The Option To Repair: Good Or Bad, Steven Silverberg Jan 2015

The Option To Repair: Good Or Bad, Steven Silverberg

St. Thomas Law Review

Insurance companies that deal with homeowner's insurance strategize around not protecting the insured; unlike the commercials say, "you're in good hands." Rather, their strategy is to "delay, deny, and defend." This is never more prevalent than in the new option to repair provision in many property insurance policies. Due to the ever-evolving nature of insurance and its trying to find more ways to deny claims, insurance companies, such as People's Trust Insurance Company, are employing the option to repair provision, which is anything but trustworthy. Since this provision is new to the state of Florida, the courts have yet to …

Lawyer-Client Confidentiality: Rethinking The Trilemma, Monroe H. Freedman Jan 2015

Lawyer-Client Confidentiality: Rethinking The Trilemma, Monroe H. Freedman

Hofstra Law Review

The article discusses three ethical obligations which bear on attorney-client confidentiality in America in cases involving client perjury as of 2015, and it mentions how U.S. lawyers are required to learn as much as they can about their clients' cases, inform their clients of a lawyer's obligation to keep information confidential, and reveal confidential information to a court if an attorney knows that a client has committed perjury. The American Bar Association's ethical rules are examined.

What Can Parents Do? A Review Of State Laws Regarding Decision Making For Adolescent Drug Abuse And Mental Health Treatment, Mary Louise Kerwin, Kimberly C. Kirby, Dominic Speziali, Morgan Duggan, Cynthia Mellitz, Brian Versek, Ashley Mcnamara Jan 2015

What Can Parents Do? A Review Of State Laws Regarding Decision Making For Adolescent Drug Abuse And Mental Health Treatment, Mary Louise Kerwin, Kimberly C. Kirby, Dominic Speziali, Morgan Duggan, Cynthia Mellitz, Brian Versek, Ashley Mcnamara

College of Science & Mathematics Departmental Research

This study examined US state laws regarding parental and adolescent decision-making for substance use and mental health inpatient and outpatient treatment. State statues for requiring parental consent favored mental health over drug abuse treatment and inpatient over outpatient modalities. Parental consent was sufficient in 53%–61% of the states for inpatient treatment, but only for 39% – 46% of the states for outpatient treatment. State laws favored the rights of minors to access drug treatment without parental consent, and to do so at a younger age than for mental health treatment. Implications for how these laws may impact parents seeking help …

The Relationship Of Age To Personal Network Size, Relational Multiplexity, And Proximity To Alters In The Western United States, Emily Smith, Christopher Marcum, Adam Boessen, Zack Almquist, John Hipp, Nicholas Nagle, Carter Butts Jan 2015

The Relationship Of Age To Personal Network Size, Relational Multiplexity, And Proximity To Alters In The Western United States, Emily Smith, Christopher Marcum, Adam Boessen, Zack Almquist, John Hipp, Nicholas Nagle, Carter Butts

Criminology and Criminal Justice Faculty Works

Objectives.

This study examines the association of age and other sociodemographic variables with properties of personal networks; using samples of individuals residing in the rural western United States and the City of Los Angeles, we evaluate the degree to which these associations vary with geographical context. For both samples, we test the hypothesis that age is negatively associated with network size (i.e., degree) and positively associated with network multiplexity (the extent of overlap) on 6 different relations: core discussion members, social activity participants, emergency contacts, neighborhood safety contacts, job informants, and kin. We also examine the relationship between age and …

Formation Of The Radical Self: Constructs Of Change In Western Youth To Acts Of Terrorism On Home-Soil, Robyn Torok Jan 2015

Formation Of The Radical Self: Constructs Of Change In Western Youth To Acts Of Terrorism On Home-Soil, Robyn Torok

Australian Security and Intelligence Conference

The terrorist attack on a member of the Police service by a 15 year old boy in late 2015 sent shock waves not only through Australia but also throughout the world as the realisation of Islamic State targeting teenagers becomes a reality. This paper uses a blend of theoretical and empirical evidence to examine how the radicalised self is formed. Insights from various frameworks including: developmental psychology (teenage identity formation and role confusion), Foucault’s technologies of the self, governmentality and sociological issues including the perceived gap between Muslim values and those of the West. Coupled with these theoretical frameworks are …

File System Modelling For Digital Triage: An Inductive Profiling Approach, Benjamin Rice, Benjamin Turnbull Jan 2015

File System Modelling For Digital Triage: An Inductive Profiling Approach, Benjamin Rice, Benjamin Turnbull

Australian Digital Forensics Conference

Digital Triage is the initial, rapid screening of electronic devices as a precursor to full forensic analysis. Triage has numerous benefits including resource prioritisation, greater involvement of criminal investigators and the rapid provision of initial outcomes. In traditional scientific forensics and criminology, certain behavioural attributes and character traits can be identified and used to construct a case profile to focus an investigation and narrow down a list of suspects. This research introduces the Triage Modelling Tool (TMT), that uses a profiling approach to identify how offenders utilise and structure files through the creation of file system models. Results from the …

The Continuing Relevance Of International Refugee Law In A Globalized World, Guy S. Goodwin-Gill Jan 2015

The Continuing Relevance Of International Refugee Law In A Globalized World, Guy S. Goodwin-Gill

Intercultural Human Rights Law Review

The movement of people between States continues to be high on national and international agendas. One does not need to look far beyond the headlines to see what a difficult issue it is for States and for regional and international organizations, and how often they make a mess of managing it. Nor does one need to look hard to discover how desperate is the situation of many a migrant, whether in the physical hardships and risk to life and limb encountered during the search for refuge, or in the often incomprehensible and complex web of national laws and procedures with …

A Systematic Evaluation Of A Multidisciplinary Social Work– Lawyer Elder Mistreatment Intervention Model, Victoria M. Rizzo, David Burnes, Amy Chaify Jan 2015

A Systematic Evaluation Of A Multidisciplinary Social Work– Lawyer Elder Mistreatment Intervention Model, Victoria M. Rizzo, David Burnes, Amy Chaify

Social Work Faculty Scholarship

This study introduces a conceptually based, systematic evaluation process employing multivariate techniques to evaluate a multidisciplinary social work–lawyer intervention model (JASA-LEAP). Logistic regression analyses were used with a random sample of case records (n = 250) from three intervention sites. Client retention, program fidelity, and exposure to multidisciplinary services were significantly related to reduction in mistreatment risk at case closure. Female gender, married status, and living with perpetrator significantly predicted unfavorable outcomes. This study extends the elder mistreatment program evaluation literature beyond descriptive/bivariate evaluation strategies. Findings suggest that a multidisciplinary social work–lawyer elder mistreatment intervention model is a successful …
