Criminal Justice & Criminology: Faculty Publications
Research on lesbian, gay, bisexual and/or transgender (LGBT) students has been gaining traction in the fields of criminology, victimology, and education, but available data lag behind the demand for studies on this underserved population. While LGBT students are often perceived to face greater risk of victimization and subsequent health problems than their counterparts, little research has investigated the mechanisms behind problematic outcomes for LGBT students. This research uses data from a Southeastern University to examine sexual assault among LGBT students and their experiences with alcohol-related problems. The results show that LGBT youth are at an increased risk for sexual victimization …
Disentangling Michigan Court Rule 6.502(G)(2): The "New Evidence" Exception To The Ban On Successive Motions For Relief From Judgment Does Not Contain A Discoverability Requirement, Claire V. Madill
Michigan Law Review
Michigan courts are engaging in a costly interpretative mistake. Confused by the relationship between two distinct legal doctrines, Michigan courts are conflating laws in a manner that precludes convicted defendants from raising their constitutional claims in postconviction proceedings. In Michigan, a convicted defendant who wishes to collaterally attack her conviction must file a 6.500 motion. The Michigan Court Rules generally prohibit “second or subsequent” motions. Nonetheless, section 6.502(G)(2) permits a petitioner to avoid this successive motion ban if her claim relies on “new evidence that was not discovered” before her original postconviction motion. Misguided by the similarity between the language …
The American Jury System: A Synthetic Overview, Richard O. Lempert
The American Jury System: A Synthetic Overview, Richard O. Lempert
Articles
This essay is intended to provide in brief compass a review of much that is known about the American jury system, including the jury’s historical origins, its political role, controversies over its role and structure, its performance, both absolutely and in comparison to judges and mixed tribunals, and proposals for improving the jury system. The essay is informed throughout by 50 years of research on the jury system, beginning with the 1965 publication of Kalven and Zeisel’s seminal book, The American Jury. The political importance of the jury is seen to lie more in the jury’s status as a one …

This study examines whether participation in Extended Foster Care (EFC) or the Aftercare Program increase perceptions of independence in former and current foster dependents ages eighteen and older. Foster youth have historically experienced worse outcomes than the general population after reaching age 18. This study surveyed 72 young adults, 36 were in Extended Foster Care (EFC) and 36 were in the Aftercare Program in San Bernardino County. The areas examined were demographics, health care, employment, transportation, education, housing, mental health, pregnancy/parenting status, social support, services received in Independent Living Program (ILP), EFC, and/or the Aftercare Program and the young adults’ …

Beliefs About Children Who Have Been Incarcerated: What Do Parents Know?, Aryriana Alexander
Electronic Theses, Projects, and Dissertations
The purpose of this study is to explore the relationship between traditional African-American American parenting and the overrepresentation of African-Americans in America’s jails and prisons. This qualitative study utilized semi-structured interviews of twelve parents who have had a child incarcerated in their adult life to gather data. Study participants were asked their experiences with several traditional happenings, supported by research, in some traditional African-American households. Topics discussed included religion, spanking, and single parenthood. The study found that many of the traditional happenings of African-American parenting occurred within the homes of parents with children who were incarcerated, which supports previous research. …
Social Work Students' Perceptions Of Sex Offenders, Mayra Bernal, Henry Christopher Meza
Social Work Students' Perceptions Of Sex Offenders, Mayra Bernal, Henry Christopher Meza
Electronic Theses, Projects, and Dissertations
Social workers who choose to work in the field of child welfare will almost unavoidably be exposed to sexual trauma. This requires that social workers are prepared to understand and work with those who have been sexually abused, as well as the perpetrators of sex crimes. The purpose of this study was to explore social work students’ perceptions of sex offenders since it is anticipated that they will work with the sex offender population at some point in their careers. Exploring this topic could help future social workers gain valuable knowledge related to recognizing barriers that may exist when working …
Extended Foster Care: The General Population's Perspective, Laura Andrade, Daniela A. Salinas
Extended Foster Care: The General Population's Perspective, Laura Andrade, Daniela A. Salinas
Electronic Theses, Projects, and Dissertations
The following is a quantitative study, with a convenience sample of 117 adults, ranging in age from 18-73, to gather information about the public’s perspective towards extended foster care (EFC) and emerging adulthood. Topics varied from when foster youth should emancipate to when emerging adult children should move out of their parents’ homes. There is very little literature regarding the topic of EFC, which could impact the sustainability of this program as its objective is to help emerging adults transition more successfully into adulthood and out of the child welfare system. An online survey was created through Qualtrics with 25 …

The Green To Blue Pipeline: Defense Contractors And The Police Industrial Complex, Karena Rahall
The Green To Blue Pipeline: Defense Contractors And The Police Industrial Complex, Karena Rahall
Cardozo Law Review
Images of police in tactical gear, pointing automatic weapons at unarmed demonstrators in Ferguson, Missouri, represented a flashpoint in public awareness that American police are rapidly militarizing. Federal grants have been quietly arming police with tanks, drones, and uniforms more suited to waging war than patrolling the streets. As police have acquired more military gear, Special Weapons and Tactics teams and deployments have proliferated. Even small towns receive surplus military materiel to fight the "wars" on drugs and terrorism. In addition, police training uses a military approach that threatens to transform the traditional police mandate of protecting and serving into …

Predicting Future Special Education Eligibility From Developmental Assessment Of Young Children (Dayc) Scores, Helen E. Shaw Tripp
Doctoral Dissertations and Projects
This quantitative non-experimental correlational study used logistic regression and archival data to examine the relationship between scores obtained by children at age three on the Developmental Assessment of Young Children (DAYC) rating scale and later special education eligibility status. The purpose of this study was to determine if DAYC scores can predict future special education eligibility as defined by the criteria of the State of Tennessee Department of Education and thereby provide a tactic for early identification and intervention. The 74 participants were students from a small, rural, high-poverty school district who were initially evaluated at age three using the …

This project will offer prescriptive and preventative measures to all parties involved, in an effort to heal and stop sexual abuse. Through research …
Marriage As Black Citizenship?, R. A. Lenhardt
Marriage As Black Citizenship?, R. A. Lenhardt
UC Law Journal
The narrative of black marriage as citizenship enhancing has been pervasive in American history. As we mark the fiftieth anniversary of the Moynihan Report and prepare to celebrate the 150th anniversary of Thirteenth Amendment, this Article argues that this narrative is one that we should resist. The complete story of marriage is one that involves racial subordination and caste. Even as the Supreme Court stands to extend marriage rights to LGBT couples, the Article maintains that we should embrace nonmarriage as a legitimate frame for black loving relationships—gay or straight. Nonmarriage might do just as much, if not more, to …
Keeping The News Domestic: Why A Toxic Environment For The American Press And Ready Access To Foreign Media Organizations Like Wikileaks Compel The Rapid Adoption Of A Federal Reporters’ Privilege, Ryan C. Stevens
UC Law Journal
In 2008, the U.S. Department of Justice subpoenaed James Risen, a Pulitzer Prize winning New York Times journalist, to testify against one of his confidential sources in a criminal proceeding against that source. After Risen fought the subpoena and it expired in 2009, the Justice Department renewed it in 2010. The saga that followed brought a mass of media attention to the debate over the idea of a testimonial privilege for news reporters. While debates over the reporters’ privilege have raged since the Supreme Court first denied the privilege in 1972, this Note examines the overlooked effect that WikiLeaks has …

What's It Worth To Keep A Secret?, Gavin C. Reid, Nicola Searle, Saurabh Vishnubhakat
What's It Worth To Keep A Secret?, Gavin C. Reid, Nicola Searle, Saurabh Vishnubhakat
Faculty Scholarship
This article is the first major study of protection and valuation of trade secrets under federal criminal law. Trade secrecy is more important than ever as an economic complement and substitute for other intellectual property protections, particularly patents. Accordingly, U.S. public policy correctly places a growing emphasis on characterizing the scope of trade secrets, creating incentives for their productive use, and imposing penalties for their theft. Yet amid this complex ecosystem of legal doctrine, economic policy, commercial strategy, and enforcement, there is little research or consensus on how to assign value to trade secrets. One reason for this gap is …

Conflict Classification In Ukraine: The Return Of The “Proxy War”?, Robert Heinsch
Conflict Classification In Ukraine: The Return Of The “Proxy War”?, Robert Heinsch
International Law Studies
The article examines the exact conditions for classifying an armed conflict under international humanitarian law against the backdrop of the crisis in Ukraine, taking into account the difficult factual situation on the ground and the involvement of the different parties to the conflict. Apart from dealing with the requirements of an international or a non-international armed conflict, it looks again into the specific circumstances for the “internationalization” of an internal armed conflict. In doing so, the author revisits the various approaches found in the jurisprudence of the International Court of Justice in its 1986 Nicaragua and 2007 Genocide judgments, as …
Predictors Of Money Spent On Drugs In Substance Users, Simona Ciobotaru
Predictors Of Money Spent On Drugs In Substance Users, Simona Ciobotaru
DePaul Discoveries
Financial need is a major stressor for individuals who are reentering the community after substance abuse and/or incarceration. Family members and friends make up a great majority the support networks from which reentering people can receive financial support. However, that financial support could possibly contribute to drug use when the individual is actively using. The goal of this study was to further understand the implications of material and financial support specifically being transmitted from family members. This study looks at psychosocial predictors in relation to money spent on drugs in the last 30 days of 270 individuals entering substance abuse …

Regulating Hostilities In Non-International Armed Conflicts: Thoughts On Bridging The Divide Between The Tadić Aspiration And Conflict Realities, Geoffrey S. Corn
International Law Studies
International Humanitarian Law (IHL) evolved to strike a rational balance between the necessity of using combat power to defeat enemy opponents, and the humanitarian interest of mitigating the human suffering resulting from armed conflict. Ironically, however, the “type” of conflict most comprehensively regulated by this law—international or inter-State (IACs)—is not the “type” of armed conflict that has been most notable for producing humanitarian suffering since the end of World War II. Instead, non-international armed conflicts (NIACs)—conflicts between States and organized non-State belligerent groups, or even between multiple non-State belligerent groups—have been notorious for their brutality, indifference towards humanitarian restraint, and …
