Rounding Up The Three-Fifths Clause: Eradicating Prison Gerrymandering In The South, Abigail N. Falk Feb 2023

Rounding Up The Three-Fifths Clause: Eradicating Prison Gerrymandering In The South, Abigail N. Falk

Pepperdine Law Review

This Comment examines the phenomenon of prison gerrymandering, a practice that involves counting prisoners as residents of the counties where their state correctional facilities are located—rather than in their home communities—for redistricting and representational purposes. This practice of counting inflates the voting power of rural, white districts with large prison complexes and diminishes the voting power of minority communities. Prison gerrymandering has become especially pervasive across southern states while many of the South’s northern counterparts have eradicated this practice through legislative reform. This Comment proposes a solution to stop prison gerrymandering in the South, arguing a strategy to produce a …

Sentenced To Prison, Not To Death: Home Confinement During The Pandemic And Moving Beyond Covid-19, Sydney Mcconnell Feb 2023

Sentenced To Prison, Not To Death: Home Confinement During The Pandemic And Moving Beyond Covid-19, Sydney Mcconnell

Arkansas Law Review

A prison sentence should “not include incurring a great and unforeseen risk of severe illness or death.” But for the 2.3 million people housed in our nation’s prisons and jails during the COVID-19 (“COVID”) pandemic, their sentences have included just that. Since the beginning of the pandemic, the Bureau of Prisons has transferred approximately 49,068 inmates to home confinement. The decision to expand home confinement is an important one. It is a step in the right direction to address another broader, and distinctly American, issue: mass incarceration. Lawmakers on both sides of the political aisle have reached the consensus “that …

The Status Of Women In Utah Politics: A 2023 Update, April Townsend, Susan R. Madsen

Marketing and Strategy Faculty Publications

Although Utah has a rich heritage of women’s involvement in voting, advocacy, and various types of political participation, for decades Utah has lagged behind most states in terms of women running for and serving in elected political roles. To track progress, the Utah Women & Leadership Project (UWLP) began reporting on the status of women in Utah politics in 2014, with updates in 2017, 2021, 2022, and now 2023. Although strides have been made in increasing the number of women serving in political roles in recent years, there is still work to be done. Research continues to confirm that when …

Freedom Of Expression And The Charter: 1982-2022, Jamie Cameron Feb 2023

Freedom Of Expression And The Charter: 1982-2022, Jamie Cameron

Commissioned Reports, Studies and Public Policy Documents

In 2022, on the 40th anniversary of the Canadian Charter of Rights and Freedoms, I wrote a 5-part blog series that reviewed the Supreme Court of Canada’s s.2(b) jurisprudence. These blogs were published by the Centre for Free Expression (CFE) at Toronto Metropolitan University (TMU), and can be found on the CFE website (See author page: https://cfe.torontomu.ca/blog?issues=All&authors=117). The five blogs, which are consolidated here, begin with a comment on the Court’s 2021 landmark decisions in City of Toronto v. Ontario and Ward v. Quebec. The second blog shifts, providing a quantitative and qualitative survey of the …

The Silent Suffering Of Survivors: The Covid-19 Pandemic's Impact On Domestic Violence Resources, Osoniya I. Wodi Feb 2023

The Silent Suffering Of Survivors: The Covid-19 Pandemic's Impact On Domestic Violence Resources, Osoniya I. Wodi

XULAneXUS

Increased reports of domestic violence has coincided with the eruptions and growth of the COVID-19 pandemic. Previous research has shown a positive correlation between domestic violence and the occurrence of humanitarian crises. Recently published research about domestic violence police reports in the COVID-19 pandemic has also supported this correlation. We used data from the National Network To End Domestic Violence (NNEDV) to analyze the number of survivors served by domestic violence programs in the United States, type of resources available, and unmet request from 2019-2021, one year pre-pandemic and the first two years of the pandemic. Findings from this study …

Exploring The Impact Of Interpersonal Trust On Health Outcomes In Rapidly Gentrifying Neighborhoods In Portland, Oregon, Julie T. Ha

PSU McNair Scholars Online Journal

Social determinants have been recognized to be significant factors contributing to the overall health outcomes of individuals. However, there is limited research on how these factors have directly impacted the mental and physical wellness of people in neighborhoods that are experiencing rapid gentrification. The objective of this study is to determine whether the present level of interpersonal trust between individuals in neighborhoods is associated with the mental and physical health outcomes among its residents. This quantitative study uses the Albina-Rockwood Neighborhood Promise Survey, which uses data from a random sample of families living in two rapidly gentrified neighborhoods in Portland, …

Survival In The City Streets: An Autoethnographic Analysis Challenging The Criminalization Of Urban Street Gangs, Robert Northman

PSU McNair Scholars Online Journal

To varying outcomes, many attempts have been made to understand and define urban street gangs. Though these understandings and definitions of gangs may vary, they almost always rely on criminality as at least one of the gang’s “purposes.” The author, a gang member for approximately thirty years seeks to contribute lived experiences to the conversation centered on gangs. This auto-ethnographic analysis of urban street gang culture seeks to highlight the author’s experiences as potential determinants of gang membership while also exacting the realities of some common myths and other misconceptions surrounding the urban street gang, including the criminalization thereof. The …

International Criminal Trials Creating A Dominate Narration Of History And Overlooking Historical Blind Spots, Hoor El Masry

Theses and Dissertations

History is key to developing a better understanding of the world, what has happened in the past helps one understand the present. The Egyptian National Anti-Trafficking Law ‘Adoption Process And Assessment’, Nourhane Awad

Theses and Dissertations

This thesis is about the impact of Egyptian national laws on the protection of African migrants and refugees. Egypt has been considered a transit country for African migrants and refugees fleeing their countries toward European countries or Israel in the past due to its specific geographic location. For that reason, Egypt is considered one of the essential parts of the trafficking process in the middle east. For that reason, it is essential to study and explore how the Egyptian government is controlling and governing the trafficking of persons. In addition, it is important to understand its institutional setup and framework …

The Long Road To Justice: Why State Courts Should Lower The Evidentiary Burden For Proving Racialized Traffic Stops And Adopt The Exclusionary Rule As A Remedy For Equal Protection Violations, Abby M. Fink Feb 2023

The Long Road To Justice: Why State Courts Should Lower The Evidentiary Burden For Proving Racialized Traffic Stops And Adopt The Exclusionary Rule As A Remedy For Equal Protection Violations, Abby M. Fink

Washington Journal of Social & Environmental Justice

Racist and brutal policing continues to pervade the criminal legal system. Black and brown people who interact with the police consistently face unequal targeting and treatment. Routine traffic stops are especially dangerous and harmful and can lead to death. Under Whren, a police officer’s racist motivations or implicit bias towards a driver do not influence the constitutionality of a traffic stop. An officer only needs to show there was probable cause to believe a traffic stop occurred. Although the unconstitutionality of pre-textual traffic stops has been widely explored since Whren, both federal and state courts have struggled to find legal …

Symposium: The Future Of Reproductive Rights: Foreign Law In Dobbs: The Need For A Principled Framework, Sital Kalantry Feb 2023

Symposium: The Future Of Reproductive Rights: Foreign Law In Dobbs: The Need For A Principled Framework, Sital Kalantry

ConLawNOW

This article critiques the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization for its unprincipled and superficial use of foreign law sources to overturn Roe v. Wade. It explains the surprising use of foreign law by conservative justices who had previously opposed all use of non-US law in decision-making. And it shows how international and foreign law can be used on by either side to both expand and retrench rights. The article thus argues for a more principled framework for when and how to use international law sources including a more contextual analysis of that law.

Linguistic Predictors Of Engagement On Anti-Incel Forums, Daniel Beutler Feb 2023

Linguistic Predictors Of Engagement On Anti-Incel Forums, Daniel Beutler

Student Theses

This thesis examines the determinants of social media engagement with extremist views in general and misogynistic ones in particular. The study, which is a part of an ongoing, large-scale examination of online hate, examined posts from r/IncelTears, a sub-forum in the long-form social media Reddit dedicated to attacks on the Involuntary Celibate (‘Incel’) digital communities. Previous research on engagement – and by extension virality – of online posts has broadly implicated linguistic markers of affect, morality, extremism, and social identity. This exploratory study correlated metrics of online engagement such as the number of Upvotes and Comments that each post garnered …

Minor Role: Youth Under Age 18 And New York City Violence, Jeffrey A. Butts, Sheyla A. Delgado, Richard A. Espinobarros Feb 2023

Minor Role: Youth Under Age 18 And New York City Violence, Jeffrey A. Butts, Sheyla A. Delgado, Richard A. Espinobarros

Publications and Research

Media outlets attribute recent concerns about increased violent crime in New York City to the behavior of juveniles and associate the increase with New York State's policy governing the handling of 16 and 17-year-olds in family courts rather than adult criminal courts. This databit explores age differences in violent crime arrests and shooting victimizations in New York City and finds the recent concerns to be misplaced.

Marsy's Law: Florida's Victim Classification Protections Are Too Broad And Wrongfully Utilized By Florida Law Enforcement Agencies, Ashley Lee Feb 2023

Marsy's Law: Florida's Victim Classification Protections Are Too Broad And Wrongfully Utilized By Florida Law Enforcement Agencies, Ashley Lee

Journal of the National Association of Administrative Law Judiciary

While new trends in legislation may aim to reduce the use of excessive force by law enforcement, some Florida agencies interpreted their state’s Marsy’s Law to protect officers accused of using excessive force. This Comment examines the inappropriateness of Florida’s law enforcement agencies’ interpretation of Marsy’s Law, particularly in the context of the law’s original intentions. This Comment points to a potential solution to this problematic interpretation, advocating for an additional limiting clause that narrowly targets how law enforcement interpreted this statute in the context of excessive force reports.

The Philippines And The World: Which Country Do Filipinos Trust More And Why, Mark Gabriel Wagan Aguilar Feb 2023

The Philippines And The World: Which Country Do Filipinos Trust More And Why, Mark Gabriel Wagan Aguilar

Graduate Research Conference (GSIS)

Agreements between and among countries have been going on for centuries for the purpose of trade, security, employment, and peace among others, however, changes on these agreements do happen, for instance, when a new President gets elected and see a different direction for his/her country. When President Rodrigo Duterte became President of the Philippines in 2016, he have made it clear that he doesn't trust the United States of America, while expressing preference in working with China, in fact, in his 6 year term, he has never step foot on the country for an official visit, however, a new perspective …
