Pleading For Pre-Bargain Disclosure In State Legal Ethics, Anthony R. Guttman Feb 2023

Pleading For Pre-Bargain Disclosure In State Legal Ethics, Anthony R. Guttman

Denver Law Review

Plea bargains dispose of over 97% of criminal matters in the United States’ criminal justice system. Proponents of plea bargaining typically justify the practice under the “shadow of trial” theory, claiming that plea bargains reflect predicted trial outcomes minus a discount for the prosecutorial resources saved. But scholars challenge this theory because other factors influence whether a defendant will enter a plea bargain. Among many are attorney competence, workloads, and legal resources. Yet a largely overlooked gap is that state ethics rules undermine the theory responsible for the legitimacy of plea bargaining. Each state has enacted a similar variation of …

Perceptions Of Law Enforcement Officers Regarding Eyewitness Identification Policies: A Survey Of Chief Executive Officers (Ceos) Of Arkansas Police Agencies., Chadwick Shane Henson Feb 2023

Perceptions Of Law Enforcement Officers Regarding Eyewitness Identification Policies: A Survey Of Chief Executive Officers (Ceos) Of Arkansas Police Agencies., Chadwick Shane Henson

Student Theses and Dissertations

Eyewitness identification evidence is extremely dependent on the processes utilized by law enforcement to acquire and uphold the evidence. Unquestionably, research has led to a variety of significant findings regarding the ways in which law enforcement obtains identification evidence from eyewitnesses. Despite these findings and academics' best efforts to disseminate their results to public agencies, policymakers, and important law enforcement personnel using a variety of evidence, changes to policy and practice have been slow to come about, if they have come at all. Using a sample of Chief Executive Officers (CEO) of police agencies in Arkansas (N = 69), we …

Should Prosecutors Be Expected To Rectify Wrongful Convictions?, Bruce A. Green Feb 2023

Should Prosecutors Be Expected To Rectify Wrongful Convictions?, Bruce A. Green

Texas A&M Law Review

In 2008, the American Bar Association amended the Model Rules of Professional Conduct to address prosecutors’ post-conviction conduct. Model Rules 3.8(g) and (h) establish the remedial steps a prosecutor must take after achieving a criminal conviction when confronted with significant new evidence of an injustice. They require prosecutors to disclose the new exculpatory evidence and to take reasonable steps to initiate an investigation, and if clear and convincing evidence then establishes the convicted defendant’s innocence, the prosecutors’ office must take reasonable steps to rectify the injustice. Since then, 24 state judiciaries have adopted versions of one or both rules. Although …

“In These Times Of Compassion When Conformity’S In Fashion”: How Therapeutic Jurisprudence Can Root Out Bias, Limit Polarization, And Support Vulnerable Persons In The Legal Process, Michael L. Perlin Feb 2023

“In These Times Of Compassion When Conformity’S In Fashion”: How Therapeutic Jurisprudence Can Root Out Bias, Limit Polarization, And Support Vulnerable Persons In The Legal Process, Michael L. Perlin

Texas A&M Law Review

This Article considers the extent to which caselaw has—either explicitly or implicitly—incorporated the precepts of therapeutic jurisprudence (“TJ”), a school of legal thought that focuses on the law’s influence on emotional life and psychological well-being, and that asks us to assess the actual impact of the law on people’s lives. Two of the core tenets of TJ in practice are commitments to dignity and to compassion. I conclude ultimately that with these principles as touchstones, TJ can be an effective tool—perhaps the most effective tool—in rooting out bias, limiting polarization, and supporting vulnerable persons in the legal process. But this …

Modern Approaches To Addressing The Mass Incarceration Of America's Mentally Ill Population, Cameron A. Bice, April N. Terry Feb 2023

Modern Approaches To Addressing The Mass Incarceration Of America's Mentally Ill Population, Cameron A. Bice, April N. Terry

Academic Leadership Journal in Student Research

Correctional facilities negatively affect individuals with pre-existing mental and behavioral health concerns while also creating an environment that manifests future mental illness. Issues include facility overcrowding, restrictive housing practices, lack of accessible services, and ill-informed practices and procedures when working with individuals with mental illness. Incarcerated individuals with mental illness also face disparities through (1) sentence length, (2) race/ethnicity and gender, and (3) increased risk in victimization. This paper draws attention to a long-standing, yet current critical issue in the American criminal justice system—the use of jails and prisons as modern-day psychiatric hospitals. This literature yields many options for disrupting …

Pathology Research and Scholarship

BACKGROUND: Estimating the economic costs of self-injury mortality (SIM) can inform health planning and clinical and public health interventions, serve as a basis for their evaluation, and provide the foundation for broadly disseminating evidence-based policies and practices. SIM is operationalized as a composite of all registered suicides at any age, and 80% of drug overdose (intoxication) deaths medicolegally classified as 'accidents,' and 90% of corresponding undetermined (intent) deaths in the age group 15 years and older. It is the long-term practice of the United States (US) Centers for Disease Control and Prevention (CDC) to subsume poisoning (drug and nondrug) deaths …

Match Up: Increasing Disclosure Of Facial Recognition Technology With Criminal Discovery Rules, Paget Barranco Feb 2023

Match Up: Increasing Disclosure Of Facial Recognition Technology With Criminal Discovery Rules, Paget Barranco

Duke Journal of Constitutional Law & Public Policy Sidebar

Facial recognition technology (FRT) is an automated computer tool that compares the image of one face in a target image to one or more images of other faces. Law enforcement at both the federal and state levels increasingly use FRT to identify unknown perpetrators of crimes. FRT has great potential to generate investigative leads and assist in solving crimes, but there are issues with the technology and a lack of transparency about how it is used. Further, law enforcement and prosecutors may not disclose information about the FRT search results that they relied on to identify a suspect, affecting defense …

Two-Stage Approach For Forensic Handwriting Analysis, Ashlan J. Simpson, Danica M. Ommen Feb 2023

Two-Stage Approach For Forensic Handwriting Analysis, Ashlan J. Simpson, Danica M. Ommen

SDSU Data Science Symposium

Trained experts currently perform the handwriting analysis required in the criminal justice field, but this can create biases, delays, and expenses, leaving room for improvement. Prior research has sought to address this by analyzing handwriting through feature-based and score-based likelihood ratios for assessing evidence within a probabilistic framework. However, error rates are not well defined within this framework, making it difficult to evaluate the method and can lead to making a greater-than-expected number of errors when applying the approach. This research explores a method for assessing handwriting within the Two-Stage framework, which allows for quantifying error rates as recommended by …
