With Great Power Comes Great Responsibility: Superheroes & The Law, Thomas Simmons, Chris Dellicarpini, Rick Collins

Faculty Publications

Legal issues and lessons abound in superhero narratives. Caped heroes often act above and outside the law but deliver on law’s promises of justice and mercy in ways that ordinary legal actors cannot. Legal ethics, criminal law, and procedure are all on display. Superheroes supply a framework for examination of multiple legal issues and lessons, including what it means to be ethical (within the context of the rules of professional conduct and also in a broader sense) and how a legal life can be a virtuous one.

Thomas Walker v. John Baldwin

Appeal from the United States District Court for the Northern District of Illinois, Western Division, Honorable Iain D. Johnston (3:19-cv-50233)

From the Summary of the Argument

The Seventh Circuit should re-examine its precedent to allow for monetary damages for individual capacity suits under the Religious Land Use and Institutionalized Persons Act (RLUIPA) for three reasons. First, RLUIPA’s text follows the same approach as 42 U.S.C. § 1983 and should be interpreted to afford the same types of broad remedies. Before Employment Division of Oregon v. Smith, 494 U.S. 872 (1990), reduced the …

We Charge Genocide: An Examination Of Racism As Black Genocide In America, Jasmine Jordan Oct 2022

We Charge Genocide: An Examination Of Racism As Black Genocide In America, Jasmine Jordan

Undergraduate Research (Journal)

The US Civil Rights Movement and race relations in the US have been met with recent academic popularity, with different historiographies being hotly contested (Hall, 2007) – the result is a complex understanding of African American history (Dwyer, 2000; Lawson, 1991). African Americans were enslaved, segregated, massacred, beaten, raped, and lynched for hundreds of years, leading some academics to believe that African Americans faced a genocide, specifically a ‘Black Genocide’ (Wright, 1969). For the purpose of this essay, the term genocide will follow Lemkin’s orginal conception of the word as well as the United Nation’s definition, where genocide is not …

Conservative State Policies Contribute To Higher Mortality Rates Among Working-Age Americans, Jennifer Karas Montez, Nader Mehri, Shannon M. Monnat Oct 2022

Conservative State Policies Contribute To Higher Mortality Rates Among Working-Age Americans, Jennifer Karas Montez, Nader Mehri, Shannon M. Monnat

Population Health Research Brief Series

The risk of dying during working ages (25 to 64) is high, rising, and unequal in the United States. Working-age mortality rates are much higher in some states than others. Part of the explanation may relate to differing policies across states that affect health. While some states enact policies that invest in people’s economic, social, and behavioral wellbeing, others enact policies that are potentially harmful to health. Using mortality data from the U.S. Centers for Disease Control and Prevention, this study examined how state policies on criminal justice, taxes, environment, firearms, marijuana, health care, labor, and tobacco were associated with …

Exploring Parenthood And The Influence Of Lived Experiences On Parenting Behaviors Among Child Welfare-Involved Adults, Veronica Howell Oct 2022

Exploring Parenthood And The Influence Of Lived Experiences On Parenting Behaviors Among Child Welfare-Involved Adults, Veronica Howell

USF Tampa Graduate Theses and Dissertations

The World Health Organization asserts the healthy development of children is essential. Cases of violence and maltreatment impede the development of children worldwide. Six in 10 adults in the general US population have reported at least one adverse childhood experience (ACE), while vulnerable populations, including child welfare-involved adults (i.e., parents and caregivers), often report more. This history is associated with higher morbidity and mortality rates alongside higher economic costs; therefore, preventing ACEs and promoting safe, stable, and nurturing relationships between parents and children is critical. The purpose of this exploratory qualitative study was to understand the meanings and responsibilities associated …

Difference In Preparedness: Do School Staff Feel Prepared For An Active Shooter Or Attack?, Susanne R. Gaal, Matthew B. Fuller, Stacie Szaal, Katherine Linn, Cherokee Ford

School Leadership Review

The 2020 Texas Educators’ Needs Assessment Regarding School Safety and Victims Services included responses from educators across the state of Texas regarding school safety. This needs assessment generated data that provided researchers with the unique opportunity to analyze the school safety issues in Texas (Fuller et al, 2020). The purpose of the study was to evaluate Texas K-12 educators responses to their school’s preparedness for an active attack or shooter using data from that needs assessment. To build a strong analysis, the results were separated into three categories: educator role; Texas school regions; and urbanicity. Pearson chi square statistical analysis …

University Media Coverage Of Rape Cases And Its Contribution To Victim Blaming, Chelsea Cheyenne Hays

Student Theses and Dissertations

In this study I focus on whether the media has any effect on victim-blaming in the universities setting. I looked particularly at Ivy league universities due to their prestige. I focus on how they handled the assault, the language used by the media for the perpetrator and the survivor. In this study the university that I studied were Duke University, Vanderbilt University, and Stanford University. I used a critical content to analysis to find emerging themes throughout national newspapers, The New York Times and USA Today. I also looked at the student newspaper for each university. My findings concluded that …

A Multi-Site Study Of Firearms Displays By Police At Use Of Force Incidents, Timothy Cubitt, Justin Nix Oct 2022

A Multi-Site Study Of Firearms Displays By Police At Use Of Force Incidents, Timothy Cubitt, Justin Nix

Criminology and Criminal Justice Faculty Publications

The power to use force is a defining characteristic of policing, one that is accompanied by a responsibility to exercise these powers in the circumstances deemed necessary. This study analyzes data from four policing agencies to predict the likelihood of an officer drawing and pointing their firearm at a use of force incident. Findings suggest that situational factors were important in influencing whether an officer may draw and point their firearm. However, a priming effect, in which officers were more likely to draw their firearms when dispatched to an incident, may also be present. The rate that officers drew and …

Concerns Re: Rikers Island And The Increase In Inmate Deaths, Emma Guggenheimer Oct 2022

Concerns Re: Rikers Island And The Increase In Inmate Deaths, Emma Guggenheimer

Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog

In recent years, New York City’s jail system has been in a state of constant crisis due to overcrowding, violence, and consistent sick outs from correction officers. When Mayor Eric Adams took office in January 2022, Department of Corrections commissioner Louis Molina said he was “unequivocally committed to transparency and restoring public trust in the agency.” The agency has been plagued by corruption and sixteen detainee deaths in 2021. As of September 27, 2022, sixteen people have died after being held in Riker’s Island, even as officials have rushed to implement reforms to stave off a looming June 2022 threat …

The Principle Of Proportionality In Sentencing: A Dynamic Evolution And Multiplication Of Conceptions, Marie Manikis Oct 2022

The Principle Of Proportionality In Sentencing: A Dynamic Evolution And Multiplication Of Conceptions, Marie Manikis

Osgoode Hall Law Journal

This article examines the theoretical foundations and developments of the concept of proportionality in common law sentencing. It traces its evolution within its two main underlying frameworks: desert-based and consequentialist theories of punishment. It specifically examines the Canadian context and demonstrates that this concept was primarily rooted in a desert-based framework but has increasingly been infused with consequentialist rationales. It is argued that this multiplication of underpinnings has led to a conceptual muddling of proportionality, risking voiding the concept of its meaning and usefulness to decision-makers at sentencing. The article therefore proposes a nuanced framework, similar to the one in …

The Application Of Bystander Intervention Scripts: Implications For Guardianship In Action, Leah C. Butler, Amanda Graham, Bonnie S. Fisher Oct 2022

The Application Of Bystander Intervention Scripts: Implications For Guardianship In Action, Leah C. Butler, Amanda Graham, Bonnie S. Fisher

Criminology and Criminal Justice Faculty Publications

Responding to high rates of interpersonal victimization and perpetration among adolescents, schools have implemented bystander intervention (BI) training to educate students to intervene to prevent or stop violence. These trainings function much like an application of scripts for guardianship in action. The current study builds on the overlapping and complementary bodies of BI and routine activities research by testing whether participation in BI training, namely Green Dot (GD), influences individuals’ underlying ability to intervene. Using four years of survey data collected from high school students (N = 2,374–3,443), we use item response theory to model the difficulty of engaging …

The Impact Of Gender Identity, Medical Transition, And Other Substances On Marijuana Use For Transgender Adults, Alex Redcay, Elisabeth Counselman Carpenter, Kevin Lally Oct 2022

The Impact Of Gender Identity, Medical Transition, And Other Substances On Marijuana Use For Transgender Adults, Alex Redcay, Elisabeth Counselman Carpenter, Kevin Lally

Journal of Social, Behavioral, and Health Sciences

Transgender individuals have been identified as having greater rates of substance use. Previous research often focused on the intersection of HIV risk and substance use on specific age ranges or on how minority stress and discrimination relate to substance use. Using data from the 2015 United States Transgender Survey, our study is one of the first to explore the relationship among gender identity, age, the role of medical transition, and the use of marijuana within the transgender community. A deeper understanding of the relationship of these variables will benefit the transgender community by allowing for more thorough and accurate assessment …
