The signing of the first international AI treaty by the United States, European Union, and other nations marks a pivotal step in establishing a global framework for AI governance, ensuring that AI systems respect human rights, democracy, and the rule of law. This article advances the concepts of justice, equity, and the rule of law as yardsticks of socially responsible AI—from development through deployment—to ensure that AI technologies do not exacerbate existing inequalities but actively promote fairness and inclusivity. In his 2022 book, Ward Farnsworth crafts a metaphor from the lead-pipe theory for the fall of Rome to consider how rage and misinformation traveling through today’s technology-enabled pipes are poisoning our civic engagement and threatening our governmental structures: “We have built networks for the delivery of information––the internet, and especially social media. These networks too, are a marvel. But they also carry a kind of poison with them. The Italian Mafia, encompassing groups like the Cosa Nostra, Camorra, and 'Ndrangheta, has historically exerted significant influence across Italy’s economy and governance through criminal and legitimate enterprises. This thesis investigates the Mafia’s infiltration into the waste management and retail sectors, employing a mix of economic data analysis and theoretical frameworks to uncover the mechanisms and extent of their impact. Using publicly available data from Bloomberg Terminal, the United Nations Office on Drugs and Crime (UNODC), and the Italian National Institute of Statistics (ISTAT), this study examines indicators such as corruption, extortion, money laundering, environmental crimes, and drug trafficking.

In this paper, I investigate the paradox revealed by the Young Thug trial where certain portrayals of Blackness in rap music are simultaneously praised and punished by white institutions. I propose that the theatrics of the Young Thug trial and other instances of rap lyrics used in criminal trials are emblematic of what I call the Black Spectacle. The Black Spectacle is the role Blackness plays in American entertainment. It has three elements: (1) It entertains white audiences because of Black people’s perceived otherness, (2) it provides white people, particularly white men, with a vehicle through which they can …

During and for some period after the COVID-19 pandemic, there was considerable international recognition of the phenomenon dubbed “wolf warrior” diplomacy, where Chinese diplomats acted in an unusually unprofessional manner, often leveraging ad hominem attacks, violent rhetoric, and occasionally physical aggression to communicate specific points. In this paper, I question the fundamental assumptions that we make of “wolf warriors” – that they are young, early-career professionals that acted only during and after the height of the COVID-19 pandemic – and find instead that “wolf warriors” are often mid-career professionals. Technological advancements in big data and algorithmic modeling have contributed to the rise of advanced predictive policing techniques. Law enforcement agencies utilize these tools to predict and prevent crime before it occurs. However, these techniques have been the subject of extensive ethical debates, particularly regarding their potential to reinforce racial biases. This thesis provides a historical overview and analysis of a prominent example of people-based predictive policing: the Chicago Police Department’s Strategic Subject List (SSL) program. Social Impact Bonds (SIBs) are a form of outcomes-based financing that fund social programs by shifting financial risk from the government to private investors. While SIBs have gained international traction, their long-term viability in the United States depends on structural reforms. This thesis examines two completed U.S. SIB projects, Rikers Island in New York and the Just-in-Reach project in Los Angeles, through an analysis of their design, implementation, and outcomes. While both projects focus on criminal justice, they provide context about the scalability of SIBs across multiple social policy areas.The three primary constraints are high transaction costs, limited investor interest, …

Maternal health outcomes in the U.S. are remarkably poor, especially when compared to those in other industrialized countries. For example, our maternal death rate is more than twice that of Canada’s. Women of color in the U.S. suffer maternal morbidity and mortality at rates considerably higher than white women. Indigenous women experience the worst maternal health outcomes of all. Yet, most maternal deaths and injuries are preventable. Furthermore, rates of maternal harm, including death, are lower when midwives and similar birthing attendants are involved. This Article is the first to fully explore the unique skillset of traditional birth attendants (TBAs). …

Legislators come from a range of backgrounds. Many legislators happen to be lawyers. Parliamentary rules typically allow legislators who are not members of Cabinet to practice a profession part-time. However, the part-time practice of law poses special legal ethics challenges. In this article, we consider the legal ethics issues that arise when a backbench legislator of the governing party practices criminal defence law part-time. We argue that such a dual role engages three serious, unavoidable, and perhaps even unresolvable legal ethics issues. The first issue is the time constraints imposed by outside interests. Crown prosecutors and government lawyers are reliant on governments for their funding but exert no meaningful influence or control over such funding decisions. Nonetheless, this article demonstrates that as a question of law, under-funded Crown prosecutors and government lawyers risk violating their professional duties. If so, they must promptly inform the government, refuse new matters and, if necessary, withdraw from existing matters. If the government purports to block such refusal or withdrawal and does not provide adequate funding, resignation will become necessary. While law societies will likely not prioritize disciplinary action against such lawyers, the policy reasons to forego such …

While there is extensive legal literature and case law addressing the role and ethical responsibilities of Crown attorneys, questions about that role and those responsibilities at the appellate stage are largely absent from the literature and somewhat scattered across the case law. In this article, the authors seek to address this gap by answering four key questions. The first is whether the ethical obligations of the Crown, as expressed in R. v. Social inequalities that lead to criminal conduct are often not considered in sentencing; individuals subject to structural inequities receive the same formal sentence as those convicted of like crimes irrespective of the latter’s social advantage. Individual characteristics may also affect how a sentence will be experienced by an individual. While Characteristics and Experience-Sensitive Sentencing (CESS) already exists in various forms and to various degrees in sentencing theory and praxis, a more cohesive, comprehensive, and principled CESS remains wanting. Technology-facilitated sexual violence (TFSV) is a pervasive issue, yet research on the availability, accessibility, and effectiveness of services for TFSV victimsurvivors remains limited, particularly in Canada. This qualitative study examines the state of service provision for TFSV in Nova Scotia, drawing on insights from 12 interviews with service providers specializing in sexual violence prevention and response. The study explores the availability and nature of services offered to TFSV victim-survivors and the key challenges faced by professionals in providing support. In this conceptual paper, we consider novel avenues for development in the Anglophone Caribbean by addressing the historical heritage of chattel slavery, Indigenous dispossession, and extractive capitalism and their pivotal roles in shaping capitalist modernity. Our analysis encompasses the historical configurations of the development paradigm, elucidating the impact of colonial violence, extractive and racial capitalism, and the resulting material and epistemic repercussions. Positioned within the conceptual framework of reparations, we propose restructuring the aid system and asserting the right to epistemic autonomy as two strategic avenues for reshaping the current developmental trajectories of Caribbean societies.

Acts of voter harassment are often difficult to prevent. One longstanding, albeit underused, tool for addressing such harassment is found in section 11(b) of the Voting Rights Act (VRA). Continued use of the provision, however, is threatened by recent decisions restricting private enforcement of the VRA. This Essay examines one challenge to such enforcement, exploring the linkage between section 11(b)’s prohibition on voter intimidation and the enforcement of constitutional voting guarantees, on which private enforcement of the provision presently depends. When a child commits a crime, how do states determine if that child is culpable? There are procedural rules that determine the forum for a minor’s trial and doctrines that limit children’s exposure to the most severe sentencing. But when it comes to culpability, states employ the same substantive law whether the defendant is 50 or 15. As this Article explains, that approach is profoundly flawed. In the early 21st century, in a series of cases known as the Miller trilogy, the United States Supreme Court established that youth are fundamentally different from adults and state sentencing practices must recognize …

Recent legislation, exemplified in statutes from California and Washington, creates new methods for resentencing defendants in old cases. These laws place controlling authority for resentencing in the hands of local officials, especially local prosecutors, and invite variation at the county level.
While some new procedural channels for reducing the sentences of people convicted of past crimes are mandatory, in that they entitle certain defendants to resentencing if they were convicted of certain crimes or were subject to certain penalty enhancements that are no longer valid, other statutes create discretionary resentencing channels. In this study, we investigated the extent to which law enforcement efforts predicted drug and other kinds of illicit yield in search warrant executions. The data are drawn from one major metropolitan police department during 2005, 2009, and 2012. Using multilevel random intercept logistic regression models and multilevel random intercept multinomial logistic regression models, we regress high yields of various kinds of drugs and other illicit items seized during searches on the investigative activities that led to search warrant applications and the enlistment of teams of officers or other agencies in executing the search. Lack of access to evidence-based care for drug addiction is an urgent problem amid a decades-long overdose crisis that kills tens of thousands of Americans a year. Opioid addiction is the primary driver of overdoses today, and medicines exist to treat such addiction that can dramatically improve quality of life while reducing the risk of deadly overdose by more than half. Yet fewer than one in four of the nine million Americans who need such evidence-based medical care for their addiction receive it. งานวิจัยเรื่อง “ความหวาดกลัวของประชาชนต่อเหตุการณ์กราดยิงในเขตกรุงเทพมหานคร” มีวัตถุประสงค์เพื่อศึกษาปัจจัยส่วนบุคคล การรับรู้ข่าวสาร และทัศนคติต่อประสิทธิภาพการทำงานของตำรวจที่มีอิทธิพลต่อระดับความหวาดกลัวของประชาชนต่อเหตุการณ์กราดยิงในเขตกรุงเทพมหานคร เพื่อเสนอแนวทางเชิงนโยบายในการป้องกันและลดความวิตกกังวลของประชาชนต่อภัยอาชญากรรมรุนแรงในพื้นที่สาธารณะ การศึกษานี้ใช้ระเบียบวิธีวิจัยเชิงปริมาณโดยเก็บข้อมูลจากกลุ่มตัวอย่างจำนวน 396 คน ในเขตปทุมวัน กรุงเทพมหานคร ครอบคลุมกลุ่มนิสิตนักศึกษา ผู้ใช้บริการห้างสรรพสินค้า และผู้ใช้พื้นที่สาธารณะทั่วไป ซึ่งเป็นกลุ่มที่มีความเสี่ยงหรือเกี่ยวข้องกับเหตุการณ์ลักษณะดังกล่าว โดยใช้แบบสอบถามที่ผ่านการตรวจสอบความเที่ยงตรงและความเชื่อมั่นทางสถิติเป็นเครื่องมือในการวิจัย วิเคราะห์ข้อมูลโดยใช้สถิติเชิงพรรณนาและเชิงอนุมาน ได้แก่ การทดสอบค่า t การวิเคราะห์ความแปรปรวน เพื่อเปรียบเทียบความแตกต่างของระดับความหวาดกลัวระหว่างกลุ่ม รวมถึงวิเคราะห์การถดถอยอย่างง่ายเพื่อทดสอบอิทธิพลของตัวแปรอิสระผลการศึกษาพบว่า ปัจจัยส่วนบุคคลด้านเพศ มีความสัมพันธ์อย่างมีนัยสำคัญทางสถิติกับระดับความหวาดกลัว โดยกลุ่มเพศหญิงมีระดับความหวาดกลัวมากกว่า ขณะที่ปัจจัยด้านช่วงอายุไม่พบความแตกต่างอย่างมีนัยสำคัญ พบว่าการรับรู้ข่าวสารเกี่ยวกับเหตุการณ์กราดยิงจากสื่อมวลชนและสื่อออนไลน์ส่งผลให้ระดับความวิตกกังวลเพิ่มขึ้นอย่างชัดเจน และพบว่าทัศนคติต่อประสิทธิภาพการทำงานของตำรวจมีความสัมพันธ์ในทางลบกับความหวาดกลัว กล่าวคือ ผู้ที่เชื่อมั่นในความสามารถของตำรวจจะมีความกลัวน้อยกว่า ผลการศึกษาโดยรวมชี้ให้เห็นว่าความหวาดกลัวต่อเหตุการณ์กราดยิงไม่เพียงเป็นปฏิกิริยาทางจิตวิทยาต่ออาชญากรรมเท่านั้น แต่ยังสะท้อนความรู้สึกไม่มั่นคงในสังคมเมืองสมัยใหม่ งานวิจัยนี้เสนอแนวทางการวางแผนการป้องกันและรับมือกับเหตุการณ์กราดยิง โดยให้รัฐและหน่วยงานที่เกี่ยวข้องบูรณาการมาตรการทั้งสามระดับอย่างเป็นระบบ ได้แก่ มาตรการด้านพื้นที่และโครงสร้างกายภาพเพื่อเพิ่มประสิทธิภาพในการเฝ้าระวัง มาตรการด้านสถาบันและการปฏิบัติการเพื่อจัดกำลังตามความเสี่ยงและยกระดับความพร้อมในการตอบสนองเหตุฉุกเฉิน และมาตรการด้านการสื่อสารความเสี่ยงเพื่อสร้างความเชื่อมั่นและลดความตื่นตระหนกของประชาชน ซึ่งการประสานกลไกทั้งสามระดับจะช่วยลดทั้งความเสี่ยงเชิงจริงและความหวาดกลัวเชิงรับรู้ พร้อมเสริมสร้างสภาพแวดล้อมเมืองที่ปลอดภัยและยั่งยืนยิ่งขึ้น

การสร้างเมืองปลอดภัยเพื่อป้องกันปัญหาอาญากรรม ยังประสบสภาพปัญหาช่องว่างเชิงนโยบาย (Gaps for Policy Formulation) การกำหนดตัวชี้วัดให้สอดคล้องในพื้นที่ (Contextual Index) และสภาพปัญหาด้านการคำนึงถึงผู้มีส่วนได้เสีย (Stakeholders Concern) ส่งผลให้การกำหนดนโยบายขาดความชัดเจนและอาจไม่สอดคล้องกับบริบทในพื้นที่ ผู้วิจัยจึงมุ่งศึกษาสภาพปัญหาและนำเสนอนโยบาย “เมืองปลอดภัยเชิงรุก (Pro-Active Safe City)” เพื่อแก้ไขปัญหาช่องโหว่ของการตีความและการกำหนดเป้าหมายผ่านตัวชี้วัด โดยนำร่องการศึกษาในพื้นที่ศึกษา ต.บ้านโพธิ์ อ.เมือง จ.สุพรรณบุรี โดยดำเนินการวิจัยแบบผสมผสานระหว่างการเก็บข้อมูลเชิงปริมาณ - เชิงคุณภาพ การออกแบบเชิงบูรณาการตามหลัก 4D Design Thinking และการวิเคราะห์เชิงพื้นที่ (Spatial Analysis) โดยริเริ่มสำรวจด้วยดัชนีตัวชี้วัดความปลอดภัยเชิงกายภาพรายพื้นที่ (Crime Vector Index: CVI) จากการสำรวจออนไลน์ ประชากรจำนวน 382 ราย เพื่อประเมินความเสี่ยงและความต้องการ และการเก็บข้อมูลเชิงคุณภาพผ่านการสัมภาษณ์เชิงลึกผู้บริหารและผู้แทนท้องถิ่นจำนวน 7 ราย และการจัดอภิปรายกลุ่มสำหรับภาครัฐ-ภาคประชาชนจำนวน 25 ราย ทั้งนี้ ผลการศึกษาวิจัย พบว่า ประชาชนในพื้นที่มีความต้องการให้เน้นย้ำกลไกการสร้างพื้นที่ส่วนกลางสำหรับการใช้ชีวิตร่วมกันและการพักผ่อน (ร้อยละ 25.13) การติดตั้งเสาไฟส่องสว่าง (ร้อยละ 21.20) และการสร้างอาสาสมัครชุมชนช่วยลาดตระเวนในพื้นที่ (ร้อยละ 14.66) และประชาชนในพื้นที่มีความกังวลต้องรับมือความเสี่ยงของอาชญากรรม โดยต้องการมุ่งเน้นการปกป้องความปลอดภัยในชีวิต การแก้ไขปัญหาพื้นที่เสี่ยง สกัดกั้นความเสี่ยงจากภัยภายนอก ในขณะที่ความเข้มแข็งทางสังคมและการสร้างแนวร่วมเฝ้าระวังภัยอาชญากรรมเป็นกลไกสำคัญ และการสร้างพื้นที่ส่วนกลาง ขยายโอกาสในการใช้พื้นที่ร่วมกันและเศรษฐกิจในพื้นที่ ฉะนั้น แนวทางการสร้างเมืองปลอดภัยสำหรับพื้นที่ จึงนำเสนอในรูปแบบเมืองปลอดภัยเชิงผสมผสาน โดยออกแบบมิติความปลอดภัยเชิงกายภาพผ่านการติดตั้งอุปกรณ์และเทคโนโลยีเฝ้าระวังจุดเสี่ยงบริเวณพื้นที่รอยต่อ และมิตินามธรรมผ่านกลไกสร้างชุมชนเข้มแข็งให้เป็น “หุ้นส่วนความปลอดภัยสาธารณะ (Strategic Partnership for Public Security)” และสร้างความสมดุลระหว่างสังคม - เทคโนโลยีโดยเน้นย้ำการมีส่วนร่วม (Engagement) จากผู้มีส่วนได้เสียทุกภาคส่วน (Stakeholders) สร้างความตระหนักการรู้สึกเป็นเจ้าของพื้นที่ (Sense of Belonging) เป็นพลเมืองตื่นรู้ (Active Citizen) เพื่อป้องกันอาชญากรรมพื้นฐาน (Street Crimes) และยาเสพติด และยกระดับสู่การสร้างข้อเสนอแนะเชิงปฏิบัติการ เพื่อแนะนำกระบวนการและขั้นตอนการปฏิบัติ และธรรมาภิบาลด้านเมืองปลอดภัย ด้านกฎ …

งานวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาประสิทธิภาพของการบังคับใช้กฎหมายจราจรเกี่ยวกับความผิดเมาแล้วขับ (2) วิเคราะห์ปัญหาและสาเหตุที่เป็นอุปสรรคต่อการบังคับใช้กฎหมาย และ (3) เสนอแนวทางพัฒนาการบังคับใช้กฎหมายให้เกิดประสิทธิภาพยิ่งขึ้น โดยมุ่งเน้นกรณีศึกษาในพื้นที่กรุงเทพมหานครซึ่งเป็นเขตเมืองที่มีความหนาแน่นของประชากรและยานพาหนะสูง การวิจัยใช้ระเบียบวิธีเชิงคุณภาพ ผู้ให้ข้อมูลสำคัญจำนวน 7 ราย ประกอบด้วยเจ้าหน้าที่ตำรวจจราจรในสังกัดกองบัญชาการตำรวจนครบาล 3 ราย ผู้พิพากษาและพนักงานอัยการในเขตกรุงเทพมหานคร 3 ราย และนักวิชาการด้านอาชญาวิทยาและนโยบายกฎหมายจราจร 1 ราย การวิเคราะห์ข้อมูลใช้การวิเคราะห์เนื้อหา ผลการศึกษาพบว่า ประสิทธิภาพการบังคับใช้กฎหมายเมาแล้วขับในพื้นที่กรุงเทพมหานครยังไม่บรรลุเป้าหมายด้านการยับยั้ง แม้กรอบกฎหมายจะกำหนดบทลงโทษไว้ค่อนข้างครบถ้วน แต่การบังคับใช้ในทางปฏิบัติยังขาดความต่อเนื่องและความสม่ำเสมอ โดยมักเข้มงวดเฉพาะช่วงเทศกาลหรือวันหยุดยาว ประกอบกับข้อจำกัดด้านกำลังคน อุปกรณ์ตรวจวัด และเทคโนโลยีสนับสนุน รวมถึงช่องโหว่ของกระบวนการยุติธรรม เช่น การลงโทษสถานเบาในบางกรณี การติดตามผู้กระทำผิดซ้ำที่ไม่เข้มแข็ง และการขาดฐานข้อมูลกลางเชื่อมโยงระหว่างหน่วยงาน ส่งผลให้ความแน่นอนของบทลงโทษลดลงและพลังในการป้องปรามไม่เพียงพอ จากผลการวิจัย เสนอให้พัฒนาการบังคับใช้กฎหมายในเชิงระบบ ได้แก่ การสุ่มตรวจอย่างทั่วถึงตลอดปี การจัดสรรทรัพยากรให้เพียงพอ การปรับปรุงกฎหมายและกระบวนการเพื่อเพิ่มความแน่นอนของบทลงโทษ โดยเฉพาะต่อผู้กระทำผิดซ้ำ การพัฒนากลไกบูรณาการและฐานข้อมูลกลาง การใช้เทคโนโลยีสนับสนุนควบคู่มาตรการฟื้นฟูและการสร้างจิตสำนึกทางสังคม เพื่อยกระดับประสิทธิภาพการบังคับใช้กฎหมายเมาแล้วขับอย่างยั่งยืน

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษารูปแบบการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ของพนักงานรัฐวิสาหกิจในปัจจุบัน ศึกษาระดับการตระหนักรู้ในการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ของพนักงานรัฐวิสาหกิจ และศึกษาแนวทางการป้องกันในการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ของพนักงานรัฐวิสาหกิจ เป็นการวิจัยเชิงปริมาณ กลุ่มตัวอย่างคือ พนักงานการไฟฟ้าฝ่ายผลิตแห่งประเทศไทย (กฟผ.) จำนวน 400 คน โดยการสุ่มตัวอย่างแบบง่าย ผลการวิจัยพบว่า รูปแบบการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ของพนักงาน กฟผ. ในปัจจุบัน คือ ภัยจากการหลอกลวง ภัยจากมัลแวร์และไวรัส ภัยจากการเข้าถึงโดยไม่ได้รับอนุญาต ภัยจากเนื้อหาที่เป็นอันตราย และ ภัยทางอ้อมอื่นๆ มีระดับการตระหนักรู้ในการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ และมีระดับพฤติกรรมการป้องกันตนเองจากการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ ในระดับมากที่สุด หากแต่มีประสบการณ์ตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ส่วนมาก ในระดับน้อย การทดสอบสมมุติฐาน พบว่า ไม่มีความสัมพันธ์ระหว่างเพศ ระดับการศึกษา อายุการทำงาน ระดับการทำงาน ต่อการตระหนักรู้ในการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ นอกจากนี้ประสบการณ์ตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ไม่มีความสัมพันธ์กับการตระหนักรู้ในการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ และพฤติกรรมการป้องกันตนเองจากการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ ในขณะที่การตระหนักรู้ในการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์มีความสัมพันธ์กับพฤติกรรมการป้องกันตนเองจากการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ อย่างมีนัยสำคัญทางสถิติที่ระดับ 0.05 โดยมีผลบวก คือ พนักงาน กฟผ.ที่มีระดับการตระหนักรู้ในการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์มาก จะมีพฤติกรรมการป้องกันตนเองจากการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์มาก แนวทางการป้องกันในการตกเป็นเหยื่ออาชญากรรมทางไซเบอร์ของพนักงาน กฟผ. คือ ความมีสติและความรอบคอบ การตรวจสอบและยืนยันข้อมูล การปฏิเสธและป้องกัน และการจัดการและปฏิบัติเพื่อลดความเสี่ยงหรือแก้ไขปัญหาที่เกิดขึ้น ข้อเสนอแนะของการศึกษาคือ การจัดตั้งหน่วยงานและระบบเฉพาะ การประชาสัมพันธ์ให้ความรู้จากภาครัฐ การศึกษาและสร้างความตระหนักรู้ การมีสติ และการระมัดระวัง

การวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษามาตรการด้านความปลอดภัยสำหรับนักท่องเที่ยวต่างชาติในจังหวัดเชียงใหม่ตั้งแต่อดีตถึงปัจจุบัน (2) วิเคราะห์สถานการณ์ สภาพปัญหา จุดแข็ง และจุดอ่อนของมาตรการดังกล่าว และ (3) พัฒนามาตรการด้านความปลอดภัยที่เหมาะสมต่อบริบทจังหวัดเชียงใหม่ การวิจัยใช้วิธีการเชิงคุณภาพผ่าน การสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ 23 คน ประกอบด้วยข้าราชการ ภาคเอกชน และนักท่องเที่ยวต่างชาติ รวมทั้ง การวิเคราะห์ข้อมูลสถิติคดีอาชญากรรมที่เกิดกับนักท่องเที่ยวในช่วงปี พ.ศ. 2563–2568ผลการศึกษาพบว่า มาตรการด้านความปลอดภัยในอดีตมุ่งเน้นการใช้กำลังคนและการตั้งจุดตรวจในพื้นที่ท่องเที่ยว ขณะที่ปัจจุบันพัฒนาไปสู่การบริหารจัดการเชิงรุกและการบูรณาการระหว่างหน่วยงาน โดยมีการใช้เทคโนโลยีขั้นสูง เช่น กล้อง AI ระบบ Biometric แอปพลิเคชัน CM-CHANA ระบบขนส่งสาธารณะประเภทไฟฟ้าความเร็วต่ำ รวมถึงการจัดตั้งศูนย์ปฏิบัติการด้านความปลอดภัยการท่องเที่ยว การทำ MOU กับผู้ประกอบการ และการมีส่วนร่วมของภาคเอกชน เช่น หอการค้า สมาคมมัคคุเทศก์ และสมาคมโรงแรมจุดแข็งสำคัญของจังหวัดเชียงใหม่ ได้แก่ ความร่วมมือภาคเอกชนและชุมชนที่เข้มแข็ง นวัตกรรมด้านเทคโนโลยี ภาพลักษณ์ด้านความปลอดภัยที่ดี และการมีส่วนร่วมของสถาบันการศึกษา อย่างไรก็ตาม จุดอ่อนสำคัญ ได้แก่ การทำงานแบบแยกส่วนฐานข้อมูลไม่เชื่อมโยงกัน ช่องโหว่ด้านกฎหมายที่ทำให้การดำเนินคดีในกรณีผู้เสียหายเป็นชาวต่างชาติดำเนินการได้ยาก การสื่อสารความปลอดภัยเชิงรุกยังไม่ถึงนักท่องเที่ยว และความคลาดเคลื่อนของนิยาม “ความปลอดภัย” ระหว่างรัฐและนักท่องเที่ยว โดยนักท่องเที่ยวให้ความสำคัญกับอุบัติเหตุและมลพิษ PM2. 5 มากกว่าอาชญากรรมแนวทางพัฒนาที่เสนอ ได้แก่ การจัดตั้ง “ศูนย์ข้อมูลอัจฉริยะด้านความปลอดภัยการท่องเที่ยวเชียงใหม่” เพื่อบูรณาการข้อมูลระหว่างหน่วยงาน การพัฒนาแอปพลิเคชันที่รองรับการสื่อสารหลายภาษาและระบบแจ้งเหตุฉุกเฉิน การสร้างเครือข่ายความร่วมมือระหว่างรัฐ เอกชน การขยายอาสาสมัครความปลอดภัยสู่ชุมชนรอง การนำแนวคิด Tourism Risk Governance มาประยุกต์เพื่อให้ความปลอดภัยครอบคลุมสุขภาพและภัยพิบัติ รวมทั้งพัฒนามาตรการเพื่อกลุ่มเปราะบาง พร้อมทั้งเสนอให้ตราข้อบัญญัติท้องถิ่นและจัดตั้งกองทุนด้านความปลอดภัยการท่องเที่ยว เพื่อสร้างความยั่งยืนด้านงบประมาณและการบริหารจัดการ รวมถึงความร่วมมือระดับภูมิภาคในการรับมืออาชญากรรมข้ามชาติ

การศึกษาวิจัยเรื่อง “เส้นทางสู่วาระท้ายของผู้ต้องขังที่ป่วยในเรือนจำ” เป็นการวิจัยเชิงคุณภาพที่มุ่งสะท้อนประสบการณ์ของผู้ต้องขังป่วยระยะท้ายผ่านการสร้างเรื่องเล่า (Narrative) เพื่อทำความเข้าใจสภาวะและความหมายของการดำรงอยู่ในช่วงวาระสุดท้ายภายใต้ข้อจำกัดของเรือนจำ ผู้วิจัยดำเนินการศึกษาข้อมูลจากเอกสาร (Documentary Study) ทั้งหนังสือ บทความทางวิชาการ รายงานการวิจัย และวิทยานิพนธ์ที่เกี่ยวข้อง ทั้งในและต่างประเทศ โดยเน้นประเด็นด้านแนวคิดและทฤษฎีการดูแลผู้ป่วยระยะสุดท้าย การดูแลแบบประคับประคอง (Palliative Care) สิทธิขั้นพื้นฐานของผู้ต้องขังตามหลักสิทธิมนุษยชน มาตรฐานสากลด้านสิทธิเสรีภาพของผู้ต้องขัง ตลอดจนกรอบสิทธิมนุษยชนระหว่างประเทศเป็นฐานในการวิเคราะห์ นอกจากนี้ งานวิจัยยังพิจารณาปัจจัยเชิงระบบที่มีผลต่อการดูแลผู้ต้องขังป่วยระยะท้าย เช่น ความแออัดของเรือนจำ โครงสร้างพื้นฐานด้านสาธารณสุข ความพร้อมของบุคลากรทางการแพทย์ และข้อจำกัดด้านทรัพยากร ตลอดจนศึกษาแนวปฏิบัติในต่างประเทศซึ่งมีการพัฒนาระบบการดูแลผู้ต้องขังป่วยระยะท้ายอย่างเป็นรูปธรรมมากกว่า ได้แก่ ประเทศสหราชอาณาจักร ฝรั่งเศส และสหรัฐอเมริกา ซึ่งมีรูปแบบบริการด้านการดูแลประคับประคองในเรือนจำตั้งแต่การจัดตั้งหน่วยดูแลเฉพาะทาง การพัฒนาอาสาสมัครผู้ต้องขัง ไปจนถึงกลไกการปล่อยตัวด้วยเหตุผลด้านมนุษยธรรม การเก็บข้อมูลภาคสนามใช้การสัมภาษณ์เชิงลึก (In-depth Interview) จากผู้ให้ข้อมูลสำคัญ (Key Informants) ได้แก่ แพทย์ พยาบาลวิชาชีพ นักทัณฑวิทยาที่มีประสบการณ์ดูแลผู้ต้องขังป่วยระยะท้าย และผู้ต้องขังจำนวน 2 นายที่กำลังเผชิญภาวะป่วยระยะสุดท้าย ข้อมูลที่ได้ถูกนำมาวิเคราะห์เพื่อสร้างภาพรวมของประสบการณ์ในวาระสุดท้ายของผู้ต้องขังในด้านร่างกาย จิตใจ จิตสังคม และจิตวิญญาณ รวมถึงอุปสรรคที่พบในการเข้าถึงบริการสุขภาพภายในเรือนจำ ผลการศึกษาคาดว่าจะสะท้อนให้เห็นถึงความท้าทายสำคัญของการดูแลผู้ต้องขังป่วยระยะท้ายภายใต้ข้อจำกัดด้านทรัพยากร โครงสร้างพื้นที่ และระบบบริการสาธารณสุขในเรือนจำ อาทิ การดูแลรักษาที่ไม่ต่อเนื่อง การขาดบริการเฉพาะทางด้านประคับประคอง และความจำกัดในการตอบสนองความต้องการทางจิตใจและจิตวิญญาณของผู้ต้องขัง นอกจากนี้ การศึกษายังมุ่งเสนอแนวทางพัฒนาระบบการดูแลผู้ต้องขังป่วยระยะท้ายในเรือนจำไทยให้มีลักษณะครอบคลุมและสอดคล้องกับมาตรฐานสากล โดยเน้นความสำคัญของการดูแลแบบองค์รวม การเคารพศักดิ์ศรีความเป็นมนุษย์ และการสนับสนุนให้ผู้ต้องขังมีคุณภาพชีวิตที่ดีที่สุดในช่วงวาระสุดท้ายของชีวิต

การศึกษาวิจัยในครั้งนี้ มีวัตถุประสงค์เพื่อศึกษารูปแบบและลักษณะการฉ้อโกงธุรกรรมอิเล็กทรอนิกส์ และแนวทางการใช้เทคโนโลยีปัญญาประดิษฐ์สำหรับการป้องกันการฉ้อโกงดังกล่าว เพื่อนำมาพิจารณาสำหรับการออกมาตรการหรือแนวนโยบายสำหรับป้องกันการฉ้อโกงธุรกรรมอิเล็กทรอนิกส์โดยการใช้เทคโนโลยีปัญญาประดิษฐ์ที่เหมาะสมภายใต้บริบทของประเทศไทย โดยอาศัยวิธีการวิจัยเชิงคุณภาพผ่านการค้นคว้าเชิงเอกสาร การศึกษาผ่านกรณีศึกษา รวมถึงการสัมภาษณ์เชิงลึกกับผู้เชี่ยวชาญจากหน่วยงานต่าง ๆ ที่เกี่ยวข้องทั้งภาคการเงินและธนาคาร หน่วยงานรัฐ หน่วยงานกำกับดูแล รวมไปถึงผู้เชี่ยวชาญด้านเทคโนโลยีปัญญาประดิษฐ์ และกฎหมายที่เกี่ยวข้อง ซึ่งผลการศึกษาพบว่า รูปแบบและลักษณะการฉ้อโกงธุรกรรมอิเล็กทรอนิกส์ยังคงอาศัยเทคนิคพื้นฐานอย่าง Social Engineering โดยอาศัยเทคโนโลยีเพิ่มมากขึ้น ประกอบกับการพัฒนาเทคนิคการฉ้อโกงใหม่ ๆ อย่างต่อเนื่องในลักษณะขององค์กรอาชญากรรม ทำให้รูปแบบและลักษณะการฉ้อโกงมีแนวโน้มซับซ้อนมากขึ้น การพิจารณาใช้เทคโนโลยีปัญญาประดิษฐ์ที่มีศักยภาพในการประมวลผลและการตรวจจับความผิดปกติแบบ Real-time จึงเป็นอีกแนวทางหนึ่งในการป้องกันการฉ้อโกงธุรกรรมอิเล็กทรอนิกส์ตั้งแต่ขั้นตอนการสมัครจนกระทั่งจบขั้นตอนการทำธุรกรรม โดยอาศัยโมเดลแบบผสมผสาน (Hybrid Model) ที่มีประสิทธิภาพในการตรวจจับและป้องกันการฉ้อโกงธุรกรรมอิเล็กทรอนิกส์ที่ซับซ้อนได้ ทั้งนี้ การใช้เทคโนโลยีปัญญาประดิษฐ์ต้องคำนึงถึงจริยธรรมทั้งในด้านช่องว่างความรับผิด ความเป็นส่วนตัวของข้อมูล รวมไปถึงอคติและความโปร่งใสของเทคโนโลยีปัญญาประดิษฐ์ ดังนั้น การออกมาตรการควรมีการกำหนดหลักเกณฑ์ของเทคโนโลยีปัญญาประดิษฐ์ที่เหมาะสม รวมไปถึงสนับสนุนหรือแนะนำให้มีการใช้เทคนิคอื่น ๆ เพื่อเพิ่มประสิทธิภาพในการพัฒนาเทคโนโลยีปัญญาประดิษฐ์ที่คำนึงถึงจริยธรรมและความรับผิดชอบ เช่น Federated Training และ Explainable AI รวมไปถึงการบริหารจัดการความเสี่ยงของเทคโนโลยีปัญญาประดิษฐ์ที่สอดคล้องกับระดับความเสี่ยง ซึ่งจะมีส่วนช่วยให้การป้องกันการฉ้อโกงธุรกรรมอิเล็กทรอนิกส์โดยใช้เทคโนโลยีปัญญาประดิษฐ์ มีประสิทธิภาพและเหมาะสมกับบริบทของประเทศไทย ทั้งในแง่ของการป้องกันการฉ้อโกงและในแง่ของจริยธรรมอย่างแท้จริง
