a variety of areas of the law. Proponents and opponents of multi-parentage agree that …

Arsenic Contamination Needs Serious Attention: An Opinion And Global Scenario, Abhijnan Bhat, Kamna Ravi, Furong Tian, Singh Baljit

Articles

Arsenic (As) contamination is a serious global concern, polluting our natural resources, including water and soil, and posing a danger to the environment and public health. Arsenic is present in the groundwater of several countries and this contaminated water is used for irrigation, drinking, and food preparation, which poses the greatest threat to public health. Nearly 106 countries are affected by groundwater arsenic contamination and an estimated 230 million individuals worldwide are exposed to its adverse health effects, including increased cancer risks, associated cardiovascular disease and diabetes, skin lesions, neurological effects, kidney damage, and foetal or cognitive-development-related complications. Arsenic is …

BACKGROUND: Genetic variants and gene expression predict risk of chronic obstructive pulmonary disease (COPD), but their effect on COPD heterogeneity is unclear. We aimed to define high-risk COPD subtypes using genetics (polygenic risk score, PRS) and blood gene expression (transcriptional risk score, TRS) and assess differences in clinical and molecular characteristics.

METHODS: We defined high-risk groups based on PRS and TRS quantiles by maximising differences in protein biomarkers in a COPDGene training set and identified these groups in COPDGene and ECLIPSE test sets. We tested multivariable associations of subgroups with clinical outcomes and compared protein-protein interaction networks and drug repurposing …

Rebalancing Judicial Immunity For Civil Rights Actions, Bailey D. Barnes Jan 2024

Rebalancing Judicial Immunity For Civil Rights Actions, Bailey D. Barnes

Faculty Publications

Sterilization for shorter jail sentences. Vasectomies and birth control implants for freedom. In 2017, a criminal court judge in rural Tennessee made this offer to people incarcerated through sentences issued by his court. When litigators sought monetary damages and to enjoin the practice, and the local media exposed the scheme, the judge begrudgingly rescinded the order while expressing surprise that it was controversial. The Board of Judicial Conduct issued a letter of reprimand to the judge. Meanwhile, the United States District Court for the Middle District of Tennessee summarily dismissed the constitutional tort claims against the judge based on absolute …

The Success Of Pre-Enforcement Challenges To Antidiscrimination Laws, Alexander Gouzoules Jan 2024

The Success Of Pre-Enforcement Challenges To Antidiscrimination Laws, Alexander Gouzoules

Faculty Publications

Formally, judicial analysis of a challenged statute's validity should be consistent, regardless of the challenge's pre- or post-enforcement posture. A post-enforcement posture arises when an aggrieved party defensively challenges a purportedly unconstitutional statute being enforced against them. Alternatively, a pre-enforcement posture arises when an impacted party strikes first, attacking the statute by asserting a credible threat that the law will be enforced against them in the future. Either way, judicial evaluation of a statute's validity should turn on its content and effect-not on whether it was challenged before or after enforcement.

This Article challenges that assumption, arguing that pre-enforcement challengers …

The law cannot be kept secret. We cannot comply with rules that we do not know. Nor can we question their legitimacy, which is both our right and our duty as citizens. And yet, a substantial body of law applied in this country is difficult for anyone but federal agency insiders to piece together. Rather than publishing regulations that lay out standards of conduct for the future, many agencies interpret the law, and articulate and implement new policies, as they go. Those subject to the law they implement are left to piece the rules together by studying whatever information is …

Pharmacy Faculty Articles and Research

The prevalence of Non-alcoholic Fatty Liver Disease (NAFLD) is increasing, particularly in individuals who consume minimal to no alcohol. Currently, NAFLD affects at least 32% of the global population. Although not all but approximately 5-10% cases of NAFLD progress to non-alcoholic steatohepatitis (NASH), a condition arising from lipotoxicity. Patients with NASH may further develop liver fibrosis, cirrhosis, and hepatocellular carcinoma (HCC). However, it is important to note that progression from NAFLD to NASH and HCC is not inevitable for all patients. The pathogenesis of HCC in the context of NAFLD and NASH remains poorly understood, however, fat accumulation, often due …

Article 103 Of The United Nations Charter: Uncharted Possibilities? The Ukraine Conflict And Beyond, Eran Sthoeger

Michigan Journal of International Law

Article 103 of the United Nations Charter establishes the primacy of states’ obligations under the Charter over their other international obligations. The effect of Article 103 on states’ obligations has been discussed in the jurisprudence and literature but only in the context of obligations conflicting with binding Security Council decisions. Those discussions fail to shed light on its legal significance in a variety of other situations. This writing explores the application of Article 103 in other contexts. It explores the legal ramifications of Article 103 applied to states’ obligations that conflict with the Charter itself, with obligations contained in certain …

Computer Science and Engineering Faculty Publications

Open data initiatives and knowledge graphs, in synergy, have contributed to an increasing volume of disaster-related data in the Semantic Web. Synthesizing and enriching these data is critical to support all aspects of data-driven disaster risk reduction and management. A standard template that coherently defines, maps, and classifies the wide range of hazards to which communities are exposed is a key input for this task. The UNDRR-ISC Hazard Information Profiles (HIPs) provide evidence-informed standardization of hazard nomenclature and definitions and a “science-backed” classification. Unfortunately, they are not in a machine-readable format. This paper develops the HIP Ontology as its FAIR …

Vaccines are one component to the public health strategies to alleviate the COVID-19 pandemic. Hesitancy regarding COVID-19 vaccines in the United States has been problematic, which is not surprising given increasing overall vaccine hesitancy in recent decades. Most vaccines are administered during childhood years. Consequently, understanding hesitancy toward administration of vaccines in this age group may provide insight into possible interventions to reduce vaccine hesitancy. The present study analyzed a subset of over 130,000 public comments posted in response to a notice of meeting of the vaccine advisory group to the Food and Drug Administration. The meeting addressed whether to …

Establishing Recharge Rates In The High Plains Aquifer: Mapping, Precipitation Modeling, And An Evaluation Of The Chloride Mass-Balance Method, Arindam Mukherjee

Electronic Theses and Dissertations

In this dissertation, three studies related to understanding and predicting recharge are presented. First, geospatial techniques were used to identify potential groundwater recharge areas in the High Plains Aquifer. Second, a precipitation generator was developed to produce site specific synthetic precipitation series that depend on daily precipitation occurrences, particularly on the distribution of wet spells for sites to be used in numerical modeling. Third, the unsaturated flow code VS2DI was modified to allow the simulation of chloride accumulation from recharge, and this model was used to evaluate errors in the Chloride-Mass-Balance (CMB) method for estimating recharge due to heterogeneity.

Design Of Topical Ocular Drug Delivery Systems For Management Of Eye Keratitis, Chuntian Cai Jan 2024

Design Of Topical Ocular Drug Delivery Systems For Management Of Eye Keratitis, Chuntian Cai

Electronic Theses and Dissertations

Due to the complexity of the anatomical and physiological barriers in the eye, ocular drug delivery presents significant challenges. The poor solubility of many drugs and short retention times on the ocular surface results in low bioavailability from traditional topical dosage forms. Various types of eye infections, such as bacterial keratitis (BK) and fungal keratitis (FK), can become critical and lead to serious visual disabilities. Therefore, this research study aims to enhance the solubility and corneal permeation of two drugs, Ciprofloxacin (CIP) for BK and the antifungal agent Natamycin (NT) for FK, using nanoemulsion (NE) and cyclodextrin (CD) based technologies.

Bigger Than Bees: Victorian England’S Relationship To The Bee – Considering Symbolism And Understanding, Grace Jacqueline Kaim Jan 2024

Bigger Than Bees: Victorian England’S Relationship To The Bee – Considering Symbolism And Understanding, Grace Jacqueline Kaim

Electronic Theses and Dissertations

The complex and beautiful relationship the people in Victorian England had to the bee is one that goes beyond ideas of politics and religion. This thesis will explore this relationship by utilizing print, ephemera, jewelry, and household items, to demonstrate how the representation and symbolism of the bee was recognized and cherished by Victorians. While bees did certainly have an intimate relationship to the areas of politics and religion, one that is acknowledged throughout this work, their connection to grander themes of introspection, industrialism, folklore, morality, and status helps us understand the Victorians on a deeper level.

A Qualitative Examination Of The Interplay Of Attachment Styles, The Supervisory Relationship & Counseling Self-Efficacy, Kamiron Ball Tran

Electronic Theses and Dissertations

This phenomenological qualitative study explores the intricate dynamics between attachment styles, the supervisory relationship, and counseling self-efficacy among supervisory dyads in counseling. The findings reveal five themes: supervision is relational, supervision is a therapeutic space, security within supervision bolsters self-efficacy, supervision is a mirror for clinical practice, and the nuanced "both/and" nature of attachment and self-efficacy dynamics. This study addresses a gap in the literature by offering qualitative insights into the interplay of attachment styles, supervisory relationship, and counselor self-efficacy, thus contributing to a deeper understanding of the complexities within supervisory practices in counseling.
