Examining The Relationship Between Victim Self-Protective Behaviors And Sexual Assault Case Processing, Caralin C. Branscum

Criminology and Criminal Justice Theses and Dissertations

Sexual assault, a severely underreported crime in the US, is hindered by negative interactions between victims and criminal justice system actors’, contributing to high case attrition rates. Accordingly, understanding factors impacting case outcomes, such as criminal justice system actors’ perceptions of the victim and decision-making, is crucial. Victim self-protective behaviors—which are the range of actions, reactions, or strategies employed by individuals to mitigate or prevent harm from a crime, such as sexual assault—lack sufficient research on their impact on case processing. To fill this gap, this study analyzed 469 reported sexual assault cases, employing bivariate and multivariate analyses to assess …

An Exploration Of The Available Services For Offenders With Mental Illness (Omi), Kaliah Moulton

The study is an exploration of services available for offenders with mental illness (OMI) and obstacles to providing treatment. It aims to identify services and obstacles to delivering treatment for offenders with mental health and substance use disorders in Augusta and Rockingham Counties. Semi-structured interviews were conducted with representatives of local agencies. Based on the agencies interviewed, services for OMI vary across the Sequential Intercept Model, with services like Crisis Intervention Teams, Medication-Assisted Treatment, and supervisory housing. Participants reported that despite the variation in services, barriers in infrastructure due to poor funding, low staffing, and lack of housing were present. …

In this Essay, we briefly describe key aspects of [generative artificial intelligence] that are particularly relevant to, and raise particular risks for, its potential use by lawyers and law students. We then identify three foundational goals of clinical legal education that provide useful frameworks for evaluating technological tools like GenAI: (1) practice readiness, (2) justice readiness, and (3) client-centered lawyering. First is “practice readiness,” which is about ensuring that students have the baseline abilities, knowledge, and skills to practice law upon graduation. A profound shift is occurring in the way many decisions are made, with machines taking greater roles in the decision-making process. Two arguments are often advanced to justify the increasing use of automation and algorithms in decisions. The “Awful Human Argument” asserts that human decision-making is often awful and that machines can decide better than humans. Another argument, the “Better Together Argument,” posits that machines can augment and improve human decision-making. These arguments exert a powerful influence on law and policy.

Several decades of study have established an understanding that media have a unique power to influence the perspectives and worldviews of audiences. This phenomenon has been explored through the lenses of Social Learning and Cultivation theory, wherein media appeal to base human tendencies of self-preservation and teaches audiences how to maximize rewards for their actions by acting as a sort of instructor or friendly warning from members of the community. Behavior analysts conduct functional analyses to identify the environmental contingencies maintaining challenging behavior, which allows them to develop a function-based treatment plan. Behavioral staff must be fully trained on functional analysis methodology before conducting the analysis. A common way to train staff to conduct a functional analysis is through behavioral skills training (BST), but BST is time consuming and includes numerous materials. Teach-back, a widely used training method in healthcare settings, requires less time and no materials. INTRODUCTION: US federal policies are evolving to expand the provision of mobile treatment units (MTUs) offering medications for opioid use disorder (MOUD). Mobile MOUD services are critical for rural areas with poor geographic access to fixed-site treatment providers. This study explored willingness to utilize an MTU among a sample of people who use opioids in rural Eastern Kentucky counties at the epicenter of the US opioid epidemic.

METHODS: The study analyzed Cross-sectional survey data from the Kentucky Communities and Researchers Engaging to Halt the Opioid Epidemic (CARE2HOPE) study covering five rural counties in the state. Logistic regression models investigated the …

Effects Of Global Experiences For The Undergraduate Student, Patricia K. Adams

The purpose of this non-experimental quantitative study was to determine the effect global experiences have on undergraduate students’ self-confidence, cultural awareness, and career choice. The research took place at a single research site, a private, faith-based university in the Southeastern United States. Students who had participated in a global experience, such as a mission trip or a study abroad experience, were invited to complete the researcher-created survey, the Global Experience Exit Survey. The data from 59 undergraduate students was analyzed using SPSS, specifically one sample t-tests. The results indicated statistically significant findings for all three subconstructs. “A Cruel System Indeed”: Extending The Statute Of Limitations For Claims By The Harmed Youth Of West Virginia’S Mismanaged Foster Care System, Caroline Toler

The current statutes of limitations in West Virginia pose a barrier for harmed youth to bring suits to recover. A child who experiences sexual abuse will have 18 years to bring a civil suit. However, a child who experiences another form of abuse (e.g., psychological or emotional abuse) must bring a suit within two years. In a novel argument, this Note proposes that state legislatures, and the West Virginia State legislature in particular, should extend the statute of limitations for civil suits by former foster youth harmed while in state care. Reviving Indian Country: Expanding Alaska Native Villages’ Tribal Land Bases Through Fee-To-Trust Acquisitions, Alexis Studler

For the last fifty years, the possibility of fee-to-trust acquisitions in Alaska has been precarious at best. This is largely due to the Alaska Native Claims Settlement Act of 1971 (ANCSA), which eschewed the traditional reservation system in favor of corporate land ownership and management. Despite its silence on trust acquisitions, ANCSA was and still is cited as the primary prohibition to trust acquisitions in Alaska. Essentially, ANCSA both reduced Indian Country in Alaska and prohibited any opportunities to create it, leaving Alaska Native Villages without the significant territorial jurisdiction afforded to Lower 48 tribes. Artificial intelligence (AI)-enabled tools have produced a myriad of injuries, up to and including death. This burgeoning technology has caused scholars to ask questions, such as, How do we create a legal framework for AI? Because AI creators have acknowledged that even they do not know the capacities of their technology for good or bad outcomes, this Article argues that an existing framework, strict liability, is an appropriate fit for harms arising from this new technology because a party need not prove negligence to prevail. Nonviolent Drug Offenders Need Treatment--Not Prison: The Solution To Prison Overcrowding In West Virginia, Kendra Amick

West Virginia Law Review

A tenfold increase in prison populations has occurred due to the policies and laws enacted by the War on Drugs campaign in the United States. This increase is the direct result of a rise in the incarceration of nonviolent drug offenders. Rearrest rates for nonviolent drug-related offenders sentenced to prison are 50%. For those offenders permitted to participate in a drug court program, this rate decreases by over half. In West Virginia, the battle against the opioid epidemic has caused it to become one of the fastest-growing prison populations in the nation. With a fast-emerging crisis on the rise, West …

The artificial intelligence market is swarming. Supercharged start-ups, global tech giants, and increasingly algorithmic governments target diverse use cases with new and stunningly innovative AI applications coming online every day. Where people are the computational subjects of those algorithmic machinations, however, there is no law, present or effective, to protect them against great and propagating harms. Consequently, people become data production units, the commoditized of the Data Industrial Complex and unfree, unpaid inputs to AI production.
