When At Loggerheads With Customary International Law: The Right To Run For Public Office And The Right To Vote, Thompson Chengeta

Brooklyn Journal of International Law

Many populist demagogues in America and Europe have spoken; and continue to speak; against human rights in their campaigns for political office. This article discusses the factors that have contributed to the current wave of populism; and the nature of the challenges that are presented by populism to democracy; human rights; and constitutionalism from an international human rights law perspective. It also focuses on President Donald Trump; who was voted President of the United States; even after he clearly and publicly indicated his support for torture and his intentions to approve it in the United States. To that end; the …

Mobile Bodies, (Im)Mobile Beliefs? Religious Accord And Discord As Migratory Outcomes, Lily Kong, Orlando Woods Jun 2018

Mobile Bodies, (Im)Mobile Beliefs? Religious Accord And Discord As Migratory Outcomes, Lily Kong, Orlando Woods

Research Collection School of Social Sciences

This article advances a new understanding of the outcomes that arise from the movement and settlement of religion. These outcomes can range from religious accord to discord; or, from the full integration of migrant religions to inter-religious conflict. It identifies two axes that determine such outcomes. The first relates to the interplay between transnational religious agency and the strength of local religious structures. Harder structures are more likely to require migrant religious groups to make greater compromises to bring about situations of religious accord, while softer structures are less likely to do so. The second relates to the interplay between …

Long-Term Impacts Of Parliamentary Gender Quotas In A Single-Party System: Symbolic Co-Option Or Delayed Integration?, Devin K. Joshi, Rakkee Kuttikadan Thimothy Jun 2018

Long-Term Impacts Of Parliamentary Gender Quotas In A Single-Party System: Symbolic Co-Option Or Delayed Integration?, Devin K. Joshi, Rakkee Kuttikadan Thimothy

Research Collection School of Social Sciences

In recent years scholars have shifted their attention from the causes behind parliamentary gender quotas to their consequences for women’s descriptive, substantive, and symbolic representation. We contribute to this literature by focusing on long-term effects of gender quotas in the context of an authoritarian one-party system. Here we contest dominant theoretical explanations which posit that gender quotas in authoritarian states primarily serve the goals of symbolic co-option and window-dressing. Rather, we argue that while authoritarian adaptation may motivate the introduction of gender quotas, these quotas may result over time in what we call a delayed integration process featuring a gradual …

Objective—To describe differences in cognitive functioning across rural and urban areas among older Mexican adults.

Method—We include respondents aged 50+ in the 2012 Mexican Health and Aging Study (MHAS). Cognitive functioning by domain is regressed as a function of community size. The role of educational attainment in explaining rural/urban differences in cognitive functioning is examined.

Results—Respondents residing in more rural areas performed worse across five cognitive domains. The majority, but not all, of the association between community size and cognitive functioning was explained by lower education in rural areas.

Discussion—Respondents residing in more rural areas were disadvantaged in terms of …

Theses and Dissertations

This thesis analyzed stylized performance of Arabic-English code-switching (CS) and its interaction with gender, social class, and social networks in the context of the Egyptian comedy TV series Nelly and Sherihan. The theories of indexicality (Ochs, 1992; Silverstein ,1976), stance (Du Bois, 2007), and social networks (Milroy, J. & Milroy, L., 1985) were used to answer the research questions: 1) What is the social motivation for Arabic-English CS in relation to social class and gender specifically in the Egyptian TV series Nelly and Sherihan? 2) How do social networks as a variable affect Arabic-English CS of the main character in …

Investment Facilitation For Development: A Rights Perspective Of Multilateral Governance, Clair Gammage Jun 2018

Investment Facilitation For Development: A Rights Perspective Of Multilateral Governance, Clair Gammage

Indian Journal of International Economic Law

This article problematises the proposal to include rules relating to investment facilitation for development at the multilateral level. Embedding rules on investment facilitation will bring foreign direct investment (FDI) explicitly within the scope of the World Trade Organisation (WTO) with a view to fostering “development” and enabling countries to diversify their export capacity, integrate into global value chains, and link up the digital economy. The proposal for a multilateral agreement on investment facilitation for development raises normative questions about the evolutive nature of International Investment Law (IIL) and its interconnections with other species of international law, including trade and human …

The Role Of Bilingual Interactional Contexts In Predicting Interindividual Variability In Executive Functions: A Latent Variable Analysis, Andree Hartanto

Dissertations and Theses Collection (Open Access)

Despite a huge number of studies examining bilingual advantages in executive functions (EFs), the research findings with regards to the relations between bilingualism and EFs are mostly inconsistent and mixed. In order to shed light on these inconsistent findings, the current research aimed to tackle on both conceptual and methodological limitations that are prevalent in previous studies, namely: (a) failure to consider bilingual experiences in assessing bilingual advantages, and (b) task impurity due to substantial influence of non-EFs processes on EFs task performance. Based on Adaptive Control Hypothesis and Control Process Model of Code-switching, a theory-driven multisession study coupled with …

What Can Brown Do For You?: Addressing Mccleskey V. Kemp As A Flawed Standard For Measuring The Constitutionally Significant Risk Of Race Bias, Mario L. Barnes, Erwin Chemerinsky Jun 2018

What Can Brown Do For You?: Addressing Mccleskey V. Kemp As A Flawed Standard For Measuring The Constitutionally Significant Risk Of Race Bias, Mario L. Barnes, Erwin Chemerinsky

Northwestern University Law Review

This Essay asserts that in McCleskey v. Kemp, the Supreme Court created a problematic standard for the evidence of race bias necessary to uphold an equal protection claim under the Fourteenth Amendment of the U.S. Constitution. First, the Court’s opinion reinforced the cramped understanding that constitutional claims require evidence of not only disparate impact but also discriminatory purpose, producing significant negative consequences for the operation of the U.S. criminal justice system. Second, the Court rejected the Baldus study’s findings of statistically significant correlations between the races of the perpetrators and victims and the imposition of the death …

"Playing It Safe" With Empirical Evidence: Selective Use Of Social Science In Supreme Court Cases About Racial Justice And Marriage Equality, Russell K. Robinson, David M. Frost Jun 2018

"Playing It Safe" With Empirical Evidence: Selective Use Of Social Science In Supreme Court Cases About Racial Justice And Marriage Equality, Russell K. Robinson, David M. Frost

Northwestern University Law Review

This Essay seeks to draw connections between race, sexual orientation, and social science in Supreme Court litigation. In some respects, advocates for racial minorities and sexual minorities face divergent trajectories. Among those asserting civil rights claims, LGBT rights claimants have been uniquely successful at the Court ever since Romer v. Evans in the mid-1990s. During this period, advocates for racial minorities have fought to preserve earlier victories in cases such as Regents of the University of California v. Bakke and have failed to overturn precedents that strictly limit equal protection possibilities, such as McCleskey v. Kemp. Nonetheless, we argue …

Diversity Entitlement: Does Diversity-Benefits Ideology Undermine Inclusion?, Kyneshawau Hurd, Victoria C. Plaut Jun 2018

Diversity Entitlement: Does Diversity-Benefits Ideology Undermine Inclusion?, Kyneshawau Hurd, Victoria C. Plaut

Northwestern University Law Review

Ideologies are most successful (or most dangerous) when they become common-sense—when they become widely accepted, taken-for-granted truths—because these truths subsequently provide implicit guidelines and expectations about what is moral, legitimate, and necessary in our society. In Regents of University of California v. Bakke, the Court, without a majority opinion, considered and dismissed all but one of several “common-sense” rationales for affirmative action in admissions. While eschewing rationales that focused on addressing discrimination and underrepresentation, the Court found that allowing all students to obtain the educational benefits that flow from diversity was a compelling rationale—essential, even, for a quality education. …

Virtual Rituals: Community, Emotion, And Ritual In Massive Multiplayer Online Role-Playing Games—A Quantitative Test And Extension Of Structural Ritualization Theory, Joseph M. Simpson, J. D. Knottnerus, Michael J. Stern Jun 2018

Virtual Rituals: Community, Emotion, And Ritual In Massive Multiplayer Online Role-Playing Games—A Quantitative Test And Extension Of Structural Ritualization Theory, Joseph M. Simpson, J. D. Knottnerus, Michael J. Stern

Sociology Faculty Publications (Archived)

Millions of people worldwide immerse themselves in massive multiplayer online role-playing games (MMORPGs). These games generate large, diverse communities that engage in rituals within the game, completing missions or quests. What role do these MMORPG rituals play in commitment to these gaming communities? To address this question, we extend structural ritualization theory to explain the impact of ritual events and emotion on commitment to community in the game World of Warcraft. Our findings suggest that players focused on inanimate resources are less committed than players who focus on social aspects of the ritual events inside the game. We also find …

Birds Of A Feather? Friendship Utilization By Sexual Minority Students During The Transition To College, Jessica Morrow Jun 2018

Birds Of A Feather? Friendship Utilization By Sexual Minority Students During The Transition To College, Jessica Morrow

Department of Sociology: Dissertations, Theses, and Student Research

Friendship is important for individuals at any point in their lives, but takes on a new role during emerging adulthood as individuals make the transition into adult roles and responsibilities (Arnett 2000, 2006). Potentially even more significant is the importance of friendship to sexual minority young adults who are also forming their identities at this stage (Brandon-Friedman and Kim 2016). Since the transition to college takes place during emerging adulthood, it is important to examine how sexual minority young adults utilize their friendships with other sexual minorities as well as heterosexual peers to navigate this transition. Drawing on in-depth interviews …

Third-Person Perception Of Science Narratives: The Case Of Climate Change Denial, Michael Field Dahlstrom, Sonny Rosenthal

Research Collection College of Integrative Studies

Science communicators are increasingly recognizing the potential of narratives to reach and influence audiences. However, do audiences recognize and consider this tactic when evaluating how such messages influence themselves and others? This study compares third-person perceptions of persuasive narrative and nonnarrative messages in a climate change context. Results suggest that individuals are aware of the influence of narratives and are able to resist this influence, but this is only when they perceive a message as having negative influence. Otherwise, individuals underestimate the influence of narratives on themselves. These findings add an audience-centered perspective to the current discussions on incorporating narratives …

How Strong Is Public Support For The Death Penalty In Singapore?, Wing-Cheong Chan, Ern Ser Tan, Jack Tsen-Ta Lee, Braema Mathi

Research Collection Yong Pung How School Of Law

Singapore is well known internationally for its uncompromising stance towards law and order and its use of the death penalty in particular for murder and drug trafficking. Until 2012, it was one of the few countries in the world where the death penalty was mandatory for persons convicted of these two crimes. The law was amended in 2012 to give a judge the choice to impose the death penalty or life imprisonment (with caning) for non-intentional murder and drug trafficking in some situations. What do Singaporeans think of the use of the death penalty in their own country? This article …

Therapeutic Justice: Crime, Treatment Courts And Mental Illness, Karen A. Snedker Jun 2018

Therapeutic Justice: Crime, Treatment Courts And Mental Illness, Karen A. Snedker

Sociology Faculty Books and Book Chapters

"This book examines Mental Health Courts (MHC) within a socio-legal framework. Placing these courts within broader trends in criminal justice, especially problem-solving courts, the author draws from two case studies with a mixed-methods design. While court observational and interview data highlight the role of rituals and procedural justice in the practices of the court, quantitative data demonstrates the impact of incentives, mental health treatment compliance and graduating patterns from MHC in altering patterns of criminal recidivism. In utilising these methods, this book provides a new understanding of the social processes by which MHCs operate, while narrative stories from MHC participants …

Nasser And Park: Development, State Building, And Elite Consolidation, David Wooil Choi Jun 2018

Nasser And Park: Development, State Building, And Elite Consolidation, David Wooil Choi

Theses and Dissertations

This thesis examines the relationship between elites and development and state building. It looks at how elite consolidation does or does not affect development and state building. It does this in the context of the cases of Egypt under Gamal Abdal Nasser and Korea under Park Chunghee. The thesis initially puts forward the argument that Korea's advantages from the colonial era set the basis for later development and state building, and paved the way for elite consolidation into the 1960s. However, the thesis ultimately finds that while Korea may have had some advantages from the colonial era that helped in …

In this research, the relationship between gender and entrepreneurial intention among non-entrepreneurs was investigated. The research shed light on the …
