Keeping It Private, Maimon Schwarzschild
Keeping It Private, Maimon Schwarzschild
San Diego Law Review
Public law adjudication has grown dramatically in recent decades in many English-speaking countries. In the United States, and increasingly in other countries where it used to be rare for public questions to be decided in court, controversial questions of public policy are tried as constitutional or human rights issues and decided by court order. But in other areas of law - in everyday tort, contract, and property cases - court decisions are typically much less dramatic and seldom if ever announce controversial innovations in public policy. Yet in private law cases too there are implicit questions of social justice. In …

Interpreter Of Maladies: Analyzing Current Young Adult Indo-Caribbean Literature For Inclusion In Today's High School Canon, Reshma Ramkellawan
HIM 1990-2015
The high school English Language Arts curricula of Central Florida has faced increasing scrutiny during the past decade under often conflicting influences such as a rapidly diversifying student population, activism for and against multicultural curriculum reform, and pressure to streamline curricula and make it conform to state testing standards. Against this social backdrop, the question of how to introduce Inda-Caribbean literature at the secondary level presents unique intellectual and political challenges. On the one hand, first and second generation Inda-Caribbean migrants make up an increasingly significant percentage of Florida's student population. Like other first and second generation Caribbean migrants, Inda-Caribbean …

Privacy, Identity And Security, Benjamin J. Goold

This paper examines the relationship between security, surveillance, privacy and identity, both in the context of legislation such as the Anti-terrorism Act and the PATRIOT Act, and also in the light of ongoing changes in how that personal information is gathered, processed and used. It is argued that prevailing notions of privacy — and the legal frameworks that aim to protect privacy interests — are ill-suited to defending individuals from an increasingly sophisticated array of surveillance and data processing techniques, which enable information to be acquired and shared at almost zero-cost and which threaten to establish the ‘categorical identity’ as …

Booklists: Should- And Want-To-Reads, Stephanie Wiegand, Sarah Naper
University Libraries Publications
Booklists ... librarians love them, but they also raise many questions. This session explores where today's libraries fit in the dichotomy between what we 'should read,' what we 'want to read.' Our first stop on this exploration will be the concept of a booklist. Highlights of this part of the adventure will be: testing attendee's knowledge of current booklists, a review of booklist sources, and identification of OCLC booklist highlights. The literary canon will be the second focus of our session. After defining this concept, we will ask attendees to join us in a discussion of the library's role in …

Incapacitation Through Maiming: Chemical Castration, The Eighth Amendment, And The Denial Of Human Dignity, John F. Stinneford
UF Law Faculty Publications
This year marks the tenth anniversary of California's enactment of the nation's first chemical castration law. This law requires certain sex offenders to receive, as part of their punishment, long-term pharmacological treatment involving massive doses of a synthetic female hormone called medroxyprogesterone acetate (MPA). MPA treatment is described as chemical castration because it mimics the effect of surgical castration by eliminating almost all testosterone from the offender's system. The intended effect of MPA treatment is to alter brain and body function by reducing the brain's exposure to testosterone, thus depriving offenders of most (or all) capacity to experience sexual desire …

On February 19, 1942, following the attack on Pearl HarÂÂbor and the declaration of war against Japan, President Roosevelt isÂÂsued Executive Order 9066 which empowered the Secretary of War to exclude any and all persons from designated areas in the United States. Shortly thereafter, some 120,000 civilians of Japanese descent were prohibited from living, working, or traveling on the West Coast. By October 1942, over 100,000 evacuees were relocated and conÂÂfined to ten remote internment camps for the duration of the war. The War Relocation Authority (WRA) administered these camps and had the responsibility to feed, house, educate, and provide …

Dissertations: Past, Present, And Future, Matthew D. Barton
USF Tampa Graduate Theses and Dissertations
Current policies and traditions regulating the dissertation process are responsible for a devaluation of dissertations and fail to recognize the economic and technological developments wrought by the emerging Internet. Some of the problems with the current process involve ideology, such as the insistence that dissertations be single-authored, original, and owned by someone. Others involve adherence to traditions that no longer serve a useful purpose, such as forcing authors to conform to a format better suited to a printed book than an online project. Finally, economical considerations such as the costs involved with purchasing and training authors to use advanced technology …

The Ethical Perceptions Of Salespeople And Sales Managers Concerning The Use Of Gps Tracking Systems To Monitor Salesperson Activity, Scott A. Inks, Terry W. Loe
Faculty Articles
Global Positioning Satellite (GPS) tracking systems are starting to be used by sales organizations to monitor salespeople as they drive their company cars in their territories. This paper examines and compares ethical perceptions of salespeople and sales managers regarding the use of GPS tracking technology. The results of a survey of salespeople and sales managers suggest both sales managers and salespeople perceive the use of such systems as ethical, provided the salesperson is aware of the system's installation and use. The results also indicate that while salespeople perceive the personal use of a company car as unethical, most are likely …

This paper
This paper lays out some of the basics of a language-based, person-centered, or agentic model of practice for nonprofit organizations, voluntary action and philanthropy within the emerging domain of commons theory. Six principles are identified for the practice of commons. Two threats to the production of common goods - bureaucratization and colonization of the life world - are discussed and evaluated as limitations of the practice of commons.
