In 2019, a widely disseminated video of the arrest of a six-year-old girl in her Florida elementary school provoked outrage across the country. The footage shows the girl sobbing as an armed police officer in full uniform and bullet-proof vest handcuffs and leads her from the principal’s office to a waiting patrol car. Her crime was having a temper tantrum in class after a sleepless night. When it was revealed that another six-year-old was arrested at the same school by the same officer on the same day and for similar reasons, media pundits and the general public debated questions of …

Reproductive Rights And Felony Disenfranchisement: The New Frontier Of An Old Voter Suppression Tactic, Jessie Rubini

Northwestern Journal of Law & Social Policy

Voter suppression and anti-abortion, anti-reproductive care efforts are mutually reinforcing, working together to diminish political participation, especially for women of color. I argue that politicians could use the Dobbs decision to further suppress Black voters, specifically Black women voters, by prosecuting abortions as felonies. The effect would be disenfranchisement of thousands of people. This Comment covers the connected histories of voting rights and abortion rights in America. The first section of this Comment will briefly cover the history of voting rights in America with a focus on racial discrimination. The juvenile waiver was established in 1966 with the landmark case Kent v. United States. This case deemed it constitutional to transfer youth from the juvenile court to the adult criminal court, and significant repercussions have since ensued. One issue includes the notable 3.5% increase in the recidivism rates for youth subjected to the waiver (Augustn, 2017a). The purpose of these waivers was to impose harsher punishments, particularly for serious offenses like murder, and this "tough on crime" approach gained momentum in the 1990s. In this improvement science dissertation in practice (ISDiP), a continuous improvement cycle was used to attempt to reduce office discipline referrals on the playground with 4th and 5th grade students. The intervention involved a team of peers who received training to recognize prosocial behaviors in students on the playground. Over the course of 90 days, Peer Influencers went to recess and rewarded positive behavior with Recess Compliments. A networked improvement committee (NIC) was formed to examine the effects on office discipline referrals and consider adaptations that needed to be implemented. In this Article, we offer—we believe for the first time in the scholarly literature—a potentially (at least partially) ameliorative solution to the problems faced by persons with autism (ASD) and fetal alcohol disorder (FASD) in the criminal justice system: the creation of (separate sets of) problem-solving juvenile mental health courts specifically to deal with cases of juveniles in the criminal justice system with ASD, and with FASD. Over the past few decades, studies have shown a relationship between childhood abuse and neglect and juvenile justice system involvement. Additionally, the United States supervises and incarcerates more youth than other established country. This process—from abuse to incarceration—has become known as the abuse-to-prison pipeline or victimization-to-imprisonment. Many traumatized youth find themselves responding to their trauma with behaviors deemed delinquent (e.g., skipping school and running away) which then begins their path into the juvenile justice system. The process of punitive disciplinary processes are shifting in K-12 educational institutions. This study explored the implementation of a school-wide disciplinary process that integrates the philosophy of restorative justice and its practices. The goal of the study was to reduce the amount of punitive punishment, address social issues of bullying and discrimination, and improve the overall school climate. While the public debates whether law enforcement has a problem with mis- or over-using force, the field lacks critical information concerning how often officers use force in their dealings with citizens. Consequently, the various reforms proposed have little evidence supporting them. Using data from Mapping Police Violence combined with census and LEOKA data, we examine the impact of U.S. Supreme Court jurisprudence and the restrictions that each state placed on law enforcement’s ability to use force and what constituted reasonable force within each state. The cyberpunk genre dominates much of our popular culture, from how we think of cyber- and white-collar crime, to our understanding of how technology influences the criminal justice system. This article explores the common criminological themes prevalent within the recent video game Cyberpunk 2077 as an example of popular criminology. Specifically, it explores the game’s story and environment by examining key characters’ responses to structural inequalities through an anomie theory lens. Key characters and groups within the game exemplify Merton’s (1938) different responses to rampant poverty and socioeconomic inequality. Thus, the game can be used to explore how cultural goals …

Far too many juveniles are incarcerated in juvenile correctional facilities, and in some cases, waived into the adult criminal legal system. Life course theory helps explain this pathway as many of these youth grow up in poverty-stricken environments, with restricted access and poor quality of schooling, during which they may experience abuse and neglect, leading them into the school-to-prison pipeline. Likewise, youth experiencing Adverse Childhood Experiences (ACEs)—forms of abuse, neglect, and household dysfunction—endure the additional abuse-to-prison pipeline. Once incarcerated, these youth experience reentry issues when attempting to successfully transition back into their homes and communities. However, this issue starts before …

A Window Of Opportunity: Describing Participants Engaged In A Comprehensive Perinatal Care Model To Treat Substance Use Disorder During Pregnancy, Christina Jäderholm

In 2019, 12% of pregnant persons were estimated to use psychoactive substances, the highest rate in US history. Substance use disorder (SUD) is a chronic, relapsing condition, and while pregnancy presents a unique opportunity for SUD intervention, research on pregnant and postpartum SUD patient experiences is vital for informing perinatal systems of care. The purpose of this presentation is to describe a sample from SUN, a comprehensive perinatal care program for pregnant persons with SUD in North Carolina.

Methods

What Can We Learn About Teaching Excellence From Our Students? Lessons From Six Years Of Teaching Award Data, Christopher Shortell, Kris Henning, Carl Christiansen

Political Science Faculty Publications and Presentations

Teaching excellence in higher education can be defined and studied in different ways, but research efforts to date have often focused on institutional or instructor perspectives. This article uses a data set of over 500 open-ended comments submitted by Political Science undergraduates as part of a teaching award process to identify themes that matter most to students. We find that being supportive, bringing humor, enthusiasm, and passion to the classroom, and engaging students with relevant, challenging, and exciting activities are what defines teaching excellence from a student’s perspective. Overlooked Psychometrics: An Examination Of The Construct Validity Of The Level Of Service/Case Management Inventory (Ls/Cmi), Agnieszka M. Nogalska

Construct validity is an important and under-examined source of evidence contributing to the psychometric properties of risk assessment instruments. This study assessed the construct and predictive validities of the LS/CMI examining a sample of 95 incarcerated male participants in the Northeastern United States. Results support a two-factor structure for the instrument, with the Criminal History, Education/Employment, Procriminal Attitude, and Antisocial Pattern subscales demonstrating convergence with other well-validated measures of these constructs. The results further suggest relatively weak discriminative ability for predicting recidivism (AUC = 0.67). Exposure to physical and psychological trauma has produced a post-millennial epoch of posttraumatic stress disorder (PTSD), a debilitating anxiety disorder that occurs after exposure to an extreme stressor or prolonged victimization. After an extensive review of treatment protocols in 2008, the Institute of Medicine (IOM) exhorted clinicians to focus on defining the concept of recovery, concentrating on symptom reduction, removal of the PTSD diagnosis, and end-state function. Although the IOM report mobilized large-scale efforts to quantify treatments and standardize delivery of treatment protocols, PTSD recovery remains a concept that has been largely unexplored. A 2004 literature review commissioned by the U.S. Department of Education estimated that one in every ten students would experience sexual harassment or abuse at the hands of an educator during their time in public schools. Even more alarming, multiple studies within Shakeshaft’s 2004 review suggested that this issue goes well beyond the reported data. At that time, leading social science research estimated that only 6% of children who were victims of educator sexual misconduct reported it. Watson Institute for Urban Policy and Research at Kean University, in partnership with New Jersey Legislative Black Caucus, under the leadership of the Honorable Assemblywoman Shavonda E. Sumter, hosted a series of community conversations to bolster the statewide urban policy agenda on collaborative, evidence-informed solutions to prevent and reduce violence in urban centers and for all New Jerseyans.
