Lack Of Protection For Whistleblowers At The Workplace In Nigeria: Drawing Lessons From Selected Jurisdictions, David Tarh-Akong Eyongndi, Faith Nwayemogho Opara
Padjadjaran Jurnal Ilmu Hukum (Journal of Law)
The Nigerian government has created anti-corruption agencies, such as the Economic and Financial Crimes Commission and the Independent Corrupt Practices and other related offences Commission (ICPC), to contend with corruption. In 2015, the Federal Ministry of Finance introduced the whistleblowing policy. The policy enables corrupt practices in any workplace, either private or public, to be exposed. However, following the policy, there is no legal framework for the implementation nor protection of the whistleblower. This article adopts doctrinal and comparative methodology to examine the utilitarian values and the propriety of whistleblowing vis-à-vis the employee’s obligation to act in good faith under …

The Presidential Declaration of Corona Virus Disease 19 as a ‘dangerous contagious disease’ occasioned the emergence of several regulations imposing restrictions on movements and social distancing measures. The Chief Justice of Nigeria and other heads of court also approved the Guidelines and Practice Directions containing modalities for virtual court sessions. This paper aims to examine the legal implications of virtual court session. The traditional requirement that court sessions should be held in places open to the public signifies a constitutional disapproval of virtual court sessions. It is contended that Practice Directions and Guidelines are weak mechanisms for entrenching virtual court …

Law of Money Laundering has a fundamental point to eradicate transnational predicate and serious crimes. Each state has different arrangements to address predicate crime. Indonesia considers predicate crime in the category of ordinary crime consisting of fraud and embezzlement. However, ordinary or conventional crimes may only be subject to the Law under limited circumstances. Article 69 of the Law of Money Laundering remains debatable among criminal law experts due to the relation with Articles 77 and 78 of the Law. The last two articles prescribe that burden of proof on the case of predicate crimes is on defendant, not public …

Children Involvement In Terrorism Activities: Perpetrator Or A Victim? (A Study In The Circle Of Violence), Wawan Edi Prastiyo, I Ketut Rai Setiabudhi
Padjadjaran Jurnal Ilmu Hukum (Journal of Law)
Terrorism is an extraordinary crime since it violates human rights. However, it will be different if children commit it. The legal approach is not necessarily taken against children who become terrorists. The problem of children's involvement in terrorist activities does not end there. Another important issue that must also be considered is children of terrorist parents. They must be rescued from a violent social environment. In this study, we will discuss the position of children as victims in the cycle of violence of terrorism and criminal policies in overcoming the involvement of children in terrorism activities. This research is normative …

The Judicial Pardon Arrangement As A Method Of Court Decision In The Reform Of Indonesian Criminal Law Procedure, Mufatikhatul Farikhah
Padjadjaran Jurnal Ilmu Hukum (Journal of Law)
Judicial Pardon is a new concept formulated in the 2019 Draft of the Criminal Code. The concept refers to the judges’ new powers to forgive defendants who are convicted guilty. However, the formulation of the concept has not been adjusted to the formulation of decision types in the draft of the Criminal Law Procedure. There has to be a harmonization between the Draft of the Criminal Code and the Draft of the Criminal Law Procedure. This article is based on a legal study on the importance of regulating judicial pardon as a form of the court decision. It reveals that …

The interests of justice are criteria of the requirements under Article 53 of the Rome Statute to open a formal investigation of a case. However, it can be misinterpreted due to its lack of clear scopes and standards. The Afghanistan case highlighted this obscurity when The Pre-Trial Chamber (PTC) decided that the case should not proceed due to the interests of justice despite lacking negative determination from the Prosecutor, and the Appeals Chamber (AC) overturned this decision by excluding the interests of justice from proprio motu cases. This article verifies the limitations of the criteria in international criminal law (ICL) …

This study discusses three issues: (1) diversion in juvenile criminal justice system, (2) restitution in diversion, and (3) comparison of restitution in the Philippines and Thailand. This study employs normative legal approach, which examines the ambiguity of norms of restitution forms. Currently, restitution is interpreted merely as reimbursement for victim. This study collected primary and …

Indonesian labors have rights, either individually or collectively, to associate and to establish organizations. Union is one form of protection and enforcement of workers’ normative rights, on conditions that the rights are in line with, and does not conflict with, laws and regulations. The negative attitudes and perceptions of company management towards workers’ unions and legal norms still restrict the space for the unions. The situation enables the occurrence of anti-union actions by employers. It becomes increasingly difficult to stop because workers’ unions are often trapped by fanaticism that makes them difficult to unite perceptions regarding anti-union actions. This study …

In Indonesia, the provision of in absentia in the Money Laundering Crime Law raises problems if the crime act is originally conventional crime act. Conventional crime act should be handled based on the provisions of the Indonesian Criminal Law Procedures Code. On the one hand, the Money Laundering Crime Law regulates the provisions of the court in absentia and, on the other hand, the Indonesian Criminal Law Procedures Code does not recognize trial in absentia. This study covers the issue. To be precise, it reveals the possibility of a conventional crime act that is charged with the Money Laundering Crime …

The objective of the establishment of the International Criminal Court by the Rome Statute 1998 is to achieve global justice. The spirit to end impunity established the ICC to respond to four previous criminal tribunals that have been criticized as victor’s justice and selective justice. The ICC has material jurisdiction on the four most serious crimes: crimes against humanity, genocide, war crimes, and crimes of aggression. These crimes can be committed in any part of the world, including Southeast Asia. The latest case was crimes against humanity that lead to genocide of the Rohingya people in Myanmar, not to mention …

Criminal justice system consists of sub-systems that carry out different tasks and authorities. However, they have the same purpose to implement legal provisions against crimes. The sub-systems cover police, prosecutor, court, and correctional institution. However, in practice, especially in Indonesia, the relation of these sub-systems is not harmonious. It causes legal certainty becoming hard to achieve. One of the solutions is the establishment of supervisory institutions. Nevertheless, in Indonesia, the function of supervisory institution is still unbalanced. Police investigators and prosecutors are stationed at different institutions. The National Police Commission (Kompolnas –Komisi Kepolisian Nasional) and the Prosecutorial Commission …

The Irrelevance Of The Application Of The Principle Of Opportunity By The Attorney General And The Principle Of Equality Before The Law, Kharisma Ramadhan
Padjadjaran Jurnal Ilmu Hukum (Journal of Law)
Abstract
In the Indonesian criminal justice system, dismissal of cases for the good of public interest is a manifestation of the principle of opportunity as set forth in Article 35(c) of Law Number 16 of 2004 on Indonesian Attorney. The application of the principle of opportunity is deemed to contradict the principle of equality before the law, which is introduced in the Indonesian Constitution, because it creates discrimination in the process of law enforcement. The absence of a comprehensive legislation policy on the application of the principle of opportunity in the Indonesian criminal justice system has led to contradictions. It …

Workplace violence is an issue that while not unique to a healthcare setting, is certainly more prevalent. Even more disturbing is that many instances of workplace violence go unreported. Identifying and implementing evidenced based approaches that seek to ensure the safety and well-being of healthcare workers and patients is no small task. Healthcare organizations are faced with the dilemma of protecting and advocating for the safety of their staff against acts of workplace violence, while also providing necessary care for patients who may be violent or disruptive. Properly managing these behaviors requires a thoughtful and thorough approach that recognizes the …

In 2017, the #MeToo movement garnered international attention when millions of people used the hashtag to share personal experiences of sexual violence. The present study examines how non-celebrity users discussed their experiences of sexual victimization through a qualitative and quantitative content analysis of a random sample of #MeToo tweets (N=1,427). We found that survivors prioritized details about the “who,” “what,” “where,” “when,” “why,” and “how” of trauma in their disclosures (Bogen et al., 2021). Key themes in their responses included child sexual abuse (22.7%), long-term adverse effects (17.6%), and polyvictimization (10.4%) across the life course. Survivors also utilized #MeToo to …
