Do Attorneys Matter In Civil Rights Litigation?, Nancy Leong, Mary Emmerling, Aili Miyake, Rochelle Orlando Jan 2026

Do Attorneys Matter In Civil Rights Litigation?, Nancy Leong, Mary Emmerling, Aili Miyake, Rochelle Orlando

FIU Law Review

Civil rights cases brought under 42 U.S.C. § 1983 are very difficult for plaintiffs to win. Commentators generally blame stringent doctrinal and pleading standards for plaintiffs’ low rates of success. This Article instead focuses on factors related to attorneys who litigate civil rights cases: the identity of the attorney (i.e., whether the attorney is a solo practitioner or affiliated with a firm or a nonprofit), the prior experience of the attorney in litigating civil rights cases, and whether these two elements are related to plaintiff success. We identified and coded the dockets for 463 civil rights cases, or 20% of …

Silenced By Fear: Undocumented Immigrant Victims Of Sexual Assault, Adriana Isabel Herrera Jan 2026

Silenced By Fear: Undocumented Immigrant Victims Of Sexual Assault, Adriana Isabel Herrera

FIU Law Review

Imagine being sexually assaulted and then having to choose between justice or deportation. In today’s climate of heightened immigration enforcement, many undocumented immigrant victims of sexual assault understandably remain silent. After all, who would risk everything just to report a crime that might get them deported? The fear of being separated from their families, ripped from the lives they have built, and sent back to dangerous conditions in their home countries prevents these victims from coming forward and seeking justice. Additionally, the current protections available to them are flawed and insufficient—primarily due to the U visa cap and prolonged processing …

No Justice Without Transparency: The Case For A Broad Presumption Of Public Access To Court Documents, Taylor Quimby Jan 2026

No Justice Without Transparency: The Case For A Broad Presumption Of Public Access To Court Documents, Taylor Quimby

FIU Law Review

This Comment argues that a broad presumption of public access to court  documents is essential to preserving the legitimacy and constitutional values  of the American legal system. Although the principle of public access is  rooted in common law and constitutional tradition, individual states differ in  how they approach transparency in the context of court documents. These  jurisdictional inconsistencies continue to gain significance, as the digital age  has completely transformed the way people consume information. The  increasing digitization of court records has heightened the need for consistent  and constitutionally grounded standards that preserve transparency while  adequately protecting legitimate privacy interests. Florida’s …

Carceral Schools: Black Geographies Of Confinement, Surveillance, And Policing, M. Alex Evans Jan 2026

Carceral Schools: Black Geographies Of Confinement, Surveillance, And Policing, M. Alex Evans

FIU Law Review

This Article charts the deeply entrenched traditions of policing, containing, and surveilling blackness throughout this Nation’s history, with particular focus on Black students and schools. It provides school discipline data demonstrating the perpetual racial, gender, and ability disparities that Black students face decade after decade. Secondary Traumatic Stress In Front Line Professionals: An Exploration Of Risk Factors, Laura Lanigan, Sharon Lambert Dr, Raegan Murphy, Graham-Gill Emerson Jan 2026

Secondary Traumatic Stress In Front Line Professionals: An Exploration Of Risk Factors, Laura Lanigan, Sharon Lambert Dr, Raegan Murphy, Graham-Gill Emerson

Irish Journal of Applied Social Studies

Objective: This study sought to explore the prevalence of secondary traumatic stress in a range of front-line services and the potential impact of age, gender, experience, occupation and adverse childhood experiences. Literature has identified the vulnerability of front-line workers to secondary traumatic stress. However, the literature exploring risk factors for secondary trauma is limited and inconsistent. It was hypothesised that secondary traumatic stress would be prevalent in front-line services. It was hypothesised that demographic factors would not be identified as potential risk factors, while adverse childhood experiences would increase the risk for secondary traumatic stress. Method: Analysis of data collected …

The 2025 Michigan Supreme Court Ruling On Lwop Protections: Morally Justifiable?, Asa Smith Jan 2026

The 2025 Michigan Supreme Court Ruling On Lwop Protections: Morally Justifiable?, Asa Smith

Res Publica - Journal of Undergraduate Research

This paper examines the moral permissibility of the 2025 Michigan Supreme Court ruling that found life-without-parole (LWOP) sentences for 19- and 20-year-olds to be unconstitutional under Michigan state law. The paper supports its argument on whether the ruling was morally permissible by drawing on neuroscientific data as well as moral frameworks such as a rehabilitative theory of punishment and John Rawls’s ‘veil of ignorance’ thought experiment for the application of justified principles in society. The paper considers and replies to potential objections to its argument and to alternative interpretations of the moral frameworks it deploys. It concludes by contending that …

The First Systematic Review Of Treatment Characteristics And Recidivism Outcomes For Indigenous People Who Have Sexually Offended, James L. Finney, Natalie Gately, Suzanne Rock, Braden Hill Jan 2026

The First Systematic Review Of Treatment Characteristics And Recidivism Outcomes For Indigenous People Who Have Sexually Offended, James L. Finney, Natalie Gately, Suzanne Rock, Braden Hill

Research outputs 2022 to 2026

It is of great importance that research investigates the impact of sexual offender treatment programmes given the damage caused by sexual offences to victims and society more broadly. However, psycho-criminological literature has focused on reporting post-treatment recidivism outcomes for people who have sexually offended homogeneously and has not investigated the unique experiences of Indigenous people. Therefore, we systematically collated and critically appraised studies reporting recidivism outcomes for Indigenous people who have received treatment for sexual offences. Fourteen studies were identified utilising a sample of 5,635 individuals (30.7% Indigenous or First Nations). Recidivism was lower for Indigenous and First Nations people …

Measuring Outcomes In Evaluations Of Interventions To Prevent Youth Crime And Violence: Challenges And Potential Solutions, Sajid Humayun, Finlay Green, Helen Downham, Nick Axford

Peninsula Medical School

There is a clear imperative to prevent youth crime and violence owing to the significant social and economic costs for individuals involved and wider society. A considerable evidence base for ‘what works’ in this space exists but gaps remain. To address these, it is necessary to evaluate intervention effectiveness. The aim of this article is to explore challenges and potential solutions regarding outcome measurement in such evaluations. To do this we draw on the literature and our experience as evaluators. We argue that outcome selection should be informed by a robust theory of change, and that normally this will mean …
