The Maladaptive And Adaptive Effects Of Trust And Distrust On Externalizing Behavior, Shou-An Ariel Chang Oct 2023

The Maladaptive And Adaptive Effects Of Trust And Distrust On Externalizing Behavior, Shou-An Ariel Chang

Yale Graduate School of Arts and Sciences Dissertations

A wide range of behaviors, from hostility and defiance to more severe forms ofnorm violations, such as theft and violence, comprise the spectrum of externalizing behaviors. The psychological, physical, and social consequences associated with externalizing behaviors place a significant burden on the individual, their families, and society. Research has made substantial advances in identifying environmental-level and individual-level risk factors for externalizing behavior. However, despite work indicating that both externalizing behaviors themselves and several risk factors associated with externalizing behaviors are related to disruptions in trust and distrust, limited work has considered interactions between environmental- and individual-level risk factors and levels …

Consequences Of Childhood Maltreatment And Exposure To Community Violence: A Single-Moment And Longitudinal Trajectory Examination, Suzanne Charlotte Estrada Oct 2023

Consequences Of Childhood Maltreatment And Exposure To Community Violence: A Single-Moment And Longitudinal Trajectory Examination, Suzanne Charlotte Estrada

Yale Graduate School of Arts and Sciences Dissertations

Childhood adversity is one of the strongest predictors of long-term psychological, social, and physical negative life outcomes. Two subtypes of adversity, one perpetrated by someone in the home environment (i.e., childhood maltreatment, parental harshness) and the other perpetrated by someone in the community (i.e., exposure to community violence), are especially salient predictors of poor mental health and increased antisocial behavior. Research aimed at describing the occurrence of adversity often examines these subtypes separately. As a result, our understanding of the ways individuals experience adversity in the home and community and the long-term impact of co-occurring adversity is limited. Additionally, perhaps following …

After The Criminal Justice System, Benjamin Levin Oct 2023

After The Criminal Justice System, Benjamin Levin

Washington Law Review

Since the 1960s, the “criminal justice system” has operated as the common label for a vast web of actors and institutions. But as critiques of mass incarceration have entered the mainstream, academics, activists, and advocates increasingly have stopped referring to the “criminal justice system.” Instead, they have opted for critical labels—the “criminal legal system,” the “criminal punishment system,” the “prison industrial complex,” and so on. What does this re-labeling accomplish? Does this change in language matter to broader efforts at criminal justice reform or abolition? Or does an emphasis on labels and language distract from substantive engagement with the injustices …

Taking The Long Road: The Excessive Fines Clause As A Tool For Protecting Washington's Unsheltered Population, Anna Ferron Oct 2023

Taking The Long Road: The Excessive Fines Clause As A Tool For Protecting Washington's Unsheltered Population, Anna Ferron

Washington Law Review

Over the last decade, Washington State has seen a substantial increase in its unhoused population and an increase in laws that harm this group. Many of these laws subject unhoused and unsheltered people to fines, fees, and forfeitures that are exceedingly difficult for them to afford. The ExcessiveFinesClauses in the United States and Washington Constitutions protect citizens from fines deemed constitutionally excessive and could be used to shield unsheltered people from the burden of paying unjust fines they cannot afford. In City of Seattle v. Long, the Washington State Supreme Court analyzed the ability to pay of a person who …

“Stamping Out Segregation In Kansas”: Jim Crow Practices And The Postwar Black Freedom Struggle, Brent M. S. Campney Oct 2023

“Stamping Out Segregation In Kansas”: Jim Crow Practices And The Postwar Black Freedom Struggle, Brent M. S. Campney

History Faculty Publications

This study examines Jim Crow practices and the Black Freedom Struggle in Kansas between 1945 and 1960, focusing at the state level. It proceeds in three sections. First, it examines Jim Crow in housing, employment, schools, public accommodations, and sundown towns. Second, it addresses the enforcement of these practices through mob violence and, to a greater degree, police violence. Third, it investigates the activism of Black Kansans who were, irrespective of age, gender, or class, determined to destroy Jim Crow through public protests, legal strategies, and physical self-defense, even if they represented considerable ideological, methodological, and strategic diversity. The study …

Proceedings At An Impasse: Appealing Fugitive Disentitlement Orders Of International Defendants Under The Collateral Order Doctrine, Parker Siegel Oct 2023

Proceedings At An Impasse: Appealing Fugitive Disentitlement Orders Of International Defendants Under The Collateral Order Doctrine, Parker Siegel

Fordham Law Review

The doctrine of fugitive disentitlement allows federal courts to decline to entertain a defendant’s claims when that defendant is deemed a fugitive from justice. Once disentitled, defendants cannot seek relief from the judicial system until they submit to the court’s jurisdiction. But complications emerge when federal district courts disentitle non–U.S. citizens who reside outside of the United States, who are indicted for alleged misconduct committed abroad, and who attempt to dismiss charges while remaining in their home countries. Federal circuit courts of appeals are split on whether such defendants can appeal from a fugitive disentitlement ruling without submitting to the …
