Worker advocates seeking to affect labour policy change in the United States have shifted their attention and energy to states and localities in a move that has been called the “new labour federalism.” new labour federalism has broadened the scope of public worker protections, while also making the enforcement of those protections even more necessary. In this article, we draw on interviews with agencies and advocates, analysis of agency enforcement data, violation estimates, and publicly available information to understand better how federalism has created both opportunities and challenges for workers, employers, and agencies tasked with enforcing employment standards. The Legal Framework For Sexual Harassment At Work In Australia And In Québec: Case Studies Of Complexity And Its Countervailing Forces, Rachel Cox

This paper analyses the complex legal framework for sexual harassment at work in Australia and Québec using Peter Schuck’s (1992) definition of complexity and drawing on Alejandro Camacho and Robert Glicksman’s (2019) model of the dimensions of authority and how they combine with the different functions an authority carries out.

In both Australia and Québec, overlapping institutions and approaches can improve enforcement, especially when they are coordinated. overlap is less likely to improve matters if the focus is on standard-setting, where uniformity is important to ensure the clarity, transparency, and legitimacy of the rules for duty holders and workers.

Domestic violence victims suffer not only physical abuse but also emotional, psychological, and economic violence, leading to long-term trauma, poverty, and recovery barriers. At least 40% of victims of abuse and their children have experienced some form of violence. The lack of shelters, counseling, and legal support deepens the sense of hopelessness victims often feel. In this study, the gap in literature was addressed by exploring coping strategies of survivors of intimate partner and domestic violence in rural North Carolina. There is a problem with recidivism in the North Carolina prison system and the United States. This study fills the gap in the literature by focusing on what life experiences contribute to behaviors in recently released offenders not to reoffend in North Carolina. Edmund Husserl's (1913) Transcendental Phenomenology used several angles of perception and a thematic analysis of the participant’s lived experiences. This study employed a purposive sampling method by targeting 17 participants who may have represented characteristics of the intended population. Mock Juror Perceptions Of Intimate Partner Rape Victims: The Effects Of Mental Illness And Emotional Expression, Kristina Lambert

Intimate partner rape (IPR), defined as non-consensual sexual intercourse between domestic partners, has a high prevalence rate especially among women with mental illness, yet it is highly under-convicted. This is often due to a lack of evidence in rape cases resulting in jurors relying on extralegal factors, such as a victim’s mental illness or emotional expression, in their decision making. Jurors may provide lower pro-victim judgments (e.g., guilty verdicts, victim credibility) when a victim has a mental illness, whereas jurors often expect a victim to express emotions, which can increase pro-victim judgments. Tuberculosis (TB) in humans, caused by Mycobacterium tuberculosis, is a significant global health concern, resulting in high disease burden and mortality each year which together make it the world’s topmost infectious killer. The emergence of multidrug-resistant tuberculosis (MDR-TB) in recent decades has further exacerbated the present situation and warrants an urgent need to develop and investigate innovative treatment regimes. Unbeknownst to many, human rights violations occur on a large scale behind prison walls. This paper examines some of these violations, especially those exacerbated by climate change, through an environmental lense in order to emphasize the need for social welfare-based solutions in the abolition of the prison industrial complex. It also seeks to illustrate the connection between the environmental justice movement and the prison abolition movement so that marginalized peoples may be free from shouldering disproportionate effects of environmental hazards and imprisonment. The Deterrence Dilemma: Is It Time For Canada To Abandon General Deterrence As A Sentencing Objective?, Caitlin Salvino

When Canada first codified its sentencing framework in the Criminal Code, Parliament included deterrence as a sentencing objective. The sentencing objective of deterrence encompasses two aspects: specific deterrence for the individual offender and general deterrence for other potential offenders. I engage with the concept of general deterrence and its incorporation into Canadian sentencing law throughout this article. I argue that Parliament should abandon general deterrence as a sentencing objective under the Criminal Code. After reviewing the jurisprudence on general deterrence and conducting a systematic review of its current application in Ontario sentencing decisions, I argue that general deterrence should be …

This qualitative study explores the structural behaviors within public K-5 education that affect African American students' attendance, behavior, and academic outcomes. With a persistent achievement gap disproportionately affecting African American learners, the research investigates how systemic inequities and institutional practices hinder equitable access to quality education. Using a phenomenological approach, the study draws on the lived experiences of educators, administrators, and support staff across several school districts to understand the nuanced challenges African American students face.

This study examined how employer risk perceptions, beliefs in rehabilitation, and support for second-chance employment influence hiring decisions regarding individuals with criminal records, while also evaluating whether remote work moderates these relationships. Prior research has extensively explored employer attitudes toward ex-offenders in traditional, in-office environments; however, limited attention has been given to how remote work arrangements may alter perceived risk or hiring willingness. Given the expansion of remote and hybrid work models in the United States, understanding whether physical workplace separation reduces stigma or perceived liability is both theoretically and practically significant.
