This Preface, which introduces the American Criminal Law Review’s Symposium Issue on Reform-Minded Prosecution, begins by describing the power that prosecutors hold in the criminal legal system, which has historically gone unchecked and unquestioned. As mass incarceration, police violence, and wrong- ful convictions began to permeate the public consciousness, many communities focused their attention on the critical role of their local elected prosecutor and elected leaders who promised to do the job differently. Nearly half a million people are currently held in pretrial detention across the United States. Legal scholarship has explored many of the actors and factors contributing to the deprivation of freedom of those presumed innocent. And while the scholarship in these areas is rich, it has primarily focused on certain system actors—including judges, prosecutors, and profit-seeking sheriffs—structural concerns, such as the role race plays in who is being held in pretrial detention, or critiques of the failed promise of algorithms to deliver on bias-free bail determinations. But relatively little scholarship exists about the contributions of public defenders to this deprivation. …

Sex trafficking is a hidden crime that affects many vulnerable groups such as women and children. Prior research has demonstrated that individuals currently or formerly engaged in sex trafficking experience heightened levels of depression, anxiety, posttraumatic stress disorder (PTSD), and other mental health concerns. Most of these studies relied on structured interviews and, to date, no empirical studies have evaluated the psychological difficulties of sex trafficking victims with an empirically valid measure. Emojis are 3,633 ubiquitous symbols-as-communication used by 92 percent of internet users. These tiny yet influential pieces of evidence hold the power to complete, enhance, mitigate, and flip the meaning of surrounding text. Consequently, court references to emojis have grown exponentially in the last five years. As emojis have become a cornerstone of digital discourse, courts have increasingly encountered the significant impact of emojis on parties’ legal claims. A guide for handling of emoji evidence under the Federal Rules of Evidence (FRE), therefore, is important to afford proper treatment to this relatively new evidentiary form.

Face Recognition Under Adverse Viewing Conditions: Implications For Eyewitness Testimony, Charles C. F. Or, Denise Y. Lim, Siyuan Chen, Alan L. F. Lee

Eyewitness testimony forms an important component in deciding whether a case can be prosecuted. Yet, many criminal perpetrators deliberately conceal their faces with disguises or under dim lighting, undermining eyewitness accuracy. This article reviews recent studies to characterize the factors that impair face recognition performance, specifically, various forms of face disguise (e.g., face masks, sunglasses) and different lighting conditions. Research shows that identification accuracy, alongside eyewitness confidence and decision bias, all affect the reliability of eyewitness accounts. A consistent finding across studies is that face-identification accuracy can be improved by matching the viewing conditions during the police lineup with those …

Following the murder of George Floyd, the U.S. Congress called upon the National Organization for Black Law Enforcement Executives (NOBLE) to play a role in the reimagining of policing in America, including a transformation of policing from a warrior to a guardian mentality. In turn, NOBLE partnered with the Institute for Polarities of Democracy (the Institute) to conduct an analysis of the 21st Century Policing Report (the Report), which focused on addressing a myriad of issues that challenged the relationship between the police and communities. Many opportunities to learn from the 2013 Boston Marathon bombing have not been capitalized on. The terrorist attack was launched in the heart of Boston, a densely populated urban area with a population of approximately 670,000. Those numbers are amplified by the hundreds of thousands of spectators that line the streets along the Marathon route, with most at the finish line on Boylston Street. Two pressure cooker bombs were detonated in the finish line area, killing three and injuring 264. Among the injured were 16 who suffered traumatic amputations. Alcohol use among fraternity affiliated men presents a concerning trend with harmful consequences (DeSimone, 2009; Hingson et al., 2017; McCreary et al., 2021; Nuwer, 2001; Patrick et al., 2022; Ranker & Lipson, 2022). The availability theory of alcohol-related problems suggests alcohol use could be influenced based on the availability and proximity of alcohol outlets in the environment (Dimova, 2023; Kypri et al., 2008; Scribner et al., 2008; Single, 1984; Weitzmann et al., 2003). In an era marked by profound neighborhood transformation, the phenomenon of gentrification emerges as a dominant force. This dissertation undertakes a holistic exploration of gentrification, unraveling its diverse typologies and consequential impacts on health outcomes. Manuscript 1 details the concept of displacement pressure, exploring the multi-faceted experiences of residents in transforming neighborhoods while highlighting psychological and physiological repercussions beyond mere physical relocation. Manuscript 2 leverages the innovative methodology of repeated measures latent profile analysis (RMLPA) to investigate the multiple manifestations of gentrification. The note argues that the compulsory collection and indefinite maintenance of juvenile forensic DNA profiles violate the Fourth Amendment's protection against unreasonable searches and seizures. It asserts that such practices are particularly problematic for minors due to their heightened privacy interests, the low recidivism rates among juveniles, and the contradiction with the juvenile justice system's focus on rehabilitation and confidentiality. The note advocates for legislative reforms, such as New York Senate Bills 998 and 3104, to address these issues and protect juveniles' privacy rights.

Mexico and the United States both contend with the issue of human trafficking and implement measures to address this prevalent challenge, not only within their respective territories, but also along their shared border region. Despite significant efforts, both nations encounter obstacles in their anti-trafficking endeavors. The U.S. promotes a comprehensive legal framework, exemplified by the Victims of Trafficking and Violence Protection Act, yet faces criticism regarding deportation policies and inadequate victim support mechanisms. The current literature on the use of arson in homicides analyzes the role of psychosis and mental illness, detection avoidance, and fire-setting as a precursor to violent crime. Only recently have researchers examined the connection between arson and family violence through the means of coercive control. Remaining unanswered is the role of arson in family mass murders occurring in a private residence. Using the Mass Killings in America database compiled and maintained by the Associated Press, USA Today, and Northeastern University (2006-2022), I compare characteristics of family mass murders that are arson-related to those that are non-arson-related. Racial/Ethnic Group Differences In Older Adults' Involvement With Adult Protective Services, Kenneth J Steinman, Jason Burnett, Rebecca Hoffman

This paper represents the first study to focus on quantifying racial/ethnic group differences in older adults' involvement with adult protective services (APS).  Across 3 independent county programs, the rate of APS reports was about twice as high for Black older adults compared to White older adults.  These differences were greater for clients who were older and male but remained similar across allegation type.  The percent of reports validated was slightly but consistently lower for Black clients than for White clients, and a lower percentage of Black clients' cases were closed due to investigation or service refusal. This builds upon the initial report in the Data Collaborative for Justice's Bail Reform and Recidivism Series - Does New York's Bail Reform Law Impact Recidivism? A Quasi-Experimental Test in New York City. Using controlled-interrupted time series analysis (CITS), this follow-up study estimated effect of New York's initial reform on recidivism in New York City by comparing re-arrest rates between bail-ineligible versus bail-eligible offenses before and after the reforms.

In higher education, sense of belonging has been linked to improved outcomes such as retention and academic achievement (e,g., Pittman & Richmond, 2007). Previous research has also identified participation in learning communities and campus residency as interventions which improve sense of belonging for students in this context (e.g., Solanki et al., 2019; Soria & Roberts, 2021). However, little research has been conducted to empirically study sense of belonging as a multidimensional construct, and no research has investigated interactions between on-campus residency and learning community participation on its development.

To Fee Or Not To Fee: Requester Attitudes Toward Freedom Of Information Charges, A. Jay Wagner, David Cuillier

This study seeks to establish a foundation for how FOI fees are received by public record requesters, and how fees influence behavior across demographics and requester types. A survey of 330 public records requesters in the United States revealed sharp disparities in how requesters perceive fees. Private citizens, journalists, academics, and nonprofit requesters were more likely to identify excessive fees as a serious impediment, whereas commercial requesters and lawyers did not. The study also found differences in how fees are experienced at the federal, state, and local levels. Findings suggest that fees are particularly problematic for certain requester types, notably …

Clear and fair criminal laws are foundational to criminal justice, and any meaningful reform effort should begin with the criminal laws. The Mississippi Code has been justifiably criticized as often being neither clear nor fair. This article about reforming the theft crimes is the fourth in a series of articles advocating for change to the Mississippi criminal laws. The first article explained why change is needed.
