Police Promotions And Assignments: Understanding Law Enforcement Officers’ Experiences With Particularism, John Leo Glasser Iii
Police Promotions And Assignments: Understanding Law Enforcement Officers’ Experiences With Particularism, John Leo Glasser Iii
Doctoral Dissertations and Projects
The purpose of this qualitative descriptive study was to have police officers describe how they experience, understand, and navigate within their agency as it relates to their decisions to assign and promote police personnel within the scope of particularism in New Jersey. The conceptual framework guiding this study was the debate between researchers, and industrial-organizational psychologists who have reached opposing viewpoints on whether particularism and similar practices are beneficial or detrimental in the organizational context. Three research questions guided this study: 1) How do police officers describe their experiences with their agency as it relates to their agencies' decisions to …
The Wages Of Crying Life: What States Must Do To Protect Children After The Fall Of Roe, Leah A. Plunkett, Michael S. Lewis
The Wages Of Crying Life: What States Must Do To Protect Children After The Fall Of Roe, Leah A. Plunkett, Michael S. Lewis
Pepperdine Law Review
In the post-Roe world, can a state rationally claim that the value of human life justifies the imposition of abortion bans but does not demand that a state protect the vulnerable young who are “born human beings”—commonly called “minors” or “children”—and are entitled to protection under a state’s laws? This essay advances the claim that it cannot. This essay asks that those who say they are “Pro-life” in politics and law demonstrate that they protect vulnerable life beyond the abortion context, and that they do so in the most minimal fashion: through a demonstrated commitment to protecting the basic welfare …

Settler-On-Settler Violence: Ritual Protocols In Youtube Street Fight Videos - Part Two, Kelly Menzel, Tyson Yunkaporta
Journal of Indigenous Research
This is part two of a series of two papers exploring a project was conducted by two Australian Aboriginal researchers, one male and one female, and might be described as ‘reverse anthropology’, in the same way that people sometimes refer to positive discrimination as ‘reverse racism’. But we would just call it anthropology; a tidal river is still a river when it flows back the other way. The project could hardly be acknowledged as anthropology though, as it was based on Indigenous methods of inquiry that do not yet belong to a formal discipline. Initially the goal was to disrupt …

The Prosecutor In The Mirror: Conviction Integrity Units And Brady Claims, Lissa Griffin, Daisy Mason
The Prosecutor In The Mirror: Conviction Integrity Units And Brady Claims, Lissa Griffin, Daisy Mason
Loyola of Los Angeles Law Review
In Brady v. Maryland, the Supreme Court held that a prosecutor has a due process obligation to disclose exculpatory evidence that is material to guilt or punishment. The failure to fulfill this duty is particularly insidious because it bears directly on both whether an innocent defendant may have been convicted as well as on whether the adjudicatory process was fair. The failure to disclose exculpatory evidence has been characterized as “epidemic” and has been documented to have made a major, outsized contribution in cases that resulted in exonerations. It is not surprising, then, that conviction integrity units in prosecutor’s …

Safety In Policy: An Assessment Of The Utilization And Perceived Efficacy Of Sex Offender Legislation, Morgan Graham
Safety In Policy: An Assessment Of The Utilization And Perceived Efficacy Of Sex Offender Legislation, Morgan Graham
Honors Program: Senior Projects (Public)
Current sex offender legislation in the United States is the result of a number of laws passed during the 1980-1990s. This study evaluates the efficacy and perception of these laws in Nebraska, including registration, community notification, and housing restriction policies. Using data from the Nebraska Annual Social Indicators Survey (NASIS), 1,814 people from 2008 and 1,232 people from 2017 were examined to determine the efficacy and popularity of sex offender legislation and how the data has changed over time. Results showed that only a minority of Nebraskans have accessed the registry. Of those who checked, women and individuals with children …

Managing The Atmosphere: Intelligence And Assessment In The Early Years Of The Northern Ireland Peace Process—An Interview With Sir John Chilcot, Graham Spencer
New England Journal of Public Policy
Though the Northern Ireland peace process was shaped by the involvement of many actors and participants, it is also evident that certain figures were central to its development. One such figure was Sir John Chilcot, who, based in the Northern Ireland Office in the formative years of the peace process, provided a point of focus for communicating with and managing a range of individuals and groups with the overriding objective of ending conflict in Northern Ireland. This article is based on an extended interview with Chilcot about the challenges he faced in assessing intelligence across a range of sources and …
Collective Memory, Criminal Law, And The Trial Of Derek Chauvin, Sean A. Berman
Collective Memory, Criminal Law, And The Trial Of Derek Chauvin, Sean A. Berman
Duke Law Journal
This Note describes how criminal trials for prominent criminal acts contribute to the collective memory of the underlying offense. Hannah Arendt once argued that the purpose of criminal trials is to “render justice, and nothing else.” Unlike criminal trials, political trials strive to produce collective memory. This Note utilizes political trials as a foil to criminal trials to identify the ways that criminal trials succeed (and fail) to produce collective memory. Several features of the criminal trial— namely, the trial’s unique narrative form, constituent storytellers, capacity to capture the gravity of the offense, and jury—add to society’s shared narrative of …

Understanding Community Safety And Policing In San José, California: A Qualitative And Communal Analysis, Michael Dao, Soma De Bourbon, Melissa Mcclure Fuller, William Armaline, Miranda Worthen
Faculty Research, Scholarly, and Creative Activity
In Summer 2020, persistent public protest about racial injustice and police violence spurred conversations and action across the United States and the world about what community safety means and the various ways it can be achieved–particularly for diverse community members whose lives may be threatened under the status quo. In San José, California, this led in part to a community engaged research study on reimagining community safety–The People's Budget of San José. The project intended to inform justice policy reform in the city according to the perspectives and needs of residents. Through this community-academic partnership, 14 focus group discussions were …

Movement of people that are cross-border or international migration is a global phenomenon whose frequency is increasing from year to year because it is driven by developments in the current global situation. The presence of migrants and/or refugees can bring new threats to state security and sovereignty. Threats that not only contribute to the emergence of transnational crime but are more complex in relation to other threats such as environmental degradation, the development of religious radicalism, sectarianism and others which are increasingly undermining the existence of a nation and state. The phenomenon of illegal immigrants connected to terrorism has been …

Denker, Kendra Knight, Riley K. Carroll, Kathryn R. Bradley, Peyton J. Bonine, Sophia M. Lauck, Heidi S. Przytulski, Michael L. Storr
Journal of Communication Pedagogy
The COVID-19 pandemic created an exigency for educators to reevaluate their approaches to the classroom with one major dimension being course modality. This study uses the Instructional Beliefs Model to examine the impacts of course modality (i.e., hybrid versus face-to-face formats) and students’ communication growth mindset on student engagement in the foundational public speaking course. Consistent with pre-COVID-19 findings, the results indicated that modality does not significantly impact student engagement, with one exception: higher cognitive interest scores were reported among students in the hybrid modality. Communication growth mindset associated positively with all student engagement variables examined: student interest–emotional, student interest–cognitive, …

How Children's Advocacy Centers Law Enforcement Officers Cope With Work-Related Stress: Impacts And Approaches To Self-Care, Oliver W.J. Beer, Brieanne Beaujolais, Kathryn G. Wolf, Akram Ibrahim, Megan M. Letson
School of Health Professions
Work-related stress has been identified as being harmful for law enforcement officers’ (LEOs) health. The absence of effective coping strategies exacerbates the negative psychophysiological impacts on health. The literature suggests that law enforcement employers and communities also feel the impact of stress among LEOs. This study addresses the gap in the current literature in terms of qualitative-based exploration of the personal and professional impacts of LEs working within Children's Advocacy Centers (CACs) and self-care and stress alleviation practices in response to environmental stressors. CAC LEOs’ responses to three open-ended responses were analyzed from a national survey in the United States. …

Developing An Anti-Racist Practice In Occupational Therapy: Guidance For The Occupational Therapist, Justin E. Lerner, Angie Kim
Developing An Anti-Racist Practice In Occupational Therapy: Guidance For The Occupational Therapist, Justin E. Lerner, Angie Kim
The Open Journal of Occupational Therapy
A strong anti-racist practice is critical for occupational therapists who represent an overwhelmingly white and female workforce yet serve people from all ethnic and racial backgrounds. These therapists are commonly unprepared to work with a racially diverse clientele because of a lack of reflective and critical practice grounded in anti-racism. This article provides some critical literature about race and racism in occupational science. We present important concepts for therapists to deepen their understanding of anti-racist practice, including intersectionality, agent and target groups, and equity and equality. We then explore some critical theoretical frameworks that can help conceptualize anti-racist practice, such …

Process Pluralism In The Post-Covid Dispute Resolution Landscape, Orna Rabinovich-Einy
Process Pluralism In The Post-Covid Dispute Resolution Landscape, Orna Rabinovich-Einy
Texas A&M Law Review
Among her numerous contributions as a founder of the field, Professor Menkel-Meadow coined and developed the term “process pluralism,” one of the most influential concepts in the dispute resolution arena. Process pluralism serves both as a descriptive lens in observing the dispute resolution landscape and as a normative prism through which various procedural schemes can be evaluated and procedural reform can be devised.
In the last few years process pluralism has gained new meaning as diversity in procedural avenues increasingly encompassed a broader range of mediums. Initially, such additional procedural choices existed mainly in written asynchronous form, but with the …
Feminist Legal Theory And #Metoo: Revisiting Tarana Burke’S Vision Of Empowerment Through Empathy, Penelope E. Andrews
Feminist Legal Theory And #Metoo: Revisiting Tarana Burke’S Vision Of Empowerment Through Empathy, Penelope E. Andrews
Texas A&M Law Review
It is my purpose to ground this Article in ubuntu and the politics of radical love as applied to the goals of #MeToo and its pursuit of redress for victims of sexual harms. Part II explores the convergences and divergences of #MeToo with feminist campaigns of an earlier era. Part III questions whether a renewed quest for gender equality, largely spawned by a Twitter/social media campaign, may lead to sustainable change built on notions of empathy and restorative justice, which was the vision espoused by Carrie in her work and which influenced Tarana Burke when she founded #MeToo. Part IV …

Black Market: An Exploration Of Black Mental Health In America, Alexandria D. Burroughs
Psychology from the Margins
The stories and experiences of marginalized groups are rarely heard and given the attention they deserve, so the purpose of this article is to analyze the history of the African American community and the treatment they have received from the mental health profession. The article takes an in depth look into the journey of the Black community beginning with the Trans-Atlantic Slave Trade and ending with the current sociocultural climate of present day society. This journey through the history of the African American community reveals generational scars that are still very prevalent within the community and the obstacles they continue …
