Human Rights In The United States: Primer On Recommendations From The Inter-American Human Rights Commission & The United Nations, Human Rights Institute
Human Rights In The United States: Primer On Recommendations From The Inter-American Human Rights Commission & The United Nations, Human Rights Institute
Human Rights Institute
Over the past decade, U.S. social justice advocates have increasingly recognized that international and regional human rights mechanisms are important avenues for seeking human rights accountability. A broad and diverse range of advocates have mobilized, in particular, around United Nations human rights reviews, including treaty compliance reviews, Special Rapporteur visits to the United States, and the U.N. Human Rights Council Universal Periodic Review process, increasing visibility of numerous domestic human rights concerns.
A smaller number of advocates and social justice groups have engaged with the Americas’ regional human rights system, the Inter-American Human Rights System, which offers additional and complementary …

The New Black On The Development Catwalk: Incorporating Rule Of Law Into The Sustainable Development Goals, Per Bergling, Sophie Jin
The New Black On The Development Catwalk: Incorporating Rule Of Law Into The Sustainable Development Goals, Per Bergling, Sophie Jin
Washington International Law Journal
As the post-2015 Development Agenda is set to replace the Millennium Development Goals (“MDGs”), one of the most controversial new elements of the new agenda is the rule of law. While all of the official fora for discussing and producing recommendations have concluded that the rule of law (or some variation) should be included, there are still significant challenges to its incorporation in the final Sustainable Development Goals (“SDGs”). The interrelated points of contention have included whether rule of law applies at the national government level, whether it encompasses domestic governance, and how the concept should be defined and measured. …

Psychological And Social Variables Impacting Young Adults Caring For Severely Mentally Ill Mothers, Courtney Gale Deloney
Psychological And Social Variables Impacting Young Adults Caring For Severely Mentally Ill Mothers, Courtney Gale Deloney
Dissertations
This dissertation study examined the psychological and social functioning of young adults who care for their severely mentally ill mothers; in doing so this study examined the independent variables coping style, perceived stress, quality of life, and resilience. The dependent variables considered were race, socioeconomic status, support group participation, and living in the same household as one’s mother. Young adulthood was examined as a distinct period of human development. The policy of deinstitutionalization led many families to become caregivers for their severely mentally ill relatives. While some knowledge on this exists, little is known about the experiences of young adult …

Impossible To Regulate: Social Media, Terrorists, And The Role For The U.N., Paulina Wu
Impossible To Regulate: Social Media, Terrorists, And The Role For The U.N., Paulina Wu
Chicago Journal of International Law
The posting of journalist beheadings online and the arrests of numerous nationals attempting to join terrorist organizations have shown that terrorists are increasingly using social media to spread ideology and recruit members. The popularity of social media around the world provides a huge potential audience for terrorist content. Unfortunately, because of states' inability to cooperate, previous attempts to govern and police the Internet have failed. Any regulation of the Internet or social media also raises collective action problems and baseline definition issues. The U.N. is not in the position to pass a binding treaty or convention because use of social …
An Efficient Anticorruption Sanctions Regime? The Case Of The World Bank, Tina Søreide, Linda Gröning, Rasmus Wandall
An Efficient Anticorruption Sanctions Regime? The Case Of The World Bank, Tina Søreide, Linda Gröning, Rasmus Wandall
Chicago Journal of International Law
With its sanctions regime, the World Bank has sent a clear message to client governments and suppliers that it will not tolerate corruption. However, as this Article argues, with its present design, the sanctions regime at the same time runs counter to the World Bank’s own development agenda. Thus, the regime will have limited effect in protecting funds for development, reducing corruption risks, promoting the integrity and functionality of markets, and strengthening domestic law enforcement institutions. A key problem is that efforts to strengthen law enforcement at the national level are too limited. The sanctions primarily target private suppliers, while …

Freedom Of Expression, Discrimination, And The Internet: Legislative Responses And Judicial Reactions, Talia Joundi
Freedom Of Expression, Discrimination, And The Internet: Legislative Responses And Judicial Reactions, Talia Joundi
Canadian Journal of Law and Technology
In Part I of this article, I argue that cyber racism is inextricably linked with systemic discrimination. The definition of systemic discrimination relied on was first provided by Judge Abella in the Report of the Royal Commission on Equality in Employment (Abella Report), which states that systemic discrimination points to practices or attitudes that can result in inequality of opportunity for individuals or groups. The Supreme Court of Canada has since adopted this definition, and in some instances, has acknowledged that systemic problems require systemic remedies. The purpose of this discussion is to demonstrate how situating cyber racism within the …
A Framework On Mandating Versus Incentivizing Corporate Social Responsibility, Margaret Ryznar, Karen E. Woody
A Framework On Mandating Versus Incentivizing Corporate Social Responsibility, Margaret Ryznar, Karen E. Woody
Marquette Law Review
There are two primary but different methods of controlling behavior, whether it is the behavior of individuals or corporations: to incentivize it or to regulate it. Governments are in a unique position to employ either or both options because of their ability to pass regulatory schemes and to extend tax incentives. This Article analyzes the two methods of shaping corporate behavior, examining the regulation issue through the case of the conflict minerals provision of the Dodd–Frank Act and examining the taxation issue through several examples of corporate tax incentives.

Editor's Note, Padraig O’Malley
New England Journal of Public Policy
In this edition of the journal several articles address a range of important, and in some cases too often overlooked policy issues, too broad in scope for their conclusions and recommendations to be encapsulated adequately in a brief paragraph. Their diversity, however, highlights a key characteristic of the New England Journal of Public Policy – that of being open to publishing articles that have insightful bearings on how public policy is addressed, not only in the New England states, but throughout the country and in the international community – a community of nations increasingly interdependent with constraints on national sovereignty …
Preventing Juror Misconduct In A Digital World: A Comparative Analysis, Thaddeus A. Hoffmeister
Preventing Juror Misconduct In A Digital World: A Comparative Analysis, Thaddeus A. Hoffmeister
School of Law Faculty Publications
This article examines the reform efforts employed by common law countries to address internet-related juror misconduct, which generally arises when jurors use technology to improperly research or discuss a case. The three specific areas of reform are (1) punishment, (2) oversight, and (3) education. The first measure can take various forms ranging from fines to public embarrassment to incarceration. The common theme with all punishments is that once imposed, they make citizens less inclined to want to serve as jurors. Therefore, penalties should be a last resort in preventing juror misconduct.
The second reform measure is oversight, which occurs in …
Boys, Rape And Masculinity: Reclaiming Boys' Narratives Of Sexual Violence In Custody, Brenda V. Smith
Boys, Rape And Masculinity: Reclaiming Boys' Narratives Of Sexual Violence In Custody, Brenda V. Smith
Project on Addressing Prison Rape - Articles
This article examines a little studied area at the intersections of masculinity, feminist studies, and criminal justice – sexual abuse of boys in custody by female staff. Professor Smith will outline the scope of the problem and discusses competing narratives that attempt to explain the phenomena: (1) female staff as “mother, sister, friend”; (2) adolescent development theory; (3) complex early childhood trauma; and (4) female authority and power. There is a gap in both masculinity and feminist theory in analyzing sexual aggression and power by women over boys. The talk will colclude with policy and practice prescription and recommendations for …
Leaving Dumb Phones Behind: A Commentary On The Warrantless Searches Of Smartphone Data Granted In R. V. Fearon, Jordan Fine
Leaving Dumb Phones Behind: A Commentary On The Warrantless Searches Of Smartphone Data Granted In R. V. Fearon, Jordan Fine
Canadian Journal of Law and Technology
Given the incredible rate of smartphone technological evolution, is it about time the Supreme Court of Canada devised a special test to give law enforcement agents significantly more power to search through phone data without a warrant upon arrest of a suspect? In R. v. Fearon, the majority did just that. But this article argues the opposite is true: the increasing potential for immense privacy infringements when police search powerful and constantly evolving technological devices demands a greater limitation to police powers.
In recent cases, the Supreme Court has agreed with the position that limitations are needed concerning computers. Additionally, …

Predictive Validity Of The Look, Joy Wiechmann Cox
Theses and Dissertations
The LOOK, an iOS app, is a viewing time measure used to assess sexual interest. The measure is based on the assumption that sexual interest can be assessed by the amount of time a participant spends looking at an image. The purpose of this study was to examine the ability of the LOOK, a newly developed viewing time instrument, to accurately screen and diagnose individuals with deviant sexual interest. The profiles of known sexual offenders were compared to norm-referenced profiles of an exclusively heterosexual, non-pedophilic, male, college student population. Researchers were not able to find a fair constant multiplier that …

This Masters of Global Affairs project has been constructed for the use as a piece contributing to policy recommendations for the Canadian Federal government on their response to handling state-sponsored cyber attacks on critical national infrastructure (CNI) in Canada. Throughout this project an exploration is undertaken to understand the means of attacks that Canada has faced since the millennium, as well as to see what defense and security measures were of use, and what security measures were under-utilized. By exploring these attacks to Canada’s CNI, clarification on improvements for the federal government on its future state of cyber defense become …

Frames used in presenting news/articles and images used in portraying children, were discussed by …
Advancing Tribal Court Criminal Jurisdiction In Alaska, Ryan Fortson
Advancing Tribal Court Criminal Jurisdiction In Alaska, Ryan Fortson
Alaska Law Review
Extensive case law already exists in Alaska on the jurisdiction of tribal courts over domestic relations cases, with one of the seminal cases—John v. Baker—establishing that Alaska tribes have jurisdiction even in the absence of Indian country. A common assumption, though, is that Alaska tribes do not have jurisdiction over criminal offenses. This Article argues that both under the logic of John v. Baker and the development of Indian law in the Lower 48, Alaska tribes already possess inherent jurisdiction over criminal offenses within their Native villages. With the gamut of social challenges facing Alaska Natives in rural …
Caregivers’ Emotional Experiences Regarding Their Adolescent’S Substance Abuse Problem, Cindy Reyes, Brenda Jane Duchene
Caregivers’ Emotional Experiences Regarding Their Adolescent’S Substance Abuse Problem, Cindy Reyes, Brenda Jane Duchene
Electronic Theses, Projects, and Dissertations
The primary aim of this investigation was to explore caregivers’ emotional experiences regarding their adolescent with substance abuse problems. These researchers systematically examined the literature on caregiver stress and found a large body of studies on caregivers of persons with mental illness, severe medical problems including cancer, HIV/AIDS, and developmental disabilities. Yet, an absence of research was found on caregivers including parents of adolescents with drug and/or alcohol problems. Based on the findings on investigations with other types of caregivers, these researchers expected caregivers of adolescent substance abusers to report high levels of emotional and psychological distress. Like caregivers of …
The Importance Of Social Support For Newly Emancipated Foster Youth, Valentina Vela
The Importance Of Social Support For Newly Emancipated Foster Youth, Valentina Vela
Electronic Theses, Projects, and Dissertations
The Child Welfare system is widely known as the macro system responsible for ensuring the safety of children within particular parameters, which, in some cases, results in the removal of these individuals from their family of origin. Research has explored the short- and long-term effects of this disruption in hopes of improving the ability of services to effectively prevent negative effects. Despite improvements on a macro and micro level, foster youth continue to be unprepared for the transition out of the foster care system, resulting in negative outcomes. According to research, the newly developed theory of emerging adulthood may have …
